Abstract

Investasi illegal melalui platform digital seperti Binary Option telah menyebabkan kerugian besar bagi Masyarakat. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi korban kejahatan investasi ilegal yang dilakukan oleh afiliator Binary Option di Indonesia, berdasarkan Putusan No. 117/Pid.Sus/2022/PT.Btn. Penelitian ini ditulis dengan menggunakan metode normatif dengan pendekatan studi kasus terhadap putusan pengadilan serta analisis terhadap peraturan perundang-undangan terkait. Hasil penelitian menunjukkan bahwa meskipun terdapat regulasi hukum yang dapat digunakan seperti UU ITE dan KUHP untuk melindungi korban, praktik Binary Option yang sistematis dan tidak diatur secara eksplisit dalam regulasi yang ada menyebabkan tantangan dalam perlindungan hukum. Penelitian ini menyimpulkan bahwa perlindungan hukum di Indonesia terhadap korban investasi ilegal masih memiliki kekurangan. Oleh karena itu, diperlukan perbaikan regulasi dan peningkatan edukasi untuk memberikan perlindungan yang lebih baik kepada masyarakat.

Abstract

Efforts to Increase Students' Learning Motivation Through the Civics Subject Discussion Method at SMPN Satap Bonelohe No. 36 Selayar Islands. Thesis of the Department of Civics and Legal Sciences, Faculty of Social and Legal Sciences, Makassar State University, supervised by Muh. Sudirman and Andi Aco Agus. This research aims to find out: (1) the application of the discussion method in learning can contribute to increasing students’ learning motivation. (2) the influence of the success of the discussion method as a strategy to increase students’ learning motivation. This type of research uses qualitative methods, data collection techniques through observation, interviews and documentation, data sources come from 7 informants, as well as data analysis through data reduction, presentation of data, drawing conclusions and verification. The results of this research show that: (1) The application of the discussion method in learning is an effective way to encourage interaction between teachers and students and between fellow students. Where the teacher divides groups, then the teacher first explains the material that will be discussed, studentsare divided into groups and groups 2 which allows students to espress their thoughts and arguments during the lesson, the use of appropriate learning methods is one of the factors for teacher success in learning. (2) The success of the discussion method can be said to have been successful which can be seen from supporting data such as pretest and posttest carried out on students to assess learning outcomes and the results of this data show an increase in student learning outcomes so this proves that the discussion method is able to increase student learning motivation.

Abstract

This research aims to find out: (1) The strategies used by schools to strengthen the nationalist character of students through habituation at SMP Negeri 1 Sebatik Tengah. (2) Supporting and inhibiting factors in the implementation of strengthening the nationalist character of students at SMP Negeri 1 Sebatik Tengah. This research is qualitative research with a qualitative descriptive approach, the types of data used in the research are primary data and secondary data. Data collection techniques were obtained through observation, interviews and documentation. The results of the research show that: (1) The strategy used by schools to strengthen the nationalistic character of students is through habituation in the form of flag ceremony activities, singing the national anthem before and after learning, use of Indonesian then scout extracurricular activities, teacher example, and Learning based on local wisdom, namely Yameto and Lukiwol regional gymnastics. This habituation program has very important benefits and contributions in supporting the strengthening of students' nationalistic character. (2) Supporting and inhibiting factors in the implementation of strengthening the nationalist character of students at SMP Negeri 1 Sebatik Tengah (a) Supporting factors are the active role of teachers, consistency and regularity in carrying out habituation activities. (b) inhibiting factors, namely the influence of the living environment.

