Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan wakaf uang dalam pengelolaan Halal Mart MUI Sumut Perspektif UU No. 41 Tahun 2004 Tentang Wakaf Uang. Penelitian ini menggunakan metode penelitian kualitatif fenomenologis dengngan menggunakan teknik pengumpulan data observasi, wawancara, dan dokumentasi. Hasil penelitian ini menunjukkan bahwa pengelolaan wakaf uang dari Halalmart MUI Sumut merupakan bentuk dari wakaf melalui uang. Pendiriannya diawali dari dana wakaf yang terhimpun dipakai sebagai modal usaha mini market. Selanjutnya modal usaha tersebut dikelola agar menghasilkan dan lebih produktif. Hasil keuntungan dari pengelolaan wakaf uang sampai saat ini digunakan sebagai modal pengembangan Halalmart MUI Sumut agar lebih bertambah aset wakafnya dan juga digunakan sebagai dana sosial yang diberikan pada yang berhak (mauquf ‘alaih).  Akad-akad yang digunakan dalam pengelolaan wakaf uang di Halalmart MUI Sumut meliputi akad jual beli, akad wakaf, akad hibah hasil manfaat. Akad ini yang memenuhi setiap kegiatan di Halalmart MUI Sumut sehari-harinya. Dalam pandangan fiqh, model pengelolaan seperti yang dilakukan oleh Halalmart MUI Sumut tidak melanggar aturan syariat. Meskipun terdapat multiakad dalam kegiatan jual beli barang di Halalmart MUI Sumut, akan tetapi akad-akad tersebut tidak bertentangan. Akad yang digunakan merupakan hasil modifikasi sistem muamalah yang terus berkembang agar ibadah harta tidak monoton.

Abstract

Inheritance law in Indonesia, at least sociologically, there is still pluralism, in the sense that it is still permissible for interested parties to distribute inheritance/inheritance based on the preferred law (choice of law). Especially in Tanjung Pura Langkat, until now it has been implemented with different systems. there is an inheritance distribution system that is shared equally, some through family agreements, some represent the oldest children to share inheritance, some use Islamic law, if an inheritance dispute occurs, the heirs in resolving disputes through the mediation of the village head, and community leaders, they do not want to settle disputes in court because of the high costs and lengthy process in court. The people of Tanjung Pura are a society whose majority of the population is Muslim and upholds Islamic values, however, many of them share inheritance using customary law.

Abstract

Di Kabupaten Tapanuli Tengah tepatnya di Kecamatan Lumut ada sebuah perdesaan dengan nama desa Sidomulyo terdapat beberapa kelompok yang dikenal sebagai Jamaah Tabligh. Jamaah Tabligh adalah sekelompok aktifis dakwah yang berpergian selama tiga hari, tujuh hari, sepuluh hari, 30 hari hingga 120 hari yang dilakukan oleh para muballigh. Dengan meninggalkan keluarga baik istri dan anak maka bentuk pengawasan sebagai suami atau ayah berkurang, terlebih lagi jika kedua orang tua baik suami ataupun istri mengikuti kegiatan aktifis dakwah tersebut. Mereka rela meninggalkan anak mereka selama beberapa hari dan apabila seorang ayah yang pergi dakwah akan meninggalkan istri dan anak-anaknya lebih lama lagi hingga berbulan-bulan dengan lokasi yang cukup jauh demi berdakwah. terkait hal ini perlu adanya suatu pengawasabn lebih terhadap anak yang ditinggal pada saat khurj atau masturah sehingga anak yang ditinggal tidak terjun dalam kenakalan remaja dengan usaha memberikan suatu pemahaman nilai agama, niai sosial dan lain-lain.

