Abstract

As the first Islamic kingdom in Java, the Sultanate of Demak played a crucial role in integrating Islamic teachings with the pre-existing political and legal structures of the region. Far from being limited to religious rituals or spiritual concerns, the application of Islamic law in Demak extended into various aspects of governance, social regulation, and public ethics. This integration marked a significant transformation in Javanese society, as Islamic norms gradually began to influence decision-making processes, judicial practices, and administrative structures. One of the most significant features of the Demak period was the emergence of Islamic educational institutions, which served as centers for both religious instruction and intellectual development. These institutions not only provided a formal setting for the study of the Qur’an, Hadith, and fiqh (Islamic jurisprudence), but also helped shape a generation of scholars and leaders who would continue the process of Islamization throughout Java. At the heart of this intellectual and spiritual movement were the ulama, particularly the legendary Walisongo (Nine Saints), whose influence extended beyond religious teaching. Through da'wah (missionary work), educational outreach, and social leadership, the Walisongo helped embed Islamic legal and moral values into the everyday lives of the Javanese people. Their holistic approach combined law, ethics, and community welfare, thereby facilitating both spiritual growth and social harmony. The legacy of the Demak Sultanate, therefore, lies not only in its political achievements but also in its pivotal contribution to the institutionalization of Islamic law and education in Java’s historical landscape.

Abstract

This research focuses on the concept of equality rights in the perspective of human rights as reflected in the Qur'an. The essence of this research is to examine the importance of the principle of equality in building a plural and civilized social life. This research uses a qualitative method with a library research approach, which relies on analyzing Qur'anic verses related to the issue of equality and human dignity. The results show that Islam, as reflected in the Qur'an, does not differentiate between men and women in terms of human rights. Both sexes are positioned equally as servants of God who have the same honor, responsibilities, and rights in spiritual, social, and moral dimensions. This finding confirms that the Qur'an upholds the principles of justice and equality as the main foundation in respecting human rights.

Abstract

This article examines the intellectual dynamics of Nusantara scholars in the 19th century, a period marked by the paradox of colonial oppression at home and outstanding achievements in the Islamic scholarly centers of Haramain (Mecca and Medina). Using a historical-descriptive approach, this study explores how Dutch colonial pressures actually propelled the intellectual journeys of Nusantara scholars to the Middle East. The main focus is on the contributions of figures such as Sheikh Nawawi al-Bantani and Sheikh Mahfudz at-Tarmasi, who attained prominent positions in Haramain. This article analyzes their contributions to teaching, writing influential works, and forming transnational intellectual networks. Furthermore, it discusses the impact of these achievements on the development of Islamic thought in Nusantara, including their influence on reform movements and resistance against colonialism. The article concludes by highlighting the resilience and intellectual brilliance of Nusantara scholars who, despite facing adversity at home, managed to reach the pinnacle of scholarly excellence on the global stage. These achievements not only constitute a historical pride but also lay a crucial foundation for the development of Islamic discourse and intellectual identity in Indonesia in subsequent periods.

Abstract

This study examines the hadd punishment for adultery through an interpretive analysis of the Qur'an Q.S An-Nur verses 1-3 and the hadith, and makes a comparison with Article 284 of the Criminal Code (KUHP) from the perspective of Indonesian law. This study uses a qualitative approach, with a library research method. This study uses primary sources: classical tafsir books by Ali Al-Shabuni, Wahbah Zuhaily, Al-Qurthubi, and other commentators. Supporting data were obtained from a review of relevant academic books and journals. The results of the study indicate that Islamic law views adultery as a serious violation that is categorized based on the perpetrator's marital status, namely ghairu muhshan (unmarried) and muhshan (married), with different legal implications. In this regard, there is an overlap between Islamic criminal law and Indonesian positive law in viewing adultery, although Islamic law offers a more comprehensive scope. This study confirms that hadd punishment in Islam is a form of holistic protection of Human Rights, including the rights of other parties. Unequal punishment for human rights violators on the grounds of respecting human rights is a disregard for the principle of human rights itself. Keywords: interpretation, zina, hadd

Abstract

This study investigates the methodology of muqāranah al-mażāhib (comparative of madhhabs) as applied by Ibn Qudāmah in his seminal work, Kitāb al-Mugnī, a key reference in the landscape of Islamic jurisprudence in Indonesia. The primary purpose is to critically analyze Ibn Qudāmah’s comparative legal approach and assess its relevance for contemporary ijtihad. Employing a qualitative method, the research utilizes content analysis and textual hermeneutics to examine selected chapters of al-Mugnī—specifically those related to acts of worship and mu‘āmalah (social transactions). The findings reveal that Ibn Qudāmah's method systematically compares the legal views of the four major Sunni madhhabs and includes perspectives from other jurists, presenting them with detailed argumentation and rational justification. His use of tarjīḥ (preference) reflects a critical evaluative process that selects the most compelling legal opinion based on textual evidence and reasoning. The originality of this study lies in its focused analysis of Ibn Qudāmah's structured comparative technique, which balances scholarly objectivity with methodological rigor. The implications of this research are significant for contemporary Islamic legal scholarship, particularly in advancing the practice of collective ijtihad, refining fatwa formulation processes, and fostering a tolerant yet disciplined engagement with legal diversity. Furthermore, the integration of maqāṣid al-sharī‘ah into this comparative framework enriches its applicability in addressing modern socio-legal issues.

Abstract

Abstract

This study aims to examine the strategic role of education in shaping Islamic civilization during the time of the Prophet Muhammad, particularly through the social dynamics that took place during the Mecca and Medina periods. This study uses a systematic literature review method, collecting data from various historical literature, classical Islamic education, and current academic sources. The results of the study indicate that education during the time of the Prophet Muhammad SAW not only served as a means of conveying religious teachings but also as an effective instrument of social change. Through a prophetic approach integrated with societal realities, education was able to shape individuals of faith while building a civilized, inclusive, and value-based social system rooted in divine principles. The conclusion of this study emphasizes that education is the main foundation in the process of transforming a jahiliyyah society into an Islamic society that is just and civilized. This prophetic education model is relevant as inspiration for the development of a holistic and transformative contemporary Islamic education system.
