Abstract

This study aims to determine the phenomenon of land sale and purchase practices without land deeds. The research method used is empirical research method. The results obtained show that one of the problems that often occurs in buying and selling transactions as an activity of transferring land rights is buying and selling land without a certificate. In fact, land certificates are valid and strong evidence of land ownership as stated in Article 19 Paragraph 2 Letter c of the UUPA. Factors causing this practice include legal, economic, social, and administrative factors. Slow and confusing processing of land certificates, lack of availability of land with legal status, the high cost of processing land certificates, lack of supervision from the community and government, and lack of public awareness and attention.

Abstract

This study discusses in depth the legal provisions for the provision of remuneration to Foundation administrators in Indonesia and the related dispute resolution mechanisms, based on Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. As a non-profit legal entity, a Foundation has unique characteristics that emphasize the principle of non-profit, where the use of the Foundation's assets must be fully directed to achieving social, religious, or humanitarian goals. However, in practice, the need for professionalism and high workloads often require Foundation administrators to receive reasonable compensation. This study aims to analyze the legal provisions regarding the provision of remuneration for Foundation administrators in Indonesia and to evaluate the dispute resolution mechanisms that may arise, by referring to Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. This study uses a normative legal approach with a prescriptive analysis method, and finds that remuneration is permitted as long as the administrator is not a founder, patron, or supervisor; carries out his duties directly and fully; and is regulated transparently in the Articles of Association. In the event of a dispute, the resolution can be reached through deliberation, mediation, arbitration, or court. This study also highlights the importance of accountability, internal supervision, and regulatory intervention from the government in maintaining the integrity of Foundation governance. Thus, the law on foundations in Indonesia needs to be continuously strengthened to remain relevant to social dynamics and the practical needs of professional management of non-profit organizations. Remuneration for Foundation administrators is permitted on the condition that the administrators are not founders, advisors, or supervisors, carry out their duties directly and fully, and are regulated transparently in the Articles of Association. Dispute resolution can be carried out through deliberation, mediation, arbitration, or court, with an emphasis on accountability, internal supervision, and the need for government regulation to strengthen Foundation governance.

Abstract

This study aims to analyze the legal protection for insurance customers in the settlement of policy claims at PT Asuransi Bumi Putera, with reference to Law No. 8 of 1999 concerning Consumer Protection. The main problem faced by customers is the delay in payment of claims, which is contrary to the main purpose of insurance to compensate for losses experienced by customers. Based on available data, many claims have not been paid, indicating the non-compliance of insurance companies with their obligations. This research examines the forms of legal protection regulated in the Consumer Protection Law, particularly regarding the customer's right to obtain clear information, compensation, and dispute resolution. In addition, this study also highlights the preventive and repressive aspects of legal protection, where preventive protection aims to prevent disputes from occurring, while repressive protection provides legal avenues for aggrieved customers to obtain compensation. While the law has provided a clear basis of protection, consistent implementation and enforcement are still needed to ensure customer rights are fulfilled. This research is expected to contribute to improving legal protection for insurance customers in Indonesia, as well as encouraging insurance companies to fulfill their obligations in a timely manner in accordance with applicable regulations.

Abstract

Online lending has become an increasingly popular financial solution in Indonesia, providing easy access to funds for people who are not fully served by traditional financial institutions. Despite offering many conveniences, the rapid growth of online lending brings various risks, such as the rise of illegal online loans, high interest rates, and the potential misuse of users' personal data. This research aims to analyze consumer protection in online loan transactions, by reviewing existing regulations, such as Law No. 8/1999 on Consumer Protection, OJK Regulation No. 77/Pojk.01/2016, and the Electronic Information and Transaction Law (ITE Law). This research uses a normative legal research method with a statutory approach that prioritizes legal materials in the form of laws and regulations as the main reference. Data collection techniques are carried out through library research, analyzing relevant regulations and related literature. The results show that although these regulations already exist, the implementation of supervision and law enforcement is still weak, resulting in many violations harming consumers. Stricter supervision from OJK, strict sanctions against illegal fintech providers, and increased education to the public about their rights as consumers are needed. With more effective supervision and clearer regulations, it is hoped that the online lending industry can develop healthily and provide benefits without harming consumers.

