Abstract

This research aims to find out the juridical limits, before grant recipients with the donated assets originating from the criminal acts of corruption can be threatened with criminal penalties based on Act Number 8 of 2010 concerning Prevention and Eradication of the Crime of Money Laundering as passive perpetrators of money laundering crimes. This research is a normative type of research that is prescriptive in nature, and is based on a statute, case, historical, and the conceptual approach. This research is based on legal materials consisting of primary and secondary legal materials, which were carried out by studying library materials, then analyzed through a deductive mindset using the syllogism method. Based on this research, the results obtained are that grant recipients with donated assets originating from assets that resulting from criminal acts of corruption can be punished as passive perpetrators of money laundering crimes, if the grant recipient has fulfilled the elements of the act as stated in the formulation of Article 5(1) Act Number 8 of 2010 concerning Prevention and Eradication of the Crime of Money Laundering. However, apart from fulfilling the elements of action according to this article, in order to be responsible for their actions, the recipient of the grant must have been proven to have made a mistake, for which there is no forgiving reason that can erase the mistake.

Abstract

This study aims to examine and analyze the process of implementing the one-stop integrated service licensing policy at the Regional Office of the Ministry of Religious Affairs of Gorontalo Province, focusing on organization, interpretation, and application. A qualitative approach with a descriptive method was employed. Data collection techniques included observation, interviews, and documentation. Data analysis was conducted through data reduction, data display, and conclusion drawing, with data validation via triangulation. The results indicate that implementing the One- Stop Integrated Service Licensing at the Regional Office of the Ministry of Religious Affairs of Gorontalo Province has not been optimally executed following Ministerial Regulation (PMA) Number 65 of 2016. Several aspects evidence this: Organization has not fully optimized resources and lacks facilities such as filing cabinets and computers; Interpretation has been limited, as the socialization provided only covers schedules and service structures, leaving PTSP managers without a clear understanding of the technical rules and services; Application remains ineffective and inefficient, with services not well-integrated, resulting in administrative processes being centralized in specific fields. The study recommends that the PTSP at the Regional Office of the Ministry of Religious Affairs of Gorontalo Province adhere consistently to PMA Number 65 of 2016 regarding Integrated Services, optimize human resources both quantitatively and qualitatively, and improve facilities and infrastructure.

Abstract

This study aims to examine how time, accuracy, and service delivery style affect the effectiveness of E-KTP registration services at the Population and Civil Registration Office of Boalemo Regency. The study employed a qualitative methodology with techniques of data collection, including interviews, observation, and documentation. Data analysis was then conducted through data reduction, data display, and conclusion drawing. The findings indicate that the effectiveness of E-KTP registration services at the Population and Civil Registration Office of Boalemo Regency is determined as satisfactory. However, considering the time, accuracy, and service delivery style, it is not yet optimal. Among the factors studied, time and accuracy are identified as suboptimal. Time is influenced by equipment readiness and staff capacity, with challenges such as network issues and equipment malfunctions affecting service duration. Meanwhile, accuracy is generally adequate, however, technical errors in data input and verification persist, primarily due to insufficient re-verification by staff. This suggests that implementing, accuracy in E-KTP registration services remains less than optimal.

Abstract

This study aims to identify and analyze the legal implications associated with the ownership of overlapping land certificates concerning Decision Number 4/G/2021/PTUN-G, as well as to evaluate the responsibilities of the National Land Agency (BPN) regarding these overlapping certificates. This study employs an empirical method based on human behavior, gathering verbal data through interviews and actual behavior through direct observation. Study findings in the last five years, from 2020 to 2024, indicate that several complaints have been reported to the Gorontalo Regency Land Office regarding the issuance of overlapping certificates. The study's findings suggest that five complaints reached mediation, while one case escalated to court, specifically through Decision Number 4/G/2021/PTUN-GTO. This decision pertains to a land dispute between Mr. Arudji Gobel and Mrs. Ratna M. L. Datau in Ulapato Village, Telaga Biru Subdistrict, Gorontalo Regency, involving the issuance of overlapping certificates. Contributing factors to the overlapping certificates include public misunderstanding, informal sales, lack of available data at the village level, and legal and administrative loopholes. These issues result in a lack of legal certainty, as the primary aim of land registration is to obtain certificates as valid proof of ownership. The responsibility for overlapping certificates lies with the National Land Agency (BPN), which must verify both physical and legal data prior to issuing certificates. In the event of overlapping certificates, the National Land Agency (BPN) is required to annul one of the certificates. If any error or maladministration by National Land Agency (BPN) staff is discovered, they may face criminal or civil penalties. Even without maladministration or errors, the National Land Agency (BPN) remains responsible for resolving such issues. With clear legal regulations, affected parties can assert their rights through legal channels.

