Abstract

This research aims to describe the position of the wife's income from the perspective of the law in Indonesia, Malaysia, Turkey, and Brunei Darussalam. The research method uses normative legal studies by comparing the four countries' legal views. The results showed that the wife's income assets in Indonesia and Turkey became joint assets and were divided equally upon separation. Meanwhile, in Malaysia and Brunei, the size of the wife's share when there is separation is determined by the amount of the wife's income.

Abstract

The governance of majelis taklim (Islamic study groups) is still diverse and unstandardized, resulting in differences in community participation and management effectiveness, which in turn affect the quality of Nonformal Islamic education. This study examines the governance of Nonformal Islamic educational institutions, specifically majelis taklim, through a qualitative multisite approach in eighteen majelis taklim in Mandailing Natal Regency. Data were collected through observation, interviews, and documentation. The results revealed two distinct governance models: open and closed. Open governance is typically found in majelis taklim established and managed by the community, characterized by high participation in decision-making and management. In contrast, closed governance is observed in majelis taklim managed by religious scholars, where decisions are centralized. The type of governance structure influences community participation levels, open governance shows higher involvement, while closed governance is more limited. These findings indicate that governance structures play a crucial role in determining community engagement and influencing Nonformal Islamic education practices. This study implies the importance of adaptive and participatory governance guidelines to enhance the effectiveness of Islamic study group management and strengthen the role of communities in Islamic education.

Abstract

This study examines ‘Ā`iḍ al-Qarnī's approach to understanding ḥadīth, focusing on matan analysis and the application of maqāṣid al-sharī‘ah in contextual interpretation. The research method used is qualitative through a literature review of ‘Ā`iḍ al-Qarnī's works and classical and contemporary ḥadīth literature. The main findings indicate that al-Qarnī criticises the literalist approach to ḥadīth matan, which often overlooks the maqāṣid dimension, and offers a thematic understanding model that integrates social context and universal Islamic values. Although he does not explicitly develop a methodology for sanad criticism, al-Qarnī emphasises the validity of meaning and the relevance of ḥadīth messages in the context of modern life. This study contributes theoretically by expanding the discourse on contemporary ḥadīth methodology through the integration of textual validity and maqāṣid al-sharī‘ah, while also providing practical implications for the renewal of a more adaptive and applicable approach to ḥadīth studies in modern Islamic education. Penelitian ini mengkaji pendekatan ‘Ā`iḍ al-Qarnī dalam memahami hadis dengan fokus pada analisis matan dan penerapan maqāṣid al-sharī‘ah dalam tafsir kontekstual. Metode penelitian yang digunakan adalah kualitatif melalui studi kepustakaan terhadap karya-karya ‘Ā`iḍ al-Qarnī dan literatur hadis klasik serta kontemporer. Temuan utama menunjukkan bahwa al-Qarnī mengkritisi pendekatan literalistik terhadap matan hadis yang sering mengabaikan dimensi maqashid, serta menawarkan model pemahaman tematik yang mengintegrasikan konteks sosial dan nilai universal Islam. Meskipun tidak membangun metodologi kritik sanad secara eksplisit, al-Qarnī menekankan validitas makna dan relevansi pesan hadis dalam konteks kehidupan modern. Studi ini memberikan kontribusi teoritis dengan memperluas wacana metodologi hadis kontemporer melalui integrasi antara validitas tekstual dan maqāṣid al-sharī‘ah, sekaligus memberikan implikasi praktis bagi pembaruan pendekatan studi hadis yang lebih adaptif dan aplikatif dalam pendidikan Islam modern.
