Abstract

Happiness (falah) constitutes the ultimate objective of Islamic economics, encompassing both material prosperity and spiritual well-being within the framework of Maqāṣid al-Sharī‘ah. However, conventional welfare indicators—such as GDP and income—remain limited in capturing the moral, psychological, and social dimensions of human well-being. This study aims to empirically examine the contribution of the five dimensions of Maqāṣid al-Sharī‘ah—preservation of religion (ḥifẓ al-dīn), intellect (ḥifẓ al-‘aql), life (ḥifẓ al-nafs), progeny (ḥifẓ al-nasl), and wealth (ḥifẓ al-māl)—to Indonesia’s National Happiness Index. Using balanced provincial panel data covering 34 provinces across three observation periods (2014, 2017, and 2021), this research applies a Fixed Effects panel regression model, selected based on Chow and Hausman tests, to estimate the impact of each dimension. The findings indicate that ḥifẓ al-nafs (proxied by labor force participation) and ḥifẓ al-nasl (life expectancy) exert statistically significant but negative effects on happiness. In contrast, ḥifẓ al-dīn (zakat), ḥifẓ al-‘aql (literacy rate), and ḥifẓ al-māl (GRDP per capita) show positive but statistically insignificant relationships. These results suggest the presence of non-material trade-offs, where increased economic participation and demographic improvements do not necessarily translate into higher subjective well-being. The study provides empirical support for the argument that national happiness cannot be adequately explained by economic growth alone. Instead, it requires a multidimensional framework that integrates spiritual, social, and ethical dimensions, as emphasized in Islamic welfare theory. This research contributes to the literature by bridging Maqāṣid al-Sharī‘ah with empirical happiness measurement and offers policy implications for designing more holistic and value-based development indicators in Muslim-majority contexts.

Abstract

This study aims to unveil the manifestations of sexual violence in Bengkulu and subsequently elucidate the significance of the Sexual Violence Law in safeguarding families through the lens of Maqasid Sharia. Employing a qualitative library research methodology with a normative-conceptual approach, the investigation reveals two main findings. First, the ratification of the Sexual Violence Law signifies a legal stride to address and protect victims, filling a void in specific legislative provisions. Notably, Bengkulu ranks fourth in sexual violence cases within Sumatra, with perpetrators predominantly known to the victims. However, the region lacks comprehensive psychosocial support, including educational aid, psychological services, reproductive health examinations, and talent development opportunities for child victims. The absence of secure shelters compels social workers to resort to orphanages as an alternative. Second, the urgency of the Sexual Violence Law, viewed through the Maqasid Sharia perspective, aligns with the dharuriyat level, emphasizing the protection of religion (Hifz al-Diin), safeguarding the body and soul (Hifz al-Nafs), ensuring mental well-being (Hifz al-‘aql), and protecting offspring (Hifz al-Nasl). This study sheds light on the necessity of legal provisions in mitigating sexual violence while emphasizing the broader societal and familial dimensions from a Maqasid Sharia standpoint.

Abstract

Tulisan ini mengambarkan eksistensi nasikh dan mansukh dalam penetapan hukum islam. Dari kajian ini ditemukan adanya perbedaan pandangan terkait persoalan nasikh dan mansukh dalam istinbath ahkam yang dimotori oleh mufassir ortodoks dan mufasir kontemporer. Mufassir ortodoks berpendapat bahwa nasikh dan mansukh dalam ayat al-Qur’an benar-benar terjadi secara haqiqi, sehinga hukum yang sudah dibatalkan (dinasakh) tidak bisa diberlakukan kembali. Sementara mufassir kontemporer menolak pandangan tersebut dengan dasar bahwa semua ayat al-Qur’an tetap berlaku (operatif), dan tidak ada satu ayat al-Qur’an pun yang dibatalkan (dinaskh). Eksistensi nasikh dan mansukh hanya terjadi secara majaziyah semata tidak secara haqiqiyah. Golongan ini berpendapat bahwa Naskh yang diartikan pembatalan atau penghapusan, bisa dimaknai dengan “penangguhan”, hal ini dikarenakan terjadinya perubahan situasi dan kondisi. Apabila situasinya kembali kekeadaan semula, maka hukum yang ditangguhkan pun kembali seperti semula lagi.

