Abstract

Natural resources are utilized and controlled to achieve the well-being and prosperity of the population, as directed by Article 33 paragraph (3) of the 1945 Constitution. The state is responsible for designing policies to mitigate the ecological crises and environmental deterioration caused by the usage of natural resources, particularly energy, to prevent ecological disasters. Utilizing New Renewable Energy can help mitigate environmental harm, optimize natural resource potential, and promote community well-being. This research intends to investigate the necessity of controlling the utilization of natural resources, particularly focusing on new and renewable energy (EBT) as a key strategy to optimize the use of natural resources in Indonesia. This study is prescriptive juridical-normative legal research. The legal materials utilized consist of primary and secondary legal materials obtained through library research. The legal materials are evaluated using a logical syllogism tool. The research findings indicate that the advancement of EBT in Indonesia would not only affect the economy but also provide advantages to the society. Using EBT will enhance efficiency and promote the attainment of a pristine and healthy environment. The current EBT restrictions are inadequate to support the ongoing use of EBT due to its dispersion across many laws and regulations. The Government must align and coordinate laws and regulations in the energy sector to prevent any duplication of legislation within the legal framework. Creating a specific law for EBT will help address the legal gaps in the EBT sector, ensuring legal clarity, protection for enterprises involved in procurement, use, and development, as well as promoting sustainable and responsible administration of EBT. Furthermore, under a specific EBT regulation, individuals might face criminal penalties for causing harm to technical facilities or equipment powered by EBT.

Abstract

This research was conducted with the aim to find out how the discretionary authority of Government officials based on Law No. 30 of 2014 concerning Government Administration and how the Implementation of General Principles of Good Governance (AUPB) within the discretionary authority of Government officials based on Law No. 30 of 2014 concerning Government Administration. By using the normative juridical research method, it is concluded: 1. Discretion is a decision or action determined or carried out by a government official to overcome concrete problems encountered in the administration of government in terms of laws and regulations that provide choice, not regulate , incomplete, or not clear, or government stagnation. In accordance with Law No. 30 of 2014 concerning Government Administration for its use discretion is used primarily because; first, an emergency that makes it impossible to apply written provisions; second, there are no or no regulations goingverning it; third, there are rules but they are vague or multiple interpretations. Freedom of discretion is freedom of administration which includes freedom of administration (interpretatieverijheid), freedom of consideration (beoordelingsvrijheid), and freedom to take policy (beleidsvrijheid). 2. General Principles of Good Governance is a way that directs and maintains the use of government authority in order to remain controlled from the abuse of power of government officials. This shows that the legal relationship between discretionary authority and General Principles of Good Governance (AUPB) is the General Principles of the Government.

Abstract

This article explores the rationale behind the revocation of Government Regulation (GR) No. 5 of 2021 on Risk-Based Business Licensing and its replacement by GR No. 28 of 2025. Using a normative juridical approach, the study assesses the effectiveness of the existing regulatory framework and the urgency for reformulating Indonesia’s business licensing system. The findings indicate that the implementation of GR 5/2021 encountered significant challenges, including systemic fragmentation, poor inter-agency coordination, and limited legal certainty. GR 28/2025 introduces key reforms such as the full integration of the Online Single Submission (OSS) system, the implementation of a strict Service Level Agreement (SLA), and the expansion of regulated business sectors. These reforms mark a strategic step toward a more transparent, responsive, and integrated business licensing regime in Indonesia.

Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) merupakan salah satu pilar utama dalam menopang perekonomian nasional, baik dari sisi penciptaan lapangan kerja maupun kontribusinya terhadap pertumbuhan ekonomi daerah. Salah satu sektor UMKM yang mengalami perkembangan pesat dalam beberapa tahun terakhir adalah usaha coffee shop. Pertumbuhan ini didorong oleh meningkatnya budaya konsumsi kopi serta perubahan gaya hidup masyarakat, khususnya di kalangan generasi muda yang menjadikan coffee shop tidak hanya sebagai tempat konsumsi, tetapi juga sebagai ruang interaksi sosial dan produktivitas. Kota Madiun menjadi salah satu daerah yang mengalami peningkatan signifikan jumlah usaha coffee shop, sehingga menimbulkan dinamika baru dalam hubungan ketenagakerjaan. Penelitian ini dilatarbelakangi oleh pentingnya perlindungan hak-hak pekerja coffee shop, terutama terkait dengan pemenuhan hak atas upah yang layak. Permasalahan utama yang dikaji adalah bagaimana bentuk perlindungan hukum terhadap hak upah pekerja coffee shop di Kota Madiun berdasarkan Undang-Undang Nomor 6 Tahun 2023. Penelitian ini bertujuan untuk menganalisis efektivitas penerapan perlindungan hukum tersebut dalam praktik ketenagakerjaan di sektor UMKM. Metode penelitian yang digunakan adalah metode penelitian hukum normatif empiris, yaitu dengan mengombinasikan kajian terhadap peraturan perundang-undangan yang berlaku dengan data lapangan yang diperoleh melalui wawancara dan studi keputusan. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 6 Tahun 2023 telah menyediakan kerangka perlindungan hukum yang cukup komprehensif, meliputi pengaturan upah minimum, jaminan sosial ketenagakerjaan, pengaturan jam kerja, serta mekanisme penyelesaian perselisihan hubungan industrial. Implementasi perlindungan hukum belum berjalan optimal, lemahnya pengawasan pemerintah daerah, rendahnya kesadaran hukum di kalangan pekerja dan pengusaha, serta karakter hubungan kerja di sektor coffee shop cenderung fleksibel dan informal.

