<![CDATA[As a guide for judges in the Religious Court, the Supreme Court has issued Perma No.2 of 2008 concerning the Compilation of Sharia Economic Law (KHES). It contained Gashb and Itlaf, in Book II about the Covenant, whereas Gashb and Itlaf have interpreted as deprivation and destruction. Briefly, Gashb and Itlaf seem to be an offence because of the phrase taking or destroying someone else's property. Offence in the field of Islamic economics is the absolute authority of the State Court. For this reason, it is necessary to examine whether Gashb and Itlaf included in the context of Islamic economics. It also needs to be examined whether Gashb and Itlaf are the absolute authority of the Religious Court. Normative juridical research carried out by discussing Book II of KHES, specifically Chapter XV. It then analysed with the absolute competence of the Religious court, the provisions of Article 49 of the Law of Religious Court. The analysis complemented by a study of legal principles in Islamic economics. Comparisons also made with the concepts of legal relations in the Civil Code, especially regarding the binding and offence in the Criminal Code.The research results of Gashb and Itlaf do not originate from the contract and do not include business activities with Islamic economic principles. Thus Gashb and Itlaf are not included in the absolute authority of the Religious Court. Gashb and Itlaf are not intended as offences because the sanctions are compensation claims. Claims are filed based on lawsuits that violate the law and become the absolute authority of the State Court. Placement of Gashb and Itlaf in KHES is wrong because it does not include Islamic economic activities, so it must have removed from KHES.]]>

<![CDATA[The Jakarta Embarkation Dormitory is a temporary stopover for prospective pilgrims in the DKI Jakarta and Banten Provinces before leaving for the holy land. Various preparations for departure and supplies are carried out by involving all officers who help serve all the needs of the congregation so that good performance needs to be carried out because this is related to the welfare of the prospective congregation.This study aims to determine the role of Hajj officers' performance in the implementation of departure services which include one stop service in multipurpose building 2, consumption and catering services, availability of facilities and infrastructure, worship guidance services, health services, services for elderly congregations, high risk and special needs. , as well as security services at the Jakarta Embarkation during the 2019 Hajj season. This study uses a qualitative descriptive method in which the results of the data are obtained from observations, interviews, and documentation.From the results of the research that the authors found in a series of services carried out by hajj officers at the Jakarta Embarkation, the results of the performance of hajj officers were good and optimal, meaning that the entire series went as planned. Hajj officers perform their main duties and functions in accordance with operating standards in the seven functional divisions of the Hajj Organizing Committee. <![CDATA[BRI Syariah is a sharia bank that provides financing facilities needed bycustomers for the purchase of land and buildings consisting of various sizesand types, in a condition ready to live in or ready to build. Financing is a formof funding issued to support investments that have been planned either to bedone alone or given to others. The purpose of this study was to determine the procedure for financing BRI Syariah iB Prosperous KPR through a murabahah contract and to determine the eligibility of customers to receive KPR Sejahtera financing with using 5C analysis. The method in this study uses a qualitative method with a descriptive analysis approach, to describe the data obtained at the research site. The results of this study can be concluded that Bank BRI Syariah KCP Serpong in analyzing whether or not customers are eligible to receive KPR Sejahtera iB financing at Bank BRI Syariah KCP Serpong uses the 5C principles, namely: character, capacity, condition of economy, capital, and colleteral. BRI Syariah merupakan bank syariah yang menyediakan fasilitas pembiayaanyang dibutuhkan oleh nasabah untuk pembelian tanah dan bangunan yangterdiri dari berbagai ukuran luas dan tipe, dalam keadaan siap huni atau siapbangun. Pembiayaan adalah sebuah bentuk pendanaan yang dikeluarkan untukmendukung investasi yang telah direncanakan baik dilakukan sendiri ataudiberikan kepada orang lain.Tujuan dari penelitian ini adalah untukmengetahui prosedur pembiayaan KPR Sejahtera BRI Syariah iB melalui akadmurâbahah dan untuk mengetahui kelayakan nasabah dalam menerimapembiayaan KPR Sejahtera dengan menggunakan analisis 5C. Metode padapenelitian ini menggunakan metode kualitatif dengan pendekatan deskriptifanalisis, untuk memaparkan data-data yang didapatkan di tempat penelitian.Hasil dari penelitian ini dapat disimpulkan bahwa Bank BRI Syariah KCPSerpong dalam menganalisis layak atau tidaknya nasabah dalam menerimapembiayaan KPR Sejahtera iB Bank BRI Syariah KCP Serpong inimenggunakan prinsip 5C yaitu: character, capacity, condition of economy,capital, and colleteral.]]>

