Abstract

Penegakkan Hukum Sistem peradilan pidana terdiri dari beberapa komponen berikut: kepolisian, kejaksaan, pengadilan, dan lembaga pemasyarakatan. Prosedur pemeriksaan-yaitu proses penyelidikan dan penyidikan, yang meliputi penangkapan, penahanan, penggeledahan badan, penggeledahan rumah, penyitaan, dan pemeriksaan surat-surat-dilakukan di masing-masing komponen tersebut. Dalam Prosesnya sering terjadi kesalahan sehingga merugikan tersangka. Sehingga ada Lembaga yang Bernama Pra-pradilan. Pra-pradilan adalah wewenang pengadilan negeri untuk memeriksa dan memutuskan menurut aturan undang-undang tentang: sah atau tidaknya suatu penangkapan, sah atau tidaknya penghentian penyidikan, dan permintaan ganti rugi atau rehabilitas. Penelitian ini menggunakan metode Normatif Penelitian ini didasarkan Hukum Primer, Sekunder dan Tersier berdasarkan Penelitian ini diperoleh bahwa penetapan tersangka masuk kedalam objek praperadilan dan hakim dilarang menolak untuk memeriksa, menggali, mengikuti dan memahami nilai-nilai hukum dan rasa keadilanya serta. Dalam Perkara Praperadilan Mengenai Penetapan Tersangka yaitu Bahwa penetapan tersangka tidak diatur dalam pasal 77 KUHAP, tetapi tentang objek praperadilan pasal 77 KUHAP telah diatur secara limitative

Abstract

Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis Analisis Putusan Kasasi Jessica Kumala Wongso Tanpa Dilakukan Otopsi Menyeluruh (Studi Putusan Nomor 498K/PID/ 2017). Penelitian menggunakan metode penelitian yuridis normatif adalah penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan pustaka atau data sekunder belaka. Hasil penelitian menunjukkan bahwa   Meskipun otopsi menyeluruh adalah prosedur yang sangat penting dalam kasus kematian tidak wajar dan seharusnya tidak boleh dihindari tanpa alasan yang lebih kuat, karena tantangan dan sensitivitas yang dihadapi dalam kasus Mirna menunjukkan perlunya pendekatan yang seimbang antara kepentingan hukum dan sensitivitas budaya atau sosial. Ini mencerminkan kompleksitas dalam penegakan hukum pidana yang melibatkan aspek forensik dan hak-hak individu. Belum lagi hal ini di dukung oleh proses kematian Mirna yang diindikasikan terkena racun sianida, tentu sudah seharusnya dilakukan otopsi tidak hanya visum saja. Seharusnya dalam kasus ini pihak keluarga tidak menghalangi dilakukannya otopsi secara menyeluruh, untuk mengetahui penyebab kematian yang lebih komprehensif, bukan hanya bagian tertentu saja, dimana hasilnya tentu masih bisa diperdebatkan. Pendekatan sosiologis dalam menganalisis vonis Jessica Kumala Wongso membantu memahami bagaimana keadilan diterima dan dipersepsikan dalam konteks sosial yang lebih luas. Ini melibatkan mempertimbangkan bagaimana nilai-nilai budaya dan norma sosial membentuk pandangan terhadap keputusan hukum, serta bagaimana status sosial dan media mempengaruhi persepsi publik. Dengan melihat semua faktor ini secara bersamaan, tinjauan sosiologi memberikan pemahaman yang lebih menyeluruh tentang dampak dari kasus ini pada individu dan komunitas yang terlibat. Media dan opini publik sangat berperan besar dalam mempengaruhi keputusan hakim sebagaimana di ketahui di awal putusan media dan publik menggiring opini Jesicalah pelakunya dengan berbagai alasan yang sifatnya subjektif. Namun setelah beberapa tahun Jesica dihukum dan munculnya film dokumenter tentang Jesica, pola pikir publik jadi berubah dan menginginkan Jesica bebas dan menginginkan peninjauan kembali.

Abstract

Penelitian ini bertujuan untuk menganalisis Studi Putusan Pidana Tambahan Kebiri Dalam Hukum Positif Indonesia. Dalam penelitian ini pendekatan yang digunakan yaitu yuridis normatif, dimana pendekatan ini digunakan untuk menelaah teori-teori, asas-asas hukum serta peraturan perundang-undangan yang berkaitan dengan penelitian. Hasil penelitian menunjukkan bahwa Majelis Hakim dalam dasar pertimbangannya memberikan hukuman tambahan kebiri kimia terhadap terdakwa hanya berdasarkan atas keterangan terdakwa sendiri yang mengakui telah melakukan perbuatan tersebut terhadap 9 (sembilan) korban anak yang berbeda. Namun, keterangan ini tidak ditindaklanjuti oleh majelis hakim untuk melakukan upaya-upaya yang diperlukan guna mencari dan menggali kebenaran materiil sesuai dengan ketentuan dan aturan Hukum Acara Pidana yang berlaku. Hal ini mengakibatkan ketidaksesuaian putusan majelis hakim dengan syarat-syarat pemidanaan hukuman kebiri kimia yang seharusnya diterapkan, serta tidak memenuhi standar yang tepat dalam menjatuhkan pemberatan hukuman kepada terdakwa. Pemberlakuan hukuman kebiri dan/atau pemasangan chip secara selektif bagi pelaku yang memenuhi kriteria tertentu bertujuan untuk memberikan perlindungan yang lebih baik bagi anak-anak dan mencegah terjadinya kekerasan seksual berulang.

