Abstract

Islamic law is divine rules that were entrusted to the Prophet Muhammad SAW to be conveyed to mankind, especially to his people, both legal rules in the form of belief and legal rules related to a deed. The previous scholars played a large role in the process of developing Islam in Indonesia. Therefore we must maintain the results of the thoughts of our predecessors whose thoughts were not carried out arbitrarily but with ijtihad which was not easy. Factors that support the use of Islamic law in Indonesia include Islam as a religion with the majority of adherents being a promising asset. Then another supporting factor lies in the broad scope of the legal field. The factors that hinder the acceptance of Islamic law in Indonesia consist of internal and external factors. Internal factors stem from the lack of maximum institutionalization and a dichotomous view of Islamic law. Meanwhile, the external factor is the influence of the government's legal politics on certain legal fields

Abstract

The rapid development of information and communication technology has had a significant impact on society, particularly through the use of social media as the primary means of disseminating information. However, this convenience has also triggered serious problems related to the spread of fake news (hoaxes), which can cause public unrest and even have implications for social and legal stability. This study aims to analyze the enforcement of laws against the criminal act of spreading fake news through social media, examine the urgency of the Electronic Information and Transactions Law (EIT Law), and formulate alternatives for reformulating Article 28(1) of the EIT Law to make it clearer and more applicable. The method used is a normative legal approach with qualitative analysis, supported by case studies and observations of the implementation of the law by the Cyber Crime Unit of the West Kalimantan Regional Police, as well as an examination of the Joint Ministerial Decree of 2021. The results of the study indicate that law enforcement against hoaxes still faces challenges in terms of proving legal elements and the ambiguity of the wording of the norms in the ITE Law. Additionally, the urgency for regulatory updates is high, as the improper application of certain provisions in some cases has led to potential violations of the right to freedom of expression. Therefore, a reformulation of Article 28(1) is necessary, emphasizing objective terminological boundaries and the actual impact of false information. This reformulation is expected to provide legal clarity, enhance enforcement effectiveness, and ensure the protection of civil liberties in the digital age.

Abstract

West Kalimantan is a region rich in cultural diversity and traditions, including in terms of conflict resolution through local cultural approaches. One of these cultural treasures is the oral tradition, which serves as a medium for mitigating and resolving social conflicts that arise within the community. This study aims to examine the forms of conflict that occur in West Kalimantan, explore Islamic values regarding conflict resolution, and analyze the role of oral traditions as a means of conflict transformation from an Islamic legal perspective. This study uses a socio-legal approach with a descriptive qualitative method, where data is collected through literature review and interviews with traditional leaders, religious scholars, and local communities. The findings of this study indicate that conflicts in West Kalimantan are often related to social issues, cultural identity, and resource disputes, but they are successfully mitigated through oral traditions such as customary advice, pantun (traditional poetry), and customary deliberation, which are rich in values of justice, reconciliation, and brotherhood. These traditions align with the principles of Islamic law, which emphasize the importance of ishlah (peace), 'adalah (justice), and ta'ayush silmi (living together in peace). Thus, oral traditions not only function as cultural instruments but also as social legal mechanisms rooted in Islamic values in transforming conflicts into sustainable peace.

Abstract

The enforcement of illegal laws from a legal and justice perspective is the main focus of this study, particularly in the context of West Kalimantan Province. The enforcement of laws that do not comply with existing legal provisions can lead to systemic injustice. This study explores the dynamics of law and justice in the context of illegal law enforcement in West Kalimantan, highlighting the role of Islamic law in the process. Using a qualitative approach, data was collected from various sources, including interviews with policymakers, legal practitioners, and local communities. The findings highlight the complex challenges faced in illegal law enforcement, including issues of legality, culture, and society. This study also considers the impact and implications of illegal law enforcement on social justice and legal stability in West Kalimantan. The findings of this study are expected to provide deeper insights into the dynamics of law and justice in the context of illegal law enforcement in the region.

