Abstract

Indonesia's National Health Insurance program faces significant challenges, including financial deficits and declining membership, managed by the Social Security Administrative Body for Health (BPJS Kesehatan). This study explores legal opportunities for alternative funding to address these issues. It employed a normative juridical approach with secondary, primary, and tertiary legal sources to examine the implementation of the Law Number 24 of 2011 and the Government Regulation Number 53 of 2018. Although cigarette tax collection regulations aim to realize health funding, there are no optimal results. However, Indonesian law offers extensive opportunities, such as increasing cigarette excise rates, leveraging corporate social responsibility, and engaging in creative funding collaborations with the government, private sector, non-governmental organizations (NGOs), and communities. These strategies are proposed to mitigate the deficit, expand participant coverage, enhance the National Health Insurance program's quality, and improve overall health standards.

Abstract

Dalam Peraturan Menteri Kesehatan Nomor 24 Tahun 2022 tentang Rekam Medis Elektronik mewajibkan semua fasilitas pelayanan kesehatan menjalankan sistem Rekam Medis Elektronik (RME). Terdapat kendala – kendala seperti kesulitan dalam mengumpulkan data dari berbagai sumber yang tersebar di departemen-departemen berbeda dan potensi bocornya data rekam medis elektronik. Permasalahan dalam penelitian ini yaitu Bagaimana pengaturan kerahasiaan medik dalam Permenkes No. 24 Tahun 2022, dan Bagaimana tanggung jawab hukum Pemerintah dalam perlindungan rekam medis elektronik yang bocor dan merugikan hak-hak pasien? Jenis penelitian yang akan digunakan dalam tulisan ini yaitu yuridis normatif, mengacu kepada norma-norma hukum yang ada dalam Perundang-Undangan. Pendekatan yang digunakan yaitu Pendekatan Undang-Undang dan Pendekatan Konseptual serta data yang diperoleh yaitu data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian ini menunjukan bahwa Pemerintah bertanggungjawab dalam hal pengaturan kerahasiaan medis dan kebocoran data pasien di rekam medis elektronik dengan cara Regulasi dan Pengawasan, Pencegahan dan Deteksi Keamanan Data, Penegakan Hukum, Bantuan dan Pemulihan, serta Evaluasi dan Perbaikan Sistem.

Abstract

Patients have the right to accept and refuse treatment, and the right to receive information from their doctor before giving Consent to Medical Action. Patients have the right to self-determination as a basis for human rights, and the right to information owned by the patient about their illness and what medical action is to be performed on them. To find out the hymen examination carried out by medical personnel or health workers who meet the principles of propriety and do not violate professional ethics. The research method used in this study is in accordance with normative juridical supported by prescriptives related to the protection of women's human rights against medical actions regarding hymen examination using the 'two-finger' test method. The results of the study on secondary data (primary, secondary and tertiary legal materials), then obtained on the technical implementation of the examination contained in the Standard Operating Procedure Guidelines for the Implementation of Minimum Service Standards (SPM) in the Field of Integrated Services for Women and Children Victims of Violence. The conclusion is that hymen examination using the 'two finger' test method is very contrary to the law, both in terms of the Medical Practice Law, contrary to the medical code of ethics, contrary to the regulations of the Minister of Health, contrary to Human Rights and contrary to the recommendations of the World Health Organization (WHO).

Abstract

The outreach program to children in orphanages regarding the impact of theft and bullying, as well as preventive measures, is an important effort to raise awareness and provide better understanding to children who are vulnerable to such actions. The aim of this study is to evaluate the effectiveness of the outreach in reducing the risk of theft and bullying in orphanage environments. The method used is a descriptive approach with a qualitative design through interviews, observations, and distributing questionnaires to the children and caregivers in the orphanage. The outreach was conducted through interactive sessions with materials on the negative impacts of theft and bullying, as well as preventive strategies, including the importance of communication, empathy, and social skills. The results of the study show that after the outreach, children in the orphanage demonstrated a better understanding of the importance of protecting themselves from bullying and theft, and they exhibited higher awareness to avoid and report such incidents. This outreach program has a positive impact in creating a safer and more respectful environment in the orphanage