Abstract

This study aims to analyze the legal responsibility of PT Sritex in fulfilling severance pay for employees who experience termination of employment (PHK) due to the company's bankruptcy. The method used is the normative legal research method, namely a method that relies on the analysis of laws and regulations, legal doctrine, and literature relevant to the subject matter. Data sources were obtained from primary legal materials such as the Civil Code, Law Number 13 of 2003 concerning Manpower, and Law Number 6 of 2023 concerning Job Creation, as well as secondary legal materials in the form of books, scientific journals, and other academic writings. The analysis was carried out qualitatively to examine and formulate legal arguments regarding the company's obligations in guaranteeing workers' normative rights. The results of the study show that PT Sritex is legally obliged to provide severance pay to workers who are laid off, as regulated in the principles of contract law, the principle of justice, and national statutory provisions. This obligation remains in effect even though the company is bankrupt. In addition, international norms such as the UN Guiding Principles and ILO conventions reinforce the importance of corporate commitment to fulfilling basic workers' rights ethically and sustainably. This study has limitations because it has not explored empirical realities in the field. Therefore, further research is recommended to explore aspects of the implementation of corporate responsibility directly and form a more adaptive legal protection system in situations of economic crisis.

Abstract

This study aims to analyze efforts to fulfill children's rights a decade after the Constitutional Court Decision No. 46/PUU-VIII/2010, focusing on the practice of protecting the rights of children born from unregistered marriages, reflecting legal certainty. The methodology used in this research is normative research with a legislative approach and case approach, utilizing primary and secondary legal materials as the main sources of analysis. The results show that Constitutional Court Decision No. 46/PUU-VIII/2010 provides a crucial legal foundation in guaranteeing the rights of children born from unregistered marriages, creating clearer recognition and legal status for these children. Furthermore, the decision opened the possibility for children born from unregistered marriages to request a legal determination through the court system under the Supreme Court's jurisdiction. This study also highlights the alignment between the Constitutional Court Decision and the establishment of other judicial bodies, emphasizing the importance of legal certainty for children born from unregistered marriages, ensuring that they can live, grow, and develop with legally recognized rights.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan dan hak waris anak di luar nikah menurut hukum adat Tionghoa serta relevansinya dengan perkembangan hukum nasional di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kualitatif, didukung data sekunder berupa peraturan perundang-undangan, putusan pengadilan, dan literatur hukum terkait. Hasil penelitian menunjukkan bahwa dalam hukum adat Tionghoa, anak di luar nikah umumnya tidak diakui sebagai ahli waris kecuali terdapat pengakuan resmi dari ayah biologis, sehingga hak warisnya sangat terbatas. Sementara itu, KUHPerdata dan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 memberikan peluang lebih luas bagi anak luar kawin untuk memperoleh hak waris dari ayah biologis, asalkan diakui secara hukum atau dapat dibuktikan secara ilmiah. Namun, implementasi di masyarakat masih menghadapi hambatan berupa kuatnya tradisi dan minimnya pemahaman hukum. Penelitian ini merekomendasikan perlunya edukasi hukum dan peran aktif negara serta tokoh masyarakat untuk memastikan perlindungan hak waris anak di luar nikah secara adil dan tanpa diskriminasi