Abstract

This study discusses the adaptation strategies of non-Muslim MSMEs to halal certification regulations in Manado City from the perspective of Maqasid al-Syari'ah. This is a qualitative study. The research design is field research. The informants in this study consisted of MUI officials in North Sulawesi Province and non-Muslim MSME actors in Manado City. The results of this study indicate that: Non-Muslim SME actors have demonstrated a high level of adaptation to halal certification regulations through gradual and pragmatic strategies. They began by improving hygiene, recording raw materials, and participating in training and capacity-building programs. These strategies reflect that the actors do not reject the regulations but require an approach tailored to their capacities. In many cases, halal certification is even positioned as a branding tool and a means of market expansion, rather than merely legal compliance. This adaptation also reflects the success of a values-based approach rooted in the principles of maqasid, where regulations are accepted as meaningful and beneficial ethical business practices. Through a dialogic and contextual approach, non-Muslim SME operators have successfully transformed halal certification into an opportunity rather than a threat to their identity.

Abstract

Pertimbangan hakim Pengadilan Agama Majene dalam penetapan dispensasi kawin pada tahun 2022-2024 menjadi latar belakang penelitian ini. Beberapa submasalah dalam pokok masalah tersebut , yaitu: 1) Bagaimana realitas penetapan dispensasi kawin di Pengadilan Agama Majene pada tahun 2022-2024, 2) Bagaimana dasar pertimbangan hakim dalam penetapan dispensasi kawin di Pengadilan Agama Majene, dan 3) Bagaimana analisis pertimbangan hakim dalam penetapan dispensasi kawin di Pengadilan Agama Majene perspektif mas}lah}ah. Jenis penelitian ini tergolong field research kualitatif deskriptif dengan pendekatan penelitian yang digunakan adalah: teologis-normatif (syar’i), yuridis-normatif, dan yuridis Empiris (sosio­logis). Hasil penelitian ini menunjukkan bahwa realitas penetapan dispensasi kawin di Pengadilan Agama Majene pada tahun 2022-2024 adalah berjumlah 64 penetapan dispensasi kawin dengan rincian 54 perkara dikabulkan, 2 ditolak, 2 digugurkan, dan 5 dicabut . Kemudian dasar pertimbangan hakim dalam penetapan dispensasi kawin di Pengadilan Agama Majene adalah 1) Pertimbangan dalam hukum: al-Qur’an, Hadis, Kaidah Fikih, Putusan Hakim, dan Undang-Undang. 2) Pertimbangan hakim di luar hukum. Kemudian analisis pertimbangan hakim dalam penetapan dispensasi kawin di Pengadilan Agama Majene perspektif mas}lah}ah adalah Hakim dalam penetapan mengabulkan dispensasi kawin mempertimbangkan kepentingan anak terhadap perkawinan dan faktor-faktor resiko perkawinan di bawah umur, hal ini sesuai dengan kaidah fikih menolak mafsadat lebih utama daripada mendatangkan maslahat. Implikasi dari penelitian ini : 1) Diharapkan pemerintah Kab. Majene melakukan sosialisasi kepada masyarakat akan pencatatan perkawinan, pencegahan perkawinan di bawah umur dan pencegahan pergaulan bebas. 2) Diharapkan keluarga melakukan  pengawasan cermat, menanamkan nilai moral dan memberikan pendidikan agama. 3) Diharapkan kepada pemerintah memberikan sanksi administrasi bagi pelaku perzinahan.

Abstract

Penelitian ini bertujuan untuk menganalisis hikmah dan rahasia masa iddah dalam perspektif filosofis hukum Islam. Penelitian ini termasuk dalam kategori penelitian kualitatif dengan metode studi pustaka (library research) dan pendekatan deskriptif-analitis terhadap konsep masa iddah. Hasil kajian menunjukkan bahwa masa iddah merupakan masa tunggu yang diperuntukkan bagi perempuan setelah terjadinya perceraian atau wafatnya suami, di mana dalam masa tersebut perempuan dilarang untuk menikah kembali. Ketentuan ini tidak hanya bersifat normatif, melainkan juga mengandung nilai-nilai filosofis dan sosial yang mendalam. Di antara hikmah dari masa iddah adalah untuk memastikan kebersihan rahim guna menghindari percampuran nasab, memberi ruang untuk mempertimbangkan kembali keputusan perceraian, sebagai bentuk ketaatan (ta‘abbudi) kepada Allah SWT, serta memberikan waktu pemulihan emosional bagi perempuan. Selain itu, masa iddah juga merupakan bentuk perlindungan terhadap syariat Islam dalam kerangka maqāṣid al-syarī‘ah, yakni tujuan-tujuan pokok dari hukum Islam yang mencakup lima aspek utama hifẓ al-dīn (menjaga agama), hifẓ al-nafs (menjaga jiwa), hifẓ al-‘aql (menjaga akal), hifẓ al-nasl (menjaga keturunan), dan hifẓ al-māl (menjaga harta). Dengan demikian, masa iddah merupakan wujud nyata dari kebijaksanaan syariat yang bertujuan menjaga kemaslahatan umat manusia.