Abstract

Healthcare services are inherently complex and challenging activities, particularly in terms of medical risks and the potential for medical errors or malpractice. Medical risks, medical errors, and malpractice in healthcare are interconnected concepts that are interesting to examine together, as all three can have negative consequences for the patient's body. Therefore, it is essential to explore them further to distinguish between them clearly. This research aims to examine the legal aspects of the relationship between medical risk, medical error, and malpractice, as well as the potential legal liabilities that may arise in medical practice. The approach used is normative juridical, with primary sources including legislation, legal principles, and relevant scholarly literature. The findings suggest that medical risks are inherent consequences of any medical action, which cannot always be avoided, and do not imply negligence if performed in accordance with professional standards, ethics, and operational procedures. In contrast, medical errors refer to unintentional mistakes in the implementation or planning of medical actions, which still need to be evaluated to prevent recurring adverse impacts. Medical malpractice occurs when there is an element of negligence and a violation of professional standards that results in harm to the patient, potentially leading to both criminal and civil legal liability. By clearly distinguishing between medical risk, medical error, and malpractice, this research highlights the importance of therapeutic communication, the application of informed consent principles, and the need for balanced legal protection that balances both patient safety and medical personnel protection. Abstract

Program Jaminan Kesehatan Nasional (JKN) yang diselenggarakan oleh BPJS Kesehatan merupakan wujud pelaksanaan hak konstitusional atas pelayanan kesehatan. Namun, dalam implementasinya, muncul berbagai persoalan hukum, khususnya terkait tuduhan fraud (kecurangan) yang dialamatkan kepada rumah sakit mitra. Tuduhan ini seringkali disampaikan tanpa prosedur pembuktian yang jelas, serta tidak diiringi dengan perlindungan hukum yang memadai, sehingga menimbulkan ketidakpastian hukum dan ketimpangan relasi antara BPJS dan rumah sakit. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai pembuktian fraud dalam program JKN, mengevaluasi tanggung jawab hukum atas tuduhan yang tidak berbasis fakta, serta menilai penerapan prinsip keadilan dalam proses penegakan hukum administratif oleh BPJS. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum (legal vacuum) dalam mekanisme pembuktian tuduhan fraud oleh BPJS, yang membuka ruang bagi penyalahgunaan kewenangan dan potensi pelanggaran asas praduga tak bersalah serta keadilan substantif. Oleh karena itu, diperlukan penguatan regulasi yang lebih akuntabel dan berkeadilan untuk menjamin perlindungan hukum bagi rumah sakit sebagai mitra strategis dalam pelayanan kesehatan nasional.

Abstract

BPJS Kesehatan sebagai penyelenggara jaminan kesehatan nasional bertujuan untuk memberikan perlindungan bagi peserta dalam memperoleh layanan kesehatan yang layak. Tetapi terdapat pembatasan dan pengecualian terhadap beberapa jenis obat yang berdampak pada aksesibilitas terapi pengobatan bagi pasien. Penelitian ini menganalisis perlindungan hak pasien BPJS terhadap terapi pengobatan serta iuran biaya atas obat yang dibatasi dan dikecualikan, dengan berlandaskan pada regulasi seperti Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Permenkes No. 71 Tahun 2013 Pasal 13 ayat 1. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi literatur untuk menelaah aspek hukum dan kebijakan terkait. Hasil penelitian menunjukkan bahwa meskipun terdapat dasar hukum yang menjamin hak pasien, masih terjadi kendala dalam implementasi, terutama dalam pemenuhan kebutuhan medis yang tidak sepenuhnya tercakup dalam daftar obat yang ditanggung BPJS. Diperlukan evaluasi kebijakan guna memastikan keseimbangan antara efisiensi biaya dan hak pasien dalam mengakses terapi pengobatan yang optimal.

