Abstract

Penelitian ini bertujuan untuk melihat aspek hukum ekonomi syariah dalam  konsep Enviromental, Social and Govenance (ESG) yang dapat digunakan untuk pemulihan ekonomi melalui peningkatan investasi. Inovasi pemulihan ekonomi yang ditawarkan dan dapat diaplikasikan oleh setiap perusahaan yaitu dengan menjalankan green investment berdasarkan konsep ESG yang telah sesuai dengan prinsip-prinsip syariah. Metode penelitian yang digunakan dalam penelitian ini yakni penelitian pustaka (library researc). Analisis data yaitu dengan menggunakan metode deskriptif kualitatif yakni memamparkan seluruh data dengan apa adanya data sebagaimana data yang telah terkumpul. Hasil penelitian menunjukkan bahwa pemulihan ekonomi dapat dilakukan dengan menerapkan konsep ESG pada setiap perusahaan investasi. Hal ini melihat telah banyaknya investor yang mulai melirik untuk menanamkan sahamnya di perusahaan yang berbasis ESG, sehingga penerapan ESG selain menjadi kewajiban perusahan juga menjadi salah satu strategi marketing dalam peningkatan penanaman saham. Implikasi dari penelitian ini yaitu memberikan pengetahuan tentang literasi finansial dalam pemulihan ekonomi.

Abstract

This study examines the sociological implications of marriage and divorce in Islamic law in modern Muslim societies. It aims to explore how Islamic legal principles related to marriage and divorce are interpreted and applied in contemporary contexts and their impact on family dynamics, gender roles, and societal norms. The research employs a qualitative approach, with the data collected through interviews, focus groups, and ethnographic observation analyzed using thematic coding and narrative analysis. This approach allowed for identifying recurring themes and patterns and exploring participants' perceptions, attitudes, and personal stories. A combination of a literature review with a comprehensive review of existing scholarly works, legal texts, and sociological studies on Islamic marriage and divorce laws was conducted. This review helped to identify key themes, gaps in research, and the evolving nature of Islamic family law across different cultural and regional contexts. Sources include classical and contemporary Islamic jurisprudence (fiqh), academic articles, books, and NGO reports on women's rights and legal reforms in Muslim-majority countries. For the literature review, the study focused on sources published between 2000 and 2020. The following criteria guided the selection of literature to ensure that the materials were relevant, credible, and up-to-date with contemporary debates and issues: Relevance to Topic, Academic and Peer-Reviewed Sources, Publication Date, Geographical Scope, Legal and Sociological Focus. Literature that addresses the intersection of Islamic law, gender dynamics, and the sociological implications of marriage and divorce. Respondents from members of Muslim communities across diverse socio-cultural settings. This analysis is applied to identify variations in the application of Islamic family law in different regions. The findings reveal that local cultural norms and legal systems often influence Islamic principles governing marriage and divorce. While Islamic law emphasizes justice, mutual respect, and the protection of family welfare, its implementation varies significantly, creating diverse sociological outcomes. For example, in some regions, divorce laws have been adapted to address gender equality concerns, while in others, traditional practices continue to dominate, often to the detriment of women's rights. The study concludes that while Islamic family law provides a robust framework for regulating marriage and divorce, its sociological implications are shaped by the interplay between religion, culture, and modern legal reforms. To address the challenges faced by Muslim families, there is a need for a balanced approach that respects religious principles while promoting social justice and gender equality. This highlights the importance of ongoing dialogue and reform to ensure that Islamic family law remains relevant and supportive in modern societal contexts

Abstract

Penelitian ini bertujuan untuk memahami hubungan antara hukum internasional dan hukum nasional. Metode penelitian yang digunakan adalah penelitian hukum normatif atau penelitian kepustakaan. Penulis melakukan penelitian dan menelaah berbagai bahan dan data sekunder. Penelitian ini fokus pada pembahasan mengenai hubungan antara hukum internasional dan hukum nasional, serta mempelajari literatur yang terkait dengan penelitian ini. Hasil penelitian menunjukkan bahwa pembahasan mengenai hukum internasional berarti memahami peristiwa internasional melalui perspektif hukum nasional. Selain itu, belajar mengenai hukum internasional memberikan pemahaman tentang pendekatan analisis melalui teori yang ada. Pendekatan dan analisis ini dianggap sebagai dasar fundamental dalam berpikir mengenai hubungan hukum antara negara-negara. Secara teoritis terdapat dua pandangan mengenai hukum internasional, yaitu pandangan yang disebut dengan voluntarisme, bahwa hukum internasional dan hukum nasional sebagai dua kesatuan perangkat hukum yang hidup berdampingan dan terpisah. voluntarisme mendasarkan berlakunya hukum internasional dan bahkan persoalan ada tidaknya hukum internasional pada kehendak negara. Pandangan objektivis, menganggapnya sebagai dua bagian dari satu kesatuan perangkat hukum. Pandangan obyektif yang menganggap keberadaan dan keberlakuan hukum internasional tidak tergantung pada kehendak negara dualisme, yang bersumber pada teori bahwa kekuatan mengikatnya hukum internasional didasarkan pada kehendak negara, maka hukum internasional dan hukum nasional merupakan dua sistem atau perangkat hukum yang terpisah satu dengan yang lainnya.

