Abstract

Penelitian ini bertujuan untuk mengetahui penerapan keadilan restoratif di Kepolisian Resor Polewali Mandar dalam menyelesaikan tindak pidana penggelapan dalam jabatan dari tahun 2022 hingga tahun 2023 serta faktor penghambatnya. Jenis penelitian ialah penelitian campuran normatif dan empiris. Pengumpulan data dilakukan melalui studi kepustakaan, wawancara, dan studi dokumen. Analisis data yang digunakan yaitu secara kualitatif kemudian disajikan secara deskriptif. Hasil penelitian menunjukkan penerapan keadilan restoratif dalam penyelesaian perkara pidana penggelapan dalam jabatan di Kepolisian Resor Polewali Mandar di tahun 2022 hingga tahun 2023 belum berjalan optimal diakibatkan penanganan kasus tahun 2022 terdapat 7 (tujuh) kasus dengan 6 (enam) kasus yang tidak berhasil diselesaikan dengan keadilan restoratif. Demikian pula pada tahun 2023 dari 4 (empat) kasus terdapat 3 (tiga) kasus yang tidak berhasil diselesaikan dengan keadilan restoratif. Faktor yang menjadi hambatan dalam penerapan keadilan restoratif guna menyelesaikan tindak pidana penggelapan dalam jabatan di Kepolisian Resor Polewali Mandar dari tahun 2022 hingga tahun 2023 dipengaruhi oleh (1) faktor internal berupa sumber daya manusia dan sosialisasi ke masyarakat; dan (2) faktor eksternal yaitu pelapor dan tersangka. This research aims to find out the application of restorative justice in the Polewali Mandar Resort Police in solving the crime of embezzlement in office from 2022 to 2023 and the inhibiting factors. The type of research is mixed normative and empirical research. Data collection is done through literature studies, interviews, and document studies. The data analysis used is qualitatively and then presented descriptively. The results showed that the application of restorative justice in solving criminal cases of embezzlement in positions at the Polman Resort Police from 2022 to 2023 has not run optimally due to the handling of cases in 2022 there were 7 (seven) cases with 6 (six) cases that were not successfully resolved with Restorative Justice. Similarly, in 2023 out of 4 (four) cases, 3 (three) cases cannot be successfully resolved with Restorative Justice. Factors that become obstacles in the application of Restorative Justice to solve embezzlement crimes in positions at the Polewali Mandar Resort Police from 2022 to 2023 are influenced by (1) internal factors in the form of human resources and socialization to the community; and (2) external factors i.e. the whistleblower and the suspect.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana penerapan restorative justice dalam kasus tindak pidana pencemaran nama baik melalui media sosial di Polres Bulukumba dan untuk mengetahui faktor penghambat penerapan restorative justice pada tindak pidana pencemaran nama baik melalui media sosial di Polres Bulukumba. Jenis penelitian Empiris, yakni penelitian yang dilakukan dengan pendekatan pada realitas hukum dalam masyarakat. Lokasi penelitian di kantor Kepolosian Resort (Polres) Kabupaten Bulukumba. Pengumpulan data dilakukan melalui kuisioner dan wawancara. Data-data dianalisis menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan: 1) Penerapan Restorative Justice dalam Kasus Tindak Pidana Pencemaran Nama Baik melalui Media Sosial di Polres Bulukumba sebenarnya telah berjalan optimal akan tetapi belum sepenuhnya karena dalam beberapa kasus masih terdapat tidak adanya kesepakatan antara kedua belah pihak pelapor dan terlapor yang menyebabkan perdamaian sebagai syarat formil dalam upaya restorative justice tidak tercapai. 2) Faktor penghambat penerapan Restorative Justice pada Tindak Pidana Pencemaran Nama Baik melalui Media Sosial di Polres Bulukumba dipengaruhi oleh 3 faktor yaitu: a. Faktor hukum yang mengakibatkan pihak korban dan pihak pelaku tidak tercapai kesepakatan perdamaian. b. Faktor ekonomi yang dimana pihak pelapor menuntut bayaran ganti rugi yang tidak disanggupi oleh terlapor. c. Faktor sosial yaitu adanya intervensi dari pihak ketiga dalam hal ini keluarga This study aims to find out how the application of restorative justice in cases of criminal defamation through social media at the Bulukumba Police Station. This type of empirical research, namely research conducted with an approach to legal reality in society. The research location is at the Polres Resort (Polres) office of Bulukumba Regency. Data collection was carried out through questionnaires and interviews. The data were analyzed using a qualitative approach. The results of the study show: 1) The application of Restorative Justice in the Criminal Case of Defamation through Social Media at the Bulukumba Police has actually been running optimally but not yet fully because in several cases there was still no agreement between the two parties who reported and reported which led to peace as a formal requirement in restorative justice efforts are not achieved. 2) The inhibiting factors for the implementation of Restorative Justice in the Criminal Act of Defamation through Social Media at the Bulukumba Police Station are influenced by 3 factors, namely: a. Legal factors that result in the victim and the perpetrator not reaching a peace agreement. b. Economic factors in which the reporting party demands compensation payments that the reported party cannot afford. c. The social factor is the existence of intervention from a third party in this case the family

