Abstract

Keefektifan Lembaga Manajemen Kolektif (LMK) dalam memungut royalti patut dipertanyakan hal tersebutdikaitkan dengan lahirnya Undang-Undang Hak Cipta No.28 Tahun 2014 yang mengatur keberadaan LMK lebihkhusus. Penggunaan musik untuk tujuan komersil wajib membuat perjanjian lisensi kepada Lembaga ManajemanKolektif legal yang telah mendapatkan izin dari Menteri, tujuan penelitian ini: (1). menjelaskan efektifitaspemungutan royalti oleh Lembaga Manajemen Kolektif berdasarkan Undang-Undang No. 28 Tahun 2014; (2)menjelaskan mekanisme pemungutan royalti oleh Lembaga Manajemen Kolektif berdasarkan Undang-Undang No.28 Tahun 2014. Jenis penelitian yang digunakan adalah yuridis empiris. Dengan pendekatan peraturan perundangundangandan wawancara. Hasil penelitian menunjukkan bahwa efektifitas pemungutan royalti oleh LMK sudahefektif, di dasarkan pada teori efektifitas dari Soerjono Soekanto. Mekanisme pemungutan royalti dengan pemberiankuasa oleh pencipta atau pemegang hak cipta lagu atau musik kepada KCI untuk memungut royalti hakmengumumkan atas pemakaian hak ciptanya oleh orang lain untuk kepentingan komersial. Kesimpulan penelitianini adalah efektifitas pemungutan royalti oleh LMK sudah sesuai, hanya dipengaruhi budaya masyarakat Indonesia.Sarannya Perlunya menumbuhkan kesadaran kepada masyarakat akan perlindungan dan penghargaan kepadapencipta lagu untuk mendapat hak ekonomi yaitu royalti; Peran Lembaga Manajemen Kolektif Nasional (LMKN)untuk lebih di tingkatkan untuk menghindari LMK yang tidak resmi; pemerintah segera menerbitkan PP tentangUUHC.Kata kunci: Efektifitas; LMK; Royalti; Hak Cipta

Abstract

Coffee is one of the leading commodities for Indonesia. The growth of coffee farming throughout Indonesia has also increased significantly in line with the growing trend of love for coffee on a national and international scale. This paper aims to discuss and explain the legal protection of coffee farmers registered with geographic indications in Tlahap Village, Kledung Temanggung, Central Java. This paper describes and analyzes various efforts to increase understanding of legal protection of geographic indications for coffee farmers. The method used in this program is direct assistance to coffee farmers in Tlahap Village and evaluation through interviews and surveys. The program found that the main obstacle faced by geographically indicated coffee farmers in Tlahap Village is human resources. The absence of a certified party to control coffee quality is one of the obstacles faced, in addition to the constraints of the geographical indication coffee farmer organizational structure. In addition, this program emphasizes that by increasing the understanding of legal protection for coffee farmers with geographical indications, the farmers are able to have readiness to face various obstacles in the field, one of which is regarding brand disputes, label fraud, and other legal problems. This program concludes that in terms of legal protection, cross-sectoral cooperation between farmer associations, government agencies and universities is required.

Abstract

Legal assistance is one of the needs of the community in the midst of many legal cases today. The existing consultations and assistance also seem formal and very rigid, such as being carried out in offices and the like. In fact, in the success of legal assistance, the comfort of both parties is the main key. This program emphasizes the development of a more comfortable pattern of legal assistance and consultation by combining coffee shops as an alternative place for legal consultation. This program was developed and implemented in Wanureja Village, Tegal, Kendal Regency, Indonesia. This place and program have continually provided clients with access to the best legal advice and representation available, all in an informal, stress-free setting with a low cost for the initial consultation. We meet you where you are most comfortable –an in-person meeting at an attorney’s office, a conversation at the local coffee house, or if you are disabled or incapacitated in any way, at your location.