Abstract

Penelitian ini bertujuan untu menjelaskan praktik kewarisan di Kabupaten Padang Pariaman, mengetahui filosofi apa yang menyebabkan bagian perempuan dalam menerima harta pusako lebih banyak dibanding laki-laki di Kabupaten Padang pariaman dan mengetahui bagaimana sistem pembagian harta waris di Kabupaten Padang Pariaman ditinjau dari Hukum Islam. Jenis penelitian yang digunakan dalam penulisan ini adalah penelitian kualitatif. Hasil penelitian menunjukan bahw praktik warisan perempuan di Kabupaten Padang Pariaman mendapat harta waris lebih banyak dibandingkan kaum laki-laki, adapun bagian pusako yang diterima anak laki-laki adalah gelar sako adat yang diturunkn dari mamak kepada kemenakan laki-laki. Hasil penelitian juga menunjukkan selain bertugas sebagai penerus keterunan perempuan di Minangkabau sangat dimuliakan keberadaannya dan juga dilibatkan dalam bermusyawarah dalam keluarga dan nagari. Namun dalam pemakaian harta perempuan dipercayakan untuk mengelola harta pusako karena perempuan di Minangkabau dikenal sebagai pemegang kunci “ amban puruak” yang mana harta tersebut digunakan untuk menjamin kelangsungan hidup anak cucu mereka serta sistem pembagian harta waris yang digunakan adalah menggunakan sistem matrilineal yakni dibagi berdasarkan garis keturunan ibu dan seterusnya dan hal ini tidak bertentangan denga Hukum Islam. Karena harta waris yang dimaksud dalam ilmu kewarisan adalah harta milik penuh dari pemiliknya, sedangkan harta pusako tinggi adalah harta milik bersama yang tidak bisa dibagi-bagi.

Abstract

Konsep demokrasi dalam Islam telah memicu perdebatan di kalangan cendekiawan dan intelektual Muslim. Perbedaan pandangan tersebut disebabkan oleh inti paham demokrasi yang menempatkan kedaulatan di tangan rakyat. Sedangkan dalam perspektif Islam, kedaulatan berada di tangan Allah sebagai pembuat undang-undang, dan dalam sistem pemerintahan, Islam menganut konsep syura. Meskipun demokrasi dan syura berbeda dalam filosofi, konsep inti, dan praktiknya, kedua sistem tersebut memiliki kesamaan dan kemiripan yang signifikan. Para ulama yang menentang demokrasi cenderung menekankan perbedaannya dengan syura, dan mereka yang mendukungnya cenderung menekankan persamaannya. Kelompok ulama yang menganut sistem demokrasi dan meyakininya sesuai dengan ajaran Islam mengacu pada demokrasi Islam, yaitu demokrasi yang tidak melanggar prinsip syariah. Penelitian ini membahas tentang pengertian demokrasi, sejarah singkat, dan prinsip-prinsipnya. Kemudian mengkaji persamaan dan perbedaan antara demokrasi dan syura. Lebih lanjut, memaparkan pandangan para ahli kontemporer mengenai demokrasi dalam perspektif syariah, serta menyebutkan beberapa fatwa para ulama mengenai pemilu dan partisipasi di parlemen. Implikasi penelitian ini agar dapat dijadikan referensi mengembangkan demokrasi.

Abstract

Fintech syariah hadir sebagai bagian dari solusi keuangan berbasis nilai-nilai Islam dan teknologi digital, menawarkan alternatif layanan finansial yang bebas dari riba, gharar, dan maisir. Penelitian ini bertujuan untuk menggali persepsi milenial Muslim terhadap peran fintech syariah dalam meningkatkan kemandirian finansial. Metode yang digunakan adalah kualitatif deskriptif dengan pendekatan fenomenologis. Hasil penelitian menunjukkan bahwa fintech syariah tidak hanya menjadi sarana transaksi keuangan, tetapi juga dipandang sebagai media edukasi finansial, penguatan nilai religius, dan pemberdayaan ekonomi pribadi. Temuan ini menggarisbawahi pentingnya integrasi teknologi dan prinsip syariah dalam membangun kemandirian finansial bagi generasi muda Muslim.

