Abstract

The main focus of this research is to analyze the implementation of law enforcement against the practice of vote buying in elections and to examine it from the perspective of siyasah tanfidziyyah (executive political governance). This study employs a qualitative approach with a juridical-empirical research method, in which data were collected through interviews, observations, and documentation conducted in Ulu Danau Village, Sindang Danau District, South OKU Regency. The findings indicate that vote-buying practices remain prevalent during elections due to weak supervision and the low level of public legal awareness. Although Article 515 of Law Number 7 of 2017 provides for criminal sanctions, its implementation has not been optimal because of difficulties in proving violations and the lack of firmness among law enforcement officers. From the perspective of siyasah tanfidziyyah, vote buying constitutes an act that contradicts the principles of justice, trustworthiness, and public welfare. Therefore, law enforcement should not only be carried out juridically but also through strengthening the moral and spiritual values of society to realize fair and integrity-based elections. Abstract

Abstract:  The issue of legal protection for women and children remains a crucial concern in many Muslim countries, particularly regarding gender inequality, domestic violence, and limited access to justice. Although Islam upholds the principles of justice and respect for human dignity, its implementation is often influenced by patriarchal culture and legal systems that have yet to fully protect vulnerable groups. Based on this background, this study aims to analyze the forms and implementation of legal protection for women and children in Saudi Arabia, Egypt, and Indonesia through the mubadalah (reciprocity) perspective. This research is a qualitative library study using normative and comparative approaches, drawing on Islamic legal sources, national legislation, and relevant academic literature. The results indicate that Saudi Arabia remains oriented toward classical fiqh but is beginning to transform through legal reform; Egypt has progressively codified family law; while Indonesia integrates Islamic justice principles with national law through comprehensive regulations protecting women and children. From the mubadalah perspective, all three countries demonstrate efforts toward more equal and just legal relations, affirming that true legal protection must be grounded in reciprocity, humanity, and gender justice.   Keywords: Protection, Women and Children, Muslim Countries, Mubadalah

Abstract

This study analyzes profit-sharing practices in catfish farming in Srikaton Village, Buay Madang Timur District, East Ogan Komering Ulu Regency, South Sumatra, from the perspective of Islamic economic law. The main objective of this research is to examine the conformity of existing profit-sharing mechanisms with the principles of mudharabah as regulated in Islamic jurisprudence and sharia economic regulations. This research employs a qualitative field research approach using participatory observation, in-depth interviews, and document analysis. Data were collected from key informants consisting of capital owners, pond managers, and religious figures, and were analyzed using the Miles and Huberman interactive model. The findings indicate that profit-sharing practices in catfish farming are generally based on verbal agreements without written contracts, resulting in unclear contractual terms, limited cost transparency, and unilateral changes in profit-sharing ratios at the end of the production cycle. These practices do not fully comply with the fundamental principles of mudharabah, particularly contractual clarity, transparency (al-shafāfiyyah), and justice (al-‘adl). Changes in profit-sharing ratios without prior mutual consent potentially lead to injustice and undermine trust between the contracting parties. This study contributes to Islamic economic law by providing empirical evidence from the fisheries sector and highlighting the importance of formalized mudharabah contracts in rural economic activities. It recommends the implementation of written agreements, full cost transparency, and periodic review mechanisms to ensure fairness, legal certainty, and the sustainability of profit-sharing partnerships in accordance with sharia principles.Keywords: profit-sharing; catfish farming; Islamic economic law; mudharabah; transparency

Abstract

This study explores the application of the ijarah principle in the wage system for sales workers in Banjaran District, focusing on assessing justice ('adl) and worker protection. The research aims to evaluate whether the commission-based wage system implemented in small-scale toy businesses aligns with the principles of ijarah contracts in Islamic law. Using a descriptive-analytical qualitative approach, data were collected through interviews, observation, and documentation. The findings indicate that the wage system formally meets essential elements of ijarah, including clear contracts and mutual consent. However, substantive justice and worker protection are not fully achieved, as workers bear economic risks without a guaranteed minimum income. This study proposes a reform of the ijarah-based wage model by integrating income guarantees and risk-sharing mechanisms in accordance with the maqāṣid al-sharī'ah. These findings are expected to contribute to the development of a fairer wage system in Sharia-compliant employment relations

