Abstract

Waqf is considered a recommended act of worship in Islamic teachings and reflects the devotion of individuals. To safeguard the community's interests, the state has established a legal framework concerning Waqf through Law Number 41 of 2004. According to this law, waqf pledges are no longer limited to verbal declarations but must be recorded in written form through an official waqf pledge deed. Furthermore, the law emphasizes the need for productive waqf management. In East Tanjungpinang District of Tanjungpinang City, the quantity and size of waqf land surpass those of other districts within the city. This presents an intriguing opportunity to investigate the effectiveness of productive waqf land management in this District based on Law No. 41 of 2004 on Waqf. The research takes an empirical juridical approach, aiming to assess effectiveness and identify constraints encountered in the implementation of the Waqf Law in East Tanjungpinang District. Data for the study was collected from various sources, including books, journals, relevant documents (secondary data), and interviews conducted with stakeholders involved in waqf management (primary data). The findings of the study demonstrate that waqf implementation in East Tanjungpinang District aligns with Islamic teachings and Law No. 41 of 2004 concerning Waqf. However, several obstacles hinder its effective implementation, including law enforcement, infrastructure, community, and cultural factors.

Abstract

Verdict of Indonesian Constitutional Court No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015 raises the new values in the expiration claims in the field of labor. This study aims to reveal the description of the new values that applicate at the dogmatic level related to the expiration claims after the Indonesian Constitutional Court Verdict No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015 on the corporate perspective. This study uses normative juridical research, by analyzing secondary data obtained, including related legislation and court Verdicts. The results of this study are: there still found inconsistencies in the level of implementation of the cases which related to the expiration claim in the labor law, that causes legal uncertainty. This inconsistency is influenced by the philosophical basis used by the Indonesian Constitutional Court to decide the Indonesian Constitutional Court's Verdict No. 100 / PUU-X / 2012 and No. 114 / PUU-XIII / 2015. It is necessary and immediate to change the law related to the regulation of the expiration claims in the field of labor that prioritizing the principle of the good faith to see the interests of all parties in employment.

Abstract

Introduction: Technological developments have an impact on today's business world, which is buying and selling activities carried out through Instagram.Purposes of the Research: The purpose of this study is to examine the perspective of civil law books regarding the phenomenon of buying and selling via Instagram and analyzing the best solution so that buying and selling activities via Instagram do not violate the law.Methods of the Research: The method in this study is normative juridical which uses a library approach. In answering the formulation of the problem, the juridical basis is used, namely the civil law code book and the theoretical basis, namely modern contract law theory.Results of the Research: Based on research results, buying and selling activities via Instagram are very difficult to fulfill the legal requirements of an agreement as stipulated in the civil law code. This has also led to many cases of law violations through Instagram. Therefore, it is necessary to apply the principle of good faith in the buying and selling process on Instagram.

Abstract

Marriage is a physical and emotional bond between a man and a woman that aims to build a happy, lasting family. Such a bond should be seen not only as a way of satisfying biological need, but also as the marriage’s purpose to produce offspring. This research aims to analyze the legal responsibility of the Head of the Religious Affairs Office (KUA) and the Penghulu in Sei Beduk Sub-district, Batam City, for same-sex marriage involving fake identities. Then, what is the legal status of such marriages, and what legal remedies can be pursued? This research uses a field study method with an empirical juridical approach. Primary data was obtained from the Head of KUA and Penghulu in Sei Beduk Sub-district, Batam City. Secondary data were obtained from relevant books, journal articles, theses, and dissertations. The data were collected through interviews and documentation and analyzed using a qualitative-inductive method. The results show that same-sex marriages are invalid in terms of religious norms, and do not fulfill the requirements of the applicable laws and regulations. In terms of culture and noble values that live in the soul of the Indonesian nation, similar marriages are also seen as contradictory. To demonstrate legal responsibility, the Head of KUA/Penghulu of Sei Beduk Subdistrict, Batam City, as an interested party, has applied to the Religious Court of Batam City for the annulment of the marriage after realizing that it was defective under Islamic law and national legislation. In the decision of the Batam City Religious Court No. 60/Pdt.G/2013/PA.Btm, the same-sex marriage that took place at the KUA of Sei Beduk Subdistrict, Batam City, was finally annulled, resulting in the status of the marriage being deemed nonexistent.

Abstract

This study explores the potential use of technological innovation in the transfer of receivables through cessie as a solution to the rising issue of non-performing loans in Indonesia’s financial sector. The research employs a normative juridical method, without quantitative data, relying entirely on legal literature and doctrinal analysis. Using statutory and case approaches, it analyzes the legal framework and case examples relevant to digital receivables transfer. The study specifically aims to examine (1) how fintech and blockchain contribute to the efficiency and transparency of cessie transactions, (2) how Indonesian regulations adapt to digital cessie mechanisms, and (3) the legal obstacles in implementing these technologies. The findings reveal that fintech enables faster, more accessible receivables trading, while blockchain provides secure, verifiable transaction records. However, implementation faces significant regulatory challenges, such as the absence of explicit legal recognition for electronic contracts and a lack of standardized digital procedures for debtor notification, as required by Article 613 of the Indonesian Civil Code. The study recommends regulatory reforms to legally recognize smart contracts and formalize digital notification procedures. Improving digital infrastructure and ensuring legal certainty will be essential to support the broader integration of digital cessie practices into Indonesia’s financial legal system

