Abstract

One form of democracy's embodiment is through general elections. The Philippines and Indonesia are two countries in the Southeast Asian region that are currently still developing their democratic practices through general elections. This study aims to compare how the general elections have been enforced in the two countries to obtain input on the implementation of democracy in Indonesia. The normative legal research design was used in this study, and data collection was carried out through a literature study. The functional comparative approach compares the implementation of general elections in the two countries. The data collected by literature searches were analyzed using a qualitative juridical analysis method. The analysis shows that although the two countries have declared themselves democracies and the general election is the form of their implementation in the constitution, general elections have been used to perpetuate power in both countries. The two countries have differences in implementing general elections due to historical differences and national problems. The most distinguishing matter that can be learned is how the Philippines implemented the general election through the existence of a plebiscite that makes the people more involved in the state process. In addition, information technology in the Philippines' general election has also made the process of conducting the general elections effective and efficient. This study is still limited to analyzing general elections at the national level, especially the presidential and vice-presidential elections. Further research on the general elections of legislature members and regional heads can add to our understanding of the comparative implementation of the two countries.

Abstract

The enactment of Law Number 30 of 2014 concerning Government Administration, it certainly provides clear directions regarding the implementation of governance, encompassing the acquisition and exercise of authority, as well as prohibitions against the misuse of authority. The distribution of authority, finances, utilization of natural resources, and other resources are conducted fairly and harmoniously between the central government and regional governments. Similarly, the arrangement of authority distribution in the management of marine natural resources stipulates that the management of marine natural resources from the coastline up to a distance of 12 nautical miles beyond oil and natural gas falls under the jurisdiction of provincial regional governments. However, up to this point, the collection of fees for utilization remains under the control of the central government through technical implementation units in the region. This research employs a juridical-empirical method with a legislative approach, analyzing its effectiveness based on its implementation within the province of Riau Islands. The study is conducted using a qualitative method and described in a descriptive manner. The research findings indicate that the regional government does not benefit from the management of marine natural resources in the port sector, particularly concerning the collection aspects of the utilization of marine natural resources within the 0 to 12 nautical miles in the regional government's territory.

Abstract

This research generally aims to determine the role of the Batam Concession Agency and the strategy of the Batam Concession Agency in managing land related to the existence of idle land. The research method used in this research is the normative juridical research method, namely a research method whose main data is obtained from statutory regulations. Based on the research results obtained and analyzed by land researchers in Batam City, it is regulated based on PERKA No. 3 of 2020 concerning the Implementation of Land Allocation, Land Rights in Batam City are divided into two, namely, HGB for 30 years and can be extended for 25 years, and Right to Use for 25 years and can be extended for 20 years, both rights can be renewed according to their interests . The position of the land agreement in Batam City is a product issued by BP Batam. The land agreement is made based on the request of the beneficiary of the Right to Get the approval from the head of BP Batam. Regarding idle land in the city of Batam, it is divided into two, land that has not yet completed administration and idle land that has completed administration but has not been utilized properly.

Abstract

Indonesian Migrant Workers refer to any citizen who is currently or has engaged in employment beyond the borders of Indonesia, receiving wages or compensation. The prevalent issue at hand is the rising number of Indonesian Migrant Workers operating illegally, driven by individuals offering unofficial services with enticing proposals to the public. This study employs a normative legal research approach, utilizing secondary data that encompasses primary legal materials such as Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, secondary legal materials including articles, news, and other literature, as well as tertiary legal materials. Indonesia actively takes part in addressing the concerns of Indonesian Migrant Workers by enacting Law Number 18 of 2017 to ensure the fulfillment of their rights and legal protection, including criminal provisions against wrongdoers. Efforts to address this issue involve public awareness campaigns and legal measures against those engaging in criminal activities.

Abstract

AbstractThe development of information and technology has brought the economy to a new stage known as e-commerce. The presence of e-commerce also presents a new problem in society, namely the presence of a disclaimer. To examine these problems, this research uses normative legal research methods. This research shows that the disclaimer is a form of standard clause. As a form of e-commerce consumer protection, the standard clause must comply with the provisions regarding standard clauses as stipulated in statutory regulations. In Indonesia, e-commerce is regulated in Law No. 19 of 2016 concerning Electronic Information and Transactions. So, the implementation of the disclaimer in e-commerce transactions must be adjusted to the existing laws in Indonesia. Keywords: E-Commerce; Disclaimer; Consumer Legal Protection.

