Al-Hukama: The Indonesian Journal of Islamic Family Law

Al-Hukama serves academic discussions of any Indonesian Islamic family law issues from various perspectives, such as gender, history, sociology, anthropology, ethnography, psychology, philosophy, human rights, disability and minorities, digital discourse, and others. It intends to contribute to the debate in classical studies and the ongoing development debate in Islamic family law studies in Indonesia, both theoretical and empirical discussion. Abstract

This article aims to explore the portrait of the husband-wife relationship of the Yogyakarta Mentaok Congregation. The discussion is preceded by a study of husband and wife in the family, followed by a picture of the relationship pattern of the Mentaok Congregation Kotagede Yogyakarta, and then the shift in roles in the family of the Mentaok congregation in a social exchange review. The method used in this article is field research which is then analyzed deductively using a social exchange approach. The results of this study illustrate at least three patterns of relations between the Mentaok congregation: first, husband and wife work, and the wife takes care of domestic work. Second, the husband and wife work while other people care for their household work. The third form is husband and wife work, and both plunge into the domestic sphere. In a review of social exchange, researchers found that there is reciprocity in the family of the Yogyakarta Kotagege Mentaok Congregation, which is mutually beneficial and, at the same time, demands a sacrifice for a family. [Artikel ini bertujuan mengupas potret relasi suami-istri Jamaah Mentaok Yogyakarta. Pembahasan didahului dengan kajian suami istri dalam keluarga, dilanjut dengan potret pola relasi Jamaah Mentaok Kotagede Yogyakarta, dan kemudian pergeseran peran dalam keluarga jamaah mentaok dalam tinjauan social exchange. Metode yang dipakai dalam artikel ini adalah field research yang kemudian dianalisis secara deduktif dengan menggunakan pendekatan social exchange. Hasil penelitian ini menggambarkan setidaknya terdapat tiga pola relasi jamaah Mentaok, yaitu: pertama, suami dan istri bekerja serta istri mengurus pekerjaan domestik. Kedua, suami dan istri bekerja sedangkan orang lain yang mengurus pekerjaan domestiknya. Bentuk ketiga adalah suami dan istri bekerja dan keduanya terjun ke dalam wilayah domestik. Dalam tinjauan social exchange, peneliti mendapati adanya resiprositas dalam keluarga Jamaah Mentaok Kotagege Yogyakarta yang saling menguntungkan sekaligus menuntut adanya suatu pengorbanan pada suatu keluarga.]

Abstract

The family context in the strengthening religious moderation policy by the Ministry of Religion (Kemenag) has not become a top priority compared to the social and educational contexts. In the research context as well, the theme of the method of developing the religious moderation value in the family context remains limited. Therefore, this study aims to explore those themes for mapping the previous research and drawing opportunities for future research. This research is library research based on books and previous research. The results show that the methods for developing religious moderation values in the family remain limited in the mean of the number of studies, method diversity, and research type. The implications of these findings are discussed further. [Konteks keluarga dalam policy penguatan moderasi beragama oleh Kementerian Agama (Kemenag) belum menjadi prioritas utama dibandingkan konteks sosial dan pendidikan. Demikian pula dalam konteks penelitian, tema metode pengembangan nilai moderasi beragama dalam konteks keluarga masih sangat terbatas. Maka dari itu penelitian ini bertujuan mengeksplorasi hasil-hasil penelitian dari tema tersebut untuk memetakan penelitian yang telah dilakukan dan peluang bagi peneliti-peneliti berikutnya. Penelitian ini merupakan penelitian pustaka berdasarkan buku dan penelitian terdahulu. Hasil menunjukkan bahwa penelitian-penelitian bertema metode pengembangan nilai moderasi beragama dalam keluarga masih terbatas dalam hal jumlah penelitian, ragam metode, dan jenis penelitian yang digunakan. Abstract

