Abstract

This article discusses the law's effectiveness and urgency in eliminating forced marriage in Indonesia. This research is qualitative research with a legal effectiveness approach. The primary data in this research is quantitative data from previous research that discussed the phenomenon of forced marriage. Secondary data consists of related laws and regulations, journals, and books. The research results show that legal regulations regarding the rejection of forced marriage have been regulated in various favorable laws in Indonesia but have not shown a significant influence in reducing the high rate of forced marriage. It is for two reasons. Firstly, there are still overlapping legal regulations regarding forced marriage, namely between the marriage dispensation article (UUP) and the article prohibiting child marriage (UU PKS). Second, the root of the problem of forced marriage lies in social factors, like a weak economy and a low level of public education.

Abstract

As the only province in Indonesia implementing Islamic Sharia law, Aceh has a rich historical and cultural context rooted in Islamic traditions. In the modern era, understanding how Sharia law interacts with diverse community demands is crucial. This study examines the actualization of diyah (compensation) in Aceh's Qānūn Jināyah (Crimes) using a sociological approach to Islamic law. The qualitative research method employed involves descriptive data collection. The findings reveal that the diyah law in Aceh’s Qānūn Jināyah illustrates the intricate interaction between social, cultural, legal, and religious aspects in the application and acceptance of Islamic law. Diyah serves not only as a formal legal instrument for justice but also as a reflection of the strong cultural values, religious traditions, and social norms within Acehnese society. Through sociological analysis, the study highlights how the mechanism for implementing diyah in the Qānūn Jināyah embodies the integration of Islamic law with the socio-cultural values of Acehnese society, offering insights into how Sharia law adapts to contemporary social challenges and changes.

Abstract

This journal examines the role of the kabanti tradition in projecting social ethics and local literacy in Buton, Southeast Sulawesi. Kabanti, a form of oral and written literature rich in Islamic and local cultural values, has become an important medium for the dissemination of Islamic teachings and the cultivation of social values within the Buton community. Despite facing challenges from globalization and digitization, the kabanti tradition persists as a vital part of Buton's cultural identity. This research employs an exploratory, sociological, and ethnographic approach to understand how kabanti maintains and strengthens the norms, values, and social identity of the Buton community. The results indicate that kabanti is not merely an oral and written tradition but also a social institution that influences the way of life and human interactions within the Buton community. Consequently, this research contributes to preserving and empowering local cultural heritage through the kabanti tradition.

Abstract

This study examines tarekat and its development in the Islamic education curriculum at Jagat Arsy Islamic Boarding School and how it affects modern society from the development of the educational model applied to it. The method used in this research is a qualitative approach, using data from observation, interviews, and documentation. The study results show that integrating tarekat into the curriculum of Islamic religious education has significant benefits, especially in developing spirituality and morality. Tarekat helps to increase self-discipline, closeness to God, and the formation of a better-centered character. However, challenges during its implementation, including resistance from conservative factions and the struggle to develop a standardized curriculum, hindered the process. The tarekat-based education model is perceived to have shifted public opinion regarding tarekat's adaptability to modern life, leading to increased support and adoption of tarekat practices. These findings reaffirm the significance of integrating tarekat into the education system and offer fresh insights for developing a comprehensive and systematic Islamic educational model.

Abstract

This research reveals that both candidates in the 2019 Presidential Election engaged in Islamic populist movements in an attempt to garner sympathy and increase their respective electability. The symbolic convergence of Prabowo's campaign is evident in the institutional nature of the fantasy theme woven by his team, with actions that signify the fundamentalism of Prabowo's camp. In contrast, the fantasy theme constructed by Jokowi's team is notably moderate, as exemplified by the phrase "Jokowi Loves Santri," which gave rise to the narrative that Jokowi is a moderate figure. Consequently, a shared rhetorical vision was formed, positioning Jokowi as a moderate individual, with his disseminators acting more individually, unlike Prabowo's camp, which often coalitions with Islamic mass bases.

Abstract

This research wants to know the sustainability and changes in the sociology of sharia housing in Indonesia, which has experienced a significant increase in the last five years and changes in Islamic housing architectural design post-occupancy. Does this also change the sociological system? This research aims to determine the sustainability of Islamic residential architectural design in the modern era. The research can be a reference for practitioners and the Muslim community in building Islamic housing. The research uses qualitative methods with a case study design. The location is the Islamic Village Housing Complex in Tangerang, Banten, with an area of 120 Ha. This research concludes that applying Islamic architectural design to modern Islamic housing is not sustainable as it is influenced by social, political, economic, and cultural changes due to globalization, modernization, and other contemporary challenges. Islamic housing sociology is sustainable in building solidarity between Muslim communities, maintaining religious traditions, and participating in social and economic development. Fair distribution of wealth and resources can reduce social disparities and fulfill human rights in sustainable development.
