Abstract

Article 74 of Law Number 40 of 2007 concerning Limited Liability Companies establishes social and environmental responsibilities for companies operating in or related to natural resources. Companies based on information and technology must also be accompanied by changes in legal norms, especially in the field of implementing environmental social responsibility. According to Law Number 40 of 2007 concerning Limited Liability Companies, only companies whose business activities are related to natural resources or businesses that impact the environment are subject to environmental social responsibility, while IT startups and digital businesses do not disturb natural resources and do not affect the environment. Changes in society are indeed followed by changes in legal norms. The older a law gets, the more weaknesses and shortcomings it will have. Changes in norms governing environmental social responsibility must be adjusted to the current business climate. Environmental Social Responsibility should also be mandated for companies operating in the digital business sector. To maximize environmental social responsibility for large companies operating in the digital business sector, it must be supported by adequate legal norms.

Abstract

Lembaga perkawinan merupakan lembaga yang mengesahkan hubungan antara seorang laki-laki dengan seorang wanita dalam sebuah perkawinan. Tujuan perkawinan adalah untuk membentuk rumah tangga yang bahagia lahir dan batin. Namun tidak selamanya tujuan perkawinan ini. Dalam berbagai tindak pidana klekerasan dalam rumah tangga terdapat bentuk-bentuk tindak kekerasan, yang meliputi: Kekerasan fisik,Kekerasan psikis, Kekerasan seksual, Penelantaran rumah tangga. Tim Pengabdian Kepada Masyarakat dapat memberikan solusi terhadap masalah-masalah yang dihadapi oleh masyarakat dalam hal perlindungan terhadap kekerasan didalam rumah tangga. Faktor Penyebab Kekerasan Dalam Rumah Tangga.Dalam berbagai perkara kekersan dalam rumah tangga, faktor penyebab nya adalah ekonomi dan perkembangan teknologi, apakah dalam hal ini media sosisal dan tontonan.

Abstract

Permasalahan Hak Kekayaan Intelektual (HKI) saat ini semakin rumit karena sistem HKI semakin berkembang, yang membutuhkan pemahaman mendalam tentang HKI. Pada akhirnya, masalah HKI memengaruhi ekonomi, sosial, budaya, dan hukum di dalam dan di luar negeri. Terlepas dari fakta bahwa Indonesia memiliki undang-undang yang mengatur Hak atas Kekayaan Intelektual (HAKI), implementasi dan penegakan hukumnya sangat menantang. Salah satu masalah utamanya adalah masyarakat tidak memahami dan menyadari pentingnya HAKI dan konsekuensi negatif melanggarnya. Banyak pelaku usaha, terutama usaha kecil dan menengah, tidak menyadari bahwa melanggar HAKI dapat merugikan pemegang hak dan pencipta dan menghambat inovasi. Selain itu, penegakan hukum seringkali tidak efisien dan terkendala oleh biaya yang tinggi dan proses hukum yang lamban. Aparat penegak hukum terdiri dari hakim, jaksa, dan kepolisian yang ditugaskan oleh negara untuk menjalankan undang-undang, serta pengacara yang menjalankan undang-undang berdasarkan kepentingan klien mereka. Sudah jelas bagi masyarakat bahwa mereka mengharapkan penegakan hukum yang adil yang didasarkan pada prinsip-prinsip undang-undang dari semua aspek yang ada.

Abstract

This study aimed to analyze the effect of Sharia financial literacy, Sharia compliance, technology accessibility, and Islamic leadership on the performance of MSMEs in Riau – Indonesia, with the mediation of Sharia Financial Technology Adoption and the moderation of government regulations. This research employed a quantitative study approach using a survey methodology. The sample consisted of 500 MSMEs in Riau that had used services from Sharia financial institutions and had been operating for at least one year. The analytical technique employed was Structural Equation Modeling (SEM) with the assistance of SmartPLS 4 software. The results showed that Sharia financial literacy, technological accessibility, and Islamic leadership had a significant effect on Sharia financial technology adoption and MSME Business performance. Furthermore, Sharia fintech adoption significantly mediated the effect of these three variables on the performance of MSMEs. Conversely, the effect of Sharia compliance on Sharia financial technology adoption and MSME performance was not significant, nor was the moderating effect of government regulations, which failed to strengthen the relationship between Sharia financial technology adoption and MSME business performance.

Abstract

This article examines the prospects and challenges of Islamic insurance for the Indonesian economy. The concept of Islamic insurance stems from differing views on conventional insurance, which lacks religious consultation. The growing demand for Islamic insurance (takaful) is supported by the majority of the Muslim population. However, Islamic insurance faces numerous challenges in its implementation. Islamic insurance is also believed to have excellent prospects for supporting the Indonesian economy. This paper aims to determine the prospects and challenges facing Islamic insurance in supporting the Indonesian economy. This research uses conceptual and legislative approaches. The paper concludes that the challenge facing Islamic insurance for the Indonesian economy is public non-compliance with Islamic insurance regulations and principles, which gives rise to legal issues within the community. The relatively new nature of Islamic insurance has led to a lack of reliable resources compared to conventional insurance institutions, which are far more experienced and possess reliable human resources. The potential of Islamic insurance for economic progress in Indonesia lies in its role as a non-financial institution for the community, functioning as a risk transfer agent. Most of the premium funds are invested through Sharia-compliant banks, which are useful in supporting the provision of capital for entrepreneurs, thereby helping people improve their standard of living and contributing to Indonesia's economic progress.

