Abstract

Doxing, as a form of cybercrime, has become a serious threat to individual privacy rights in the digital era. The practice of disclosing personal data without consent not only violates human dignity but also infringes upon the constitutional right to security guaranteed under Article 28G paragraph (1) of the 1945 Indonesian Constitution. In Indonesia, doxing is regulated under the Electronic Information and Transactions Law (ITE Law) and the Personal Data Protection Law (PDP Law). However, these two regulations emphasize different aspects: the ITE Law focuses on cybercrime’s technical dimension, while the PDP Law emphasizes the protection of personal data subjects’ rights. This difference creates normative disharmony in terms of definition, offense characteristics, and sentencing disparity, which results in legal uncertainty and weak protection for doxing victims. Using normative legal research methods, this study examines the disharmony between the ITE Law and PDP Law and its implications for privacy protection. The findings show that without regulatory harmonization, the PDP Law as lex specialis cannot optimally protect victims. Therefore, harmonization of regulations, strengthening of the personal data supervisory authority, and enhancing the capacity of law enforcement officers are urgently needed to ensure legal certainty and effective privacy protection in Indonesia.

Abstract

This study aims to analyze legal certainty regarding the implementation of Minister of Energy and Mineral Resources Regulation Number 14 of 2024 in the licensing process for groundwater utilization. The regulation of groundwater licensing has undergone significant changes following Law Number 6 of 2023 on Job Creation, which emphasizes simplification and integration of business licensing through the Online Single Submission (OSS) system. This research employs a normative juridical approach using primary legal materials, namely Law Number 17 of 2019 on Water Resources and Ministerial Regulation Number 14 of 2024, supported by relevant secondary literature. The findings indicate that Regulation number 14, 2024 simplifies procedures and integrates licensing mechanisms, including provisions requiring approval from the Ministry of Energy and Mineral Resources for groundwater usage exceeding 100,000 liters per month. However, potential normative ambiguities remain in its implementation. Therefore, strengthened supervision and regulatory harmonization are necessary to ensure legal certainty and sustainable groundwater management.

Abstract

Tradisi kelaci dilakukan dalam meminang perempuan di Desa Adat Kedisan Kecamatan Kintamani. Tradisi ini dilakukan dengan membayar sejumlah hewan yang ditetapkan oleh Desa Adat. Pembayaran kepada Desa berpotensi munculnya pemikiran negatif yang menempatkan perempuan sebagai obyek dalam perkawinan sehingga perlu melakukan upaya untuk menghindari potensi negatif tersebut. Tujuan penelitian dispesifikkan untuk mengantisipasi pemikiran negatif melalui penguatan pemahaman nilai kebaikan tradisi kelaci. Metode penelitian yang digunakan menggunakan pendekatan deskriptif kualitatif dengan menggunakan data primer yang bersumber dari wawancara dan observasi. Hasil dalam penelitian menemukan bahwa pembayaran beberapa ekor babi yang saat ini dapat dinominalkan dalam bentuk uang bertujuan untuk membayar kewajiban bermasyarakat di desa. Pembayaran ini dimasukkan ke kas desa untuk dikelola dan dimanfaatkan untuk kepentingan publik bagi masyarakat di desa. Nilai-nilai kebaikan dalam pelaksanaan tradisi kelaci berhubungan dengan makna dalam prosesinya untuk menguatkan keharmonisan rumah tangga. Upaya yang dapat dilakukan untuk mencegah pemikiran negatif adalah meningkatkan peran pedulu-pedulu dalam pelaksanaan kelaci untuk memberikan wejangan atau petuah kepada pengantin mengenai makna-makna dalam pelaksanaan tradisi.

Abstract

This study aims to analyze the urgency of reformulating tourism policy in Bali in order to address environmental damage and the erosion of local culture. The mass tourism development model that has been implemented thus far has proven to have negative effects, such as infrastructure overcapacity, ecosystem degradation, and the commodification of sacred values. Using normative legal research methods, this study examines laws and regulations related to sustainable tourism and cultural preservation. The results show a gap between regulations and implementation that requires a review of the basic principles of tourism policy. Reformulation must emphasize tourism based on the values of Tri Hita Karana, limit quantity, improve quality, and involve the active participation of local communities in management and supervision.