Abstract

This article scrutinizes the legal standing and institutional analysis of the Hajj Financial Management Agency (BPKH) within the constitutional framework in Indonesia. Through a literature review, the author investigates and re-examines the legal standing and institutional structure of BPKH, employing a normative-empirical legal study approach that explores legal norms, regulations, or secondary legal data along with an assessment of the effectiveness of norm application. The findings and conclusions are as follows: 1) Regarding legal standing, Law Number 34 of 2014 on the Management of Hajj Finances serves as the foundation and mandate for establishing BPKH. However, a disharmony exists between Law Number 34 of 2014 on the Management of Hajj Finances and Law Number 8 of 2019 on the Implementation of Hajj Worship. 2) In terms of institutional aspects, BPKH is an independent institution as stipulated in the Law on Hajj Financial Management. Nevertheless, BPKH's independence differs from other independent institutions, leading to the conclusion that BPKH is functionally independent but not structurally independent. This research aims to serve as a reference for policymakers to strengthen and consolidate the position of BPKH

Abstract

The phenomenon of fruit-taking in perenggan—border areas between private land and public space—represents a recurring socio-legal issue in Kuala Tungkal, Indonesia. This study aims to examine Islamic legal perspectives on the practice of picking overhanging fruit beyond property boundaries, by integrating normative analysis with empirical data rooted in local custom (‘urf). Employing a mixed-method case study design, the research involved 597 respondents through structured surveys and in-depth interviews with religious leaders, local authorities, and affected residents. The findings reveal that 88.2% of respondents had experienced fruit theft, and 57% believed the act was religiously or customarily permissible. These perceptions are shaped by economic pressures, normalized social behavior, and misconceptions of Islamic legal concepts—such as the mistaken belief that shufʿah grants harvesting rights when fruit overhangs public space. However, Islamic legal analysis affirms that such acts constitute ghaṣb (unlawful appropriation) and are prohibited (ḥarām) under sharī‘ah. In parallel, Indonesian Civil Code Article 570 affirms that produce from privately owned trees remains the legal property of the owner, even when branches extend beyond the land boundary. The novelty of this study lies in the application of contextual ijtihād, employing the theoretical framework of maqāṣid al-sharī‘ah, qiyās (analogical reasoning), istiḥsān (juristic preference), and ‘urf (customary practice) to propose humane and locally grounded legal responses. This approach enables a balanced application of the principle of wealth protection (ḥifẓ al-māl), societal welfare (maṣlaḥah), and harm prevention (mafsadah). Recommended interventions include neighbor agreements on surplus distribution, voluntary fruit-sharing arrangements, collective ethical reinforcement, and educationally oriented taʿzīr-based sanctions. The study’s primary contribution is the formulation of a context-sensitive Islamic legal model based on socio-empirical realities, offering practical guidance for fatwa development, village policymaking, and public legal education. It enriches the growing field of applied contemporary fiqh and advances productive engagement between religious texts, state law, and local wisdom

Abstract

The Director General of Islamic Religious Institutional Development again issued Circular Number P-005 / DJ. III/Hk.00.7/10/2021 concerning marriage during the iddah period, according to the provisions of the circular "an ex-husband man can marry another woman when the iddah period of his ex-wife has ended". This article attempts to further analyze the waiting period for men due to talak raj'i divorce using Jamaluddin Aṭiyah's theory of maqashid as-sharia. This research is normative legal research. In the perspective of Maqashid As-Sharia proposed by Jamaluddin Aṭiyah, the regulation of waiting periods for men after divorce not only reflects aspects of Islamic law governing divorce, but also serves as a means to achieve broader goals in the lives of individuals, families, communities, and humanity by Islamic values. With this approach, the regulation has a profound impact on various aspects of life-related to divorce.