Abstract

The discovery of Islamic law is an epistemological process that involves the interaction between divine revelation and human reasoning in responding to legal challenges. This study examines three primary approaches in the philosophy of Islamic legal discovery: the Bayani theory, the Ta‘līl theory, and the Istislāḥī theory. The Bayani theory relies on the authority of textual language and its linguistic structure as the foundation of legal derivation. The Ta‘līl theory emphasizes the identification of the ‘illah (effective cause) as the rational basis behind legal rulings. Meanwhile, the Istislāḥī theory is oriented toward achieving public interest (maṣlaḥah) and the objectives of Islamic law (maqāṣid al-sharī‘ah) in formulating context-sensitive legal norms. This research employs a qualitative approach through literature analysis of classical works such as Al-Risālah, Al-Mustasfā, and Al-Muwāfaqāt, complemented by contemporary scholarship including Hashim Kamali, Wael B. Hallaq, and Jasser Auda. The findings suggest that these three theories are not mutually exclusive; rather, they complement one another in forming a comprehensive methodology of legal discovery. In today’s context, the integration of these approaches is essential to generate legal reasoning that is both responsive to socio-legal realities and firmly rooted in the principles of Islamic law. Thus, the philosophy of legal discovery in Islam offers a framework that is not only textual and rational, but also transformative in addressing the demands of modern times.

Abstract

This paper examines the definition, urgency, and historical growth and development of Islamic legal philosophy as a philosophical approach to Islamic law. Islamic legal philosophy is defined as a discipline that critically understands rules derived from the Qur'an and Hadith to address various human life issues, by exploring the deeper meaning of why a law is established, its objectives, and how it reflects values of justice, mercy, and public welfare in society. The purpose of this study is to thoroughly examine the definition, urgency, and historical growth and development of Islamic legal philosophy as an integral approach to understanding and developing Islamic law contextually, rationally, and humanistically. The methodology employed in this paper is a literature review, analyzing various scholarly works and the thoughts of Muslim scholars and philosophers on Islamic legal philosophy from classical to contemporary periods. The results indicate that Islamic legal philosophy holds high urgency in the development of Islamic legal studies, both in academic and social practical contexts, due to its ability to address challenges of legal contextualization, strengthen the objectives and values of Islamic law, expand ijtihad methodology, respond to modern criticisms, uncover the secrets of Sharia, analytically understand legal causes ('illat), and distinguish between static and dynamic elements in law. This research contributes to the discipline of Islamic law by providing a complete, in-depth, and perpetually relevant understanding (sholih kulli zaman wa al-makan) , and by serving as a bridge between normative texts and the dynamic realities of society.

Abstract

This study aims to explore the legislative function of the sahabah (companions of the Prophet), the authority of fatwa, the use of legal sources, and the long-term impact on the structure of Islamic law during the Khulafā’ al-Rāsyidīn period. Employing a qualitative, normative-juridical approach through library research, the analysis is based on primary and secondary sources such as the Qur’an, Hadith, classical Islamic legal texts, and relevant scholarly articles. The findings reveal that the collective ijtihad and fatwa practices of the sahabah were innovative responses to unprecedented legal challenges following the Prophet’s death, ensuring the continuity and adaptability of Islamic law in a rapidly changing socio-political landscape. The research highlights the pivotal role of collective authority and consultation (shura) in the legislative process, which laid the groundwork for the emergence of Islamic legal schools (mazhab). This study’s novelty lies in its comprehensive analysis of the collective dimension of fatwa authority and its long-term influence on Islamic legal structures, which has been underexplored in normative literature. The results suggest that the adaptive model of legislation and fatwa from this era can inform contemporary Islamic legal reforms, and further research is recommended to deepen understanding of shura mechanisms and fatwa authority as models for modern Islamic jurisprudence.