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis Penegakan Hukum Penanganan Tindak Pidana Pemerasan di Pelabuhan Soekarno Hatta Tahun, dari 2021 hingga Tahun 2023 dan Faktor yang menjadi Penghambat Penegakan Hukum dalam Penanganan Tindak Pidana Pemerasan di Pelabuhan Soekarno Hatta. Metode pemelitian yang adalah metode normatif empiris, dengan menggunakan bahan berupa  perundang-undangan, ridokumen-dokumen dan bahan hukum sekunder bersumber dari buku dan jurnal ilmiah serta bahan hukum tersier yang digunakan kamus hukum dan internet Hasil penelitian ini menunjukkan bahwa; Penegakan Hukum dalam Penanganan Tindak Pidana Pemerasan di Pelabuhan Soekarno Hatta mulai dari laporan, penyelidikan, dan penyidikan belum berjalan optimal diakibatkan dalam penanganan hukum hanya selesai pada tahap penyelidikan karena ditempuh penyelesaian melalui restorative justive selebihnya karena tidak cukup bukti. Faktor penghambat dalam Penanganan Tindak Pidana Pemerasan Polres Pelabuhan Soekarno Hatta bersumber dari dua faktor yaitu, faktor internal dan fakor eksternal, pertama faktor internal adalah faktor yang bersumber dari Kepolisian, khususnya faktor sumber daya manusia dan sarana prasarana. Faktor eksternal, adalah faktor dipengaruhi, tingkat kesadaran hukum dan faktor ekonomi yang merupakan penghambat dalam penanganan penegakan hukum This study aims to determine and analyze the Law Enforcement of the Handling of Extortion Crimes at Soekarno Hatta Port, from 2021 to 2023 and Factors that hinder Law Enforcement in Handling Extortion Crimes at Soekarno Hatta Port. The research method is the normative empirical method, using materials in the form of legislation, documents and secondary legal materials sourced from books and scientific journals as well as tertiary legal materials used legal dictionaries and the internet The results of this study indicate that; Law Enforcement in Handling the Crime of Extortion at Soekarno Hatta Port starting from reports, investigations, and investigations has not run optimally due to legal handling only being completed at the investigation stage because a settlement through restorative justive is taken for the rest because there is not enough evidence. The inhibiting factors in the handling of extortion at Soekarno Hatta Port Police Station come from two factors, namely, internal factors and external factors, the first internal factors are factors originating from the Police, especially human resources and infrastructure factors. External factors, are influenced factors, the level of legal awareness and economic factors which are obstacles in handling law enforcement