Abstract

Industri perbankan memainkan peran kunci dalam ekonomi Indonesia dengan fokus pada stabilitas dan keamanan sistem keuangan nasional, untuk mewujudkan sektor perbankan yang sehat. Terbagi menjadi bank konvensional dan bank syariah,definisi bank syariah berdasarkan Undang-Undang Perbankan Syariah adalah bank yang beroperasi berdasarkan prinsip syariah. Saat ini, bank syariah juga menyediakan berbagai pilihan distribusi dana, termasuk melalui pembiayaan istiṣnâ`. Istiṣnâ` adalah kontrak pembiayaan objek dalam bentuk pemesanan dan pembuatan, sesuai dengan syarat dan ketentuan yang disepakati antara pembeli (mustaṣni`) dan penjual (ṣâni`). Penelitian ini bertujuan untuk menganalisis konsep kontrak istiṣnâ` di Indonesia dan menganalisis risiko bank syariah dalam implementasi kontrak istiṣnâ` paralel dalam industri perbankan syariah Indonesia. Metode penelitian yang digunakan adalah normatif yuridis dengan studi literatur untuk menganalisis doktrin dan nilai yang berlaku. Hasil penelitian menunjukkan bahwa konsep kontrak istiṣnâ` dalam industri Perbankan Syariah di Indonesia sesuai dengan prinsip Hukum Islam. Namun, implementasi kontrak istiṣnâ` paralel dalam industri perbankan syariah memiliki risiko pembiayaan yang signifikan. Oleh karena itu, Indonesia melalui otoritas keuangan dan lembaga yudisial perlu konsisten menerapkan dan mengawasi implementasi kontrak istiṣnâ` dalam industri perbankan syariah, untuk mendukung pertumbuhan ekonomi nasional yang sejahtera dan berkelanjutan.

Abstract

The growth of peer-to-peer lending requires robust legal regulations to protect stakeholder rights and facilitate continued economic development in Indonesia through enhanced access to funding. This article seeks to analyze the legal developments surrounding peer-to-peer lending in Indonesia, Singapore, and Australia. Utilizing a doctrinal legal research methodology with a comparative approach, the findings reveal that Singapore and Australia can effectively leverage existing regulations without the need to create new ones, thereby mitigating the risk of legal dissonance. In contrast, while Indonesia has implemented specific regulations for peer-to-peer lending, it has not provided sufficient normative legal protection within this sector and has failed to safeguard the rights guaranteed by those regulations. These findings suggest that a specific regulatory approach may not be the most effective strategy for Indonesia's legal development, thereby contributing to the ongoing discourse surrounding legal advancements in the fintech industry.How to CiteViona Puspita et. al. Abstract

Abstrak Hakim sebagai orang yang mengadili perkara di pengadilan. Tugas dan fungsinya seorang hakim haruslah selaras dengan aturan hukum serta berdampingan dengan asas-asas seorang hakim dan agar tidak mempengaruhi tingkat kebebasan hakim dituntut tidak memihak dalam proses pemeriksaan di persidangan. Adapun tujuan penelitian ini adalah untuk mengetahui apakah kewenangan hakim dalam menetapkan tersangka telah berlandaskan kepada Peraturan Perundang – Undangan dan Asas-asas hukum. Berdasarkan tujuan tersebut yang menjadi rumusan masalah ialah apa menjadi dasar kewenangan hakim dalam menetapkan tersangka pelaku tindak pidana kehutanan? bagaimana harmonisasi hukum di Indonesia terhadap kewenangan hakim dalam menetapkan tersangka pelaku tindak pidana kehutanan?. Dalam penelitian ini menggunakan metode pendekatan penelitian yuridis Normatif. Data yang digunakan data sekunder. Hasil penelitian Kewenangan hakim dalam menetapkan status tersangka merujuk pada Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan Dan Pemberantasan Perusakan Hutan, Pasal 36. Terhadap kewenangan hakim dalam penetapan tersangka terjadi disharmonisasi hukum yaitu berkaitan dengan asas hakim yang menganut asas praduga tidak bersalah. Berdasarkan Teori Cita Hukum Gustav Radbruch, dapat disimpulkan kewenangan penetapan oleh Hakim tidak memberikan kepastian hukum, kemanfaatan dan keadilan pada setiap individu terkhusus tindak pidana perusakan hutan.

Abstract

Startups play an important role in the digital economy by bringing innovation and growth. Intellectual property can be in the form of copyrights, patents, trade secrets and trademarks owned by a startup business. However, the protection of intellectual property, especially copyrights and trade secrets, still faces major challenges. This article examines the legal lacuna in intellectual property protection, particularly regarding the relationship between startups and freelancers who often contribute valuable ideas and works. Using Philipus M. Hadjon's theory of legal protection and Gustav Radbruch's theory of legal certainty, this article highlights the need for stricter regulation to address the legal vacuum. Reforms are needed to improve trade secret protection and ensure better legal certainty. The conclusion suggests that strengthening intellectual property regulations will support the sustainability and competitiveness of startups, as well as protect their innovative assets in a competitive digital environment.