Abstract

Jenis penelitian ini adalah penelitian lapangan (field research) dan pengembangan (Research and Developement) dengan pendekatan yuridis sosiologis. Sumber Data primer berupa data hasil wawancara dari tiga informan yaitu, Panitera Pengadilan serta Mediator non Hakim dan didukung dengan observasi serta dokumentasi Hasil penelitian ini menunjukkan bahwa (1) Selama masa pandemi Covid-19 kecenderungan kasus cerai gugat di Pengadilan Agama Medan tidak mengalami perubahan jumlah perkara yang signifikan, hanya saja pada bulan April dan Mei terjadi penurunan jumlah kasus gugat cerai dikarenakan dibatasi jumlah perkara yang ingin di daftarkan oleh pencari keadilan. (2) Kelima faktor tersebut menjadi tolak ukur efektivitas mediasi di Pengadilan Agama yakni, faktor hukum, faktor penegakan hukum, faktor sarana dan prasana, faktor masyarakat dan faktor kebudayaan. Sehingga pada perkara perceraian tolak ukur keberhasilan mediasi adalah banyaknya jumlah perkara yang dicabut (3) Mediasi yang dilakukan secara online belum efektif sebagai alternative penyelesaian sengketa dalam upaya perdamaian para pihak yang ingin melakukan perceraian sehingga diperlukan pembaruan hukum terkait peraturan yang mengatur tentang Mediasi secara online yang dilengkapi insfratuktur telekomunikasi, sistem keamanan, dan lembaga mediasi online terutama di masa pandemi Covid-19.

Abstract

This study aimed to determine and analyze the distribution of Angkola customary inheritance to daughters. The type of research was field research, with a qualitative descriptive method, and the approach used legal sociology and a state approach. In contrast, the data types used consisted of primary and secondary data. The findings were that the kinship system used by the Angkola tribe in the distribution of inheritance adheres to a patrilineal kinship system, so with this patrilineal system, the position and inheritance rights of daughters are not recognized by Angkola custom. Even though they are not classified as heirs, daughters can still get a share of their parent's inheritance utilizing Olong Ate, namely giving love from a brother to his sister without a nominal amount. With the concept of Olong Ate, the share received by Daughter cannot be determined; the share for Daughter may be less, more, or equal to the share for boys. If Daughter's share is equal to or bigger than the boys, then there is a clash between Angkola customary and Islamic inheritance laws. Penelitian ini bertujuan untuk mengetahui dan menganalisis pembagian harta peninggalan adat Angkola kepada anak perempuan. Jenis penelitian yang digunakan adalah penelitian lapangan, dengan metode deskriptif kualitatif, dan pendekatan yang digunakan adalah sosiologi hukum dan pendekatan negara. Sebaliknya, jenis data yang digunakan terdiri dari data primer dan data sekunder. Hasil temuan bahwa sistem kekerabatan yang digunakan suku Angkola dalam pembagian harta warisan menganut sistem kekerabatan patrilineal, sehingga dengan sistem patrilineal ini kedudukan dan hak waris anak perempuan tidak diakui oleh adat Angkola. Meski tidak tergolong ahli waris, anak perempuan tetap bisa mendapatkan bagian dari harta warisan orang tuanya dengan memanfaatkan Olong Ate, yaitu pemberian kasih sayang seorang kakak kepada adiknya tanpa nominal. Dengan konsep Olong Ate, bagian yang diterima Putri tidak bisa ditentukan; bagian untuk anak perempuan mungkin lebih sedikit, lebih banyak, atau sama dengan bagian untuk anak laki-laki. Jika bagian anak perempuan sama atau lebih besar dari anak laki-laki, maka terjadi perselisihan antara hukum adat Angkola dan hukum waris Islam

Abstract

A marriage guardian (wali) occupies a very important role in marrying the bride to the prospective groom. There is often a unique case found among the Batak Toba Muslims in Harian District, Samosir Regency in that the lineage of a marriage guardian is not clear (cannot be proven genetically). Thus, if a bride belongs to a Samosir clan, the leader of Samosir clan can be the marriage guardian for the bride as long as he is a Muslim. This study aims to see the implementation of traditional wedding ceremony in the Batak Toba Muslim community, to see some factors contributed to this phenomenon, and to see the role of a guardian in a traditional wedding ceremony of Batak Toba Muslim in the perspective of Islamic law. After analyzing the data, it was found that many cases of marriage involving guardian of the same clan but different lineage were triggered by little understanding of Islamic marriage. Therefore, the office of religious affairs is suggested to be more active in raising people’s awareness of the important roles of a marriage guardian. In addition, for people whose marriage guardian is not from the same lineage should register their marriage with a wali hakim as their marriage guardian.