Abstract

Industri fashion yang semakin menjamur telah menuntut setiap pelaku usaha untuk memiliki nilai, inovasi, maupun ciri khas dalam menjalankan usahanya agar tetap eksis terutama dalam bentuk, konfigurasi atau komposisi garis atau warna atau gabungan di antaranya dengan tujuan memberikan kesan estetika dalam menghasilkan suatu produk atau barang. Tidak jarang dalam implementasinya terjadi hal plagiarisme terkhusus dalam pola atau desain, sehingga menyebabkan terjadinya kerugian baik materiil maupun immateriil. Penelitian ini bertujuan untuk menganalisa permasalahan terkait plagiarisme mode pakaian dalam ranah hukum Desain Industri di Indonesia. Metode penelitian yang digunakan adalah metode yuridis normatif. Hasil penelitian menunjukkan bahwa perlindungan Desain Industri terkait plagiarisme desain mode di Indonesia telah didasari oleh teori perlindungan hukum melalui dua cara, yakni perlindungan hukum preventif guna mencegah atau menghindari plagiarisme dan perlindungan hukum represif untuk mengadili pelaku plagiarisme dengan pemberian sanksi atau denda, di mana keduanya mengacu pada pemberlakuan Undang-Undang Nomor 31 Tahun 2000 tentang Desain Industri.

Abstract

Artificial Intelligence (AI) is one of the leading technologies that has begun to attract attention in the financial sector across various regions worldwide, including Southeast Asia. One potential application of AI is its ability to automatically detect specific data or situations within an electronic system, which can be utilized to identify money laundering activities. However, this cutting-edge technology may also result in certain unintended legal implications. The purpose of this study is to explore the potential and legal challenges in utilizing AI for the detection and prevention of money laundering. This research employs a normative legal research method to examine the legal implications of AI utilization in efforts to prevent and combat money laundering. The analysis reveals that significant normative issues persist regarding the legal certainty of AI applications in general, which poses complex challenges when coupled with specific legal implications, such as consumer protection and the safeguarding of privacy and data rights. This study proposes a legal development model that emphasizes balancing the efforts to prevent and combat money laundering with the rights of financial service users to maintain the integrity of the financial system.

Abstract

The aim of this research is first to analyze regulations regarding online loans, identify legal problems arising from online loans, and find an appropriate legal solution to resolving legal issues with online loans. The method used is normative juridical. The research results found that Indonesia already has written laws to regulate online loans, namely financial services authority regulations. However, this regulation is insufficient in resolving online lending legal problems. Normative inconsistencies, especially regarding capital sourcing regulations, Lack of technical clarity, such as in the implementation of lenders' general meetings, Heavy regulatory burdens for new market entrants (e.g., high equity requirements), Unregulated areas, including lender protection, AI/technology ethics, and secondary market mechanisms. Recommended Legal Solutions: 1) Clarification via OJK Circular Letters (SEOJK); 2) Issuance of Fintech Ethics & Technology Guidelines; 3) Establishment of Credit Risk Protection Schemes; 4) Progressive Evaluation and Stakeholder Dialogues; 5) Harmonization with Other Regulations and the P2SK Law.

Abstract

ABSTRACTThis research explores the legal safeguards provided to foreign workers (TKA) who possess certified professional expertise, and how their presence influences local labor (TKL) in Batam City, with a case study of two companies: PT VME and PT NSP Technology. The growing presence of foreign professionals in key positions has raised questions about the effectiveness of existing labor laws in ensuring fairness and protection for Indonesian workers. Using an empirical legal research method, the study relies on interview data and field observations. The analysis is framed by the Theory of Legal Benefit and the Theory of Legal Effectiveness. The results indicate that current regulations particularly the Job Creation Law and Government Regulation No. 34 of 2021 have yet to adequately limit the dominance of foreign workers. This ineffectiveness stems from company preferences for international labor standards, relaxed internal policies, and weak regulatory oversight. In light of these findings, the study suggests the need for firmer regulatory measures to control the number and positions of foreign employees while simultaneously enhancing the competitiveness of local workers through targeted training and skill certification aligned with industrial requirements.

Abstract

Kegiatan perbankan syariah tidak hanya mengejar profit semata, tetapi juga memiliki fungsi sosial di masyarakat yang direalisasikan dalam bentuk akad qarḍ atau pinjaman kebajikan di mana sumber dananya berasal dari zakat, infaq, sedekah, hibah, dan dana sosial lainnya sesuai Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001. Untuk memahami model akad qarḍ dan implementasinya berdasarkan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001 bagi Usaha Mikro Kecil dan Menengah (UMKM) sebagai pemegang fungsi yang sangat strategis bagi pembangunan nasional khususnya dalam hal pertumbuhan ekonomi dan penyerapan tenaga kerja di Indonesia, maka dilakukan penelitian normatif atau doctrinal research. Qarḍ merupakan kegiatan pinjam meminjam dana yang dilakukan tanpa imbalan (tanpa bunga) dengan kewajiban pihak peminjam mengembalikan pokok pinjaman secara sekaligus atau dengan cicilan dalam jangka waktu tertentu. Kesimpulan penelitian ini adalah model akad qarḍ merupakan pinjam meminjam yang sifatnya memberikan pertolongan terhadap nasabah dan wajib dikembalikan 100% (seratus persen) dari besaran jumlah pinjaman tanpa adanya tambahan yang diimplementasikan sesuai dengan Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia Nomor 19/DSN-MUI/IV/2001.