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk tindak pidana pencemaran nama baik secara berlanjut melalui media sosial dalam Putusan No. 515/Pid.Sus/Pn Mks dan untuk mengetahui putusan hakim terhadap terdakwa tindak pindana pencemaran nama baik secara berlanjut melalui media sosial telah sesuai dengan keadilan. Metode yang digunakan dalam penulisan skripsi ini adalah metode normatif, bahan yang digunakan adalah perundang-undangan, putusan pengadilan, serta dokumen negara dan bahan hukum sekunder yang digunakan adalah buku dan jurnal ilmiah. Hasil penelitan ini menunjukkan bahwa bentuk tindak pencemaran nama baik secara berlanjut melalui media sosial berdasarkan Putusan No.515/Pid.Sus/2023/Pn Mks dilakukan dengan berbagai rangkaian perbuatan mendistribusikan sehingga dapat diaksesnya dokumen elektronik melalui media sosial dan Putusan pidana pencemaran nama baik secara berlanjut melalui media sosial telah sesuai dengan rasa keadilan terhadap korban dan terdakwa dengan pertimbangan hakim hal yang memberatkan dan hal yang meringankan. Pertimbangan tersebut terhadap ketentuan kekuasaan kehakiman mengenai kewajiban hakim menggali nilai-nilai yang ada di masyarakat berupa latar belakang terdakwa dan dampak sosial yang diberikan kasus tersebut terhadap masyarakat. This resource aims to determine the form of continuing criminal defamation through social media in Decision No. 515/Pid.Sus/Pn Mks and to find out the judge's decision against the defendant for continuing criminal defamation through social media in accordance with justice. The method used in writing this thesis is the normative method, the materials used are legislation, court decisions, and state documents and the secondary legal materials used are books and scientific journals. The results of this research show that (1) The form of continuous defamation through social media based on Decision No.515/Pid.Sus/2023/Pn Mks is carried out with various series of acts of distributing so that electronic documents can be accessed through social media. (2) The verdict of criminal defamation through social media has been in accordance with the sense of justice for the victim and the defendant with the judge's consideration of aggravating and mitigating circumstances. These considerations are in accordance with the provisions of judicial power regarding the judge's obligation to explore the values that exist in society in the form of the defendant's background and the social impact that the case has on society.

Abstract

A journalist competence as intended in the Press Council Regulation is interpreted as knowledge capability without affirmation for journalists who have knowledge of certain scientific disciplines. The meaning is all journalists from any discipline may be recognized as journalists who have the competence to apply the presumption of innocence in reporting. This arrangement in journalistic practice, the press often appears' 'judgmental' in the news because the use of the terms is often interpreted the same, even though the law holds very different meanings, such as the suspect is written as the perpetrator, released is written as free, not accepted is written as rejected, sentenced to trial is written as the judge free it. To prevent the violation of the presumption of innocence principle in reporting, the regulation of journalists' competencies must be emphasized from intellectual abilities and general knowledge to legal knowledge. The affirmation is directly correlated with the news object which is in the realm of law as a function of the press that is obliged to respect the presumption of innocence principle.

Abstract

The concept of punishment is not only emphasized to the subject of the perpetrator, but also the consequences that can be caused need to be accounted. What is the ideal form of punishment for perpetrators of corruption. Does it really need extraordinary efforts to deal with this crime? This article was a type of normative research. The approach used in normative research was the statutory approach, which is an approach taken by examining all laws and regulations related to the legal issues being handled. Refund of state financial losses, especially corruption in Indonesia, is not easy and can be done. The perpetrators of corruption have very strong access to a wide network of power that is difficult for law enforcement to reach. This article describes the regulation of the return of state financial losses due to criminal acts that can be carried out through two legal instruments, namely criminal law instruments and civil law instruments.

Abstract

The appointment of journalists, especially in the field of legal coverage, is extremely urgent and has a wide- ranging impact on conveying information containing truth values, in order to realize a free and responsible press. The manifestation of this responsibility, however, is not accompanied by a system for the appointment of journalists, leading to the dissemination of information that triggers inaccuracies in news, resulting in legal claims, both criminal and civil. These claims continue to occur, and the number of journalists entangled in legal issues also continues to increase. All of this is caused by laxity, both in Law Number 40 of 1999 and in the Press Council Regulations, which do not regulate the standards for the appointment of the journalistic profession. Abstract

This study aims to determine village financial management in Bungin Village in accordance with the Minister of Home Affairs Regulation Number 113 of 2014 concerning Village Financial Management and the obstacles that occur in the implementation of village financial management in Bungin Village. This study used normative and empirical research methods and the data used were primary data and secondary data by interviewing 4 village officials and 5 communities in Bungin Village. The results of this study found that the implementation of village financial management in Bungin Village starting from the planning, implementation, administration and reporting stages was in accordance with Permendagri No. 113 of 2014 concerning Village Financial Management. However, at the accountability stage, Bungin Village did not publish accountability reports to the community. This shows that the financial accountability of villages in Bungin Village is not in accordance with Article 40 Paragraph (1) Permendagri Number 113 of 2014 concerning Village Financial Management. The obstacles in the implementation of village financial management in Bungin Village are inadequate human resources, lack of input from the community, inadequate facilities and infrastructure and late information from the district government regarding village financial disbursements.

