Abstract

Peradilan adat di Papua mempunyai kewenangan bagi penyelesaian tanah adat, khususnya pada suku Wate. Putusan peradilan adat mengutamakan musyawarah dan mufakat yang melibatkan kepala suku serta tokoh adat. Meskipun memiliki kekuatan dalam komunitas adat, putusan peradilan adat tetap harus selaras dengan hukum nasional yang berlaku di Indonesia. Permasalahan dalam penelitian ini yaitu:  Bagaimana mengimplementasikan kewenangan peradilan adat di Papua dalam menyelesaiakan sengketa adat suku Wate? Metode Penelitian yang digunakan adalah yuridis normatif, peneliti menggunakan data sekunder dengan merujuk pada bahan-bahan hukum primer, terutama Perdasus Papua No. 20 Tahun 2008. Masyarakat hukum adat Papua, Suku Wate memiliki mekanisme penyelesaian sengketa yang diwariskan melalui musyawarah adat yang mengutamakan mufakat. Perdasus Papua No. 20 Tahun 2008 tentang Peradilan Adat di Papua memberikan dasar hukum kuat bagi peradilan adat dalam menangani sengketa.  Putusan peradilan adat bersifat mengikat dan lebih berorientasi pada pemulihan, seperti denda adat dan upacara adat, dibanding dgn hukum sistem peradilan negara.

Abstract

Kongres Perserikatan Bangsa-Bangsa (PBB) Ke-8 tentang Pencegahan Kejahatan dan Perlakuan terhadap Pelaku Kejahatan, bertujuan demi penghormatan bagi yang ditahan/dipenjara serta prinsip-prinsip dasar tentang peran Pengacara. Resolusi 18 No.140 memberikan perlindungan bagi Pengacara yang berpraktik terhadap pembatasan dan tekanan yang tidak semestinya dalam menjalankan fungsi keprofesiannya. Penelitian ini berfokus di Indonesia dan Malaysia sebagai anggota Asean. Pertanyaan penelitian ialah instrumen rujukan apa yang digunakan dalam implementasi bagi peran Pengacara dan sejauhmana terimplementasi di Indonesia dan Malaysia? Penelitian ini menggunakan data sekunder yaitu bahan hukum primer, instrumen internasional PBB, pengaturan regional serta domestik. Hasil penelitian: Pertama, instrumen rujukan bagi Pengacara dalam mejalankan keprofesiannya adalah The Milan Plan of Action No. 139, yang didukung Resolusi No. 40/32; Piagam PBB yang menegaskan penciptaan keadilan dapat ditegakkan; penghormatan kebebasan fundamental tanpa diskriminasi. Deklarasi Universal HAM mengenai asas persamaan di hadapan hukum, hak atas pemeriksaan yang adil dan terbuka oleh pengadilan yang independen, jaminan yang diperlukan untuk pembelaan yang didakwa melakukan tindak pidana; serta Pengaturan Model Perilaku Profesional dan Kode Etik Tanggung Jawab Profesional di setiap negara. Kedua, Implementasi prinsip dasar di Indonesia bahwa Pengadilan tidak secara tegas merujuk pada Prinsip ini. Negara tidak mencampuri dan memposisikan independensi profesi hukum. Mahkamah Konstitusi merujuk UU Advokat, yang melindungi seorang Pengacara dari tuntutan perdata atau pidana dalam menjalankan tugasnya dengan itikad baik dan berlangsung demi kepentingan pembelaan klien. Implementasi di Malaysia dilaksanakan dengan penerapan prinsip ‘Non-intervensi dan independensi profesi hukum. Perlindungan bagi Pengacara dari intimidasi serta menghormati prinsip kerahasiaan antara Pengacara dan Klien.

Abstract

Lestari Mulya (LM) Agro-Edutourism is one of the Agro-Edutourisms included in the Aerotropolis Area, which is a tourist area supporting Yogyakarta International Airport (YIA) in Kulon Progo Regency. This Agro-Edutourism is a tourist destination designed for educational purposes for children who have received early childhood education and kindergarten students. The community services aim to support members of the Lestari Mulya Women Farmer Group as managers of the Agro-Edutourism to discover their potential, identify development alternatives and assist them to become a sustainable agroindustry. Rapid Rural Appraisal (RRA), Participatory Rural Appraisal (PRA), and Focus Group Discussion (FGD) methods were used by the Universitas Gadjah Mada community services team to gather the information needed for further development planning. The results of the in-depth interviews showed that there is potential for the land and that some ideas can be developed to improve the quality of Agro-Edutourism products. The Lestari Mulya Women Farmers Group was able to use the FGD method to design a safer and more comfortable layout for the area. The community services team has developed a master plan proposal to apply for funding to improve infrastructure to support faster development of the Agro-Edutourism

Abstract

Home Industry Putra Tunggal Wonosobo is a tempeh chip industry whose production process is manual, so it can have a negative impact on worker ergonomics. Preliminary research was conducted by interviewing pain complaints and assessing work posture using the OWAS method. The tempeh chips packaging workstation was the workstation that had the most pain complaints at 67.86% (19 of 28 body parts) and the highest OWAS score at 4, so this was at high risk of experiencing musculoskeletal disorders. The next study used the NBM questionnaire to analyze the level of pain due to work and RULA for work posture. CATIA software was used to design tables and chairs, as well as assess the posture of the design results using the RULA method. Worker performance will be compared before and after using tables and chairs based on the level of body pain due to work (NBM) and work posture (RULA). The research results showed a decrease in the risk of work-related diseases by 80 and 78 to 40 and 44 (from high to low-risk levels) as well as a decrease in the RULA score from 7 (dangerous posture) to 2 (good posture).

