Abstract

In our fast-paced and ever-evolving society, the accessibility of rights has reached unprecedented levels. Technological advances have changed the way individuals engage in various activities, facilitating access to a variety of beneficial and detrimental activities. Among the important impacts of these technological advances is the ease with which individuals can participate in unlawful activities, especially the shift from traditional gambling to online platforms. The practice of online gambling in our society does not have a strong legal basis, because it directly violates the Indonesian legal framework which strictly prohibits this activity. According to Article 27 paragraph (2) of the Information and Electronic Transactions Law (UU ITE), any person who intentionally and unlawfully disseminates, sends or provides information or electronic documents containing gambling content, is an unlawful act. Societal order is essentially closely intertwined with law, which functions as a crucial social control mechanism. This research aims to examine the sociology of law as a means of social regulation and to investigate the effectiveness of current law enforcement measures.

Abstract

Health workers in Indonesia have an essential role in providing medical services, but they face serious challenges due to increasing cases of violence and malpractice lawsuits. In 2022, there were 134 cases of physical violence against medical workers, with most incidents occurring in hospitals and community health centers. This violence has a negative impact not only on the individuals involved, but also on the overall quality of health services. In the legal context, various regulations, such as Law Number 36 of 2014 concerning Health Workers, provide legal protection to health workers. Article 57 guarantees the right of health workers to receive legal protection, while Article 66 protects them from malpractice lawsuits if the procedures carried out have met standards. However, the implementation of legal protection still faces various obstacles. This study uses a normative legal method with a descriptive-analytical approach, aiming to analyze existing legal protection and its challenges. Data were obtained through literature studies and qualitative analysis. The findings show that existing legal protection is not yet fully effective, with many health workers feeling vulnerable to violence and lawsuits. Stronger protection is needed to prevent violence and unwarranted lawsuits. In addition, the role of government, hospitals, and professional associations is very important in strengthening the legal protection system. The establishment of stricter regulations and the dissemination of information on the rights and obligations of health workers are expected to improve their safety in carrying out their duties. With these steps, it is hoped that health workers can work more calmly, which ultimately contributes to improving the quality of health services in Indonesia.

Abstract

One of the main issues that arises when investors plan to make investments in Indonesia is the transfer of land rights to one of the five investment barriers, which are connected to obstacles to land certification, building licenses, and land zoning. This effort discusses how problems involving land transfers are handled by national criminal law and how giving foreign investors legal certainty is achieved by the effectiveness of criminal legislation against land transfers. The aim of this research is to find out whether criminal law can resolve disputes related to the transfer of land rights so as to provide certainty and security for foreign investors regarding the transfer of land rights. by investigating problems through normative legal research or legal research carried out in libraries using a jurisprudential approach and theory of legal objectives, we will get solutions to existing problems so that this research provides qualitative research results based on the data and theory used. The study's findings lead to the conclusion that Article 52, paragraphs (1) and (2) of the UUPA, which deals with criminal laws against the transfer of land rights, regulates the criminal law of land area for its infringement. The form of attained legal certainty in the transfer of land rights for investors is provided by the effectiveness of criminal law in enforcing the law against communities that occupy property over the subject matter.

Abstract

Staf Khusus Presiden merupakan lembaga nonstruktural yang dibentuk untuk memperlancar pelaksanaan tugas Presiden di luar tugas-tugas yang sudah dicakup dalam susunan Kementerian dan instansi pemerintah lainnya. Staf Khusus Presiden diatur oleh Peraturan Presiden Nomor 56 Tahun 2020 Tentang Perubahan Ketiga Atas Peraturan Presiden Nomor 17 Tahun 2012 Tentang Utusan Khusus Presiden, Staf Khusus Presiden, Dan Staf Khusus Wakil Presiden. Tujuan dilakukan penelitian ini adalah untuk melihat bagaimana polemik terhadap masyarakat tentang keberadaan Staf Khusus Presiden dalam sistem pemerintahan Indonesia. Penelitian ini menggunakan jenis penelitian normatif dengan menggunakan data sekunder. Hasil penelitian menunjukan bahwa terdapat perdebatan dan kontroversi di masyarakat mengenai keberadaan Staf Khusus Presiden. Mulai dari ketidakjelasannya tugas Staf Khusus Presiden hingga proses rekrutmen Staf Khusus Presiden yang tidak jelas dan tampaknya hanya sebatas untuk balas budi terhadap pihak-pihak yang membantu pemenangan dalam pemilu. Kata Kunci: Polemik, Sistem Pemerintahan, Staf Khusus Presiden.