Abstract

Hospitals are institutions fraught with the risk of legal action, as they are dense with resources, technology, knowledge, and the risk of health measures. Health human resources (medical personnel, health personnel, and supporting personnel) carry out their work based on standards determined by the government, their profession, and the hospital, with permanent employee status or an agreement/contract, forming an employment relationship. On this basis, the hospital is responsible for negligence committed by its workers. The Corporate Liability Doctrine demands that the hospital be responsible for its workers who make mistakes. Apart from this doctrine, the theory of vicarious liability also explains the same thing. However, all accusations of negligence to obtain compensation must, of course, require proof of error in the action. Furthermore, health law does not only require hospitals to be responsible for clinics or community health centers, not being included in this category even though legally they are both legal entities. Apart from that, the amount of compensation borne by hospitals and health resources has not been regulated in the provisions, so it needs to be determined jointly by both parties because both parties have legal responsibility.

Abstract

Abstract:Technological development has become a key catalyst in transforming various aspects of human life, including the healthcare sector, through telemedicine services. Telemedicine has emerged as an innovative solution to address challenges in healthcare access, particularly during the COVID-19 pandemic, by offering convenience, efficiency, and affordability. One of the supporting technologies that strengthens the telemedicine system is artificial intelligence (AI), which can analyze medical data, accelerate diagnosis, and monitor patients in real time. AI branches such as Natural Language Processing (NLP) also play a role in processing unstructured medical data, thereby supporting efficient documentation and clinical decision-making. However, the application of AI in telemedicine requires serious legal and regulatory attention. In Indonesia, the legal framework governing telemedicine and AI remains limited, lacks comprehensiveness, and is not yet legally binding. This situation raises ethical risks, algorithmic bias, and uncertainty regarding legal liability. Meanwhile, countries such as the European Union, Singapore, and Australia have designed adaptive regulations oriented toward patient safety and data protection. In facing these challenges, legal accountability from the Indonesian government is required as part of the implementation of good governance principles. The government must formulate clear, transparent, and inclusive regulations while ensuring the involvement of medical professionals in AI-based decision-making. Such measures will serve as strategic elements in building a safe, fair, and sustainable digital healthcare system.

Abstract

Sistim Jaminan Sosial Nasional diatur dalam Undang -Undang Nomor 40 Tahun 2004 yang telah mengamanatkan bahwa program Jaminan Kesehatan melalui suatu Badan Penyelenggara Sosial. Dengan terselenggaranya program Jaminan kesehatan BPJS Kesehatan memiliki tugas, fungsi, wewenang untuk menjamin terselenggaranya Program Jaminan Sosial antara lain memiliki kewenangan yaitu kewenangan atribusi yang diperoleh langsung dari peraturan perundang-undangan. Permasalahan dalam penelitian ini adalah bagaimana kewenangan dan tanggung jawab BPJS Kesehatan dalam penyelesaian sengketa klaim rumah sakit. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normative dengan data sekunder (Studi Kepustakaan). Pendekatan penelitian ini menggunakan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Setelah data terkumpul, data tersebut diolah secara kualitatif dan ditarik dengan menggunakan Teknik penarikan Kesimpulan. Hasil penelitian ini menunjukan bahwa sengketa klaim dapat menimbulkan perselisihan atas perjanjian kerjasama dan dapat terjadi wanprestasi oleh salah satu pihak yang diatur pada Pasal 1238 KUHPerdata bahwa debitur dianggap melakukan wanprestasi apabila kewajiban membayar lewat batas waktu sesuai perjanjian. Hal-hal yang membuat sumber masalah dalam pelaksanaan kerjasama fasilitas kesehatan ini berdampak resiko kerugian pada rumah sakit. Untuk mengurangi terjadinya sengketa klaim, maka perlu pengaturan detail tentang hal-hal yang berpotensi menyebabkan perbedaan penafsiran pada klaim termasuk pengaturan tentang kewenangan dan tanggungjawab BPJS dalam penyelesaian sengketa klaim yang adil dan bermartabat agar ada perlindungan hukum dan kepastian hukum bagi rumah sakit peserta BPJS.