Abstract

This study aims to examine the legislative process of the TNI Law and assess its conformity with the principles of siyasah dusturiyah, particularly the principle of deliberation (musyawarah). The research employs a normative legal method with a library-based approach, utilizing secondary data consisting of primary legal materials and secondary legal sources. The findings indicate that, from a normative–formal perspective, the formation of the TNI Law has complied with the stages of legislation as stipulated in the 1945 Constitution of the Republic of Indonesia and Law Number 12 of 2011 on the Formation of Laws and Regulations. However, from a procedural and democratic standpoint, the legislative process raises several serious concerns, particularly regarding the fulfillment of the principles of transparency and meaningful public participation. The relatively expedited legislative process, the limited dissemination of the academic draft and the bill, and the constrained space for dialogue with civil society and academic communities demonstrate that public participation was not optimally implemented as mandated by the Law on the Formation of Laws and Regulations and the Constitutional Court’s decisions on meaningful participation. Such limited participation is inconsistent with the principle of deliberation embodied in siyasah dusturiyah

Abstract

Presidential Instruction of the Republic of Indonesia Number 1 of 2025 concerning efficiency in the implementation of the State and Regional Budgets has direct implications for education budget management at the regional level. This study aims to analyze the implications of budget efficiency policies on education budget management at the Education and Culture Office of Lampung Province and to examine them from the perspective of Fiqh Siyasah. This research employs a qualitative method using normative and empirical approaches, with data collected through documentation studies, observation, and interviews with relevant stakeholders. The findings indicate that the implementation of budget efficiency policies in Lampung Province encourages sharper prioritization of education spending, particularly in improving learning quality, strengthening educational facilities, and ensuring equitable access to education. However, it also limits the flexibility of certain development programs considered less urgent. From the perspective of Fiqh Siyasah, budget efficiency policies are consistent with the principles of public welfare (maslahah), distributive justice, and the prohibition of waste (israf), provided that they do not undermine the fulfillment of citizens’ fundamental right to education. This study concludes that education budget efficiency can be aligned with the principles of Fiqh Siyasah when it is oriented toward sustainable educational services and overall public welfare.

Abstract

Marriage (akad nikah) as a mitsāqan ghalīẓan requires the fulfillment of specific pillars and conditions, one of which is ittihād al-majlis between ijāb and qabūl. A legal challenge arises when the classical concept of ittihād al-majlis is confronted with the reality of virtual spaces that eliminate physical boundaries while enabling simultaneous audio-visual interaction. This study aims to conduct a comparative analysis of the perspectives of the Lembaga Bahtsul Masail of Nahdlatul Ulama and the Majelis Tarjih of Muhammadiyah in Lampung Province regarding the legal validity of marriage contracts conducted through video call media. Employing a qualitative field research design with descriptive-analytical and comparative approaches, the data were collected through interviews with institutional representatives as well as document analysis of fatwas, classical and contemporary fiqh literature, and relevant marriage regulations. The findings indicate that the Lembaga Bahtsul Masail of Nahdlatul Ulama interprets ittihād al-majlis as requiring physical unity of place and emphasizes the principle of legal prudence, thereby considering online marriage contracts invalid unless conducted through a mechanism of representation (wakālah). In contrast, the Majelis Tarjih of Muhammadiyah conceptualizes ittihād al-majlis as temporal continuity and clarity of communication between ijāb and qabūl, thus regarding online marriage contracts as legally valid provided that all pillars and conditions of marriage are duly fulfilled.

