Abstract

Abstract:The case of theft with a small value of goods which is now being tried in court is quite under public’s spotlight, public are generally considering that it is very unfair if the cases are threatened with a penalty of 5 (five) years as determined in article 362 of the Criminal Code. Since the punishment is not comparable to the value of the stolen goods, these cases have also encumbered the court, both in terms of the budget and public perceptions of the court. After analyzing the problem, the authors concluded that the application of PERMA Number 2 of 2012 as for Adjustment of Light Crime Limits and the Amount of Mulcts in the Criminal Code has not been used as a Court or Judge as a material consideration or a reference to decide criminal acts whose goods value is below IDR 2,500,000.00 (two million five hundred thousand rupiah).Keywords: Supreme Court Regulations, Mild Crimes, Fines Abstrak:Perkara pencurian dengan nilai barang yang kecil yang kini diadili di pengadilan cukup mendapat sorotan masyarakat, masyarakat umumnya menilai bahwa sangatlah tidak adil jika perkara-perkara tersebut diancam dengan ancaman hukuman 5 (lima) tahun sebagaimana diatur dalam pasal 362 KUHP. Oleh karena tidak sebanding dengan nilai barang yang dicurinya, perkara-perkara tersebut juga telah membebani pengadilan, baik dari segi anggaran maupun dari segi persepsi publik terhadap pengadilan. Setelah melakukan analisa terhadap permasalahan, penulis berkesimpulan bahwa penerapan PERMA Nomor  2 Tahun 2012 Tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda dalam KUHP belum dijadikan Pengadilan atau Hakim sebagai bahan pertimbangan atau pun acuan untuk memutus tindak pidana yang nilai barangnya di bawah Rp. 2.500.000,00 (dua juta lima ratus ribu rupiah).Kata Kunci: Peraturan Mahkamah Agung, Tindak Pidana Ringan, DendaАннотация:Дело о краже с небольшой стоимостью товаров, которое сейчас рассматривается в суде, находится в центре внимания общественности, общественность, как правило, считает, что очень несправедливо, если этим случаям грозит штраф в 5 (пять) лет, как определено в статье. 362 УК РФ. Поскольку наказание несопоставимо со стоимостью похищенных товаров, эти дела также обременяют суд, как с точки зрения бюджета, так и общественного восприятия суда. Проанализировав проблему, авторы пришли к выводу, что применение PERMA № 2 от 2012 года в отношении корректировки пределов легкой преступности и количества элементов в Уголовном кодексе не использовалось в качестве суда или судьи в качестве материала для рассмотрения или ссылки на принимать решения о преступных деяниях, стоимость товаров которых ниже 2 500 000,00 (два миллиона пятьсот тысяч) рупий.Ключевые слова: постановление Верховного суда, легкие преступления, штрафы

Abstract

This study intends to evaluate the existence of persons who are passive when they witness a traffic collision and the efforts or law enforcement carried out by the authorities, specifically the police, in dealing with such individuals. This study employs a qualitative approach to criminology-based research. In research, main legal texts or field data serve as data sources. Interviews and a literature review were utilized to acquire data for this investigation. The findings of this study reveal that there are still a significant number of individuals who react passively to victims of traffic accidents for a variety of reasons, such as a dread of blood, a fear of being witnesses, etc. Then, law enforcement continues to be hampered by a number of problems. Then, Islamic law has laws addressing this society's passive response.

Abstract

The overcapacity of convicts resulted in the adoption of negative living procedures at Cipinang Class I Prison, which has the ability to impede the reintegration efforts of inmates, who are feared to be able to thwart the prison's original purpose. This thesis seeks to understand the preventive and resolution efforts against the repetition of crimes in Cipinang Class I Prison as a result of the prison's overcrowding by determining in advance the impact of the prison's overcrowding on inmates' rights. This study employs a type of empirical juridical research by conducting field interviews with the Class I Cipinang Prison, followed by studies on literary materials by reading, examining, and analyzing literature to generate studies linked to the theme of this thesis. The results indicated that the overpopulation of Cipinang Class I Prison led to a lack of supervision of detainees, which disrupted the rights of inmates. In prisons when the number of inmates exceeds the capacity, the function and purpose of prisons are impeded, and jails may become criminal academies. To prevent this from occurring, Cipinang Class I Prison conducts preventative measures consisting of unannounced searches of inmate dormitories and interactions with convicts. In addition, as a kind of countermeasures, Cipinang Class I Prison administers sanctions based on the category broken by convicts.

