Abstract

Penelitian ini mengkaji pengaruh layanan paylater terhadap keputusan pembelian mahasiswa di Kota Bandung dalam konteks platform e-commerce. Dengan semakin berkembangnya teknologi digital, layanan paylater menjadi pilihan pembayaran yang fleksibel bagi mahasiswa yang memiliki keterbatasan finansial. Studi ini menggunakan metode kuantitatif dengan pendekatan survei, yang melibatkan 100 responden mahasiswa aktif pengguna e-commerce. Hasil penelitian menunjukkan bahwa layanan paylater memberikan pengaruh signifikan terhadap keputusan pembelian mahasiswa, khususnya terkait kemudahan, keamanan, dan fleksibilitas pembayaran. Namun, penggunaan yang tidak terkontrol juga berpotensi meningkatkan perilaku konsumsi impulsif dan risiko finansial. Temuan ini diharapkan dapat memberikan kontribusi pada literatur terkait perilaku konsumen digital dan literasi keuangan serta memberikan wawasan bagi penyedia layanan dalam merancang strategi yang tepat untuk segmen mahasiswa.

Abstract

The development of digital technology has opened the door to various forms of digital crime, including schemes involving fictitious job offers, illegal crypto investments and fake refunds that financially harm victims and potentially lead to money laundering offenses. This article examines digital fraud in Indonesia by comparing Islamic criminal law (Fiqh Jinayah) with Indonesian positive law. This normative juridical research employs statutory, conceptual, comparative, and case study approaches. The findings reveal that the “Remote Mining Network” case illustrates how perpetrators exploit digital anonymity to evade legal oversight. Such practices violate Islamic legal norms, including the prohibitions against gharar (uncertainty) and tadlis (deception), which align with the elements of fraud as defined in the Indonesian Penal Code and the Law on Electronic Information and Transactions. The article concludes that both Islamic and national criminal law aim to protect public interests and individual property rights (hifz al-mal). This study contributes to the development of contemporary fiqh jinayah, while also supporting efforts to enhance legal literacy and protect Muslim communities from the risks of digital crime, in accordance with the principle of hifz al-mal within the framework of maqaṣid al-shari‘ah.

Abstract

The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. This study explores how Fiqh al-Aqalliyyat a flexible jurisprudential framework can address these challenges within a multicultural society. Adopting a qualitative case study methodology, the research draws on interviews with 14 key local stakeholders, including government officials, religious leaders, and business owners. Data were gathered through purposive sampling and analyzed thematically to identify key barriers and viable solutions. The findings indicate that social stigma and inadequate infrastructure impede halal product promotion. Nevertheless, significant opportunities exist, including a growing demand for halal goods, government support for Sharia-compliant capital markets, and the active engagement of religious institutions. The novelty of this research lies in its integration of Fiqh al-Aqalliyyat and Maqasid al-Sharia as analytical frameworks to address the specific socio-economic realities of a Muslim minority in Jayapura, offering practical insights applicable to similar contexts elsewhere.The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. Abstract

Abstract. This study aims to determine the responsibility of the Land Deed Official (PPAT) for unfinished name change services and to determine the legal consequences of unfinished name change services. This study uses a type of sociological or empirical legal research that includes legal identification and legal effectiveness, empirical legal research is legal research where data is obtained through primary legal data or data obtained directly in the community. Based on the research conducted, it can be seen that the responsibility of the PPAT includes Civil, Criminal, Administrative, and PPAT Code of Ethics obligations. If the Deed has been carried out in accordance with the procedure and there is a delay caused by the negligence of the PPAT, then in practice the PPAT can be sued for compensation for the delay if the delay causes losses to the parties. The legal consequences of the transfer of Land Rights that are registered late are that the Deed cannot be registered for the Transfer of Rights at the National Land Agency Office and this is the personal responsibility of the PPAT because the PPAT is obliged to comply with the registration period for the transfer of Rights, which is a maximum of seven working days from the signing of the Deed. PPAT itself can be subject to administrative sanctions in the form of a written warning and in serious cases PPAT can be dismissed from his position. And if force majeure occurs, PPAT cannot be sued because it is beyond the fault of PPAT as long as all procedures required by the National Land Agency have been fulfilled.Keywords: Effectiveness; Empirical; Legal; Responsibility.

Abstract

This study discusses the methodology used in the interpretation of al-Qurţubi by Imam al-Qurţubī. The main objects that are the focus of research in this study are; Al-Qurtubi's method of interpreting Q.S Al-Baqarah 2:178 which is related to the crime of murder. This research is a type of library research (library study). Because this research uses descriptive and qualitative research. The data sources used in this research are books, journals and scientific works related to the research topic. After the data is collected, it is continued with data analysis and drawing conclusions as a result of the research. The data used in this research is primary data, namely the book Tafsir al-Jāmi‘ li Aĥkām al-Qur'an and secondary data which includes works related to tafsir al-Jāmi‘ li Aĥkām al-Qur'an. This research found several findings, among others, (1) Al-Qurţubī provides analysis in terms of language, (2) Al-Qurţubī interprets verses with the interpretation of al-Ma'tsur and al-Ra'yi, (3) this book of tafsir has a pattern fiqhi or law.