Abstract

One of the uses of space stated in Law Number 26 of 2007 concerning Spatial Planning is Green Open Space (RTH). This law requires that each district/city have a green open space area of at least 30% of the entire regional area. Ponorogo Regency is one of the districts in East Java Province which has an area of 137,178 Ha. This research will discuss the suitability of the green open space owned by Ponorogo Regency to Law Number 26 of 2007 concerning spatial planning and the potential for developing green open space in the Ponorogo Regency area. This article uses normative research methods with a positive legal approach and an approach using statistical data. The result is that Ponorogo Regency has not yet reached the minimum green open space limit of 30% because it is still at 19%. However, Ponorogo Regency has ambitions with the existence of Regional Regulation Number 1 of 2012 concerning RTRW 2012-2032 which states that the minimum limit of 30% RTH will be achieved in 2032. For the potential for developing RTH areas, Ponorogo Regency has three places, namely roads, river routes and mining areas.

Abstract

Currently, Indonesia is grappling with serious environmental issues exacerbated by a lack of public awareness and law enforcement. Law enforcement is crucial in addressing environmental problems, necessitating the use of coercive legal instruments such as criminal sanctions. The primary legal framework governing environmental protection and management in Indonesia is Law Number 32 of 2009 concerning Environmental Protection and Management and several amendments to Law Number 6 of 2023 concerning the Ratification of Government Regulation Number 2 of 2022 concerning Job Creation. This article focuses on the changes in criminal sanctions and how these changes occurred by comparing the two aforementioned laws and analyzing them. The results indicate that five articles concerning criminal sanctions have been amended or repealed. This is because four out of the five articles have been simplified for administrative purposes and to avoid legal ambiguities, while one of the five articles cannot be determined due to changes resulting in legal nullity.

Abstract

This study analyzes the legal status of Palilah Griya Pasiten Letter in the Baluwarti area of Surakarta within Indonesia's national agrarian law framework. Surat Palilah, issued by the Surakarta Palace as an authorization to occupy and use palace land, has no clear position under the Basic Agrarian Law (UUPA), creating legal uncertainty, particularly in land registration and certification. This research applies normative legal methods, drawing on statutory, historical, and conceptual approaches, and is supported by empirical interviews as complementary data. The study examines the legal standing of Palilah land, available forms of legal protection, and obstacles in the registration process. The findings show that Palilah land cannot be certified as ownership or building use rights and may only be recognized as a Right of Use with Palace approval. The study contributes to agrarian law scholarship by clarifying the normative gap between traditional palace land governance and the national land law system and by providing a conceptual basis for strengthening legal protection within a pluralistic agrarian framework.

Abstract

Land rights are rights that are mostly owned by Indonesian people. Because land ownership is not a new thing in our society. Because having land rights, problems that will arise in the future are the transfer of land rights, the transfer of land rights in Indonesian society mostly uses the inheritance system. The transfer of inheritance rights to land is a problem that often arises in everyday life today. The transfer of land rights using the inheritance system is a transfer of ownership of a land owned by the heir to the heirs because the heir has died. One of the transfers of land rights is regulated in Law number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA) in Article 21 Paragraph (5). However, the inheritance of land rights through the inheritance system still often causes many problems in the community. Therefore, this paper aims to examine more deeply the provisions and procedures for the transfer of inheritance of land rights in accordance with applicable law in Indonesia. The method in this paper uses a normative legal research method with the aim of further reviewing the provisions and procedures for the transfer of land rights.

Abstract

The attitude of love for the motherland is one of the contents of the noble values ​​of Pancasila which became the basis for the establishment of the independent nation and state of Indonesia. One of the positive values ​​that need to be instilled in students through the learning process as the next generation of the nation is the character of loving the motherland. Seeing the current reality, many young people are starting to lose their love for their homeland along with the era of globalization and modernization. This study aims to examine the role of Pancasila education in the formation of the character of loving the homeland by using a qualitative descriptive method. The importance of Pancasila education in creating young people as pillars of the nation has a very important role. Pancasila character education is not only limited to answering actual problems and being used as an educational advertising commodity, but there are future achievements that must be achieved, namely building a sovereign, independent and superior nation based on a sense of love for the motherland as a strong roots in implementation.

Abstract

Transparansi hukum merupakan suatu hal yang perlu dilaksanakan pada setiap negara hukum, termasuk Indonesia. Berkaitan pula dengan asas ultimum remedium harus digunakan dalam menangani kasus di kehidupan sosial dan budaya. Banyak dari masyarakat masih belum mengerti secara utuh bagaimana hukum di Indonesia diberlakukan di setiap aspek yang ada. Penulis melakukan studi literatur untuk memecahkan masalah tersebut. Ditemukan bahwa masih terdapat kasus pelanggaran hak asasi manusia (HAM), diskriminasi terhadap minoritas, dan kekerasan seksual di masyarakat Indonesia. Di mana semua kasus tersebut memerlukan asas ultimum remedium supaya tidak merugikan pihak yang berkaitan dan transparansi hukum sepenuhnya terwujud bagi khalayak.