Abstract

One of the impacts arising from the implementation of simultaneous elections and elections is the existence of vacancies in regional heads in several provinces and districts. To fill the vacancy, an Acting PJ was appointed by the Government. Rapture acting regional head as stipulated in the provisions of Article 201 paragraph (9) of the Law 10 of 2016 raises questions about its application in the DKI Jakarta Provincial Government. As regions with a special status different from other regional governments, Jakarta places the Governor with great authority, including appointing and dismissing the Mayor and Regent in Article 29 of 2007, which is indeed placed as an acting administrative task. Because of that great authority, the mechanism for electing the Governor of DKI Jakarta is more specialized, namely meeting the number of votes 50%, and if it is not fulfilled, a second round of elections will be held. This is done so that The governor elected by the people is truly of the will of the majority of the people because later the Governor has great authority. Given the specificity possessed by DKI Jakarta Government, hence the application of Article 201 paragraph (9) of Law Number 10 of 2016 is questionable, especially from its constitutionality.Keywords: Simultaneous Elections; Asymmetric Decentralization; Acting Regional Heads; DKI Jakarta AbstrakSalah satu dampak yang muncul dari pelaksanaan pemilu dan pemilukada serentak adalah adanya kekosongan jabatan pada kepala daerah di beberapa provinsi dan kabupaten. Sebagai upaya untuk mengisi kekosongan jabatan tersebut, maka diangkat Penjabat (PJ) oleh Pemerintah. Pengangkatan Penjabat (PJ) Kepala Daerah sebagaimana diatur dalam ketentuan Pasal 201 ayat (9) Undang-Undang 10 Tahun 2016 menimbulkan pertanyaan penerapannya di Pemerintah Provinsi DKI Jakarta. Sebagai daerah yang memiliki status kekhususan yang berbeda dengan pemerintahan daerah lain, DKI Jakarta menempatkan Gubernur dengan kewenangan yang besar, termasuk mengangkat dan memberhentikan Walikota dan Bupati yang dalam desain Undang-Undang Nomor 29 Tahun 2007, memang ditempatkan sebagai pelaksana tugas administratif. Karena kewenangan yang besar itu, mekanisme pemilihan Gubernur DKI Jakarta lebih dikhususkan lagi yaitu memenuhi jumlah suara 50%, dan jika tidak terpenuhi akan dilakukan putaran kedua pemilihan. Hal tersebut dilakukan agar Gubernur yang dipilih oleh masyarakat adalah benar-benar dari kehendak mayoritas masyarakat sebab nantinya Gubernur memiliki kewenangan yang besar. Mengingat kekhususan yang dimiliki Pemerintahan DKI Jakarta, maka penerapan Pasal 201 ayat (9) Undang-Undang Nomor 10 Tahun 2016 patut dipertanyakan terutama dari konstitusionalitasnya.Kata Kunci: Pemilu Serentak; Desentralisasi Asimetris; Penjabat Kepala Daerah; DKI Jakarta

