Abstract

Notaries have jurisdiction under Article 15 of the UUJN and responsibility under Article 16 of the UUJN. A Notary's responsibilities extend beyond his own, as he is a public authority authorized to make a genuine deed. Because the Notary's negligence will have legal ramifications for the deed he made. Notaries must also follow all applicable laws and regulations while preparing the Deed of Statement of Foundation Meeting Resolutions. This study used the library research approach, which involves looking through library materials or secondary data. This project will discover, explain, and categorize library materials that provide information pertinent to the concerns presented. According to the research, a Notary's principal authority is to make a genuine document, which might be an official deed (relaas) or a party deed (partij). The UUJN controls a Notary's particular authority, which is to provide legal advice in connection with the making of a deed. The Foundation Law must be followed while drafting the Deed of Statement of Foundation Meeting Decisions based on the Trustees meeting decision. Deed of Statement of the Foundation Meeting Resolutions whose minutes do not reach the quorum are subject to sanctions such as cancellation of the deed.

Abstract

The Constitutional Court believes that the element of state loss must be established and quantified, even if it is an estimate or has not yet occurred. Corruption is defined in detail in 13 articles of Law No. 31 of 1999, as revised by Law No. 20 of 2001 on the Eradication of Corruption Crimes. Corruption is classified into 30 distinct forms/types in these articles. These articles discuss the types of conduct that may result in criminal sanctions as a result of corruption. Indonesia is a constitutional monarchy. This is established in Article 1 paragraph three of the 1945 Constitution, which states that the State of Indonesia is a state of law. Indonesia's state of the law is one that always evaluates all activities on two bases. That is, in terms of its intended use or purpose and its legal foundation. The author employs a descriptive qualitative methodology in this paper. This study takes a normative juridical approach as well as a statutory or juridical method, namely legal product research.

Abstract

The rules and regulations of the law, it doesn't say anything about the criteria for collaborating perpetrator witnesses. In the Circular Letter (SEMA) of the Supreme Court of the Republic of Indonesia, a criterion called the classification of cooperating perpetrator witnesses is given that judges can use to help them decide cases. The method used in this research is normative legal research, which is done to get the information we need to solve the problem. The results of the study said that witnesses who helped were automatically protected by the law. This is the power of the LPSK. It's very important for different institutions to work together to find witnesses who will help until the perpetrators get a light sentence and get remission and other rights when they do.

Abstract

The sale and buy agreement is a consensual agreement, meaning that the existence of an agreement between the parties is sufficient to constitute the contract. However, the land sale and purchase agreement stipulated by Law No. 5 of 1960 on Agrarian Principles is a valid contract because it is founded on customary law, which is cash, real, and unambiguous. The agreement between the seller and buyer of land rights, although the sale and purchase cannot be performed before the PPAT, must be stated in a contract, which in general, such legal activities are carried out in the presence of a notary. This research employs a normative legal methodology that is supplemented by interviews. According to the findings of the study, the position of absolute power serves as the basis for the sale and purchase of recognized land rights. Absolute power as the basis for the deed of sale and purchase of land rights can be exercised so long as it is an integral component of the sales agreement. Absolute authority results from the emergence of wants based on the principle of contract freedom, whose restrictions are outlined in Articles 1320 and 1338 of the Civil Code.

Abstract

When extending credit to consumers, banks and financial institutions will always take precautions to protect themselves if the credit recipient (debtor) defaults or is unable to repay the credit. If the credit is followed by the binding of collateral, this prevention occurs. If the debtor defaults, the guarantee will serve as a replacement for credit payments made by banks and other financial institutions. In accordance with Article 2 letter b of Law No. 10 of 1998 pertaining to Banking, a violation of the precautionary principle in the provision of credit by banks carries legal repercussions, including the imposition of criminal punishment or fines. This study employs a qualitative descriptive methodology. According to the findings of this study, the granting of credit by banks needs cautious action on the part of the bank. The risk associated with extending credit is so large that it is necessary to evaluate whether the prospective debtor is deserving of credit. In banking practice, both persons and legal entities can apply for credit. Each candidate must satisfy the bank's predetermined criteria.