Abstract

This study explores the relationship between social change and domestic violence within the framework of Islamic family law in Pekanbaru, Indonesia. Using a qualitative thematic approach, data were gathered through in-depth interviews with 12 purposively selected respondents, including domestic violence survivors, religious leaders, legal practitioners, and community mediators. The findings reveal that ongoing social transformations—such as shifting gender roles, economic stress, and the weakening of traditional family structures—contribute significantly to the complexity and prevalence of domestic violence cases. Respondents demonstrated varied understandings of Islamic family law, often influenced by cultural norms rather than textual Islamic doctrines. Thematic analysis identified three core themes: (1) dissonance between religious ideals and lived social realities, (2) limited legal literacy regarding Islamic marital obligations, and (3) tensions between local customary practices (adat) and formal Islamic legal frameworks. The study concludes that while Islamic family law offers normative guidance for a harmonious domestic life, its implementation faces socio-cultural and institutional obstacles. Enhancing community-based legal literacy and integrating Islamic legal principles into local dispute resolution mechanisms are recommended to address domestic violence more effectively amidst ongoing social change.

Abstract

The determination of maritime baselines is a fundamental element in defining Indonesia’s Exclusive Economic Zone (EEZ). As an archipelagic state with over 17,000 islands, Indonesia requires precise and internationally recognized baselines to legitimize maritime jurisdiction, protect sovereignty, and secure marine resources. This study comprehensively examines the role of maritime baselines as a legal foundation for the delimitation of Indonesia’s Exclusive Economic Zone (EEZ). This study employs a normative legal approach by examining the provisions of the United Nations Convention on the Law of the Sea (UNCLOS) 1982 and Government Regulation No. 38 of 2002. Through case studies of maritime disputes with Malaysia (Ambalat Block), Vietnam (North Natuna Sea), and China (South China Sea), the research reveals that inaccurate or contested baseline determinations can trigger territorial conflicts, illegal fishing activities, and diplomatic tensions. The legal validity of baselines is crucial for Indonesia’s international legitimacy, maritime diplomacy, and sustainable resource governance. Therefore, the study recommends a multidimensional strategy involving legal reform, geospatial data modernization, precise hydrographic surveys, proactive diplomacy, and enhanced military presence in border areas. This study asserts that maritime baselines are not merely technical geographic markers, but strategic instruments in advancing Indonesia’s legal, political, and security interests amid regional geopolitical complexities.

Abstract

This study aims to critically examine the extent to which Islamic family law in Pekanbaru conducted from January to March 2025 empowers women in exercising their right to divorce. Grounded in a socio-legal and gender justice framework, the research explores both formal legal provisions and the lived experiences of Muslim women navigating divorce processes through the Religious Courts. Using a qualitative method, data were collected through in-depth interviews with divorced women, judges, and legal practitioners, and content analysis of relevant legal documents and court decisions. The findings reveal a complex interplay between religious norms, legal structures, and cultural expectations. While Islamic family law formally recognizes women's rights to divorce through mechanisms such as khulʿ and fasakh, bureaucratic hurdles, patriarchal interpretations, and social stigma often limit women's access to these rights in practice. Women who successfully obtained a divorce demonstrated strong legal awareness and support networks, suggesting that empowerment is highly dependent on socio-economic and educational factors. The study discusses the gap between normative Islamic principles that uphold justice and the structural barriers that hinder their realization in practice. It concludes that enhancing women's legal empowerment requires reforming procedural aspects of family law and promoting community-level awareness and gender-sensitive interpretations of Islamic jurisprudence.

Abstract

Child marriage remains a pressing issue in Indonesia despite legal reforms aimed at increasing the minimum age for marriage. This study conducted in Siak, Riau Province, Indonesia for explores how the practice of Islamic family law influences the persistence of child marriage, focusing on the tension between traditional religious interpretations and contemporary child protection efforts. The aim is to understand how religious court decisions, sociocultural norms, and interpretations of Islamic legal principles contribute to the continuation or mitigation of child marriage in Muslim communities. Using a qualitative approach, data were collected through in-depth interviews with religious court judges (hakim agama), community leaders, and affected families in selected West Java and Central Java regions. Document analysis of court decisions regarding marriage dispensation was also conducted to examine the reasoning behind legal allowances for underage marriages. The findings reveal that while many religious judges express concern for child protection, they often face social and religious pressures to approve marriage dispensations, especially in cases involving premarital pregnancy or economic vulnerability. Cultural traditions and local interpretations of Islamic law frequently prioritize family honor and social conformity over legal age requirements. However, some progressive interpretations are emerging, emphasizing maqāṣid al-sharī‘ah (the higher objectives of Islamic law), especially the protection of minors. This study concludes that balancing tradition and protection requires a contextual rethinking of Islamic legal practices in Indonesia. Greater emphasis on the ethical goals of Islamic law, combined with community education and judicial training, can help reduce the incidence of child marriage. The research highlights the need for an integrated approach that respects religious values while safeguarding children's rights.