Abstract

Pendidikan inklusi bertujuan untuk menjamin akses yang setara terhadap pendidikan bagi semua anak, termasuk anak dengan kebutuhan khusus. Artikel ini mengevaluasi kurikulum sekolah dasar di Indonesia dalam mendukung implementasi pendidikan inklusi. Melalui pendekatan kualitatif dan studi kasus di beberapa sekolah dasar di Jakarta, data dikumpulkan melalui wawancara, observasi, dan analisis dokumen. Hasil penelitian menunjukkan bahwa kurikulum saat ini belum sepenuhnya responsif terhadap kebutuhan siswa dengan latar belakang dan kemampuan yang beragam. Faktor utama yang menjadi kendala meliputi keterbatasan pelatihan guru, metode pengajaran yang belum inklusif, serta minimnya dukungan sumber daya. Meskipun terdapat beberapa praktik baik di sekolah tertentu, diperlukan perbaikan kurikulum, peningkatan kapasitas guru, dan dukungan infrastruktur untuk memastikan keberhasilan pendidikan inklusi secara menyeluruh.

Abstract

Indonesia merupakan negara pantai yang berbentuk kepulauan terbesar dengan 17,504 pulau, yang kemudian Indonesia dianugerahkan hak khusus oleh hukum internasional. Rezim kepulauan pada bagian IV Konvensi Hukum Laut Internasional 1982 (UNCLOS 1982) mengatur bahwa negara kepulauan berhak mengatur sendiri alur laut kepulauannya dan rute udara yang melekat diatasnya. Indonesia telah menetapkan 3 alur laut kepulauan yang memiliki pola alur utara ke selatan dan sebaliknya, serta telah diakui oleh hukum nasional dan hukum internasional. Alur laut tersebut lazimnya digunakan oleh setiap kapal dan pesawat terbang asing untuk melintasi perairan kepulauan dengan hak lintas alur laut kepulauan. Negara kepulauan memiliki kewajiban untuk memastikan keamanan pelayaran dan penerbangan pada saat mereka melakukan transit pada alur laut kepulauan. Namun, hak ini sering kali menimbulkan permasalahan terhadap kepentingan nasional negara kepulauan, terutama latihan militer negara kepulauan pada rezim perairan kepulauan. Tulisan ini mendiskusikan apakah negara kepulauan dapat menggunakan rezim perairan kepulauannya untuk tujuan kepentingan militernya pada masa damai, sementara wilayah yang sama dipergunakan untuk pelayaran internasional, instalasi laut dan konservasi kanekaragaman hayati yang diatur berdasarkan hukum nasional Indonesia serta UNCLOS 1982.

Abstract

 This study examines the urgency of documentary evidence in the form of child psychology test results as a consideration for judges in determining child custody (hadanah) in divorce cases. Legal decisions in divorce cases in Medan (2021) prioritize the best interests of children, especially those who are still minors and vulnerable to psychological trauma due to conflict and parental separation. The results of child psychology tests serve as formal indicators of trauma or emotional disturbance and can help identify which parents provide a safer and more emotionally stable environment. This article uses a normative legal research method with a statutory and conceptual approach and is supported by a comparative study of first-instance court decisions. Empirical data obtained from interviews with psychologists and several judges at the Medan Religious Court show that child psychological assessments are often submitted but rarely considered by judges in their final decisions. This study criticizes the court's decision to grant custody to parents who have a history of violent behavior based on the results of psychological tests, which causes the child to show fear and be reluctant to interact with his mother. This article concludes that the principle of justice for children as the primary victims should be reviewed and emphasized and that psychological test results should be considered as crucial legal evidence in child custody decisions. Artikel ini mengkaji urgensi alat bukti surat berupa hasil analisis tes psikologi anak sebagai bahan pertimbangan hakim dalam menetapkan hak asuh anak (hadanah) dalam perkara perceraian. Putusan hukum dalam perkara perceraian di Medan (2021) mengutamakan kepentingan terbaik anak, terutama yang masih di bawah umur dan rentan mengalami trauma psikologis akibat konflik dan perpisahan orang tua. Hasil tes psikologi anak berfungsi sebagai indikator formal adanya trauma atau gangguan emosional, serta dapat membantu mengidentifikasi orang tua mana yang memberikan lingkungan yang lebih aman dan lebih stabil secara emosional. Artikel ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual serta didukung oleh studi banding putusan pengadilan tingkat pertama. Data empiris yang diperoleh dari wawancara dengan psikolog dan beberapa hakim di Pengadilan Agama Medan menunjukkan bahwa penilaian psikologis anak sering diajukan tetapi jarang dipertimbangkan oleh hakim dalam keputusan akhir mereka. Penelitian ini mengkritik keputusan pengadilan yang memberikan hak asuh kepada orang tua yang memiliki riwayat perilaku kekerasan berdasarkan hasil tes psikologis, yang menyebabkan anak tersebut menunjukkan rasa takut dan enggan berinteraksi dengan ibunya. Artikel ini menyimpulkan bahwa prinsip keadilan bagi anak sebagai korban utama harus ditinjau kembali dan ditekankan, dan bahwa hasil tes psikologi harus dipertimbangkan sebagai bukti hukum yang penting dalam putusan hak asuh anak. Abstract