Abstract

permasalahan main hakim sendiri, khususnya di kota besar seperti Jakarta masih kerap terjadi, khususnya di kalangan remaja. fokus pengabdian, yaitu kalangan remaja di lingkungan RW 04 Kelurahan Kalibaru, Kecamatan Cilincing, Jakarta Utara. Tujuan pengabdian, pemberdayaan  dan peningkatan kapasitas serta memberikan solusi berdasarkan kajian akademik atas kebutuhan. Metode yang digunakan dalam pengabdian ini yaitu Metodologi Participatory Action Research (PAR), yaitu melalui pendekatan penelitian partisipatif dimana masyarakat terlibat aktif dalam mengidentifikasi dan menyelesaikan masalahnya. Hasil pengabdian, bahwa warga masyarakat perkotaan memahami serta menyadari, main hakim sendiri atau menghakimi orang lain tanpa melalui proses hukum yang seharusnya adalah tidak benar. Main hakim sendiri biasanya dilakukan dengan cara pemukulan, penyiksaan, pembakaran, dan sebagainya. Bahkan, beberapa kasus telah mengakibatkan kematian. Terhadap mereka yang melakukannya ada sanksi, oleh sebab hal itu merupakan perbuatan tindak pidana.

Abstract

The right to obtain remission in Indonesia is contained in Law Number 22 of 2022 concerning Corrections. Regarding the right to remission is contained in Article 34A paragraph (1) letter a of Government Regulation Number 99 of 2012 concerning Conditions and Procedures for Implementing the Rights of Prisoners. The problem that occurs is whether corruptors who harm the state and Indonesian society deserve remission. The issue of Justice Collaborator is also interesting to discuss because it has many pros and cons. This research is a doctrinal research with a statutory and conceptual approach. Legal materials are obtained from legislation, to strengthen the analysis, this research also uses some empirical and normative research results. The analysis of data is carried out using the content analysis method which focuses on the study of laws and regulations regarding remission. This study argues that the elimination of the requirement to become a Justice Collabolator for perpetrators of corruption will eliminate human rights because the right to obtain remission is not given immediately but there must be mandatory conditions and procedures that must be met for perpetrators of corruption. based on Article 29 paragraph (2) and Article 28J paragraph (2) of the 1945 Constitution that restrictions on the fulfillment of human rights can only be carried out for reasons carried out under the law and stipulated by law. Abstract

Tobacco waste has the same bioactive compounds as tobacco leaves but with lower concentrations such as nicotine, phenolic compounds, aromatic substances, and solanesols. Utilization of tobacco waste that is not optimal can be processed to produce bioactive compounds that are beneficial to the surrounding environment. Tobacco waste can be processed into biopesticides containing nicotine and solanesol which function as antifungals and antioxidants. Tobacco waste was processed using the UAE maceration method using variables of temperature (40-600C), time (15-30 minutes), and type of solvent (acetone, methanol, and 96% ethanol). The results of UAE maceration were processed using Response Surface Methodology (RSM) data to determine optimal in yield, antifungal, and antioxidant activity tests. The study produced optimal values in UAE maceration, namely using a temperature of 52.470C, 29.86 minutes, and 96% ethanol solvent with a yield of 9.92%, 97.89% antifungal, and antioxidant activity (IC50) 16.75 ppm.

Abstract

The Customs Law, in its substance, regulates matters of customs administration, which includes export and import arrangements, tariffs and customs value, exemption from import duties, procedures for payment of import duties, prohibitions and restrictions on export-import, and criminal provisions related to customs. Even though there have been precise arrangements regarding certain goods that are exempt from payable import duties, in reality, on the ground, there are still disputes regarding import duties between business actors as importers and the Directorate General of Customs and Excise as executors of customs affairs for imported goods. This study discusses how the implementation of import duty exemption procedures by the Directorate General of Customs and Excise (DJBC) applies to imported goods belonging to Representatives of Foreign Countries, in this case, the British Embassy in Indonesia, carried out by PT. Toyota Astra Motor as an agent for motorized vehicles today and how the exemption procedure for imported goods belonging to foreign representatives in Indonesia should be by the Decree of the Minister of Finance Number 90/KMK.04/2002 concerning Procedures for Granting Import Duty and Excise Exemption on Goods of Representatives of Foreign Countries and The official. This research is a normative legal research that uses secondary data as a source. The secondary data sources consist of laws and regulations, books, journals, records, and others, which can be obtained through library research and analyzed using qualitative data analysis methods. This study found the exemption procedures related to import duties and excise by the Directorate General of Customs and Excise according to the current Indonesian legal regulations for goods transactions between the British Embassy in Indonesia and PT. Toyota Astra Motor, a motor vehicle agent legal entity in Indonesia, has a rigid flow that can cause losses to one of the parties in its implementation. On this basis, it is necessary to amend the procedure for the exemption of import duty and excise in Indonesian legal regulations and clarify the meaning of exemption and return to provide benefits to both parties. These advantages include PT. Toyota Astra Motor, as the Seller, gets a refund of the import duties that have been paid previously. In this case, the British Embassy can get the goods from the sale and purchase quickly without waiting for the delivery process.