This study will examine the endogamous marriage regulation system in the Ahmadiyya congregation, the aim is to analyze the function of the rules in the family and community scope of the Ahmadiyya Jama'at in Yogyakarta. This research is a field research which also includes qualitative with a phenomenological-sociological approach that uses the theory of Maqāṣid al-Sharī'ah Jamaluddin Athiyah. The conclusion of this study is that the Ahmadiyya Jamaat's endogamous marriage in the family dimension according to the maqāṣid al-sharī'ah Jamaluddin Athiyah can be understood from the seven spaces of movement as follows; First, maintain the pattern of relationships between husband and wife. Second, preserving the existence and purity of the Ahmadiyya Community. Third, maintain the peace and integrity of the family of the Ahmadiyya Community. Fourth, maintain the purity of the family lineage. Fifth, preserving the ideology of the Ahmadiyya Community in the family environment. Sixth, maintain the principles and patterns of family relationships. Seventh, protecting family economic disparities and alleviating poverty.  [Aturan pernikahan yang berupa larangan menikah dengan selain Ahmadiyah (endogami) merupakan peraturan khusus yang diatur dalam sebuah lembaga yang bernama Rishta Nata. Aturan tersebut berorientasi pada pemeliharaan keluarga agar terbentuk keseragaman pandangan hidup dalam rumah tangga jemaat Ahmadiyah, sehingga tercipta keluarga yang harmonis dibawah naungan ajaran Ahmadiyah. Penelitian ini akan mengkaji tentang sistem peraturan pernikahan endogami di jemaat Ahmadiyah, tujuannya untuk menganalisa fungsi aturan dalam ruang lingkup keluarga dan komunitas Jemaat Ahmadiyah di Yogyakarta. Penelitian ini merupakan penelitian field research yang juga termasuk kualitatif dengan pendekatan fenomenologis-sosiologis yang menggunakan teori Maqāṣid al-Sharī’ah Jamaluddin Athiyah. Kesimpulan dari penelitian ini adalah pernikahan endogami Jemaat Ahmadiyah dalam dimensi keluarga menurut maqāṣid al-sharī’ah Jamaluddin Athiyah dapat dipahami dari tujuh ruang gerak sebagai berikut; Pertama, menjaga pola hubungan antar suami-istri. Kedua, melestarikan eksistensi dan kemurnian Jemaat Ahmadiyah. Ketiga, menjaga ketentraman dan keutuhan keluarga Jemaat Ahmadiyah. Keempat, memelihara kemurnian nasab keluarga. Kelima, melestarikan ideologi Jemaat Ahmadiyah di lingkungan keluarga. Keenam, menjaga prinsip dan pola hubungan keluarga. Abstract

This research aims to investigate progressive Court Constitution in Test limitation age marriage . Article 7 paragraph (1) of the Marriage Law Year 1/1974 has been give birth to form discrimination to female . This thing reflected from difference set age . Age limit marriage for Men is 19 years and 16) years for woman . To problematic this submit trial in Court Constitution . Later problem faced is Court Constitution no allowed by principles and stance for test Article 7 paragraph (1) of the Marriage Law which is a Open legal policy (Open legal policy). Purpose of study this is for knowing progressive Court Constitution in cut off case that . Study this is study normative with approach conceptual and approach regulation legislation . Court Constitution please receive application in decision the though Article tested  is Open legal policy [Penelitian ini bertujuan untuk menyelidiki progresifitas Mahkamah Konstitusi dalam Pengujian batasan usia perkawinan. Pasal 7 ayat  (1) UU Perkawinan Tahun 1/1974 telah melahirkan bentuk diskriminasi terhadap perempuan. Hal ini tercermin dari perebadaan usia yang diatur. Batasan usia perkawinan bagi pria adalah 19 (sembilan belas) tahun dan 16 (enam belas) tahun bagi wanit. Terhadap problematika ini diajukanlah pengujian di Mahkamah Konstitusi. Masalah yang kemudian dihadapi adalah Mahkamah Konstitusi tidak diperkenankan secara prinsip dan pendirian untuk menguji Pasal 7 ayat (1) UU Perkawinan yang merupakan Kebijakan Hukum Terbuka (Open legal policy). Tujuan dari penelitian ini adalah untuk mengetahui progresifitas Mahkamah Konstitusi dalam memutus perkara tersebut. Penelitian ini adalah penelitian normatif dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan. Hasil dari Penelitian ini menunjukkan bahwa Mahkamah Konstitusi melakukan progrsifitas hukum dengan meninggalkan prinsip dan pendiriannya. Mahkamah Konstitusi berkenan mengambulkan permohonan dalam putusan tersebut meskipun Pasal yang diujikan adalah Kebijakan Hukum Terbuka (Open legal policy).]

