Abstract

This study analyzed the case of grants in decision number 4301 / Pdt.G/2023 / Pa.Jr, which involves a mother who donates all of her property in the form of land and a house to one child without the consent of the other children. A grant is a voluntary transfer of property from one person to another without coercion and generally irrevocable. In this context, however, the grant is canceled because there is no consent from the other heirs who should have the same rights to the property.Revocation of a grant refers to the act of canceling the status of a grant that has previously been granted, which in this case occurs due to a violation of the procedure established in the law. Under Articles 210 and 212 of the compilation of Islamic law, grants made without the consent of all heirs are considered invalid. As a result, the deed of Grant registered in the name of the donee is considered null and void, so the grant is considered an inheritance that must be divided equally among all legal heirs, in accordance with Article 213 of the compilation of Islamic law.This study emphasizes the importance of complying with legal procedures in grants to prevent disputes. The cancellation of this grant also shows the relevance of the need for the consent of all heirs in the grant process so that it does not contradict the provisions of the applicable law.

Abstract

Penelitian ini membahas bagaimana institusi pendidikan Islam berinovasi dalam manajemennya di era industri ini. Fokus utama terletak pada digitalisasi dalam manajemen sebagai strategi efektif untuk menyesuaikan diri dengan cepatnya arus globalisasi dan kemajuan teknologi. Tujuan utamanya adalah untuk menemukan strategi inovatif dalam pengelolaan lembaga pendidikan yang berlandaskan Islam melalui pemanfaatan teknologi digital. Penelitian ini mengadopsi pendekatan kualitatif dengan menerapkan metode studi kasus di beberapa madrasah dan pesantren yang telah menerapkan sistem manajemen digital. Hasil penelitian menunjukkan bahwa penerapan digital dalam manajemen administrasi, proses belajar mengajar, serta interaksi dengan masyarakat memberikan dampak positif terhadap efektivitas, efisiensi, dan transparansi pengelolaan institusi. Kesimpulan yang diperoleh adalah bahwa transformasi digital menjadi suatu kebutuhan mendesak dalam pengelolaan pendidikan Islam di era saat ini

Abstract

Penelitian ini bertujuan untuk mengkaji suatu bentuk Perlindungan Hukum Bagi Notaris Dalam Pembuatan Akta Autentik Yang Didasarkan Keterangan Palsu Dari Pihak Penghadap. Notaris merupakan pejabat umum yang berwenang untuk membuat suatu Akta Autentik. Notaris dalam menjalankan jabatannya mempunyai keterbatasan yang sering tidak bisa diantisipasi terkait dengan keinginan pihak penghadap yang ingin dengan sengaja melakukan perbuatan melawan hukum yang dilarang oleh kaidah hukum, sehingga seorang notaris bisa saja terseret dalam suatu perkara di pengadilan. Apabila hakim pada suatu proses peradilan meminta untuk seorang notaris memberikan kesaksiannya terhadap akta yang telah dibuatnya yang isinya berdasarkan keterangan palsu yang disampaikan oleh pihak penghadap dan notaris dalam hal ini memutuskan untuk tidak menggunakan hak ingkarnya maka akan timbul suatu konflik norma antara menjaga kerahasiaan isi akta yang dibuatnya sesuai dengan Pasal 16 ayat (1) huruf f UUJN dan untuk menuruti perintah atau permintaan pejabat yang berwenang untuk kepentingan pemeriksaan dalam suatu proses pembuktian dalam persidangan sesuai dengan Pasal 216 ayat (1) KUHP, maka dua hal ini yang perlu dipertimbangkan secara mendalam. Penelitian yang digunakan adalah Penelitian Hukum Normatif dengan mengkaji berbagai macam aturan hukum yang bersifat formal seperti undang-undang, literatur-literatur yang bersifat konsep teoritis yang kemudian dihubungkan dengan permasalahan yang menjadi pokok pembahasan.