Penelitian ini bertujuan untuk mengulas pentingnya alat bukti surat berupa hasil analisis tes psikologi anak sebagai bahan pertimbangan hakim dalam memutuskan hak asuh anak dalam perkara perceraian. Hukum diharapkan dapat mengedepankan kepentingan korban yaitu anak yang masih di bawah umur demi perkembangannya di masa depan, mulai dari kenyamanan psikologis, kejiwaan, tempat tinggal, dan lingkungan yang mempengaruhi tumbuh kembang dan emosi anak yang menerima dampak perceraian orang tuanya. Hasil analisis tes psikologi anak dapat dijadikan acuan sebagai bukti apakah anak tersebut mengalami trauma terhadap suatu peristiwa atau tidak. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan perundang-undangan dan konseptual, untuk mendeskripsikan urgensi hasil analisis tes psikologi anak dalam pertimbangan hakim saat memutuskan hak asuh anak. Penelitian ini menyoroti kasus putusan hakim yang memberikan hak asuh kepada orang tua yang memiliki catatan perilaku buruk dalam hasil tes psikologi anak, sehingga anak menjadi enggan dan takut untuk bertemu. Penelitian ini menyimpulkan bahwa perlu adanya peninjauan kembali terhadap prinsip keadilan bagi korban sebagai pedoman pertimbangan hakim dalam memutuskan hak asuh anak, dan hasil analisis tes psikologi anak perlu menjadi bahan pertimbangan dalam memutuskan hak asuh anak.

Abstract

Justice Collaborator (Cooperating Witness) is a suspect, defendant, or convict who cooperates with law enforcement to uncover a crime in the same case. Justice Collaborator has a big role in uncovering certain crimes. Justice Collaborator also played a role in uncovering the premeditated murder case against Victim NYH who was an aide to FS who served as Head of Propam Division of the National Police Headquarters. The initial chronology presented in the police report after the incident was not premeditated murder, but rather a shooting incident between the Victim and another aide, namely RE. However, thanks to RE's courage in volunteering as a Justice Collaborator, the premeditated murder crime that occurred has been uncovered. This study discusses the problem of how the practices of determining justice collaborators in Indonesia, how the determination of justice collaborators on behalf of RE in the crime of premeditated murder, and how the legal considerations of the Panel of Judges in imposing criminal sanctions on justice collaborators on behalf of RE. The research method in this thesis uses a research method with a normative research type with a descriptive analytical research nature and a qualitative data analysis method, by examining the Decision of the South Jakarta District Court Number: 798/Pid.B/2022/PN. Jkt.Sel and laws and regulations and other legal materials related to the determination of justice collaborators in premeditated murder. The practice of determining Justice Collaborators in Indonesia is carried out based on the provisions of laws and regulations, including Law Number 31 of 2014 and SEMA Number 4 of 2011 with the requirements for determining justice collaborators, namelyjustice collaboratoris one of the perpetrators of a particular crime or a particular criminal case that he committed, not the main perpetrator in the crime and provided information as a witness in the trial process. Then against the Justice collaborator on behalf of RE who is the executor in the crime of premeditated murder, was determined as a justice collaborator with the consideration that the crime of premeditated murder he committed met the qualifications of a "certain case" with the indicator being another crime that resulted in the position of the witness and victim being faced with a very life-threatening situation and the fulfillment of the requirement that the justice collaborator in this decision is not the main perpetrator. For his role as a justice collaborator, RE was given a light sentence with a prison sentence of 1 (one) year and 6 (six) months with one of the considerationsThe victim's family has forgiven the defendant.
