Abstract

Desa Sumberwaru, Kecamatan Banyuputih, Kabupaten Situbondo, masuk kedalam pengelolaan Taman Nasional Baluran.

Abstract

Modern digital-based justice is the answer to the challenges of the development of the times. Although modern justice reflects an adaptive judicial body, it must still be equipped with established regulations. This study aims to examine the harmonization of personal data protection principles between the Supreme Court Regulation No. 7/2022 concerning electronic case administration and trials and Law No. 27/2022 concerning Personal Data Protection (PDP Law). In this case, the researcher uses a normative juridical method, with a statutory regulatory and comparative combined approach. This study highlights the norms gap in the Supreme Court Regulation No. 7/2022, particularly in the aspect of protecting the personal data of the parties input into the electronic justice administration system. The main findings exhibited are that the Supreme Court Regulation No. 7/2022 does not regulate the basic principles of data protection as mandated by the PDP Law, which has the potential to cause legal uncertainty and privacy right violations. The fact that the principle of personal data protection in the Supreme Court regulation has not been absorbed is due to the PDP Law, which only came into effect in 2024, even though both were enacted in the same year in 2022. This is seen as weakening the legitimacy of electronic justice in Indonesia. This study is expected to provide a positive contribution in the form of regulatory reform through the revision of the Supreme Court regulations, the establishment of data protection units in the judicial environment, and strengthening institutional coordination. The results of the comparative analysis of common law systems such as England show the importance of integrating data protection principles into the legal infrastructure and institutions of electronic justice to be aware of the protection of privacy rights that intersect with the guarantee of the human rights of justice seekers.

Abstract

Abstract This research investigates whether the measures taken by Indonesia to implement the security of steel imports from Taiwan and Vietnam comply with the provisions of international economic law—Safeguard on Certain Iron or Steel Products (DS496). This dispute began when Indonesia put security in place against Galvalume. The Regulation of Finance Minister of the Republic of Indonesia Number 137.1/PMK.001/2014 put in place on 22 July 2014 in 2015 implies that Taiwan and Vietnam raised a claim against Indonesia according to Articles 1 and 4 concerning Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), Article XXII of GATT 1994 and Article 14 of Safeguards Agreement concerning policies in Indonesia regarding Galvalume. This research employed normative-juridical methods supported by case and statutory approaches, revealing that Indonesia is deemed to have violated the regulatory provisions of WTO and was declared guilty. In this case, Vietnam requested retaliation from an Arbitral Board of WTO demanding that Indonesia pay the compensation for the losses caused in galvalume trade from Vietnam. Indonesia and Vietnam agreed to settle the dispute through a bilateral agreement following the recommendation from the panels of WTO. Keywords: Galvalume, Safeguard Measures, Settlement of International Economic Disputes Abstrak Penelitian ini membahas tentang apakah upaya Indonesia menerapkan tindak pengamanan impor produk baja dari Taiwan dan Vietnam sudah sesuai dengan ketentuan hukum ekonomi internasional terkait Indonesia – Safeguard on Certain Iron or Steel Product (DS496).Sengketa ini bermula ketika Indonesia melakukan tindakan pengamanan terhadap impor Baja Alumunium Lapis Seng (atau sering dikenal dengan galvalum) yang berdasarkan dengan Peraturan Menteri Keuangan Republik Indonesia nomor 137.1/PMK.011/2014 yang diberlakukan pada 22 Juli 2014 Pada 2015, Taiwan dan Vietnam mengajukan tuntutan kepada Indonesia berdasarkan Pasal 1 dan 4 Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), pasal XXII dari GATT 1994, serta pasal 14 dari Perjanjian tentang Safeguards, mengenai kebijakan yang diambil Indonesia terhadap impor BjLAS. Abstract

State-owned enterprises (SOEs) are crucial to a country's economy. One of the ways SOEs obtain capital is through the transfer of shares. SOE share transfer arrangements are important in overseeing state capital in SOE companies. This study analyses the urgency of changing the share transfer arrangements in SOEs as state capital participation. This research uses normative research methods. The techniques used by researchers to obtain legal materials are document studies and literature studies. All legal materials successfully found and selected by researchers were inventoried, classified, and analyzed using systematic, grammatical and historical interpretation techniques. The results show that the ratio legis of the transfer of state-owned shares in BUMN as state equity participation in other BUMN in Government Regulation No. 72/2016 is to improve the performance of BUMN to be more efficient, effective, and profitable. The transfer of state-owned shares in SOEs as state equity participation in other SOEs aims to increase the efficiency of SOEs by optimizing existing resources, increase the effectiveness of SOEs by improving the quality of services to the public and increase the profitability of SOEs by increasing revenue and reducing costs.

Abstract

This study evaluates the effectiveness and legal urgency of requiring foreign Over-the-Top (OTT) service providers to establish a legal entity in Indonesia. The existing regulatory framework—comprising the Income Tax Law, the Harmonization of Tax Regulations Law, and Circular Letter No. 3/2016—remains limited and has not fully adapted to digital economic realities, particularly the principle of significant economic presence. Using a normative juridical method combined with Economic Analysis of Law, this study finds that foreign OTT operations have created legal uncertainty due to regulatory fragmentation, lack of physical presence requirements, and weak enforceability. Comparative analysis with the U.S. economic nexus model demonstrates the need for Indonesia to shift towards digital presence–based taxation. The study concludes that harmonizing tax, communications, and trade regulations—supported by risk‑based and adaptive digital governance—is essential to strengthening fiscal justice, consumer protection, and national digital sovereignty.
