Abstract

Indonesia will hold the presidency of the Group of Twenty (G20) in 2022. That was the first time Indonesia was elected as the holder of the G20 presidency, since the G20 was formed in 1999. Indonesia will play a role in determining priority agendas and leading a series of G20 meetings, including the summit to be held in November 2022 in Bali. Financial route priority agenda in the G20 Indonesia 2022 Presidency. Discusses how the G20 protects countries that are still heading for economic recovery (especially developing countries) from the spillover effects of exit policies implemented by countries that recover their economies first (generally developed countries). Indonesia will add to the discussion on the latest global issue, namely food security. Food security is the goal of Indonesia to meet all the food needs of all its residents, with the fulfillment of all food needs of the Indonesian population being able to move, live healthy, and work productively. Food security is very important because it is the key to national economic development and is a basic human need to be fulfilled. The problem of food security is closely related to economic stability (particularly inflation), aggregate economic production costs (cost of living) and national political stability. This can be related to the phenomenon in Indonesia related to the conversion of agricultural land, why is that because food agricultural land is part of the cultivation function land whose existence is currently threatened for other needs such as housing, industry and so on. Thus, the method used to analyze these problems is a qualitative method which explains in depth in connection with the conversion of agricultural land to the effect on the environment and food security in Indonesia.

Abstract

Penggunaan ruang bawah tanah merupakan alternatif dalam rangka memenuhi kebutuhan lahan untuk berbagai kegiatan, khususnya pada lokasi strategis di Perkotaan. Secara yuridis pengaturan lembaga hukum hak atas ruang bawah tanah belum ada, dan UU yang sudah berlaku yaitu UUPA hanya menentukan pemanfaatan yang sangat terbatas dan relatif sehingga tidak ada kepastian hukum. Untuk pengaturan lembaga hukum harus dilakukan orientasi yuridis dari berbagai aspek terutama bidang teknik, lingkungan, dan sosial. Perkembangan wilayah perkotaan mendorong pembangunan dengan memanfaatkan Ruang Bawah Tanah (RBT) dan Ruang Atas Tanah (RAT). Secara faktual pemanfaatan RBT/RAT telah dilakukan untuk pembangunan fisik seperti fasilitas jalan layang dan rel kereta bawah tanah. Hukum tanah nasional belum mengatur secara tegas hak atas RBT / RAT. Tulisan ini mengkaji kedudukan hukum RBT/ RAT dan pengaturan RBT/RAT dalam hukum tanah nasional. Hasil analisis menunjukkan kedudukan RBT/RAT diakui dalam UUPA, yaitu hak atas RBT/ RAT di luar penguasaan hak pemegang hak atas tanah, menjadi hak negara yang pemanfaatannya dapat diberikan kepada subjek hak atas tanah, baik perorangan maupun badan hukum. Pemerintah dapat memberikan hak RBT/RAT berupa HGB, Hak Pakai, atau HGB di atas Hak Pengelolaan yang ketentuannya diatur dalam UU. Untuk menciptakan kepastian hukum dan perlindungan pemegang hak, pengaturan RBT/RAT dalam UU tentang Pertanahan yang sedang dibahas DPR perlu segera diwujudkan.

Abstract

Jurnal ini membahas analisis yuridis terhadap tindak pidana pencemaran lingkungan hidup oleh PT. SIPP di Kabupaten Bengkalis. Kasus ini menjadi sorotan karena perusahaan kelapa sawit tersebut terbukti melakukan dumping limbah secara langsung dan pengolahan Instalasi Pengolahan Air Limbah (IPAL) yang tidak sesuai dengan ketentuan. Hal ini mengakibatkan pencemaran air sungai dan pelanggaran terhadap Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup sebagaimana diubah dengan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Jurnal ini bertujuan untuk mengkaji aspek hukum dari kasus tersebut, termasuk unsur-unsur tindak pidana, dasar hukum yang diterapkan, dan potensi sanksi yang dapat dijatuhkan kepada pelaku.

Abstract

Penelitian ini dilakukan untuk menganalisis Bentuk Kekuatan pembuktian pada akta dibawah tangan memiliki kekuatan yang sama dengan akta otentik apabila isi dalam akta tersebut tidak disangkal oleh para pihak, atau dengan kata lain mengakui dan tidak menyangkal kebenaran apa yang tertulis serta tanda tangan para pihak dalam perjanjian tersebut. Sesuai pasal 1857 BW kekuatan pembuktian akta dibawah tangan dapat disamakan dengan akta otentik. Suatu perjanjian jual beli dengan menggunakan akta dibawah tangan adalah sah jika di kaji dalam pasal 1320 BW karena telah memenuhi unsur dalam syarat sah perjanjian tersebut. Metode penelitian memakai penelitian normatif dengan Pendekatan Perundang-undangan dan Pendekatan konsep. Penelitian ini menghasilkan bahwa upaya penyelesaian sengketa yang dapat dilakukan oleh pihak pembeli adalah dengan mengajukan gugatan wanprestasi ke Pengadilan Negeri, karena syarat mutlak pembuatan Akta Jual Beli (AJB) oleh PPAT harus dihadiri oleh para pihak yang bersangkutan. Majelis hakim dapat menjatuhkan putusan dengan memberikan ijin kepada pihak pembeli untuk melakukan pendaftaran Petok D melalui jual beli guna dapat mengurus Balik Nama tanpa keikutsertaan dari pihak ahli waris guna pendaftaran sertipikat Hak atas tanah di Kantor Badan Pertanahan Nasional.