Abstract

A number of liberal countries, such as the United States, England, Germany, and Sweden, have legal systems that claim to uphold the principles of democracy and human rights. However, in practice, there are more complex political dynamics. Behind the seemingly neutral codification of criminal law, there are ideological influences that are often invisible to the naked eye. This study uses a normative legal research method with a comparative approach. Data collection was collected using library research, then analyzed qualitatively and presented descriptively. The results of the study show that from the analysis of criminal policy in the United States, England, Germany, and Sweden, it is clear that criminal law not only functions as a mechanism for enforcing justice, but also as an instrument that reflects and responds to political and social dynamics in each country. Although each country has a different context and approach, there are common patterns that can be seen in criminal policy in these countries. Criminal law not only functions to uphold justice objectively, but also becomes an arena where political ideology, public fears, and social challenges meet and shape policies that ultimately affect the lives of millions of people.

Abstract

This article discusses the role of the Constitutional Court (MK) in enforcing constitutional law in Indonesia, which is the highest judicial institution in supervising and enforcing the constitution. In this context, this study focuses on the analysis of several important decisions taken by the MK, which not only affect legal aspects, but also have significant social and political impacts. Through a qualitative descriptive approach, this article identifies and evaluates crucial decisions, such as decisions related to general elections, human rights, and democratic principles. This study aims to understand how these decisions contribute to shaping legal norms and addressing various challenges in Indonesian constitutional law. Furthermore, this article also explores the implications of these decisions for society, including their influence on public trust in legal institutions and political participation. Thus, this study seeks to provide a comprehensive picture of the position of the MK as the vanguard in enforcing constitutional law, as well as the challenges it faces in carrying out its functions and responsibilities. The results of this analysis are expected to provide readers with insight into the importance of the MK's role in maintaining the constitution and encouraging better legal reform in Indonesia, as well as providing recommendations for improving the performance and transparency of this institution in the future.

Abstract

Corruption is one of the biggest challenges faced by many countries, including Indonesia. Corrupt practices not only harm the state’s finances but also erode public trust in the government. This study aims to explore how digital technology and public participation can be effectively used to enhance government transparency and accountability in efforts to combat corruption. This research employs a descriptive qualitative method with a literature review and document analysis approach. Data is collected from various relevant literature sources and official documents to analyze the use of digital technology and public participation in enhancing government transparency and accountability in anti-corruption efforts. The results show that digital technologies, such as e-government, e-procurement, blockchain, big data analytics, open data, whistleblowing systems, and digital payment systems, can facilitate broader and faster access to information and increase public participation in government oversight. Public participation, through active involvement in reporting and monitoring, can raise public awareness of corruption issues and strengthen anti-corruption efforts. This study concludes that the combination of digital technology and public participation has great potential to create a more transparent and accountable government. Recommendations include the development of better technological infrastructure, increased digital literacy among the public, and the promotion of public participation in oversight processes. By implementing these strategies, it is hoped that a cleaner and more trustworthy government can be achieved, ultimately improving public welfare.

Abstract

Management of Sedimentation Results in the Sea, Sedimentation Results in the Sea are sediment in the sea in the form of natural material formed by weathering and erosion processes, which are distributed by oceanographic dynamics and deposited which can be taken for use prevent disruption of ecosystems and shipping. The use of marine sedimentation in its regulation refers to the business licensing aspect issued by the Minister by establishing planning documents, regulated in the Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number 33 of 2023 concerning Implementing Regulations of Government Regulation Number 26 of 2023 concerning Management of Sedimentation Results in the Sea. In managing and protecting the sea, every activity at sea pays attention to the balance and preservation of the sea, if a violation occurs, it is subject to administrative and criminal sanctions. Criminal liability for illegal sand exports refers to Article 158 of Law Number 4 of 2009 concerning Mineral and Coal Mining, beside, several primary legal materials can be used for law enforcement against sand mining, namely, the Criminal Code (KUHP), Law Number 32 of 2009 concerning Environmental Protection and Management, and the other national regulations that has same meaning of this crime.

Abstract

Legal certainty in land ownership certification in Indonesia is a crucial aspect of protecting citizens' rights. This study aims to analyze the legal certainty provided by the Complete Systematic Land Registration (PTSL) program and the National Agrarian Operation Project (PRONA) in the context of land registration. Using a qualitative approach, this research examines existing regulations and challenges faced in the implementation of both programs. The findings indicate that although land certificates issued through PTSL and PRONA provide legal strength, there remains a potential for disputes arising from third-party dissatisfaction. Therefore, further efforts are needed to strengthen legal certainty guarantees in land ownership in Indonesia.

Abstract

This study explores the regulation of citizenship under Article 26 of the 1945 Constitution of Indonesia and its implications in the context of globalization. Article 26 defines who qualifies as an Indonesian citizen and provides a legal basis for more detailed citizenship regulations. In light of increased global mobility and complex international relations, new challenges have emerged that necessitate a reassessment of citizenship policies, particularly regarding dual citizenship. A normative juridical methodology is utilized in this research to explore the concept of citizenship from a constitutional viewpoint and compares Indonesia’s policies with those of other countries that recognize dual citizenship. The study finds that Indonesia’s current citizenship regulations need to be updated to be more adaptable and inclusive in addressing global changes. It is suggested that the Indonesian government consider revising its citizenship laws to better safeguard the rights of Indonesian citizens abroad and enhance connections with the diaspora.
