Abstract

The position of children who have special rights in the law makes children get special treatment. In the juvenile justice system in Indonesia, there are two systems of sanctions, namely criminal sanctions and actions, and this is done to realize the protection of children who are dealing with the law.  This research is a normative juridical review, using a statute, comparative and conceptual approaches. The results show that the imposition of sanctions on children is based on the child's age, where children aged 12 to before 14 years can only be sanctioned with actions, and children aged 14 to before 18 years may be subject to criminal sanctions or actions.

Abstract

The appointment of journalists, especially in the field of legal coverage, is extremely urgent and has a wide- ranging impact on conveying information containing truth values, in order to realize a free and responsible press. The manifestation of this responsibility, however, is not accompanied by a system for the appointment of journalists, leading to the dissemination of information that triggers inaccuracies in news, resulting in legal claims, both criminal and civil. These claims continue to occur, and the number of journalists entangled in legal issues also continues to increase. All of this is caused by laxity, both in Law Number 40 of 1999 and in the Press Council Regulations, which do not regulate the standards for the appointment of the journalistic profession. This laxity has triggered the idea of creating a system for the appointment of legal journalists based on the affirmation of a profession that meets professional standards through an ideal model, the regulation of which lies within a legal framework. ___ References Books with an author: Gant, S. Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis pelaksanaan penjatuhan sanksi di kawasan bebas asap rokok di Desa Bone-Bone, Kecamatan Baraka, Kabupaten Enrekang menurut Peraturan Desa Nomor 1 Tahun 2009 dan faktor penghambat pelaksanaan penjatuhan sanksi di kawasan bebas asap rokok di Desa Bone-Bone, Kecamatan Baraka, Kabupaten Enrekang menurut Peraturan desa Nomor 1 Tahun 2009. Tipe penelitian yang di gunakan dalam penelitian ini adalah tipe penelitian hukum normatif-empiris, dengan tektik pengumpulan bahan dan data, baik bahan Hukum primer dan bahan hukum sekunder, yaitu peraturan perundang-undangan seperti Peraturan Daerah Provinsi Sulawesi Selatan, bahan Hukum sekunder terdiri dari, buku-buku ilmiah dibidang hukum dan jurnal ilmiah, sedangkan bahan hukum tersier terdiri dari Kamus Besar Bahasa Indonesia (KBBI) dan media online. Untuk menggambarkan hasil penelitian ini digunakan teknik pengumpulan data seperti, Studi Kepustakaan, Wawancara, dan Studi Dokumentasi. Data keseluruhan yang dikumpulkan dianalisis menggunaka metode analisis deskriptif. Hasil penelitian menunjukkan pelaksanaan penjatuhan sanksi di Desa Bone-Bone, Kecamatan Baraka, Kabupaten Enrekang belum berjalan optimal, di sebabkan sistem penjatuhan sanksi di terapkan tidak mengikat, baik terhadap Aparat Pemerintah Desa dan Kepala Desa yang mengetahui dan menemukan warga merokok di kawasan tersebut. Sifat tidak mengikat menjadi faktor penghambat, baik yang bersumber internal maupun eksternal. This study aims to determine and analyze the implementation of sanctions in smoke-free areas in Bone-Bone Village, Baraka District, Enrekang Regency according to Village Regulation Number 1 of 2009 and the inhibiting factors in the implementation of sanctions in smoke-free areas in Bone-Bone Village, Baraka District, Enrekang Regency according to Village Regulation Number 1 of 2009. The type of research used in this study is the normative-empirical legal research type, with the technique of collecting materials and data, both primary legal materials and secondary legal materials, namely laws and regulations such as the Regional Regulation of South Sulawesi Province, secondary legal materials consist of scientific books in the field of law and scientific journals, while tertiary legal materials consist of the Great Dictionary of the Indonesian Language (KBBI) and online media. To describe the results of this study, data collection techniques were used such as Literature Study, Interviews, and Documentation Study. The overall data collected was analyzed using descriptive analysis methods. The results of the study show that the implementation of sanctions in Bone-Bone Village, Baraka District, Enrekang Regency has not been running optimally, because the sanctions system is applied non-bindingly, both to Village Government Officials and Village Heads who know and find residents smoking in the area. The non-binding nature is an inhibiting factor, both from internal and external sources.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan hukum pidana terhadap pelaku tindak pidana korupsi Dana Bantuan Operasional Sekolah (BOS) di Kabupaten Gowa, dengan fokus pada pertimbangan hakim dalam penjatuhan pidana berdasarkan Putusan Nomor 95/Pid.Sus-TPK/2023/PN Mks. Fokus penelitian mencakup analisis unsur-unsur tindak pidana sebagaimana diatur dalam Pasal 3 Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, pertimbangan yuridis dan non-yuridis hakim, serta relevansi putusan terhadap upaya pemberantasan korupsi di lingkungan pendidikan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kasus (case approach), yaitu mengkaji putusan pengadilan terkait untuk menemukan pola dan dasar hukum yang digunakan hakim. Data diperoleh dari studi dokumen putusan pengadilan dan literatur hukum terkait. Analisis dilakukan secara kualitatif dengan menguraikan fakta persidangan, pertimbangan hakim, dan amar putusan. Hasil penelitian menunjukkan bahwa terdakwa terbukti secara sah dan meyakinkan melakukan tindak pidana korupsi dengan menyalahgunakan kewenangan untuk menguntungkan diri sendiri atau orang lain, yang mengakibatkan kerugian keuangan negara. Hakim mempertimbangkan hal-hal yang memberatkan, antara lain dampak perbuatan terhadap keuangan negara dan kepercayaan publik, serta hal-hal yang meringankan seperti pengakuan dan penyesalan terdakwa. Putusan akhirnya menjatuhkan pidana penjara dan denda sesuai ketentuan undang-undang, yang dinilai proporsional terhadap perbuatan terdakwa. This study aims to analyze the application of criminal law to perpetrators of corruption involving School Operational Assistance (BOS) funds in Gowa Regency, focusing on the judge’s considerations in sentencing as reflected in Decision Number 95/Pid.Sus-TPK/2023/PN Mks. The research focuses on examining the elements of the criminal act as stipulated in Article 3 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 on the Eradication of Corruption, the juridical and non-juridical considerations of the judge, and the relevance of the decision to anti-corruption efforts in the education sector. The research method used is normative legal research with a case approach, analyzing court decisions to identify the patterns and legal grounds applied by the judge. Data were obtained from court decision documents and related legal literature. The analysis was conducted qualitatively, describing trial facts, judicial reasoning, and the verdict. The results show that the defendant was proven legally and convincingly to have committed corruption by abusing authority for personal or others’ benefit, causing losses to the state finances. The judge considered aggravating factors, including the impact of the crime on state finances and public trust, as well as mitigating factors such as the defendant’s acknowledgment and remorse. The final decision imposed imprisonment and fines in accordance with statutory provisions, deemed proportionate to the defendant’s actions.