Abstract

The issuance of the decision of the Constitutional Court Number 18/PUU-XVII/2019 on January 6, 2020, caused a change in the execution pattern of Fiduciary Guarantee objects. The issuance of this Constitutional Court decision was not accompanied by creating a new norm regarding the execution pattern of Fiduciary Guarantee objects. It brings legal uncertainty and ambiguity in executing Fiduciary Guarantee objects. Therefore, the statements of the problem in this paper are how is the pattern of execution after the issuance of the Constitutional Court Decision Number 18/PUU-XVII/2019? And how is the existence of new norms after the Constitutional Court Decision Number 18/PUU-XVII/2019? The research method used is the normative legal research method. The pattern of execution of Fiduciary Guarantee objects after the issuance of the Constitutional Court Decision Number 18/PUU-XVII/2019 experienced ambiguity and obscurity because the contents of the Constitutional Court's decision were only general norms. The existence of new norms after the Constitutional Court Decision Number 18/PUU-XVII/2019 is necessary to support legal certainty in executing objects of Fiduciary Guarantee.

Abstract

Hukum Agraria mengatur tentang Penguasaan Hak atas Tanah. Hak atas tanah merupakan salah satu aspek yang paling fundamental dalam kehidupan masyarakat Indonesia. Tanah bukan hanya sekadar aset ekonomi, melainkan juga memiliki dimensi sosial, budaya, politik, dan spiritual. Salah satu bentuk hak atas tanah yang diatur dalam sistem hukum agraria Indonesia adalah Hak Guna Usaha (HGU) yang diatur dalam UU No 5 Tahun 1960 tentang Pokok-Pokok Agraria ( UUPA). Di sisi lain, kawasan hutan mempunyai rezim hukum tersendiri. Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan. Persoalan menjadi semakin kompleks karena terdapat penerbitan  (HGU) di atas kawasan hutan produksi. Tumpang tindih hak atas tanah (HGU) di kawasan hutan produksi terjadi karena adanya dualisme kewenangan administrasi antara Badan Pertanahan Nasional dan Kementerian Kehutanan. Hal ini mengakibatkan ketidakpastian hukum dan berpotensi mengurangi perlindungan bagi pemegang hak atas tanah di kawasan hutan. Adapun tujuan dari Pengabdian ini untuk meningkatkan pengetahuan masyarakat Kampung Tumang mengenai hukum Agraria. Pelaksanaan pengabdian ini dilakukan di Kantor Kepenghuluan Tumang, Siak dengan metode diskusi dan pemaparan materi secara langsung oleh Narasumber kepada para peserta. Hasil kegiatan menunjukkan masyarakat dapat menumbuhkan rasa kesadaran hukum serta karakter budaya hukum dalam perspektif agraria yang berhubungan dengan hak atas tanah.

Abstract

This paper explores the legal and environmental injustices faced by the indigenous Malay communities in Riau, particularly the land dispossession caused by the expansion of logging and palm oil plantations. Over the past few decades, Riau has witnessed rapid deforestation and large-scale land conversions that have displaced indigenous Malay populations from their ancestral territories. The study critically examines the legal battles these communities face in securing land rights, focusing on the inadequacies of Indonesian land laws, such as the 1999 Forestry Law, which has facilitated the encroachment of corporate interests into indigenous territories. Through a combination of legal analysis, case studies, and interviews with affected communities, the paper explores how the legal system has systematically failed to protect indigenous land rights. The study highlights how land dispossession not only leads to environmental degradation but also to the loss of cultural identity and economic livelihoods for the Malay people. The paper also critiques the role of government institutions in enabling land grabbing and corporate encroachment, and it identifies gaps in Indonesia's land tenure system. The findings underscore the need for stronger legal protections for indigenous land rights and propose reforms to the 1999 Forestry Law, advocating for clearer recognition of customary land rights and more inclusive policies for indigenous communities.

Abstract

Gender inequality remains a significant issue in Indonesian sports, particularly in leadership positions, where women continue to face systemic barriers to entry and advancement. This paper explores the gender gaps in sports leadership, analyzing the factors that contribute to the underrepresentation of women in decision-making roles within sports organizations, federations, and government bodies. The study highlights how gender biases, cultural norms, and limited opportunities for professional development hinder women's participation in sports governance. Through qualitative interviews with female athletes, coaches, and sports administrators, the paper identifies both institutional and societal barriers to gender equality in sports leadership. It concludes by proposing strategies for fostering a more inclusive sports system, including mentorship programs, gender quotas, and policy reforms aimed at promoting women's leadership in Indonesian sports.

Abstract

This paper explores the legal and ethical dimensions of the palm oil industry in Indonesia, focusing on the economic justice issues faced by indigenous communities whose land rights are undermined by palm oil plantations. Indonesia is one of the world’s largest producers of palm oil, but the expansion of palm oil plantations has led to significant environmental degradation and land dispossession, particularly among indigenous populations. The study examines the legal frameworks surrounding land rights in Indonesia, evaluating how existing laws either protect or undermine indigenous land claims in the context of industrial development. It also considers the role of multinational corporations in perpetuating land conflicts, using case studies from regions like Papua and Kalimantan where indigenous groups have faced displacement in favor of palm oil production. The paper critically analyzes the ethical implications of palm oil production, particularly regarding the balance between economic growth and the preservation of indigenous rights and livelihoods. Drawing on legal, environmental, and human rights perspectives, the paper argues that Indonesia’s palm oil industry, while driving economic growth, does so at the expense of social justice and sustainability. The study concludes with policy recommendations aimed at improving the legal protections for indigenous land rights, promoting ethical palm oil production, and fostering more sustainable and just economic development.
