Abstract

Penelitian ini bertujuan untuk menganalisa keberadaan penjamin kredit yang menjadi solusi akhir bagi nasabah UKM yang kesulitan mendapatkan akses pendanaan di layanan perbankan. Kasus ini muncul karena ketidakmampuan menyediakan jaminan, lemahnya kemampuan dalam mengelola usaha, terbatasnya kualitas sumber daya manusia dan kurangnya kualitas administrasi. Penelitian ini merupakan penelitian hukum normative yang bersifat kritis dengan menggunakan sumber-sumber hukum dan pendekatan konseptual untuk mengtahui fenomena-fenomena terkait jaminan kredit berdasarkan hukum yang berlaku yaitu Burgerlijk Wetboek, Undang-Undang Jaminan dan Peraturan Pelaksanannya. Hasil dari penelitian ini menunjukkan bahwa jaminan kredit membuat perbankan berani memberikan kredit Kepada nasabah UKM untuk mendapatkan kredit tanpa agunan. Apabila nasabah UKM mengalami kredit macet, maka lembaga penjaminan akan melakukan pembayaran atas tunggakan yang dialami nasabah UKM. Dapat dikatakan bahwa keberadaan penjaminan kredit oleh lembaga penjaminan telah menurunkan risiko kredit UKM yang berhadapan dengan perbankan, sehingga masalah akses pendanaan perbankan untuk UKM dapat teratasi.

Abstract

This study examines the legal position of marriage agreements that eliminate joint property formation when money laundering crimes occur, focusing on the tension between contractual property separation and criminal asset confiscation. Using normative legal research methods with statutory and case analysis approaches, this study analyzes Indonesian marriage law, anti-money laundering legislation, and judicial decisions, specifically Decision Number 70/Pid.Sus-TPK/2024/PN.Jkt.Pst and its appellate decision Number 1/Pid.Sus-TPK/2025/PT DKI. The findings reveal that while marriage agreements provide legal protection for individual property rights, courts apply the "follow the money" principle to trace and confiscate assets regardless of formal ownership structures when money laundering is suspected. Marriage agreements are not recognized as absolute barriers to asset seizure if spouses cannot prove the lawful origin of their property or if evidence indicates they benefited from proceeds of crime. This study contributes to understanding the limitations of marriage agreements as protective instruments in criminal proceedings and demonstrates that substantive proof of asset origins supersedes formal contractual arrangements in money laundering cases. The research recommends that spouses executing marriage agreements maintain meticulous documentation of property origins, including purchase receipts, income records, and endorsement contracts, to avoid unjustified confiscation while acknowledging that legitimate law enforcement interests in recovering proceeds of crime may override private contractual protections.

Abstract

The integration of sustainability principles into human resource management has gained increasing scholarly attention, yet comprehensive frameworks addressing economic, social, and environmental dimensions simultaneously remain insufficiently developed. Whilst previous research has examined socially responsible HRM, green HRM, and sustainable work systems independently, the fragmented nature of these investigations limits understanding of how organisations can operationalise triple bottom line principles through strategic human resource management. This study employs a bibliometric analysis and systematic literature review to explore the incorporation of triple bottom line concepts into sustainable human resource management scholarship. Bibliometric data were collected from the Scopus database covering publications between 2015 and 2025, analysed using VOSviewer and Bibliometrix package in R to map intellectual structures, publication trends, and thematic evolution. The findings reveal substantial growth in sustainable HRM and green HRM research over the past decade, with three dominant typologies identified: socially responsible HRM, green HRM, and triple bottom line HRM. However, persistent challenges include conceptual fragmentation, inside-out economic orientations, and geographical imbalances in research contributions. The study contributes empirically by documenting intellectual evolution of triple bottom line research in sustainable HRM and conceptually by synthesising how economic viability, social equity, and environmental responsibility are progressively operationalised within human resource management domains.

Abstract

A community service program (PKM) entitled "Skincare Product Dispute Resolution" was successfully implemented in Ngadi Village, Mojo District, Kediri Regency, involving village cadres, youth organizations, and community members, particularly housewives as skincare consumers. This PKM aims to provide solutions to skincare product disputes through five stages: outreach, training, technology implementation, mentoring, and sustainability evaluation. The outreach program began with a presentation on halal skincare products and consumer protection against misleading promotional practices, delivered by speakers from the Sharia Research Group (SReG) and the Non-Governmental Consumer Protection Organization. This program also includes in-kind and in-cash contributions, including training to improve customer service quality, ensure raw material quality standards and production processes comply with international standards, and ensure product information transparency. In addition, a loyalty program and transportation cost incentives were provided to affected consumers. PKM partners played an active role in providing information and inviting the community to participate in this activity. The implementation of this activity is expected to strengthen consumer trust and ensure protection of consumer rights related to skincare products.