Abstract

RISKAWATI HASRAM. 2024. Analisis Kasus Perceraian pada masa Pandemi Covid-19 di Pengadilan Agama Bulukumba Kelas I B (Periode Januari 2019 s/d Agustus 2023). Skripsi Program Studi Pendidikan Pancasila dan Kewarganegaraan Jurusan PPKn dan Hukum Fakultas Ilmu Sosial dan Hukum Universitas Negeri Makassar.Dibimbing oleh Andi Aco Agus dan Imam Suyitno. Penelitian ini bertujuan untuk mengetahui: (1) faktor empiris penyebab terjadinya perceraian (2) Upaya mediator dalam proses mediasi perceraian (3) Pertimbangan hakim dalam memutuskan perkara perceraian. Jenis Penelitian ini adalah penelitian kualitatif bersifat deskriptif, menggunakan dua sumber data yakni Sumber data primer (hakim, mediator, panitera) dan sumber data sekunder dengan teknik pengumpulan data melalui observasi, wawancara dan dokumentasi. Analisis data menggunakan Triangulasi Sumber.Hasil penelitian menunjukkan bahwa (1) Faktor empiris penyebab terjadinya perceraian di Pengadilan Agama Bulukumba yakni perselisihan dan pertengkaran terus menerus, faktor ekonomi dan faktor meninggalkan salah satu pihak (2) Upaya mediator dalam proses mediasi mencakup pemahaman metode mediasi, pemberian nasehat, memberikan pemahaman tentang dampak perceraian, dan pelaksanaan pertemuan terpisah (kaukus). Meskipun demikian, mediator dihadapkan pada kendala seperti ketidakhadiran salah satu pihak, konflik berkepanjangan, keinginan kuat untuk bercerai dan masalah bahasa. (3) Pertimbangan hakim dalam memutuskan perkara perceraian, yakni landasan hukum, alasan perceraian, bukti dan keterangan saksi. Abstract

This research aims to find out: (1) Civics teachers' efforts in the process of nationalism character building through the cultivation of malaqbiq values in students at SMAN 1 Tinambung. (2) The inhibiting factors in the process of nationalism character building through the cultivation of malaqbiq values in students at SMAN 1 Tinambung. This research is a qualitative research with descriptive qualitative approach, the type of data used in the research is the type of primary data and secondary data. Data collection techniques were obtained through interviews and documentation. Data analysis used is data reduction, data presentation and conclusion drawing.The results showed that (1) The efforts of Civics teachers in the process of building the character of nationalism through instilling malaqbiq values in students, consist of: (a) teacher example, (b) getting used to the application of malaqbiq values in the school environment, and (c) internalizing malaqbiq values in the learning process. (2) inhibiting factors consist of globalization and domicile of origin of students.

Abstract

Abstract: This study aims to determine (1) The factors causing the divorce rate in the jurisdiction of the Watansoppeng Religious Court. (2) The strategy adopted to overcome the divorce rate in the jurisdiction of the Watansoppeng Religious Court. In this research, the research approach used is qualitative research with a qualitative descriptive research type. The data sources used are primary data sources and secondary data sources. Data collection techniques include interviews and documentation. Triangulation and member checking are used as procedures to check the validity of the data, as well as using data reduction, data presentation, and drawing conclusions as data analysis techniques. The results of the research show; (1) The factors causing the divorce rate in the jurisdiction of the Watansoppeng Religious Court are based on 13 factors or reasons for divorce which are grouped, namely; the factors of moral decadence are classified as: drunkenness, madness and gambling. Factors of household neglect are classified as: leaving one of the parties, domestic violence, and economics. Factors being sentenced to prison, polygamy, physical disability, constant disputes and quarrels, and forced marriage. (2) The strategy adopted to overcome the divorce rate in the jurisdiction of the Watansoppeng Religious Court is; First, providing outreach to the public about the importance of knowledge of legal and religious observance regarding marriage and divorce. Second, mediation in the Religious Court is the final strategy carried out with the aim of reconciling husband and wife who want a divorce.

