Abstract

Poligami merupakan salah satu persoalan paling kontroversial dalam hukum keluarga Islam. Al-Qur’an (QS. An-Nisā’: 3) memperbolehkan laki-laki menikahi hingga empat istri dengan syarat berlaku adil. Secara historis, ayat ini dipahami sebagai keringanan (rukhsah) dan solusi sosial pada masa awal Islam untuk melindungi janda dan anak yatim pasca peperangan. Namun, idealitas syariat yang menekankan keadilan dan kemaslahatan sering sulit diwujudkan dalam realitas modern. Di satu sisi, poligami dianggap sebagai ketentuan ilahi dengan hikmah menjaga keturunan, mencegah zina, dan memberi perlindungan bagi perempuan. Di sisi lain, praktik poligami kontemporer kerap menimbulkan persoalan psikologis, ekonomi, hukum, serta isu kesetaraan gender dan HAM. Penelitian ini menggunakan metode kualitatif dengan pendekatan normatif-teologis dan sosiologis. Data diperoleh dari literatur tafsir, hadis, fikih klasik, dan kajian kontemporer tentang hukum keluarga Islam serta gender. Analisis dilakukan secara deskriptif-analitis dengan menitikberatkan pada maqāṣid al-sharī‘ah, khususnya prinsip keadilan (‘adl) dan kemaslahatan (maṣlaḥah). Hasil penelitian menunjukkan bahwa poligami mengandung nilai luhur, tetapi implementasinya sangat bergantung pada kemampuan memenuhi syarat keadilan. Dalam konteks sekarang, poligami sering berbenturan dengan norma sosial, hukum nasional, dan wacana kesetaraan gender. Karena itu, poligami sebaiknya dipandang bukan sebagai kewajiban, melainkan sebagai pilihan terbatas dengan pertimbangan moral, spiritual, dan sosial yang matang.

Abstract

Pemikiran filosofis hukum Islam menghadapi tantangan baru seiring perubahan sosial, teknologi, dan budaya yang sangat cepat, sehingga memerlukan kerangka rekonstruksi yang lebih responsif dan multidisipliner. Penelitian ini bertujuan merumuskan ulang dasar-dasar filosofis hukum Islam agar mampu beradaptasi dengan dinamika era kontemporer tanpa kehilangan integritas normatifnya. Penelitian ini menggunakan metode kualitatif dengan pendekatan analisis filosofis dan kajian literatur mendalam terhadap karya-karya klasik dan kontemporer. Hasil penelitian menunjukkan bahwa rekonstruksi hukum Islam memerlukan integrasi antara nilai-nilai maqāṣid al-syarī‘ah, rasionalitas etis, serta pemahaman kontekstual terhadap perubahan sosial. Selain itu, pendekatan multidisipliner terbukti penting untuk menjawab isu-isu aktual seperti digitalisasi, bioteknologi, dan pluralitas masyarakat modern. Penelitian ini juga menemukan bahwa pendekatan tekstual yang kaku tidak lagi memadai untuk menjelaskan fenomena baru, sehingga diperlukan model epistemologis yang lebih adaptif dan dialogis. Rekonstruksi pemikiran filosofis yang ditawarkan memberikan kerangka alternatif untuk memperluas daya jangkau hukum Islam dalam merespons tantangan global kontemporer. Kesimpulannya, penelitian ini menegaskan perlunya paradigma hukum Islam yang lebih inklusif, progresif, dan berorientasi pada kemaslahatan.

Abstract

This study examines the wisdom behind the establishment of worship in Islam through an interdisciplinary approach combining Islamic theology and jurisprudence, positioning worship not merely as ritual performance but as a multidimensional system enriched with rational, spiritual, and social values. The purpose of this research is to uncover the theological foundation of worship as an embodiment of monotheism and to analyze the jurisprudential framework that regulates worship through divinely mandated pillars, conditions, and procedures. Employing a qualitative-descriptive methodology, the study conducts textual analysis of the Qur’an, the Sunnah, and classical works such as those of al-Ghazālī, al-Nawawī, and Ibn Taymiyyah, along with contemporary scholarship including Wahbah al-Zuḥaylī, Yūsuf al-Qaraḍāwī, and Ṭāhir ibn ‘Āsyūr. The findings reveal that worship serves dual functions: as a spiritual purification process fostering divine consciousness, and as a system of public welfare promoting justice, solidarity, and moral formation within society. This research contributes to the discourse of Islamic theology and jurisprudence by integrating maqāṣid al-sharī‘ah as an analytical framework, enabling worship to be understood not merely as a legal obligation but as a transformative structure capable of shaping both inner spirituality and social ethics in contemporary life.

Abstract

Philosophical studies, particularly in Islamic legal philosophy, continue to generate dynamic intellectual discourse among scholars of Islamic law. One significant area of inquiry concerns the relationship between the philosophy of sharia (falsafah al-sharī‘ah) and the philosophy of legislation (falsafah al-tashrī‘). The urgency of distinguishing and understanding the points of convergence between these two concepts becomes increasingly evident when Islamic law is confronted with contemporary challenges. This study focuses on two main objectives: (1) comparing the scope, objects, and approaches of falsafah al-sharī‘ah and falsafah al-tashrī‘; and (2) providing a clear conceptual framework to prevent overlap and terminological confusion between these two concepts in the study of Islamic legal philosophy. This research employs a qualitative library-based method using normative-theological and conceptual-comparative approaches. Data were collected from classical and contemporary Islamic legal literature and analyzed using descriptive-analytical techniques. The findings indicate that falsafah al-sharī‘ah is oriented toward legal values, objectives, and wisdom (maqāṣid), whereas falsafah al-tashrī‘ focuses on the legislative process and the methodology of legal formulation. Both intersect within the domains of maqāṣid al-sharī‘ah and uṣūl al-fiqh, which function as a bridge between ideal values and the normative formulation of Islamic law. This study contributes conceptually to clarifying the epistemological foundations of Islamic legal philosophy and its relevance to the development of contemporary Islamic law.

Abstract

Human welfare encompasses personal well-being, social and communal interests, as well as national benefit. When a government aspires to build a strong nation and ensure a safe, peaceful, and orderly society, it must prioritize public interest over individual benefit. Likewise, individuals and communities seeking a harmonious and tranquil life should emphasize actions that generate greater collective benefit. Sharia, as a divinely ordered system of law, functions as a comprehensive guide for human life, aiming to realize welfare at both personal and social levels. In relation to the values ​​of maslahah embedded in the commands of worship, Islamic law affirms that all divine prescriptions are inherently beneficial and free from harm, even when they may appear unfavorable from a human perspective. Furthermore, the pursuit of benefit in safeguarding religion, life, intellect, lineage, and property constitutes a fundamental obligation within Islamic legal thought. These essentials, classified by Islamic scholars as indispensable necessities (darūriyyāt), if neglected, would result in severe harm to worldly and spiritual life, ultimately undermining human happiness, peace, and social stability.