Abstract

Trust is an essential element in the realm of investment. This study examines two legal issues in Bancassurance's PAYDI marketing. This study employs normative legal research, a systematic scientific approach used to address legal concerns that result from regulation. The utilized data consists of secondary sources, including statutes, judicial rulings, legal doctrines, and scholarly viewpoints. This study suggests that it is important to examine the teleological contractual relationship between the parties involved, particularly those that place importance on the social and moral components of the contract's goal. The collaboration between PAYDI and life insurance firms in implementing bancassurance marketing strategies with distribution business models is essential.

Abstract

Perkembangan teknologi digital telah melahirkan berbagai bentuk benda virtual yang memiliki nilai ekonomi dan secara faktual diperlakukan sebagai objek kepemilikan dalam aktivitas sosial dan ekonomi masyarakat. Namun demikian, hukum perdata Indonesia hingga saat ini belum memberikan pengaturan yang tegas mengenai kedudukan hukum benda virtual sebagai objek hak. Pengaturan yang ada masih terbatas pada data dan informasi elektronik, sehingga menimbulkan kekosongan hukum terhadap benda virtual. Kondisi tersebut berdampak pada ketidakpastian hukum bagi pemegang hak, khususnya terkait kepemilikan, pengalihan, serta perlindungan hukum apabila terjadi sengketa atau kerugian. Penelitian ini bertujuan untuk menganalisis kekosongan pengaturan hukum benda virtual dalam hukum perdata Indonesia serta dampaknya terhadap kepastian hukum pemegang hak. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan teori hukum. Hasil penelitian menunjukkan bahwa secara doktrinal benda virtual telah memenuhi karakteristik dan prinsip kebendaan dalam hukum perdata, namun belum memperoleh rekognisi normatif yang memadai. Oleh karena itu, kekosongan pengaturan tersebut berpotensi melemahkan kepastian hukum dan perlindungan hak pemegang benda virtual, sehingga diperlukan pengembangan hukum perdata yang adaptif terhadap perkembangan teknologi.

Abstract

This study aims to examine (1) the Position of Domain Names as Intangible Objects in Indonesian National Law; (2) Legal Protection for Domain Name Owners according to Indonesian Laws and Regulations. This study employs normative legal research using a statutory approach. The legal sources used in this study include primary legal materials and secondary legal materials using the technique of collecting legal materials through document studies and analyzed using deductive method. The results of this study show that (1) Domain names in the development of Indonesian civil law can be understood as objects of modern law, but they do not meet the elements of objects that can be controlled by property rights because their power still depends on the registration period. (2) Legal protection for domain names is provided preventively through regulatory registration mechanisms, the application of the principles of first come, first served, and the obligation to use in good faith, as well as repressively through civil lawsuits and dispute resolution managed by PANDI through PPND (Domain Name Dispute Resolution). However, such protection is still limited because the rights to domain names born from registration are administrative and contractual.

Abstract

Fiduciary guarantee is a recognized security institution in Indonesian law in which the collateral object remains in the possession of the fiduciary grantor. Although registration confers a right in rem on the fiduciary recipient, this continued possession exposes the object to confiscation by the state where the debtor uses it to commit a crime such as illegal logging. This study examines the legal protection available to a creditor as fiduciary recipient once the collateral object has been confiscated by the state under a court decision, using normative legal research with statute, conceptual, and case approaches centered on Decision Number 18/Pdt.G/2015/PN Ktp. The findings show that two attributes of the right in rem attached to fiduciary guarantee, the absolute right and the droit de suite principle, cannot be enforced once the object has been confiscated, since it passes into state ownership and may no longer be used by any party. Confiscation does not extinguish the principal debt, so the debtor remains obligated to settle it, but the creditor's standing is reduced from preferred to concurrent creditor. The creditor's remaining remedies are to demand a substitute guarantee from the debtor or, failing that, to file a civil claim grounded in unlawful conduct under Article 1365 of the Civil Code.

Abstract

The rapid advancement of financial technology has led to the emergence of open banking systems, which grant standardized access to consumers’ financial data for third parties. This transformation presents significant opportunities for innovation while also raising serious challenges to personal data protection. This study aims to analyze the regulatory frameworks of open banking and personal data protection in Indonesia, Japan, and the European Union using a normative juridical method and comparative legal approach. The analysis examines policy structures, legal instruments, and supervisory mechanisms within each jurisdiction. The findings reveal that the European Union provides the most comprehensive legal framework through the integration of PSD2 and GDPR, ensuring a balance between financial innovation and privacy protection. Japan adopts a regulatory model emphasizing technical security and third-party licensing but still faces challenges in harmonizing with international standards. Indonesia remains in an early stage, with fragmented regulations between the banking and personal data protection sectors, necessitating regulatory synchronization to ensure legal certainty and consumer protection. This article recommends cross-sector harmonization and stronger regulatory oversight to build a secure and inclusive open banking ecosystem.