Abstract

Article 64 paragraph (1) of the Regulation of the Minister of Energy and Mineral Resources of the Republic of Indonesia Number 7 of 2020 states that if the holder of an IUP or IUPK wishes to make changes to its shares, it must first obtain the approval of the Minister or the Governor in accordance with their authority before registering with the Indonesian ministry in charge of government administration. the practice of law In actuality, however, the buyer has paid the seller in full for the shares under the Sale and Purchase of Shares Agreement, and it turns out that the seller cannot obtain approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia. This is a normative legal study employing a statute, case, conceptual, and analytic method. According to the results of the study, the transfer of shares that does not receive approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia cannot be continued with the signing of the transfer of rights to shares because the objective requirements cannot be met. This is due to the fact that shareholders of a limited liability company holding an IUP are required to get prior approval from the Minister of Energy and Mineral Resources of the Republic of Indonesia. In order for the disapproval of the change in shares to render the Sale and Purchase of Shares invalid.

Abstract

Today's globalized society is emerging due to advances in information and transportation technology related to complex public affairs, including the issue of online land registration at PPAT offices, an area that is emerging in parallel with the modernization process in all countries. As social and environmental changes affect the development of land management, including the government's intention to serve the community, the traditionally manual field of land management has shifted to a technology-based administrative bureaucracy. In this study, the authors used qualitative research methods and normative research types. As for the results of this study, online service applications in land registries still cannot effectively support PPAT in the execution of specific tasks related to transfer of land rights in land registration data maintenance, as online applications do not change the process, online time and cost PPAT is easier to practice effectively and efficiently, it takes longer because there are many hurdles like repetition, NIB exam and drawing are not online, so registration documents, even if they are online, have to be checked at the state office.

Abstract

Badan Penyelenggara Jaminan Sosial (BPJS) adalah badan hukum yang dibentuk dengan Undang-Undang untuk menyelenggarakan perogram jaminan sosial. BPJS menurut UU Nomor 40 Tahun 2004 Tentang Sistem Jaminan Sosial Nasional adalah trasformasi dari badan penyelenggara jaminan sosial yang sekarang telah berjalan dan dimungkinkan untuk membentuk badan penyelenggara baru sesuai dengan dinamika perkembangnan jaminan sosial. BPJS Kesehatan adalah badan hukum publik menurut UU BPJS. Terkait dengan Inpres Nomor 1 Tahun 2022 yang tersiar akan berlaku mulai 1 Maret 2022, kartu BPJS kesehatan menjadi syarat untuk melakukan transaksi jual beli tanah dan rumah. Syarat baru itu diperuntukkan masyarakat yang ingin melakukan transaksi jual beli tanah di Kementerian ATR/ BPN Nomor HR 02/ 152-400/11/2022. Terkait dengan Inpres Nomor 1 Tahun 2022 yang tersiar akan berlaku mulai 1 Maret 2022, kartu BPJS kesehatan menjadi syarat untuk melakukan transaksi jual beli tanah dan rumah. Syarat baru itu diperuntukkan masyarakat yang ingin melakukan transaksi jual beli tanah di Kementerian ATR/ BPN Nomor HR 02/ 152-400/11/2022. Dalam tulisan ini penulis menggunakan metode penelitian kualitatif deskriptif. Untuk memperoleh data yang dipergunakan dalam penelitian ini dipergunakan teknik pengumpulan penelitian kepustakaan atau studi dokumen dipelajari bahan-bahan hukum yang merupakan data sekunder. Pertama dihimpun semua peraturan-peraturan yang berkaitan dengan hukum yang menjadi objek penelitian, dan selanjutnya dari bahan-bahan tersebut dipilih doktrin, ketentuan-ketentuan lainnya. Hasil yang diperoleh disusun dalam sebuah kerangka sistematis, sehingga akan memudahkan dalam melaksanakan analisis terhadap permasalahan penelitian ini.Kata Kunci: BPJS, Jual Beli Tanak, Akta Jual Beli