Abstract

United Nations ratified the Convention on the Rights of the Child in 1089. It is a form of legal protection for children to meet children's rights in UN member countries. As a UN convention, it has coercive power on all UN member states to sign and ratify the Convention. The topic of child rights becomes interesting when the discussion focuses on countries with a long historical culture and civilization. One of them is the Malay civilization, namely Brunei, Indonesia, Malaysia, and Singapore, all are members of the United Nations. This paper presents the finding related to the agreement of the Malay community to the Convention on the Rights of the Child and the follow-up of that agreement in its implementation in the legal system of these countries. At the end of the article, it is concluded that: (1) four countries belonging to the Malay family, Indonesia, Malaysia, Singapore and Brunei, have agreed and ratified the Convention on the Rights of the Child (CRC), but with the application of reservation rights for Malaysia and Brunei; (2) four countries have passed child laws; and (3) the diversity of age limits for children in the four countries. [Pada tahun 1089 Perserikatan Bangsa-bangsa mengesahkannya sebagai Kovensi Hak Anak (Convention of Rights of The Child), yang bentuk perlindungan hukum terhadap anak, sebagai upaya pemenuhan terhadap hak-hak anak di negara-negara anggota PBB. Sebagai konvensi PBB, maka mempunyai kekuatan memaksa pada semua Negara anggota PBB untuk menandatangani dan meratifikasi konvensi tersebut. Menjadi menarik ketika difokuskan pada negara-negara yang mempunyai sejarah panjang, terutama mempunyai kesamaan rumpun dan budaya. Salah satunya adalah negara rumpun Melayu, yaitu Brunei, Indonesia, Malaysia, dan Singapura, yang kesemuanya merupakan anggota PBB. Dalam konteks inilah tulisan ini hadir, yaitu untuk mengetahui persetujuan negara negara rumun Melayu terhadap Konvensi Hak Anak, dan tindak lanjut dari persetujuan tersebut dalam implementasinya dalam system hukum negara-negara tersebut. Di akhir tulisan disimpulkan bahwa: (1) empat negara rumpun Melayu, Indonesia, Malaysia, Singapura dan Brunei, telah menyepakati dan meratifikasi Konvensi Hak Anak (CRC), namun dengan pemberlakuan hak reservasi untuk Malaysia dan Brunei; (2) empat negara telah mengesahkan undang-undang anak; dan (3) adanya keberagaman batasan usia anak di empat negara tersebut.]

Abstract

Families of different religions are a social fact in plural social life. However, interfaith marriage has always been a controversy and is considered to cause several problems, especially legal, social, and religious debates. Interestingly, some families of different religions can have good family resilience in their conditions facing social problems and religious debates. This article will answer academic anxiety about strengthening family resilience after marriage. We answer this problem with case studies and use a sociological approach.  The purpose of this article is used to explain that interfaith families have specific strategies for maintaining the resilience of their families. So, the contribution of theories and experiences of families of different religions needs to be studied in more detail through this article and subsequent research. This article produces an answer that strengthening the resilience of families of couples of different religions is carried out by mutual agreement on childcare, sharing experiences for prospective families of different religions, consultations, and couple communication that does not lead to theological differences.

Abstract

Judges are pivotal in issuing impartial decisions that advocate for women, even when they function as primary providers. This study examines the judicial sensitivity towards women as primary breadwinners within families in Padang Lawas Utara. Employing a sociological approach, the research explores the realities among the indigenous people of Padang Lawas Utara. Subsequently, it conducts a comprehensive review of five decisions from the Religious Court of Padang Sidimpuan, falling under the jurisdiction of Padang Lawas Utara. The article reveals that the judges fail to consider the wife’s familial role, especially the role of the wife as the breadwinner. They concentrate solely on the male’s capabilities and rely on evidence of the husband’s income, which proves challenging to validate. Despite the husband’s ownership of assets, including land, houses, rice fields, vehicles, and others, the judge refrains from exercising the ex officio rights to provide the wife's māḍiyah (previous alimony). This underscores the inadequacy of the judge’s sensitivity in establishing the fulfillment and protection of women’s rights, particularly in the context of post-divorce scenarios.

Abstract

This study discusses the various reasons for the legal behavior of the people of Denanyar Jombang when carrying out marriages during the Covid-19 period. Given that several policies regulate marriage during the Covid-19 period, such as Circulars, namely; P-006/DJ.III/Hk.00.7/06/2020,P-001/DJ.III/Hk.007/07/2021, and 700/415.10.1.3/2020. The problem that arises is that not all people can understand properly and completely the policies issued by the government, on the one hand, the desire to remain married cannot be rejected. By using the sociology of law approach by carrying out the grounded theory of social action initiated by Max Weber, we conclude that there are various reasons why the people of Denanyar Jombang continue to carry out marriages during the Covid-19 period, which is shown in the legal behavior taken by the community. Reading the theory of social action can be inferred and reduced to the presence of effectual action, traditional action, an act of value rationality, and an act of value rationality as the basic foundation of the Denanyar community in their action. [Kajian ini membahas mengenai ragam alasan perilaku hukum masyarakat Denanyar Jombang ketika melaksanakan pernikahan di masa Covid-19. Mengingat adanya beberapa kebijakan yang mengatur tentang pernikahan di masa Covid-19 seperti Surat Edaran yaitu; Surat Edaran Nomor:P-006/DJ.III/Hk.00.7/06/2020, Surat Edaran Nomor: P-001/DJ.III/Hk.007/07/2021, dan Surat Edaran Bupati Jombang Nomor: 700/415.10.1.3/2020. Problem yang muncul adalah tidak semua masyarakat mampu memahami secara baik dan utuh kebijakan yang dikeluarkan oleh pemerintah, pada satu sisi keinginan untuk tetap menikah tidak bisa ditolak. Dengan menggunakan pendekatan sosiologi hukum dengan menjalankan grounded theory of social action yang digagas oleh Max Weber sampai kepada kesimpulan bahwa terdapat berbagai ragam alasan masyarakat Denanyar Jombang tetap melaksanakan pernikahan di masa Covid-19 yang ditunjukan pada perilaku hukum yang diambil oleh masyarakat. Melalui pembacaan teori perilaku sosial dapat diinferensikan dan direduksi adanya affectual action, traditional action, an act of value rationality, dan an act of value rationality sebagai landasan pokok masyarakat Denanyar dalam berperilaku.]