Abstract

The purpose of this study was to determine the supervisory function of the Makassar City Regional Inspectorate in the implementation of basic education supervision in Makassar City. This research is a qualitative research. Where the type of data consists of primary data and secondary data, where primary data is obtained through interviews and direct observations in the field, while secondary data is obtained from data that has been collected by researchers through documents, books related to this research. The number of informants in this study amounted to 7 (seven) people. The data analysis technique used is descriptive qualitative analysis. The results of this study explain how the supervisory function of the Makassar City Regional Inspectorate in implementing the implementation of basic education in Makassar City, which includes a) inspection, where the inspection process carried out is well coordinated, b) repair, the form of repair carried out by the inspectorate Makassar City is in the form of a follow-up where the inspectorate provides an opportunity for the school to correct the mistake, but if it is not implemented then the inspectorate will provide a follow-up recommendation to the mayor who will then be given sanctions against the school, c) assessment, with the presence of the inspectorate in Supervising the implementation of basic education has a positive impact on schools because it provides a sense of caution for schools to use school budgets and implement them properly, which aims to educate the nation's children.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis pertimbangan hukum hakim dalam putusan Mahkamah Konstitusi Nomor 112/PUU-XX/2022 tentang Perpanjangan Masa Jabatan Pimpinan KPK dari 4 (empat) tahun menjadi 5 (lima) tahun dan pemberlakuan perpanjangan masa jabatan secara langsung dengan menerbitkan Keputusan Presiden Nomor 112/P Tahun 2023, maka masa jabatan Pimpinan KPK berakhir pada Desember Tahun 2024. Tipe penelitian ini adalah normatif dengan berfokus pada studi kepustakaan. Untuk bahan dan data hukum adalah primer, sekunder dan tersier. Bahan dan data hukum selanjutnya di analisis secara kualitatif dan diolah secara dedukatif. Hasil penelitian ini menunjukkan pertimbangan hukum hakim Mahkamah Konstitusi tidak terlepas dari pertimbangan hukum sesuai dengan Pasal 34 Undang-Undang Nomor 30 Tahun 2002 bahwa pemohon telah kehilangan haknya untuk memperoleh kepastian hukum yang adil, kedudukan yang sama di hadapan hukum dan bebas dari perlakuan diskriminatif yang bertentangan dengan Pasal 28D ayat (1,2,3) dan Pasal 28I UUD NRI Tahun 1945. Sementara pemberlakuan putusan tersebut dengan memperpanjang masa jabatan Pimpinan KPK telah di laksanakan, di mana Presiden mencabut Keputusan Presiden Nomor 112/P Tahun 2019 dan menerbitkan Keputusan Presiden Nomor 112/P Tahun 2023 yang berarti masa jabatan Pimpinan KPK di perpanjang 1 (satu) Tahun. This study aims to determine and analyze the legal considerations of judges in the Constitutional Court Decision Number 112/PUU-XX/2022 concerning the Extension of the Term of Office of the KPK Leadership from 4 (four) years to 5 (five) years and the direct implementation of the extension of the term of office by issuing Presidential Decree Number 112/P of 2023, then the term of office of the KPK Leadership ends in December 2024. This type of research is normative with a focus on literature studies. For legal materials and data are primary, secondary and tertiary. Legal materials and data are then analyzed qualitatively and processed deductively. The results of this study indicate that the legal considerations of the Constitutional Court judges are inseparable from legal considerations in accordance with Article 34 of Law Number 30 of 2002 that the applicant has lost his right to obtain fair legal certainty, equal standing before the law and freedom from discriminatory treatment that is contrary to Article 28D paragraph (1,2,3) and Article 28I of the 1945 Constitution of the Republic of Indonesia. Meanwhile, the implementation of the decision by extending the term of office of the KPK Leadership has been carried out, where the President revoked Presidential Decree Number 112/P of 2019 and issued Presidential Decree Number 112/P of 2023 which means that the term of office of the KPK Leadership is extended by 1 (one) year.