Abstract

Higher education in Indonesia faces significant challenges in improving students’ ability to write scientific papers. Amid the crucial role of scientific papers as a means of communicating research findings, students of the Distance Learning Program at UIN Siber Syekh Nurjati Cirebon often encounter difficulties in developing this skill due to limited direct interaction and access to academic resources. The community service activity aims to improve scientific writing literacy among students of the Distance Learning Program at UIN Siber Syekh Nurjati Cirebon through training and workshops. This program focuses on two main aspects: (1) enhancing the ability to write systematic scientific papers that adhere to academic standards, and (2) introducing and utilizing digital resources to support writing and academic research. Through a practical approach, students are expected to produce high-quality scientific papers and become more competent in the academic field. The expected outcome of this program is the improvement of the quality of students' scientific papers, as well as the development of more effective research skills, which in turn can support the enhancement of academic and professional achievements among Distance Learning Program students at UIN Siber Syekh Nurjati Cirebon.

Abstract

Islamic Religious Education (PAI) in Indonesia faces challenges in instilling a deep and relevant understanding of Islamic teachings, especially the concept of Islam Rahmatan lil 'Alamin, amidst globalization and cultural diversity. A comprehensive understanding of Islam as a blessing for the universe is crucial to building students' tolerant, moderate, and peace-loving characters. This study aims to develop a conceptual framework for PAI teaching materials that integrate the values of Indonesian local wisdom to improve students' understanding of Islam Rahmatan lil 'Alamin. The research method used is a qualitative literature study, by analyzing and synthesizing data from various relevant literature sources provided, including scientific journal articles, theses, and guidance documents. The results of the analysis indicate the potential for strong synergy between the objectives of PAI, the noble values in local wisdom of the archipelago (such as mutual cooperation, deliberation, tolerance, justice, and social and environmental harmony), and the essence of Islam Rahmatan lil 'Alamin. Identification of various examples of local wisdom from various regions, such as the Ngejot tradition in Lombok, Metabe' in Mandar, the values of Sipakatau, Sipakalebbi, Sipakainge' in Bugis, and Maja Labo Dahu in Bima, show alignment with universal Islamic values. Integration of this local wisdom into Islamic Religious Education teaching materials, through active, participatory, and contextual learning strategies—in line with the theory of Contextual Learning (CTL)—is identified as a promising approach. The proposed Contextual-Integrative Islamic Religious Education Teaching Materials Based on Local Wisdom (PAIKIB-RL) model has the potential to increase the relevance of Islamic Religious Education learning, strengthen students' cultural identity, and significantly deepen their understanding of Islam Rahmatan lil ‘Alamin. This study has implications for the need for innovation in the development of Islamic Religious Education curriculum and teaching materials, increasing teacher capacity, and further research for empirical validation of the proposed model

Abstract

Currently, technology has penetrated all aspects of human life. The world of education is no exception. The presence of technology has a significant positive impact on education. However, the presence of AI technology is also not free from challenges and problems. This study aims to analyze the adverse effects of using artificial intelligence in education. By using a qualitative approach with a literature study type, this research data was obtained from searching for sources of scientific articles spread across internet pages. The results of this study indicate that the use of artificial intelligence in education can decrease teacher function and role interaction between humans, erosion of student ethics and morals, and excessive dependence on AI, also resulting in the loss of learning.

Abstract

Abstract: This study aims to analyze the implementation of the use of Simpenqu, a web-based application developed internally by SMP Islam Qurani Al-Bahjah, on the effectiveness of teacher learning administration. This application includes various features such as daily journals, student attendance recording, preparation of report cards, and management of teaching modules. The results showed that the use of Simpenqu provide a significant positive impact in improving the work efficiency of teachers and encourage the involvement of parents in the educational process. In addition, this application also supports Adiwiyata program by reducing the use of paper. However, there are technical constraints such as system disruptions and infrastructure limitations that still need to be addressed. This study uses a descriptive qualitative approach with data collection techniques in the form of observation, interviews, and documentation. Abstrak: Penelitian ini bertujuan untuk menganalisis implementasi penggunaan Simpenqu, sebuah aplikasi berbasis web yang dikembangkan secara internal oleh SMP Islam Qurani Al-Bahjah, terhadap efektivitas administrasi pembelajaran guru. Aplikasi ini mencakup berbagai fitur seperti jurnal harian, pencatatan kehadiran siswa, penyusunan rapor, serta pengelolaan modul ajar. Hasil penelitian menunjukkan bahwa penggunaan Simpenqu memberikan dampak positif yang signifikan dalam meningkatkan efisiensi kerja guru serta mendorong keterlibatan orang tua dalam proses pendidikan. Selain itu, aplikasi ini juga mendukung program Adiwiyata dengan mengurangi penggunaan kertas. Namun, terdapat kendala teknis seperti gangguan sistem dan keterbatasan infrastruktur yang masih perlu dibenahi. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan teknik pengumpulan data berupa observasi, wawancara, dan dokumentasi.

