Abstract

The forced withdrawal of the object of fiduciary guarantee is a mechanism commonly used by creditors to guarantee their rights to the payment of defaulted debts. However, the Constitutional Court Decision Number 18/PUUXVII/2019 and Number 2/PUUXIX/2021 affirm that fiduciary execution cannot be carried out unilaterally without the debtor's voluntary consent. This decision aims to balance creditors' rights with legal protection for debtors in accordance with Article 28D paragraph (1) of the 1945 Constitution and Article 6 of Law Number 42 of 1999 concerning Fiduciary Guarantees. Implementation in the field shows procedural obstacles, such as differences in perceptions of defaults, criminal legal risks for creditors and third parties, and the involvement of law enforcement officials who must be careful. The Constitutional Court's decision encourages the use of mediation or arbitration as an alternative dispute resolution before litigation, in line with Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. In addition, creditors need to adjust internal procedures, while debtors must understand their rights and obligations. Broader legal education is needed so that fiduciary enforcement practices are carried out legally, fairly, and efficiently. In conclusion, the Constitutional Court's decision strengthens the principles of justice, legal certainty, and protection of human rights, as well as encourages professional and balanced fiduciary practices in Indonesia.

Abstract

This study aims to analyze the spiritual meanings contained in the oral narratives of Sendang Senjoyo through the semiotic perspective of Charles Sanders Peirce. The study employs a qualitative descriptive approach, focusing on oral narratives that have developed among the community surrounding Sendang Senjoyo. The data were analyzed using Peirce's triadic concept of sign, object, and interpretant to identify the symbols, the objects to which they refer, and the meanings formed through community interpretation. The findings reveal several major signs in the Sendang Senjoyo narratives, namely water or tirta, the figure of Joko Tingkir, laku prihatin, ancient stones or petirtaan, the guardian of the spring, and wewaler. Water or tirta is interpreted as a medium of spiritual purification; Joko Tingkir and laku prihatin represent spiritual steadfastness and self-control; ancient stones or petirtaan signify respect for ancestors; while the guardian of the spring and wewaler represent sacredness, protection, and respect for sacred space. These meanings indicate that spirituality in the Sendang Senjoyo narratives is constructed through the community's interpretation of signs transmitted through oral tradition. The oral narratives of Sendang Senjoyo therefore preserve not only stories associated with a particular place but also a system of beliefs and spiritual perspectives concerning the relationship between humans, nature, ancestors, and the transcendental dimension.

Abstract

This study analyzes the legal consequences of DNA test refusal by a putative biological father and the legal certainty of civil relations involving a child born out of wedlock. It employs normative juridical research using statutory, case, analytical, and conceptual approaches. The findings show that refusal of DNA testing may obstruct changes in the child’s legal status, delay or prevent the establishment of civil relations with the biological father, and potentially result in orders to undergo DNA testing, coercive fines, reversal of the burden of proof, findings of unlawful acts, and compensation. Analysis of three lines of court decisions reveals different judicial constructions in assessing DNA evidence, presumptions, and other forms of proof. Legal certainty has not been fully achieved because rules on the status of DNA evidence and the consequences of refusal remain absent, population administration rules are disharmonized, and follow-up registration with the Civil Registry is inconsistent. Legal reconstruction is therefore required through preliminary evidence, adverse presumptions, burden shifting, laboratory standards, genetic data protection, and integrated administrative registration.

Abstract

This study analyzes the legal consequences of a Deed of Sale and Purchase arising from the seller’s bad faith and the legal protection afforded to buyers in land rights transfers. It employs normative juridical research using statutory, case, and analytical approaches, supported by primary, secondary, and tertiary legal materials. The analysis examines the Civil Code, the Basic Agrarian Law, Government Regulation Number 24 of 1997, Supreme Court Circular Letter Number 4 of 2016, and three sets of court decisions. The findings show that a seller’s bad faith does not automatically invalidate a Deed of Sale and Purchase. Its legal consequences depend on whether such conduct affects the validity requirements of the agreement; violations of subjective requirements may render the agreement voidable, while violations of objective requirements may make it null and void. Where the sale is proven valid, the buyer’s rights remain protected. Protection is reinforced through registration, counterclaims, recognition of ownership, confirmation of transfer validity, eviction, and compensation. Evidence remains decisive in assessing authority, payment, documentation, registration, and conduct.

Abstract

The Sale and Purchase Binding Agreement (PPJB) is a preliminary agreement before the implementation of the Sale and Purchase Act (AJB). In practice, many PPJBs are not followed up with the creation of AJB because sellers do not fulfill contractual obligations, thus raising legal protection issues for buyers. This study aims to analyze the legal consequences of PPJB that are not followed up into AJB as well as a form of legal protection for buyers. The method used is normative juridical research with legislative, case, and analytical approaches, using primary, secondary, and tertiary legal materials. The analysis is carried out through systematic interpretation and analogous legal construction. The results of the study show that PPJB that is not followed up with AJB causes default by the seller, which has implications for the birth, change, or removal of the legal relationship between the parties. Even though the buyer has fulfilled the obligation, the land rights have not been transferred juridically because the AJB has not been made before the Land Deed Making Officer (PPAT). As a result, the buyer only acquires contractual rights, not material rights. Legal protection for buyers can be pursued through a default lawsuit that has the potential to result in the cancellation of PPJB, refund of payments, the provision of compensation along with interest, and other legal remedies to restore the rights of buyers in accordance with the principles of legal protection of Satjipto Rahardjo.