Abstract

Sistem ekonomi konvensional memandang bahwa uang tidak hanya berfungsi sebagai alattukar (medium of exchange) dan kesatuan hitung (unit of account) namun juga berfungsi sebagaikomoditas yang dapat diperjualbelikan hingga menghasilkan keuntungan. Dengan kemampuan uangsebagai penyimpan nilai maka uang dianggap memiliki nilai waktu (time value of money) yangdiproksi dengan tingkat bunga. Dalam perspektif ekonomi Islam bunga identik dengan riba, lalubagaimana pandangan ekonomi Islam terhadap nilai waktu uang? Ekonomi Islam memandangbahwa uang hanya berfungsi sebagai alat tukar (medium of exchange) dan kesatuan hitung (unit ofaccount) tidak sebagai komoditas. Artinya uang tidak dapat diperjualbelikan dan dispekulasikansecara bebas. Karena itu uang tidak memiliki nilai waktu, tetapi waktulah yang memiliki nilaiekonomis (economic value of time. Jika waktu tersebut digunakan dengan baik dan bijak maka waktuakan memiliki nilai ekonomis yang relatif besar

Abstract

This study aims to analyze the implementation of sacrificial worship in the perspective of authentic hadith of Al-Bukhari with a case study on the Muslim community in Tembung Village. The research method used is qualitative descriptive with a living hadith approach, which involves direct observation, interviews, and literature reviews of hadiths related to qurbani worship. The results of the study show that although the implementation of sacrificial worship in Tembung Village is generally in accordance with the guidance of Islamic law, there are several practices that are less than optimal in the application of the sunnah, such as the installment system in the purchase of sacrificial animals, sacrificing on behalf of the deceased, the mixing of sacrificial meat from various participants, to the provision of slaughterers' wages taken from the sacrificial animal parts. This study emphasizes the importance of a deep understanding of hadith as a source of Islamic law so that the practice of sacrificial worship can be carried out in accordance with the teachings of the Prophet Muhammad PBUH and have higher spiritual and social values

Abstract

The leadership of non-Muslims in Indonesia had become a hot spotlight when the action 212 was held. Many people who later conducted a study of Islamic law about the validity of a non-Muslim was appointed as a leader. One study of this matter that is quite unique is the result of the Bahtsul Masail held by the GP Ansor which resulted in a conclusion that a non-Muslim is legitimately appointed as a leader in Indonesia. The results of this study reaped polemics because by some circles, it was considered to harm NU's thoughts which had been decided at the 1999 Congress at Lirboyo. This article intends to explore how NU's real thinking as a Muslim mass organization is the largest in responding to non-Muslim leadership in the Indonesian context. From the results of this study, it was concluded that organizationally, NU had never discussed the issue of non-Muslim leadership specifically, either in the Congress or National Conference of Alim Ulama. The issue that has been raised by NU in relation to non-Muslim politics is around its electability as a legislative council.

Abstract

Divorce and marital disputes are significant social issues in Deli Serdang Regency, Indonesia. This study evaluates the effectiveness of the prospective bride and groom course program and the role of the Marriage Counseling, Guidance, and Preservation Agency (BP4) in resolving marital disputes during the 2021-2023 period. This empirical legal research employs a descriptive qualitative approach, utilizing data from BP4 statistical reports and the Lubuk Pakam Religious Court. The findings indicate that BP4's involvement in marital disputes is low, ranging from 0.95% to 1.48% of total cases filed with the Religious Court, but the success rate of mediation at BP4 is significant, reaching 33.33%. The prospective bride and groom course program is effective in reducing the number of disputes that end up in court. Policy recommendations include increasing public awareness about the importance of mediation before filing court cases and strengthening the prospective bride and groom course program as a more effective divorce prevention measure.
