Abstract

This study explores the relevance of textual and living Hadith approaches in Indonesia, focusing on the methods employed and their contributions to a contextual and applicable understanding of Hadith. The textual approach emphasizes a literal and scriptural interpretation of Hadith, while the living Hadith approach highlights the application and practice of Hadith in the daily lives of Muslim communities. Through a qualitative analysis utilizing historical and philosophical perspectives on various religious studies and practices in Indonesia, this article demonstrates that both approaches are complementary in enriching Islamic insight and enhancing the contextual understanding of Hadith within local settings. The findings indicate that textual studies concentrate on deriving meaning from Hadith texts based on established interpretive principles, whereas living Hadith studies investigate community practices shaped by their understanding of these texts. Living Hadith reflects an acculturation between Hadith and local culture, necessitating an interdisciplinary approach, particularly from the social sciences, to fully grasp Hadith phenomena in the Indonesian context.

Abstract

According to Act No. 23 of 2004, marital rape is mentioned as a variant of domestic violence. However, it still considered by some people as a reasonable action and often legitimized by religious arguments. In turn, this diversity of perception generates the contradiction between the implemented positive law and Islamic law. Through a comparative approach, this paper attempts to find the perspective of Islamic law on this critical issue by way of collecting as many Qur’ānic verses and prophetic hadith as possible, as well as the developed argumentations around it, and analyzing them accordingly in light of maqāṣid al-syarī’ah. At the end, this paper discovers that the practice of marital rape is unlawful according to Islamic law. Therefore, it can serve as a reason for divorce.Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga (PKDRT) mengategorikan marital rape sebagai salah satu varian tindak kejahatan kekerasan dalam rumah tangga. Namun dalam tataran tertentu, marital rape masih dinilai sebagai tindakan wajar dan tak jarang dilegitimasi dengan dalil-dalil agama. Perbedaan persepsi ini telah menimbulkan kontradiksi antara hukum positif yang berlaku dengan hukum Islam yang dipahami masyarakat. Secara komparatif, tulisan ini berusaha menemukan perpektif hukum Islam dalam memandang persoalan marital rape dengan cara menghimpun sebanyak mungkin ayat Alqurān dan hadis serta argumen-argumen di sekitarnya, dan menganalisisnya dalam konteks maqāṣid al-syarī’ah. Di akhir penelitian ditemukan bahwa marital rape merupakan sesuatu yang bertentangan dengan syariat Islam. Oleh karena itu dapat dijadikan sebagai alasan perceraian.

Abstract

This paper aims to explore aspects of the legitimacy of limiting the age of marriage from the perspective of maqâshid al-syarî'ah. Early marriage is regarded as highly common ini Indonesia. According to data for 2020, 1 in 9 or almost 11% of Indonesian girls get married before becoming 18 years old. Through Law Number 16 of 2019 about Amendments to Law Number 1 of 1974 about Marriage, the government is trying to suppress the practice of early marriage  through limiting the age of marriage to 19 years. Research methods are qualitative-explanative method, this paper attempts to analyze the texts and doctrines of fiqh scholars relating to the age of marriage and relate them to the purpose of marriage through the point of view of maqâshid al-syarî'ah. Through this method, it has been discovered that that marriage is a noble Islamic law and the only institution that legalizes sexual relations as a primary need (daruri) for human being in order to realize the maintenance of religion (hifzh al-dîn) through the avoidance of the practice of adultery, as well as maintaining the sustainability of mankind (hifzh al-nasl). Considering that marriage is closely related to responsibilities, it can be concluded that arrangement 19 years as the ideal age for marriage is considered to be in line with the maqâshid of marriage. Carrying out underage marriages will cause mafsadah, because it has negatives effect on health, fertility and causes bad social impacts so that maqâshid marriage cannot be realized.

Abstract

The term bid'ah has been hotly discussed in recent years. The diversity of views of scholars and the diversity of definitions are hot issues to be studied. Few are antipathy to this study, which sometimes leads to friction and disputes in the Muslim community. Imam Ahmad has a unique concept and is considered firm in determining the heresy of one case. This article focuses on examining the concept of Imam Ahmad's bid'ah and applying it to solving contemporary problems. Many expressions of sunnah, sunnah clerics (ulama), sunnah mosques, and sunnah studies have been expressed in recent years. Two good words sometimes create discomfort in the community and leave an impression. Others not labeled as sunnah are not part of the sunnah. This literature research uses the method of textual criticism of classical references that contain Ahmad's views. Globally there are two findings in this article; First, heresy, according to Imam Ahmad, only produces two taklify laws, namely haram or makhruh. Second, cleric, mosque, and sunnah studies can also be categorized as bid'ah, which is judged makruh.

Abstract

Religious radicalism often arises from rigid and literalist interpretations of Islamic sources that overlook the Prophetic values of mercy (rahmah), facilitation (taysir), and moderation. This article revisits the hadith "Yassiru wa la tuassiru, bashshiru wa la tunaffiru" ("Make things easy and do not make them difficult; give glad tidings and do not drive people away") as a normative and strategic framework for religious deradicalization in Indonesia. Using qualitative library research, the study examines the hadith through takhrij, sanad and matn analysis, asbab al-wurud, and classical and contemporary commentaries. The findings show that facilitation (taysir), encouragement (tabshir), and avoiding deterrence (tanfir) form a coherent paradigm to counter extremism by promoting inclusive, tolerant, and humanistic religiosity. Applied in education, dawah, and public policy, this Prophetic ethic strengthens religious moderation, prevents radicalization, and supports social harmony.

Abstract

Islam sebagai agama universal memiliki kemampuan akulturatif dalam merespons realitas sosial dan budaya masyarakat tempat ia berkembang. Dalam proses tersebut, Islam tidak bersifat destruktif terhadap kearifan lokal, melainkan membangun relasi dinamis melalui adopsi, adaptasi, dan koreksi terhadap tradisi yang sejalan atau bertentangan dengan nilai-nilai Islam yang fundamental. Tradisi lisan basiacuong pada masyarakat Limo Koto Kampar, Provinsi Riau, merupakan salah satu bentuk kearifan lokal yang merepresentasikan proses akulturasi tersebut melalui internalisasi nilai-nilai Islami dalam praktik sosial. Penelitian ini bertujuan untuk menganalisis pelaksanaan dan pemaknaan tradisi basiacuong dalam kehidupan masyarakat Limo Koto Kampar sebagai ekspresi living Qur’an–Hadis. Penelitian ini menggunakan pendekatan kualitatif melalui penelitian lapangan (field research) dengan teknik pengumpulan data berupa wawancara mendalam terhadap pemangku adat, tokoh agama, dan masyarakat yang terlibat dalam pelaksanaan basiacuong, disertai observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa tradisi basiacuong merupakan manifestasi akulturasi Islam dan budaya lokal yang mengandung nilai-nilai pendidikan Islam, khususnya nilai demokrasi, etika sosial, dan toleransi, yang hidup dan dipraktikkan secara berkelanjutan dalam struktur sosial masyarakat Limo Koto Kampar