Abstract

Sharp weapons are very useful and necessary in terms of arming oneself or defending or defending oneself from things that threaten the soul, but if misused or used is not in accordance with applicable laws and regulations, this research using normative legal research does not recognize field research ( field research) because what is being studied is legal materials so that it can be said to be library based, focusing on reading and analysis of the primary and secondary material. This research will then draw a conclusion regarding Juridical Analysis and Islamic Criminal Law Views of Children Carrying Sharp Weapons for Fighting Actions on a decision study (Number 70/Pid.Sus-Children/2022/PN Mdn). In Indonesia, the use of sharp weapons without rights and without permission is strictly prohibited because it can injure other people, therefore the State of Indonesia makes rules that prohibit its people fortunately not to carry or use sharp weapons carelessly which is contained in the Emergency Law of the Republic of Indonesia number 12 of 1951 Article 2 paragraphs 1 and 2. Abstract

Heretical sects are teachings or activities that deviate from religious norms. Misguided sects that are currently happening a lot both in Indonesia and in the world are sects that violate human rights. Apart from deviating from our spirituality and beliefs in religion, this sect also makes its followers victims of criminal acts by the sect leaders themselves. In collecting data the author uses normative juridical methods. The normative juridical method is library law research by examining library materials or with primary legal materials and secondary legal materials that support the author's research. The results of this study indicate that the modus operandi in committing a crime can be done in the name of religion. where this concerns the problem of our spirituality to God Almighty. This study concludes that deviant sects are also regulated in the Criminal Code where the sanctions for the perpetrators are in accordance with the conditions of the crime they committed. In the perspective of Islamic criminal law, the spread of deviant sects can be as Jarimah Hudud. Abstract

The notion of jarimah or criminal offense, a criminal act is an act or behavior that is prohibited by Sharia which is punishable by had and tazir penalties. Without realizing that violating traffic is a crime, people who go against the flow of traffic can be subject to sanctions in accordance with Article 287 Paragraph 1 of Law No. 22 of 2009 concerning road traffic and transportation. Traffic flow regulations for motorists, either motorbikes or cars, are not explained directly in Islamic jurisprudence, but in general, Islam always stays away from things that can bring harm to the surrounding community. The formulation of the problem in this journal is how Islamic criminal law and Law No. 22 of 2009 concerning LLAJ deal with violations that have occurred. The purpose of this study is to find out the views of Islamic criminal law and Law No. 22 of 2009 concerning LLAJ regarding violations that have occurred. The method used is a qualitative normative-empirical approach and the nature of the research is descriptive. Primary data sources are in the form of interviews, observations, and questionnaires. The interviews that the researchers used were in the form of unstructured interviews and distributed questionnaires to OJOL (motorcycle taxis online) and road users. Traffic violations can lead to accidents, which are certainly very detrimental to oneself or many people. In a year the highest accident rate that the authors get is 12 times a year with the vehicle used in the form of a motorbike. The factors that influence violations on the Sendal Jepit Road in the city of Pematang Siantar, namely: speeding up travel routes, avoiding police, and the habit of going against the direction.

Abstract

This research highlights academic problems in the form of child adoption which must comply with Indonesian law, including in Decision no. 438/PDT.P/2023/PA.JU. The aim of the research is to assess the suitability of the decision with the Civil Code and KHI. The research method used is qualitative research, a type of library study. Primary data was obtained from Decision No. 438/PDT.P/2023/PA.JU, Civil Code and Compilation of Islamic Law (KHI) regarding child adoption, while secondary data comes from various supporting literature, including books and journals and the results of scientific research. All data obtained was analyzed causally comparative and causal descriptive in order to achieve research objectives. The research results show that decision no. 438/PDT.P/2023/PA.JU complies with the provisions of KHI, Civil Code, and PP No. 54 of 2007 concerning adoption of children. This is because the decision takes into account the best interests of the child, involves the consent of the biological parents, recommendations from social services and strict verification by the court so that the adoption of the child by the applicant complies with regulations, ensuring that the child's rights are protected and their welfare is guaranteed.