Abstract

The widespread occurrence of illegal levies suggests that the current laws are ineffective in addressing extortion practices by mass organizations. This ineffectiveness stems from inadequate supervision of youth organization activities, insufficient transparency in financial transactions, and weak enforcement measures against organizations engaging in extortion. Actions taken by these organizations, such as coercing traders for illegal levies or soliciting donations, constitute criminal offenses under Article 368, paragraph (1) of the Criminal Code and are further underscored in Article 59, paragraph (2) of the law on Mass Organizations. This article aims to examine the challenges posed by the ineffectiveness of existing laws concerning criminal offenses related to illegal levies perpetrated by mass organizations and their members. The research employs a normative legal analysis, focusing on applicable legal rules and various doctrines to address specific issues. The methodologies utilized include statutory and conceptual approaches. The findings indicate that the current mass organization law is ineffective and requires revision, particularly regarding legal frameworks governing donation requests (illegal collections) made through coercive means. The sanctions imposed on mass organizations engaged in these practices are not criminal, rendering them ineffective. This article proposes the revision of Law No. 16 of 2017, which stipulates government regulations, to replace Law No. 2 of 2017, thus amending Law No. 17 of 2013 concerning community organizations.

Abstract

The purpose of this study is to examine how the Toba Batak Muslim community maintains its cultural identity in the face of complex dynamics while adapting to Islamic principles in the face of urbanization and economic change by examining the pattern of relationships between Islamic law and customary traditions. Three regions—traditional rural areas (Humbang Hasundutan, Tapanuli Utara, Samosir, Toba), multireligious communities (Asahan, Tanjung Balai, Labuhanbatu), and large cities (Medan, Bandung)—are the focus of this qualitative study using a case study methodology. The study's findings highlight three key trends in the interaction between Islam and customs: harmony, compromise, and adaptation. The adaptation trend is evident in individuals from the place of origin who endeavor to maintain practices with minimal impact from Islamic law. A negotiation pattern has developed among individuals in diverse religious contexts who want to reconcile local customs with Islamic principles. Simultaneously, a pattern of harmony is observed in metropolitan areas, where individuals successfully reconcile traditions with Islamic tenets within a contemporary framework. Economic conditions and social mobility significantly influence these trends. Individuals with superior economic advantages often prioritize religious ideals, whereas others with economic constraints rely more on customs as a social mechanism. Social mobility facilitates the adaptation of traditional values to be more flexible and inclusive of Islamic beliefs, particularly in metropolitan settings. This study suggests that economic factors and social mobility act as catalysts in transforming the link between customs and religion within the Toba Batak Muslim community. Research recommendations emphasize the significance of locally-based religious education, inclusive discussion between indigenous and religious leaders, and economic empowerment to foster harmony between traditional beliefs and Islam.

Abstract

This research analyzes the implementation of judicial review applications filed by both public prosecutors and defendants, focusing on the applicants’ legal grounds and the judges’ considerations in Supreme Court Decisions No. 109 PK/Pid/2007 and No. 133 PK/Pid/2011. The study employs a normative juridical approach, which examines relevant laws, legal principles, and scholarly doctrines to address the research questions systematically. The findings reveal that the right to file a judicial review is not limited to convicted persons but may also be exercised by public prosecutors. A judicial review may be accepted when judicial error occurs during the trial or when new evidence (novum) emerges that could significantly alter the verdict. The research further emphasizes that judges must act independently, free from external influence, and base their rulings solely on legal facts and judicial conviction.

Abstract

This study analyzes the criminalization of minors in narcotics abuse cases, as reflected in the Solok District Court Decision No. 2/Pid.Sus-Anak/2018/PN.Slk. Specifically, it explores the factors contributing to drug abuse among minors and the judicial considerations applied by the panel of judges in determining sanctions for juvenile offenders. The research employs a qualitative method with a statute approach, grounded in the Court Decision, Law No. 35 of 2009 on Narcotics, Law No. 35 of 2014 on Child Protection, and Law No. 11 of 2012 on the Juvenile Criminal Justice System. The findings reveal that drug abuse among minors is largely influenced by improper social interactions, which are further categorized into several triggering factors: family environment, social influence, education, psychological development, religious values, and geographical conditions. The court’s judgment in imposing sanctions on the child offender is examined from three perspectives, juridical, sociological, and philosophical while also considering the possible application of restorative justice through the diversion system. This study highlights the importance of balancing legal accountability with child protection principles in addressing juvenile narcotics offenses.