Abstract

Defamation (Defamation) is a criminal act of insult (Beleediging) formed by the legislators, both general and specific in nature and is intended to provide protection for legal interests regarding this kind of feeling. The purpose of this study is to understand and analyze the legal considerations of judges in passing decisions on perpetrators of defamation through the media of information technology (Decision Study Number: 212/Pid. Sus/2019/PN.Jmb). To understand and analyze the verdict handed down against the perpetrators of defamation through information technology media (Decision Study Number: 212/Pid. Sus/2019/PN.Jmb) has it reflected justice. The specification of this research is descriptive analytical research. In writing this thesis the author uses the Normative Juridical approach. The legal material in this thesis research was obtained through library research. Based on this consideration it has been proven legally and convincingly that the defendant has committed a crime, then the defendant must be declared guilty and the defendant must be sentenced to a sentence commensurate with his actions which the threat is according to Article 45 paragraph (3) in conjunction with Article 27 paragraph (3) of the Law Republic of Indonesia Number 19 of 2016 concerning Electronic Information and Transactions, the perpetrator is threatened with imprisonment for a maximum of 4 (four) years. However, in this case the defendant was sentenced to 8 (eight) months in prison based on decision Number: 212/Pid.Sus/2019/ PN.Jmb dated 9 May 2019. From a sociological perspective, the sentence of the defendant for 8 months is in accordance with the legal actions carried out by the defendant, although from the point of view of the victim it does not guarantee a sense of justice, it is also less preventive for potential perpetrators of other criminal acts of defamation. Because the sentencing felt so light that the value of the usefulness of the decision was felt to be less acceptable. From a philosophical aspect, to guarantee recognition and respect for the rights and freedoms of others and to fulfill just demands in accordance with security and public order considerations in a democratic society, for the realization of quality, integrity and noble human beings. Suggestions put forward that a judge should have a fair decision in his verdict so that the principle of an independent and impartial judiciary that guarantees the equality of every citizen in law runs well.

Abstract

Violations before elections committed by non-formal actors in mobilizing the masses are an interesting mechanism to discuss. This study aims to explain related to criminal policies against electoral criminal offenses in Article 523 paragraph 1 and Article 523 paragraph 2, factors that influence criminal policies in the implementation of Article 523 paragraphs 1 and 2 and criminal policies against electoral crimes Article 523 paragraph 1 and Article 523 paragraph 2 in the future. Research methods used in empirical normative research. The results of this study show that: First, criminal policies against electoral criminal violations in Article 523 paragraph 1 and Article 523 paragraph 2 can be pursued in various ways. Several ways that can be done as a form of criminal policy in solving the problem of electoral criminal violations in Article 523 paragraph 1 and Article 523 paragraph 2 include using penal methods, without using penal means (prevention without punishment) and efforts to form public opinion. Second, several factors that influence criminal policy in the implementation of Article 523 paragraphs 1 and 2 include the following: ineffective judicial implementation, unauthoritative laws, uncoordinated supervision and prevention and lack of participation from the public. Third, criminal threats in the electoral law were revised by changing criminal sanctions to administrative sanctions. Administrative sanctions are considered the most effective where the provision of sanctions will facilitate the enforcement of these norms and in turn we will see the usefulness or results of these laws and regulations. In addition, the inclusion of sanctions is also an effort to make someone comply with the provisions of laws and regulations.

Abstract

The high number of narcotics crimes every year shows that narcotics crimes, especially narcotics abuse, are a serious threat to the lives of the Indonesian people. The practice of law enforcement against narcotics abusers in Indonesia that prioritizes the imposition of criminal sanctions in prison has proven that the penal approach has failed. The urgency of establishing a Special Narcotics Court to combat narcotics crimes is the primary focus of this article, which draws lessons from the United States, Australia, and Scotland, all of which already have special narcotics courts with various systems. This paper is the result of doctrinal law research using a statutory approach and a comparative approach. Research has found that in the United States and Australia, there are Drug Courts, which are special courts. These courts were established in each state. Meanwhile, Scotland incorporates narcotics handling into the public justice system by using a rehabilitation approach to handling narcotics. The establishment of narcotics courts in Indonesia is critical to be carried out, considering that narcotics abuse can weaken Indonesia's national resilience, and the increasing number of narcotics cases results in overcrowding in correctional institutions. Narcotics crimes also have special characteristics, both in terms of the nature of the crime and the characteristics of the subject of the law, thus further emphasizing the importance of the narcotics court.

Abstract

In some cases, corruption has the potential to develop into money laundering, which will complicate the performance of law enforcement officers to track suspicious financial transactions and save assets suspected of belonging to the state. In response to this problem, the replacement money payment system is carried out by law enforcement officers. However, based on the results of the investigation, the implementation of replacement money payments for the recovery of state financial losses is considered ineffective and inefficient at the application and execution stages. Therefore, a legal breakthrough is needed in the form of the use of penal mediation as an effort to maximize state financial recovery. The purpose of this study is to identify the problems of recovering state financial losses due to corruption in Indonesia and the application of the victim offender mediation system based models to recovering state financial losses due to corruption in Indonesia. The results of this study indicate that the alternative nature contained in the construction of Article 18 of Law. No. 31 of 1999 has the potential to result in efforts to recover state financial losses being less than optimal and effective, this is due to the tendency of perpetrators to avoid responsibility for paying replacement money. The application of SBM VOM to recovering state financial losses can be done by accommodating the concept of PB in positive law in Indonesia. This research is a normative legal research using 3 approaches, namely the statutory approach (Statute Approach), the conceptual approach (Conceptual Approach) and the comparative approach (Comparative Approach).