<![CDATA[AbstrakSyariat Islam telah mengharamkan khamr sejak empat belas abad yang lalu dan hal ini berkaitan dengan penghargaan Islam terhadap akal manusia yang merupakan anugrah Allah yang harus dipelihara sebaik-baiknya. Saat ini kalangan non-muslim mulai menyadari manfaat diharamkannya khamr setelah terbukti khamr dan sebagainya (penyalahgunaan narkotika, ganja) membawa bahaya bagi bangsa. Menyangkut pengharaman khamr dalam Islam maka hal tersebut dapat dilihat dari sekian banyak ayat Al-Qur’an maupun hadis yang menjelaskan dampak negatif dari khamr. Merujuk pada Al-Qur’an maka setidaknya ada empat tahap yang dilalui sampai terbentuknya label haram. Empat tahap tersebut dapat kita ketahui melalui pengkajian terhadap Asbab An-Nuzul ayat-ayat yang berkaitan dengan khamr (QS. al-Nahl/16: 67, Al-Baqarah/2: 219, al-Nisā/4: 43, al-Māidah/5: 90-91). Berdasarkan penjelasan tentang larangan meminum khamr baik melalui dalil Al-Qur’an maupun hadis, maka dapat dikatakan bahwa motif keharaman khamr dikarenakan beberapa sebab. Pertama, merupakan perbuatan dosa (Al-Baqarah/2: 219). Kedua, merupakan perbuatan yang melampaui batas (Al-‘Arāf/7: 31). Ketiga, merusak nalar (Al-Nisā/4: 43). Keempat, merupakan perbuatan setan (Al-Māidah/5: 90-91). Kelima, minuman yang haram zatnya banyak atau sedikit tetap haram. Maka menjahui minuman ini guna menyelematkan kehidupan generasi muda dan bangsa adalah suatu keniscayaan.]]>

<![CDATA[Humans as one of the creations of Allah SWT, always need the intervention of the Creator to solve all problems. This paper reviews the importance of making religious values (al-Qur'an) a source of solving social problems. This is based on the fact that the Qur'an has discussed several types of social ills, such as: sexual perversion, gambling, alcoholism, theft, corruption, crime and so on. In addition to having told various types of social ills or known in terms of social science as social pathology, the Qur'an also explains the causes of their emergence, as well as laying strong foundations so that humans can get out of these problems by reinforcing values monotheism, noble character, uphold justice, responsibility and glue the sensitivity of brotherhood values. <![CDATA[This research discusses the basic concepts of leadership in general, spiritual leadership and prophetic leadership, as well as how leadership in the perspective of the Qur'an and its examples. Then the purpose of this study is to find out how the meaning of leadership in the perspective of the Qur'an, because there are several words in the Qur'an that mean leader but have slightly different meanings. This research uses qualitative research methods using the type of library research (Library Resarch) which discusses leadership in the perspective of the Qur'an. <![CDATA[This article discusses planning ethics from the perspective of the Koran. Planning ethics in the perspective of the Qur'an is a person's behavior in preparing thorough plans that are in accordance with Islamic law. Islam has called for every individual to be able to plan the activities they will carry out. When preparing plans, you must have ethics. Because it doesn't necessarily mean that what is planned will run smoothly according to plan, but there is a God who plans everything. We should realize that God's plan is the most perfect and good for humans. This research method uses a descriptive qualitative analytical approach, with a library research method (Library Research). The results of this research are that there are several findings in planning ethics in Islam, including: (1) Relying on plans on Allah's will, found in QS. Al-Kahf verse: 23, (2) Trust in Allah SWT, found in QS. At-Thalaq verse: 3 and the 3rd (3) Ridho (Qadha and Qadar are found in QS. Al-Ahzab verse: 38.]]>

Metode – Penelitian ini menggunakan metode kualitatif yang dapat diartikan sebagai rangkaian proses menjaring informasi suatu objek dan dihubungkan dengan pemecahan suatu masalah, baik dari sudut pandang teoritis maupun praktis. Hasil – Hasil penelitian ini menunjukkan bahwa Majelis tarjih Muhammadiyah dan Lajnah Bahtsul Masail NU keduanya membedakan antara riba dan bunga bank.]]>

<![CDATA[Religion can be likened to a straight bridge to human life. Whether a person or a community of people is bad depends on how humans interpret religion as their way of life, and only Islam is the only religion that can be such a straight bridge. Seeing the current reality where damage occurs in every inch of life to become a disease of society that is difficult to cure which in social science is called social pathology. To restore a harmonious social life, reviving religious values as one of the social controls is a necessity. As a social control, religion is very effective in answering the solution of social problems that occur today, a dry life of divine values. Long before social problems or social pathologies were widely discussed by sociologists, the Qur'an as a source of life guidelines had informed about the existence of symptoms of this social pathology even though it did not use popular language in the study of social sciences. For example, the words al-S?' and f?hisyah contained in the Quran have meanings that are in harmony with the meaning of social pathology, such as murder, adultery or cheating, homosexuals and lesbians, and so on. This paper will only discuss one of the perspectives of the concept of social pathology in the Qur'an, namely the terms al-S?' and f?hisyah with the scope they contain.]]>

<![CDATA[This article aims to find out the function of planning in the view of the Qur'an and can be used as a strengthening foundation that Islam also views the importance of planning. Considering that planning is a basic process for everything, such as choosing targets and determining how to achieve them. Therefore, a company or an educational institution must set goals and targets to be achieved before carrying out the planning processes. This article is a type of qualitative research with a library research approach. The results of the analysis show that planning is a first process when you want to do work, both in the form of thinking and a framework so that the goals to be achieved get optimal results. Likewise, in Islamic education, planning must be the first step that is really considered by managers and administrators of Islamic education. Because planning is an important part of success, mistakes in determining Islamic education planning will have very fatal consequences for the sustainability of Islamic education, as explained in the Qur'an and hadith about the importance of the function of planning.]]>