Abstract

Indonesia's demographic bonus from various studies and analyzes shows various potentials for the development of young people, but in the second phase of the demographic bonus, the elderly population is predicted to increase significantly. The peak of the demographic bonus enjoyed by Indonesia, from various government data and expert research is estimated to occur in 2028-2031. After that, the number of elderly people will grow. The increasing number of elderly population has the potential to provide many benefits if they are strong, healthy and remain productive. However, keeping the elderly population healthy, resilient and productive certainly requires a lot of preparation and support from all parties. Issues of nutritional quality, sanitation and support for a healthy environment have become a number of priorities that must be realized, as is the preparation of the quality of the productive age population. Even the National Institute on Aging (NIA) underlines that elderly people are the fastest growing proportion of the world's population. People are living more advanced, but that does not mean they are healthier. The increase in the aging population brings with it many opportunities but also a number of public health challenges that we need to prepare for. One of the challenges faced is the problem of health and poverty. In fact, according to research by the Center for Aging Society (CAS) of the University of Indonesia, based on BPS data in 2019, the number of elderly people in Indonesia has reached 25 million people. The majority of the elderly live in villages which generally have low education or only elementary school. He also noted that there were around 2.4 million elderly people who were neglected. This service program is intended to increase understanding of the right of alienation for the elderly in Kedungkelor Tegal Village by collaborating with the Kedungkelor Tegal Elderly Healthy House (RUSELA) partner. This service program is expected to not only increase the understanding of the rights of the elderly, but also increase family awareness in maintaining both mental and physical health of parents, and also as a form of responsibility for a child. This program is expected to be able to encourage positive behavior of children towards their parents and be able to improve the welfare of the elderly.

Abstract

Food insecurity among children poses a significant threat to the healthy development of children around the world such as stunted growth, poor cognitive development, stress, illnesses, and many other negative repercussions which further leads to socio-emotional and behavioural consequences. A new study released by UNICEF reveals higher levels of poverty and malnutrition among children living in low-cost housing in Kuala Lumpur, compared to the national average, as well as in some cities in Indonesia. If children from the urban poor suffer from food insecurity, what more the children living in the rural areas who may suffer the same. Which is why Sen’s Entitlement theory attributes food insecurity to poverty which prevents affordability and accessibility to food. Political and other tangible interventions should be undertaken to address food insecurity not only to promote healthy development of children in Indonesia and Malaysia but also to assure sustainability of food security as a precautionary approach. A starting point to ensure food security among children should be the school where children spend most of their time in a day.

Abstract

The Indonesian people's fondness for coffee has become one of its own potentials and attractions, both in the fields of economy and tourism, as well as socio-cultural. Various coffee shops with various concepts emerged, not only in big cities but also in villages. With the rapid flow of information and technology, it is possible for this business to have sustainability and resilience. In the cultural aspect, this business can survive because of the cultural tendency of the Indonesian people who like to discuss, gather, and talk about many things in various ways. Seeing this potential, the author tries to combine the concept of cultural culture (craving for coffee) with a legal consultation service program by paralegals in Wanureja Village, Tegal Regency, Central Java. This program is a community service program funded by the Faculty of Law, State University of Semarang. This program aims to initiate and develop a legal consultation service center at the village level by utilizing coffee shops as a means of meeting clients with consultants.

Abstract

Protection of the potential of regional products is a necessity for the region. An understanding of the importance of protecting Geographical Indications for policy makers in the regions is one of the efforts to protect the peculiarities of regional products. The specificity of the product of a region can be a regional economic strength when there is protection for Geographical Indications, because the product will increase its selling value. Regional economy is a series of economic activities carried out by local communities together in accordance with the potential of existing regions to fulfill their daily needs. Geographical indications are part of Intellectual Property which is currently a concern that was initiated by the Government to each region to map as well as to provide protection for regional products that have the potential to have geographical indications. Carica Dieng is a typical product that meets the requirements for geographical indications in accordance with Law Number 20 of 2016 concerning Trademarks and Geographical Indications and Government Regulation Number 51 of 2007 concerning Geographical Indications