Abstract

Drama, as a form of audiovisual literary work, serves not only as a medium of entertainment but also as a representation of cultural values in society. One of the cultural values found in Chinese dramas is Confucianism. This study aims to analyze the representation of Confucian values in the character Nie Xie Guang in the Chinese drama Shine On Me. This study employed a descriptive qualitative method, with data collected through documentation and the Simak Bebas Libat Cakap (SBLC) technique. The data consisted of dialogues and actions of Nie Xie Guang representing Confucian values, while the data source was the drama Shine On Me. The data were analyzed based on the context of each scene and the concepts of Confucian values. The findings revealed 24 data representing five Confucian values: 仁 (ren), 礼 ( li ), 义 (yi), 孝 (xiao) and 忠 ( zhong). Ren is represented through compassion and concern, li through politeness and respect, yithrough actions based on truth and moral principles, xiao through respect and responsibility toward parents, and zhongthrough loyalty and responsibility in fulfilling duties. The findings indicate that Confucian values in Shine On Me remain relevant to modern life through family relationships, social interactions, and the professional life of the main character.

Abstract

This study aims to analyze the application of professional ethical principles in the performance of notarial duties and their relationship with legal responsibility and the protection of public trust. This study employs normative legal research using statutory and conceptual approaches. The primary legal materials include Law Number 30 of 2004 concerning the Notary Office, as amended by Law Number 2 of 2014, and the Notary Code of Ethics. The legal materials were analyzed using a prescriptive-qualitative method to examine the relationship between legal norms and professional ethical principles. The results demonstrate that honesty, justice, responsibility, independence, professionalism, moral integrity, and confidentiality constitute the fundamental ethical principles governing notarial practice. These principles are implemented through professional obligations, prohibitions, supervisory mechanisms, and administrative, civil, organizational, and criminal sanctions. Supervision conducted by the Notary Supervisory Council and the Honorary Council of the Indonesian Notary Association plays an important role in maintaining professional compliance and dignity. Consistent implementation of professional ethics is therefore essential to preserve the notary's position as an officium nobile, ensure legal certainty, protect the interests of the parties, and maintain public trust in the notarial institution.

Abstract

Digital transformation in notarial practice has encouraged the development of the cyber notary concept, including the use of digital identity in identifying and verifying appearers. However, such mechanisms raise legal issues concerning identity authenticity, the validity of electronic appearance, personal data security, and liability in cases of identity misuse or electronic system failure. This study aims to analyze legal protection for appearers in the use of digital identity within cyber notary practices and to formulate a legal protection framework capable of ensuring legal certainty. This research employs a normative legal method using statutory, conceptual, and analytical approaches. The findings indicate that the regulation of cyber notary in Indonesia has not yet comprehensively integrated notarial law, electronic transaction law, and personal data protection. The required legal protection consists of preventive measures through multi-layer authentication, the notary's precautionary principle, data security, and audit trails, as well as repressive protection through clear liability and legal remedy mechanisms. Regulatory reconstruction is therefore necessary to establish reliable digital identity verification standards and ensure the authenticity, security, and legal protection of appearers in electronic notarial services.

Abstract

Digital transformation in notarial practice has encouraged the use of biometric verification as a means of strengthening the identification of parties involved in the execution of notarial deeds. However, successful biometric verification raises legal questions regarding whether identity authentication can be equated with valid consent under contract law and how the biometric data of appearing parties should be protected. This study aims to analyze the validity of parties' consent in notarial deeds using biometric verification from the perspectives of contract law and personal data protection. It employs normative legal research using statutory and conceptual approaches by examining contract law, notarial law, electronic transactions, and personal data protection. The findings indicate that biometric verification merely serves as a supporting instrument for identity authentication and cannot automatically establish the existence of valid agreement as required under Article 1320 of the Indonesian Civil Code. Biometric data also requires heightened protection because it constitutes specific personal data. This study proposes a dual consent model that distinguishes consent to the substance of a legal transaction from consent to biometric data processing, thereby strengthening legal certainty, data protection, and the evidentiary integrity of notarial transactions.

Abstract

This study analyzes the legal consequences and legal certainty of land Sale and Purchase Deeds (AJB) annulled by courts due to unlawful acts committed by sellers. The research employs a normative juridical method using statutory, case, conceptual, and analytical approaches. The legal materials consist of legislation, legal literature, and three Supreme Court decisions, namely Decision No. 4221 K/Pdt/2022, Decision No. 2919 K/Pdt/2012, and Decision No. 1734 K/Pdt/2018. The analysis applies R. Soeroso’s theory of legal consequences and Jan Michiel Otto’s theory of legal certainty. The findings show that annulment of an AJB may eliminate the deed’s legal force as the basis for transferring land rights, invalidate the registration of title transfer, restore ownership to the rightful party, and create liability for damages arising from unlawful acts. However, the annulment of an AJB does not automatically indicate the absence of legal certainty. Legal certainty must be assessed through the seller’s authority, the objective legal status of the land, PPAT procedures, registration of rights, the buyer’s good faith, judicial review, and enforcement of the final judgment. A good-faith buyer may remain legally protected when the buyer neither knew nor reasonably should have known of defects affecting the transaction.