Abstract

Penelitian ini mengkaji bentuk perlindungan hukum terhadap masyarakat dalam penyelesaian sengketa tanah di Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo Menurut Pasal 5 dan 6 Peraturan Menteri Agraria Nomor 21 Tahun 2020. Penelitian ini bertujuan untuk menganalisis langkah-langkah penyelesaian sengketa tanah waris di Badan Pertanahan Nasional apakah sudah sesuai dengan Pasal 5 dan 6 Peraturan Menteri Agraria Nomor 21 Tahun 2020 tentang Penanganan dan Penyelesaian Kasus Pertanahan. Penelitian ini merupakan jenis penelitian empiris yang bersifat deskriptif, teknik pengumpulan data yang dilakukan adalah dengan wawancara, observasi dan dokumentasi yang dilakukan penulis. Untuk proses analisis dalam penelitian ini dilakukan sebelum  memasuki lapangan, selama di lapangan, setelah selesai pengumpulan data dilapangan, penyajian data dan penarikan kesimpulan. Berdasarkan penelitian yang dilakukan, menunjukkan fakta bahwa langkah-langkah yang dilakukan oleh Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo sudah sesuai dengan Peraturan menteri Agraria Nomor 21 Tahun 2020 tentang penanganan dan penyelesaian kasus pertanahan. Dengan melakukan mediasi sebagai mekanisme yang dilakukan dalam penyelesaian sengketa  tanah waris di BPN Kabupaten Gorontalo yang sebelum memasuki mekanisme tersebut, terlebih dahulu ada beberapa  mekanisme lainnya yaitu diadakannya pengkajian kasus, gelar awal yang merupakan langkah dalam penyelesaian sengketa tanah, dilakukan penelitian terhadap kasus, dan yang terakhir adalah gelar akhir sebagai mekanisme terakhir dalam penyelesaian sengketa tanah waris di Badan Pertanahan Nasional (BPN) Kabupaten Gorontalo.

Abstract

Penelitian ini secara mendalam menganalisis keabsahan akta jual belitanah dan dampaknya terhadap penyelesaian sengketa pertanahan diIndonesia, dengan menitikberatkan pada temuan hasil penelitiansebagai kontribusi utama. Hasil penelitian menunjukkan bahwamayoritas sengketa tanah bermula dari akta jual beli yang tidakmemenuhi syarat formil, seperti tidak dibuat di hadapan PejabatPembuat Akta Tanah (PPAT), serta syarat materil, misalnya tidakadanya persetujuan seluruh ahli waris atau penggunaan identitaspalsu. Temuan empiris memperlihatkan bahwa akta yang cacat hukumtidak dapat dijadikan dasar pendaftaran hak atas tanah di BadanPertanahan Nasional (BPN), sehingga status kepemilikan menjaditidak pasti dan rawan gugatan pihak ketiga. Studi kasus di beberapapengadilan negeri mengungkapkan bahwa pembeli yang beritikad baiktetap berisiko kehilangan hak atas tanah jika akta jual beli dinyatakanbatal, meskipun telah terjadi pembayaran dan penguasaan fisik.Penelitian juga menemukan bahwa upaya penyelesaian sengketamelalui jalur litigasi cenderung memakan waktu lama dan biayatinggi, sementara mediasi dan musyawarah adat lebih efektif dalammencapai kesepakatan damai, meski belum sepenuhnya diakuikekuatan hukumnya. Selain itu, hasil penelitian menyoroti perlunyaharmonisasi regulasi antara hukum perdata, agraria, dan kebijakanpertanahan nasional agar perlindungan hukum bagi para pihak dapatterwujud secara optimal. Penelitian ini merekomendasikan penguatanperan PPAT dalam verifikasi dokumen, peningkatan literasi hukummasyarakat, serta reformasi administrasi pertanahan berbasis digitaluntuk mencegah terulangnya sengketa serupa di masa depan.

Abstract

This study examines legal challenges surrounding AI-generated artworks, focusing on copyright protection in Indonesia. AI art raises concerns about authenticity and ownership, prompting an analysis of existing copyright laws through a normative juridical approach and literature review. Findings show that many AI-created works fail to meet originality criteria under current laws, exposing regulatory gaps. The study also addresses issues with using copyrighted works as AI training data, particularly regarding royalties and protection on social media. Results highlight insufficient policies for creators and developers, emphasizing the urgent need for clearer legal frameworks to safeguard rights and support fair AI use in creative fields.