Abstract

The obligations of children in parental care are clearly regulated, both in Article 46 paragraph 1 of Law Number 1 of 1974 concerning Marriage and Article 321 of the Indonesian Civil Code. These two rules emphasize the obligation of children (mature) to care for and provide for their parents. However, the implementation of this rule is still not uniform. One of the contributing factors, apart from the economic level (poverty) is also the unequal perception and level of education in understanding this right which is still low. This research is a community service program funded by the Universitas Negeri Semarang. This program is located on Kedungkelor Village, Wanureja District, Tegal Regency, Central Java. This program aims to determine the level of change in understanding of the right of alimentation for the elderly group in Kedungkelor Village through the Legal Counseling Approach method. This method is a combination of methods of education, socialization, and legal assistance for residents. This program showed a pattern of significant changes in the level of understanding of the alimentation rights of the elderly. Of the 50 people surveyed showed an increasing trend of understanding. This program includes three important stages, namely: planning, advice, and legal action. In the legal action stage, this program involves the Youth Counseling Information Center (Pusat Informasi Konseling Remaja, PIKR) and the Elderly Health House (Rumah Sehat Lansia, RUSELA) in Kedungkelor Village in maximizing this level of understanding.

Abstract

Usaha Mikro kecil dan menengah (UMKM) menjadi tulang punggung ekonomi nasional sekaligus ujung tombak perputaran ekonomi dalam negeri. Mitra Asosiasi Muslimah Pengusaha Indonesia (ALISA) daerah Pemalang menghimpun UMKM di daerah Pemalang untuk lebih berdaya (mulai dari produksi, pengemasan, pemasaran, pendaftaran kekayaan inteleketual merek). Produk dari UMKM pemalang memiliki kekhasan kota pemalang telah banyak beredar dengan merek dagang yang merupakan brand dari produk UMKM seperti kamir dan ogel ogel. Merek sebagai bentuk perlindungan hukum belum sempurna bila belum di daftarkan pada Kementrian Hukum dan HAM. Sehingga merek produk dapat ditiru dengan mudah oleh sesama UMKM dengan tidak mempertimbangkan kualitas produk dan berpengaruh pada omzet pendapatan yang turun. Permasalahannya masyarakat sasaran (pelaku UMKM) belum berpengetahuan tentang urgensi pendaftaran merek. Kondisi ini dimanfaatkan oleh pihak yang mendompleng ke populeran UMKM (sudah memiliki pasar bagus). Mitra Alisa Pemalang membutuhkan pelatihan tentang edukasi, percepatan, pendampingan penyusunan dan pendaftaran berkas merek sehingga solusi pengabdi berupa kegiatan edukasi sosialisasi tentang kekayaan intelektual merek. Metode yang digunakan untuk menyelesaikan masalah program pengabdian ini adalah: Sosialisasi yang bertujuan menambah pengetahuan dan pemahaman dalam peningkatan kualitas dan pengembangan produk. Sosialisasi dierikan kepada perwakilan UMKM sejumlah 11 UMKM karena kegiatan dilakukan saat masa pandemi dengan protocol kesehatan ketat. Hasil sosialisasi berupa khalayak sasaran semula belum optimal dalam pemahaman urgensi pendaftaran Kekayaan Intelektual merek sehingga peningkatan pemahaman masyarakat UMKM Kabupaten Pemalang perlu dimaksimalkan. Pretest dan Post test dilakukan pada kegiatan.Peningkatan pemahaman pada masyarakat sasaran diukur dari rerata prosentase jawaban benar pada pre test 39 % menjadi 65% pada saat post test.

Abstract

The university has become an important place in the cultivation of character for generations in many countries. Many universities in the world also apply a variety of systems in making policies to shape the character of campus communities, including students. This study aims to analyze legal and ethical policies for students in fostering an attitude of nationalism and anti-radicalism. This study also aims to describe the various forms of implementation of student ethics policies that are applied in the Faculty of Law, Semarang State University, Indonesia. This study uses a qualitative method with direct data collection through observation and interviews. This study bases its analysis on the theory of the operation of Lawrence M Friedman's law. The results of this study indicate that legal and ethical policies for students are interpreted by a variety of different interpretations both between managers and students. Various cases of inequality of perception lead to pros and cons. However, this research proves that the implementation of legal ethics and student character policies have been regulated in various rules, both at the national level (ministerial regulation), university level (rector regulation), and faculty level (dean regulation) all of which emphasize on forming attitudes nationalism and anti-radicalism.