Abstract

Pendidikan merupakan masalah penting dalam kehidupan seseorang. Ini adalah kunci sukses di masa depan dan memiliki banyak peluang dalam hidup kita. Pendidikan memiliki banyak manfaat bagi manusia.  Kegiatan Pengabdian Kepada Masyarakat  (PKM) ini dilaksanakan oleh mahasiswa KKN Angkatan 27 Universitas Madako Tolitoli pada tanggal 17 Maret 2023.  Bertempat di SMP Negeri  Satu Atap Dusun Bambuan Desa Ogomatanang Kabupaten Tolitoli Provinsi Sulawesi Tengah. Hasil kegiatan pengabdian menunjukkan bahwa  siswa/i SMP Negeri Satu atap sangat antusias mengikuti kegiatan sosialisasi terkait pentingnya pendidikan dan mengindikasikan bahwa para peserta menyambut positif kegiatan yang telah dilakukan.Kata kunci : Kkn, pendidikan, siswa

Abstract

Marriage is a sacred and noble procession to build a household that is considered legitimate from a religious and state perspective. Positive law prohibits interfaith marriages as stated in SEMA No. 2 of 2023 concerning Judges' Instructions in Adjudicating Cases of Applications for Registration of Marriages Between People of Different Religions and Beliefs. However, the judge in Stipulation Number 423/PDT.P/2023/PN.Jkt.Utr granted the request for registration of interfaith marriage applications. The legal research used in this article is normative juridical, based on an internal perspective that is able to provide legal arguments when conflicts, ambiguities, or legal gaps are found. The results of the study show that the judge's considerations in Stipulation Number 423/PDT.P/2023/PN.Jkt.Utr are inappropriate in using the legal basis. The judge is of the view that Catholicism and Protestant Christianity are still within the same scope of faith so that they are in harmony. However, the judge did not refer to SEMA Number 2 of 2023 as a legal basis for deciding the case, did not consider the norm of Article 2 paragraph 1 of the Marriage Law, did not consider the rejection from the Dukcapil Office, did not consider evidence in the form of the Applicants' Identity Cards, and finally the Judge did not consider the prohibitions of each of the Applicants' religions. The Judge should have made a decision based on the correct legal basis as a consideration so that in the future there would be no more inappropriate decisions. Abstract

Failure to comply with the registration of the marriage agreement causes the agreement to be null and void because it does not fulfill one of the conditions for a valid agreement according to Article 1320 of the Civil Code and is contrary to Article 29 paragraph (1) of Law no. Therefore, this research will write about the role of registration of marriage agreements in ensuring legal certainty and protection of the rights of the parties concerned and the legal consequences of non-compliance in registering marriage agreements. The type of research used is a normative juridical method, namely research guided by positive legal regulations in accordance with the laws and regulations applicable in society. In resolving a legal issue, the author uses two approaches, namely the Statute Approach which is carried out by examining all statutory regulations relating to the legal issue to be studied, and the Conceptual Approach which carries out the interpretation. principles, laws and legal concepts according to the legal issue being studied. The legal materials used are primary legal materials and secondary legal materials using the library research method of collecting legal materials (Library Research) with research analysis using deductive methods. The result is registration of a marriage agreement has permanent legal force, thereby providing optimal protection for both parties from potential disputes in the future. Failure to comply with the obligation to register a marriage agreement, even though it has been made in the form of an authentic deed by a notary, has the implication that the agreement is null and void. It is hoped that in the future the government can increase outreach and education as well as simplify the procedures for registering marriage agreements.