Abstract

AbstrakPentingnya upaya membangun social and cultural capital demi menghadirkan kehidupan bersama melalui pemahaman nilai-nilai sosial kebudayaan. Pendidikan Kewarganegaraan memiliki misi psikologis-pedagogis yakni membentuk warga negara yang sosialis yang bertanggungjawab atas terselenggaranya masyarakat sosialis Indonesia yang adil dan makmur baik spiritual maupun materil yang berjiwa Pancasila. Dalam artikel ini, metode yang digunakan adalah metode studi kepustakaan. Adapun hasil dari penelitian bahwa Pembelajaran Pendidikan Kewarganegaraan (1) dapat membentuk keteladanan dan mengembangkan kreatifitas sebagai cerminan jati diri bangsa dengan nilai sosial kultural ke-Indonesiaan dalam menghadapi realitas sosial yang kurang menguntungkan secara kultural, (2) sebagai pembelajaran dapat menstimulus kemerdekaan pemikiran tentang isu sosial menumbuhkan keterlibatan warga negara dalam penyelesaian konflik sosial secara konstruktif, (3) dapat menumbuhkan wawasan serta aktivitas sosio kultural seperti tumbuhnya social sensitive dan memberikan konstribusi aksi sosial sesuai harapan di dalam masyarakatKata Kunci: Budaya, Pendidikan Kewarganegaraan AbstractThe importance of efforts to build social and cultural capital to bring a common life through understanding socio-cultural values. Abstract

AbstrakPenelitian ini bertujuan: 1). Untuk mengetahui implementasi Peraturan Bupati Soppeng No.52 Tahun 2020 dalam penerapan protokol kesehatan di Kecamatan Lalabata. 2). Untuk mengetahui faktor penghambat penerapan protokol kesehatan di Kecamatan Lalabata. Jenis penelitian ini yaitu penelitian deskriptif dengan menggunakan pendekatan kualitatif. Tekhnik pengumpulan data meliputi: pengamatan,wawancara dan angket. Data yang diperoleh dari hasil penelitian ini diolah dengan menggunakan teknik tringulasi. Hasil penelitian ini menunjukkan bahwa: 1) Implementasi Penerapan protokol kesehatan di Kecamatan Lalabata masih belum terlaksana sebagaimana mestinya masih banyak masyarakat yang mengabaikan protokol kesehatan di tempat umum meskipun mayoritas  masyarakat mengetahui aturan penerapan dan penegakan protokol kesehatan serta mengetahui pentingnya penerapan protokol kesehatan, Perilaku masyarakat yang demikian menunjukkan bahwa kepatuhan hukum masyarakat lalabata masih tergolong rendah, mayoritas masyarakat berada di tingkatan Compliance (takut dikenakan sanksi), beberapa  diantaranya berada di tingkatan kepatuhan identifikasi (menjaga hubungan baik dengan aparat penegak hukum) dan minim sekali yang memiliki kepatuhan internalisasi (mengetahui tujuan hukum diberlakukan dan mengetahui bahaya Covid-19). 2). Sanksi yang diberikan kepada pelanggar protokol kesehatan berupa teguran lisan, denda dengan nominal Rp.100.000 hingga Rp.250.000, dan sanksi fisik (push up). 3).Faktor-faktor yang menghambat masyarakat menerapkan protokol kesehatan di Kecamatan Lalabata Kabupaten Soppeng yaitu: (a) faktor kejenuhan masyarakat dengan situasi pandemi yang sudah berlangsung sejak lama, (b) faktor kurang nyaman menggunakan alat pelindung wajah ( masker), (c) Faktor rendahnya pengetahuan masyarakat akan bahaya Covid-19. 3) Upaya meningkatkan kepatuhan hukum masyarakat menerapkan protokol kesehatan di Kecamatan Lalabata ialah dengan mengadakan penyuluhan Covid-19 setiap bulan. Kata Kunci: Kepatuhan Hukum, Protokol Kesehatan, Perbup Soppeng No.52 Tahun 2020 AbstractThis research aims to: 1). To find out the implementation of Soppeng Regent Regulation No.52 of 2020 in the implementation of health protocols in Lalabata District. 2). To find out the inhibiting factors for the implementation of health protocols in Lalabata Subdistrict. This type of research is descriptive research using a qualitative approach. The techniques of data collection include: observations, interviews and questionnaires. The data obtained from the results of this study is processed using tringulation techniques. The results of this study show that: 1) The implementation of health protocols in Lalabata District is still not implemented as it should be, there are still many people who ignore health protocols in public places even though the majority of the public knows the rules of implementing and enforcing health protocols and knows the importance of implementing health protocols, such community behavior shows that the legal compliance of the lalabata community is still relatively low,  The majority of the public is at the Compliance level (fear of sanctions), some of which are at the level of identification compliance (maintaining good relations with law enforcement officials) and minimal who have internalization compliance (knowing the purpose of the law is enforced and knowing the dangers of Covid-19). 2). Sanctions given to violators of health protocols in the form of verbal reprimands, fines with a nominal amount of Rp.100,000 to Rp.250,000, and physical sanctions (push ups). 3). Factors that prevent the community from implementing health protocols in Lalabata District of Soppeng Regency are: (a) community saturation factors with the pandemic situation that has been going on for a long time, (b) factors that are not comfortable using face protection equipment (masks), (c) Factors of low public knowledge of the dangers of Covid-19. 3) Efforts to improve community legal compliance to implement health protocols in Lalabata District are to hold Covid-19 counseling every month.  Keywords: Legal Compliance, Health Protocol, Perbup Soppeng No.52 of 2020