Abstract

Article 1 of the 1945 Constitution of the Republic of Indonesia states that the State of Indonesia is a legal state which has sovereignty in the hands of the people and is implemented according to the Constitution. In order to implement the principles of the State of Indonesia in accordance with the 1945 Constitution of the Republic of Indonesia, there is a guiding instrument, namely the provisions for the formation of laws in Law Number 12 of 2011 and their amendments which maintain legal certainty in Indonesia. However, the existence of the Job Creation Law which was followed by a Government Regulation in Lieu of a Job Creation Law (Perppu) is in fact not in accordance with the Constitution and Law Number 12 of 2011 so that this research examines the benchmarks regarding compelling interest circumstances in Perppu and the relationship between the formation of Perppu with the principles of the Unitary State of the Republic of Indonesia. Because this research is legal research, the approach used is a statutory approach related to the formation of Indonesian laws and regulations supported by the concept of a rule of law and a democratic state based on Pancasila.

Abstract

Currently, illegal use of natural resources is rampant, especially among middle to lower class people, many of whom carry out mining activities without permits as a means of livelihood. Of course, carrying out mining activities without a permit/illegally is a criminal act in accordance with the provisions in Article 158 and Article 160 of the Mineral and Coal Law. However, efforts to enforce the law against illegal mining are a complex challenge for law enforcement agencies because the existence of illegal mining is related to social and economic issues faced by poor communities living around mining locations. In fact, many illegal miners report an improvement in their welfare as a result of illegal mining activities. This journal will conduct an analysis of the factors that cause the emergence of illegal mining, the impacts it causes, and policy solutions in dealing with illegal mining. Regarding the problems mentioned above, first, the factors driving illegal mining will be discussed, including regulatory issues, bureaucratic capacity in granting permits, lack of appropriate supervision, obstacles in law enforcement, and socio-economic aspects. The impacts of illegal mining will also be discussed, such as the impact on environmental damage, state revenues, and social conflicts that may arise. In the context of law enforcement, the application of utilitarianism policies and the use of punishment as a last resort will be reviewed. This journal will conclude by providing recommendations for law enforcement agencies to consider a persuasive approach to illegal miners, while the government carries out stricter guidance and supervision to turn illegal mining activities into legitimate activities.

Abstract

The case of PT Sunprima Nusantara Pembiayaan (SNP Finance) highlights the importance of effective supervision by the Financial Services Authority (OJK) of non-bank financial institutions in Indonesia. Through an evaluation of the case, this research addresses various aspects, including risk profile, corporate governance, profitability, and capitalization in the context of Non Performing Loan (NPL). It also reviews the legal aspects of the case, including violations of corporate law, criminal law, banking law, and auditor liability. The results suggest that increased supervision, the development of stricter regulations, better consumer education, and the use of technology in early detection could help prevent similar cases in the future.

Abstract

Kondisi merebaknya virus Korona di tahun 2021 lalu menyebabkan beberapa kemunduran pada masyarakat, termasuk aspek perekonomian. Demi meningkatkan kembali perekonomian nasional pasca dilandanya Indonesia dengan virus Korona, pemerintah dapat mengupayakan kemudahan berusaha dengan didukung eksistensi lembaga keuangan, baik Lembaga Keuangan Bank (LKB) maupun Lembaga Keuangan Bukan Bank (LKBB). Lembaga keuangan nasional yang mengambil berbagai tindakan dinamis pasca gelombang Covid-19 merupakan sebuah tanda pemerintah serius dalam meningkat kemudahan berusaha nasional. Oleh sebab itu, penelitian ini akan mengkaji konsep kelembagaan keuangan nasional dan peran lembaga keuangan nasional dalam usahanya meningkatkan kemudahan berusaha pasca pandemi. Dikarenakan penelitian ini merupakan penelitian hukum, maka pendekatan yang digunakan adalah pendekatan konsep terkait konsep lembaga keuangan nasional yang didukung dengan pendekatan perundang-undangan dengan menggunakan ketentuan yang sedang berlaku seperti mengacu pada Rencana Pembangunan Jangka Menengah (RPJMN) dan Peraturan Bank Indonesia.

Abstract

The diversity of Indonesia's resources from land and sea has been recognized by the world. With this diversity of resources, the country certainly needs a legal umbrella to provide protection so that the potential of these natural resources is maintained into the future. So in this case, the state is in the position of "ruler" which has the authority to regulate the use of existing earth, water and space, as stated in Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia. One embodiment of this article is the issuance of the UUPA which provides opportunities Indonesian citizens to own a plot of land in their own name, proven by ownership of a certificate. However, during the journey, a discrepancy was discovered that 1 plot of land was owned by 2 certificates, which created a sense of legal uncertainty for the owner. Therefore, this research will examine whether the problem of double certificates can be resolved at the TUN judicial body. Because this research is legal research, the approach used is a conceptual approach related to the concept of KTUN and TUN procedural law which is supported by a statutory approach using currently applicable provisions such as referring to the Constitution and other derivative regulations, KTUN,