Abstract

This article discusses the low success rate of mediation at the Bantul Religious Court in 2018-2020: a study of the analysis of the role of mediators at the Bantul Religious Court. The focus of this study is to analyze the reasons or factors for the low success of mediation by mediators at the Bantul Religious Court by utilizing the concept of legal sociology whose scalpel uses the theory of legal effectiveness, legal culture and conflict resolution. The results of this study indicate that the effectiveness of the successful role of the mediator is influenced by seven factors namely First, the parties are determined to divorce, Second, the degree of difficulty of the case. Third, the level of public awareness. Fourth, the mediation time is too short. Fifth, Mediation is only a formality. Sixth, the good faith of the parties. Seventh, the ability of the mediator. [Artikel ini membahas mengenai rendahnya tingkat keberhasilan mediasi di Pengadilan Agama Bantul tahun 2018-2020: studi terhadap analisis peran mediator di Pengadilan Agama Bantul. Fakus dari kajian ini ialah menganalisa alasan atau faktor rendahnya keberhasilan mediasi oleh mediator di Pengadilan Agama Bantul dengan memanfaatkan konsep sosiologi hukum yang pisau bedahnya menggunakan teori efektivitas hukum, budaya hukum dan resolusi konflik. Hasil penelitian ini menunjukkan bahwa efektifitas keberhasilan peran mediator dipengaruhi oleh tujuh faktor yakni Pertama, Para pihak sudah bersikukuh untuk bercerai, Kedua, Tingkat kesulitan kasus. Abstract

The issue of interfaith marriage is an interesting topic to be discussed again. Because the rules regarding interfaith marriage in Indonesia make multiple interpretations of permissibility or not. Couples want to carry out interfaith marriages can carry out marriages abroad or submit requests to court judges. The judge has full authority to grant or refuse. This study focuses on two cases that were submitted to the district court, No 122/Pdt.P/2020/PN.Pti and 42/Pdt.P/2014/PN.Ung. The author's reason for studying the two decisions is the similarity of the beliefs of the parties, namely men who are Muslims and women who adhere to Christianity. The focus of the first study was to dig up witness statements and the consent of the parents of both parties. Second; whether the authentic evidence presented at trial is a major consideration. The results of this study reveal that the strength of witness testimony and parental consent as well as authentic evidence that can be presented in court makes the judge grant the request.  [Isu Pernikahan beda agama menjadi topic yang menarik untuk diperbincangkan kembali. Karena aturan mengenai pernikahan beda agama di Indonesia menjadikan multitafsir tentang kebolehan atau tidak. Pasangan yang hendak melakukan pernikahan beda agama dapat melakukan pernikahan di luar negeri atau mengajukan permohoann kepada hakim pengadilan. Hakim mempunyai kewenangan penuh untuk mengabulkan atau menolak. Kajian ini memfokuskan pada  kepada dua kasus yang diajukan kepada pengadilan negeri yaitu Nomor 122/Pdt.P/2020/PN.Pti dan 42/Pdt.P/2014/PN.Ung. Alasan penulis mengkaji dua putusan tersebut adalah kesamaan kepercayaan para pihak yaitu laki-laki beragama Islam dan perempuan menganut agama Kristen. Fokus kajian pertama yaitu menggali Keterangan Saksi dan izin orang tua kedua belah pihak. Kedua; apakah bukti autentik yang dihadirkan dalam persidangan menjadi pertimbangan utama. Hasil penelitian ini mengungkapkan bahwa kuatnya kesaksian saksi dan izin orang tua serta bukti autentik yang dapat dihadirkan dalam persidangan membuat hakim mengabulkan permohonan.]