Abstract

This study aims to analyze how civic education can develop students' characters in terms of religious, nationalistic, and global perspectives. The research method employed is a descriptive qualitative approach. Research data were collected through interviews and observations, and then analyzed using data triangulation, adapted from Miles and Huberman, which involved data reduction, data presentation, and data/conclusion verification with MAXQDA 24 software. The results of this study found that the development of the characters of religious, nationalistic, and global perspectives in students through civic education learning is built through the simultaneous interaction of five main elements, namely: (1) the role and competence of teachers; (2) diverse learning models and methods; (3) the integration of religious, nationalistic, and global perspective values; (4) holistic assessment and evaluation; and (5) learning environment and school culture. This model offers a conceptual renewal for the revitalisation of civic education in the 21st century, while strengthening the Pancasila Student Profile as citizens who are faithful, love their country, and have a global perspective.

Abstract

Performance of Civil Servants Reviewed from the Perspective of State Administrative Law at the Ariang Sub-district Office, Makale District, Tana Toraja Regency. Thesis, Pancasila and Citizenship Education Study Program, Department of Civic Education and Business Law, Faculty of Social and Law Sciences, Makassar State University, Supervised by Imam Suyitno and Herman. This research aims to determine: (1) The performance of civil servants at the Ariang Sub-district Office in Makale District, Tana Toraja Regency, reviewed from the perspective of legal certainty. (2) The performance of civil servants at the Ariang Sub-district Office in Makale District, Tana Toraja Regency, reviewed from the perspective of justice and equality. (3) Obstacles in the application of the principles of legal certainty and justice and equality at the Ariang Sub-district Office in Makale District, Tana Toraja Regency. This type of research is qualitative research with a descriptive approach. The sources of this research are the Sub-district head and employees. Data collection techniques include observation, interviews, and documentation. Data validity checking is done using data source triangulation techniques. The results of the research show that: (1) The performance of Civil Servants at the Ariang Sub-district Office in Makale District, Tana Toraja Regency, is considered good from the perspective of legal certainty. Complete legal documents, consistency in the application of administrative legal procedures, and the level of compliance of Civil Servants with applicable legal regulations are the main indicators showing the quality of ASN's performance is quite good. (2) The performance of Civil Servants at the Ariang Sub-district Office in Makale District, Tana Toraja Regency, can be considered good from the perspective of justice and equality. ASN has shown consistency in providing fair services to all residents without discrimination, as well as openness to inputs and aspirations of the community in policy development. (3) The Ariang Sub-district Office in Makale District, Tana Toraja Regency, faces obstacles in applying the principles of legal certainty and justice and equality. The main focus is on the clarity and openness of legal information that is not accessed by the community, as well as consistency in empowering community participation. Improvement efforts include providing easily accessible legal information, increasing public legal awareness, and better coordination among related institutions. The hope is that with these steps, obstacles in the application of legal and justice principles can be overcome for better services to the community.
