Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis bentuk-bentuk kekerasan seksual dalam peraturan perundang-undangan, untuk mengetahui bentuk-bentuk pencegahan kekerasan seksual, serta untuk mengetahui dan menganalisis pembaruan perlindungan hukum bagi perempuan korban kekerasan seksual yang terdapat dalam undang-undang nomor 12 tahun 2022. Hasil penelitian ini menunjukkan keberagaman bentuk kekerasan seksual dalam peraturan perundang-undangan, bentuk pencegahan kekerasan seksual, dan Undang-Undang Tindak Pidana Kekerasan Seksual telah menjadi hukum positif baru yang menghadirkan reformasi yang jelas dan spesifik terhadap hak-hak korban kekerasan seksual, serta perlindungan bagi korban kejahatan. kekerasan seksual kriminal dalam penegakan hukum.

Abstract

One of the legal problems that occur in the community in Cipayung District, Depok City is the administration of marriage registration. Unregistered marriages or unregistered marriages occur due to several factors. First, the economic weakness of the community. Sirri married couples generally do not have sufficient funds to take care of marriage registration at the KUA. Second, still tied to the previous marriage. There are several women who marry sirri because she has not been officially divorced through the Religious Courts with her previous husband. Difficulty in accessing and lack of understanding of the legal process in the Religious Courts causes them to choose the easy way by marrying other men in a sirri way. Third, the need for continuing life for children. This happened to some women who had left their first husbands without being officially divorced in the Religious Courts. Finally they volunteered to be married sirri by another man on the grounds of the need for daily living. Keywords: Empowerment, Advocacy, Civil Registration Rights. Abstrak:Salah satu problematika hukum yang terjadi pada masyarakat di Kecamatan Cipayung Kota Depok adalah administrasi pencatatan perkawinan. Perkawinan tidak tercatat atau nikah sirri banyak terjadi yang disebabkan oleh beberapa faktor. Pertama, kelemahan ekonomi masyarakat. Pasangan nikah sirri umumnya tidak memiliki biaya yang cukup untuk mengurus pencatatan perkawinan di KUA. Kedua, masih terikat dengan perkawinan sebelumnya. Ada beberapa perempuan yang menikah sirri disebabkan ia belum resmi bercerai melalui Pengadilan Agama dengan suami sebelumnya. Kesulitan mengakses dan ketidakpahaman akan proses beracara di Pengadilan Agama menyebabkan mereka memilih jalan mudah dengan menikah kembali dengan laki-laki lain secara sirri. Ketiga, kebutuhan melanjutkan kehidupan bagi anak-anak. Hal ini terjadi bagi beberapa perempuan yang ditinggal suami pertamanya tanpa resmi bercerai di Pengadilan Agama. Akhirnya mereka merelakan diri dinikahi sirri oleh laki-laki lain dengan alasan kebutuhan akan nafkah sehari-hari. Kata Kunci: Pemberdayaan, Advokasi, Hak-hak Pencatatan Sipil.

Abstract

This study aims to determine and analyze the role of justice collaborators and whistleblowers in corruption in the procurement of goods and services carried out by state administrators and to determine the forms of corruption that occur in the procurement of goods/services. The research method used is normative legal research through a legislative approach and a conceptual approach. The results of this study found several problems, namely; There is a need for unification of perceptions and synchronization of regulations that apply to law enforcement officers in understanding aspects of witness protection related to legal collaborators and violation reporters. The most common forms of deviation in the government procurement of goods/services that can lead to corruption are: bribery, job combination, separation of duties, collusion between partners providing goods/services and procurement implementers, document falsification, waste of money. region/country, reducing the quantity and/or quality of coral/gauze, incorrectly determining the type of procurement contract for goods/services, contracts without available budget, setting their own estimated price that is too high.