Abstract

Praktik jual beli di pedesaan kerap berjalan sederhana dan berdasarkan kepercayaan, namun di balik kesederhanaan tersebut sering muncul persoalan kejelasan harga yang berpotensi menimbulkan ketidakadilan. Penelitian ini bertujuan untuk menganalisis sistem penentuan harga dalam jual beli alat pertanian di Desa Damarpura, Kecamatan Buana Pemaca, Kabupaten OKU Selatan, serta meninjau kesesuaiannya dengan prinsip hukum Islam. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan desain studi kasus melalui observasi langsung dan wawancara terhadap satu orang penjual serta sebelas orang pembeli. Hasil penelitian menunjukkan bahwa terdapat dua sistem pembayaran, yaitu tunai dan tunda. Harga tunai disepakati di awal akad, sedangkan harga tunda baru diinformasikan saat pelunasan dengan selisih harga yang signifikan tanpa adanya pencatatan tertulis. Praktik ini mengandung unsur gharar (ketidakjelasan) yang bertentangan dengan prinsip kejelasan harga (jahl bi al-tsaman), keadilan (‘adl), dan kerelaan (tarādhī) dalam fiqh muamalah, karena menimbulkan ketidakseimbangan informasi antara penjual dan pembeli. Kesimpulan penelitian ini menegaskan pentingnya penetapan harga secara jelas di awal akad, pencatatan transaksi, serta edukasi fiqh muamalah agar transaksi berjalan transparan, adil, dan sesuai prinsip syariah. Kata Kunci: Jual Beli, Harga Tunda, Fiqh Muamalah, Gharar, Keadilan Ekonomi Islam.

Abstract

Hak Asasi Manusia menjamin bahwa ODGJ berhak memperoleh perlindungan, layanan, dan pemenuhan hak tanpa diskriminasi. Namun, pelanggaran seperti penelantaran masih terjadi di Kota Bandar Lampung. Penelitian ini menganalisis pelaksanaan pemenuhan hak ODGJ oleh Dinas Sosial berdasarkan Perda Kota Bandar Lampung Nomor 4 Tahun 2024. Melalui pendekatan kualitatif, penelitian menemukan bahwa Dinas Sosial berperan dalam penjangkauan, asesmen kesehatan, rujukan medis, serta rehabilitasi melalui yayasan mitra pemerintah. ODGJ tanpa identitas menjadi tanggung jawab penuh pemerintah dengan dukungan anggaran. Hambatan utama terdapat pada sosialisasi, koordinasi antarlembaga, dan pendekatan terhadap masyarakat yang keluarga pasien.

Abstract

Penelitian ini membahas pemikiran Wahbah az-Zuhaili mengenai pernikahan perempuan yang belum menyelesaikan masa iddah serta implikasi hukumnya dalam perspektif fikih kontemporer. Masalah pernikahan pada masa iddah menjadi penting karena berkaitan dengan kesahan akad, kejelasan nasab, perlindungan perempuan, dan stabilitas keluarga. Metode penelitian yang digunakan adalah studi kepustakaan melalui analisis mendalam terhadap karya-karya Wahbah az-Zuhaili, terutama Tafsir al-Munir dan al-Fiqh al-Islami wa Adillatuhu. Hasil penelitian menunjukkan bahwa Wahbah az-Zuhaili memandang iddah sebagai mekanisme perlindungan syariat yang bersifat komprehensif. Pernikahan yang dilakukan sebelum iddah selesai dianggap batal karena tidak memenuhi syarat syar‘i, serta berpotensi menimbulkan kerancuan nasab, hilangnya hak-hak perempuan, gangguan psikologis, dan munculnya stigma sosial. Pemikiran az-Zuhaili menegaskan bahwa iddah bukanlah pembatasan, tetapi instrumen menjaga kehormatan, hak hukum, dan stabilitas keluarga. Dengan demikian, pandangan Wahbah az-Zuhaili memberikan kontribusi signifikan terhadap penguatan hukum keluarga Islam dalam konteks kontemporer
