Abstract

To provide specialist health care closer and improve quality in health care facilities, especially for remote areas, the central government utilizes information and communication technology through telemedicine services among health care facilities. This matter is regulated in the Ministry of Health Regulation No. 20 Tahun 2019 tentang Penyelenggaraan Telemedicine Antar Fasilitas Pelayanan Kesehatan. This article aims to describe the forms of legal responsibility and professional responsibilities of doctors in telemedicine services among health care facilities. The method used in this study is normative juridical. The study results show that physicians' responsibilities in telemedicine services among health care facilities can be divided into legal responsibilities (which are divided into civil, criminal, and administrative) and professional responsibilities (ethics and discipline). Doctors’ responsibility in telemedicine services among health care facilities is an obligation that doctors must fulfill because obligations are nothing but part of the tasks carried out in a particular work environment.

Abstract

Background : Doctors who practice through application-based telemedicine do not have a clear legal regarding the services they provide. Telemedicine regulations that exist in Indonesia are still inadequate to cover all actions in telemedicine transactions, especially for legal protection for doctors who are legal subjects in this transaction. Given that until now, every telemedicine transaction must be under a Health Service Facility or an Online Doctor Consultation Service Provider. Thus, the doctor here as a provider of consulting services is actually not the main person who makes this transaction possibleMethod: Normative juridical approach, namely research conducted byhow to examine theories, concepts, legal principles and legislation related to this researchResults: Article 50 of law number 29 of 2004 concerning medical practice explains that a doctor has the right to obtain legal protection as long as his actions are in accordance with professional standards and standard operating procedures. In terms of application-based telemedicine, doctors do not have a practice permit, but during the COVID-19 pandemic, telemedicine was developed massively, the pandemic was considered an emergency, so the KKI regulation NUMBER 74 of 2020 concerning clinical authority and medical practice through telemedicine was issued during the COVID-19 period. The limit of clinical authority for application-based telemedicine practice is limited to consultation, not including medical action and administration of hard drugs.Conclusion: A doctor who has pocketed the STR is authorized to provide health services in accordance with his competence. The authority obtained by a doctor who has an STR is a form of recognition given by the government to the doctor concerned that he is worthy to provide health services in the form of medical practice. The limit of clinical authority for application-based telemedicine practice is limited to consultation, not including medical action and administration of hard drugs.

Abstract

Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk memperkuat kapasitas aparatur desa dan masyarakat untuk mempersiapkan Desa Way Huwi menjadi Desa Sadar Hukum. Kesadaran hukum menjadi aspek penting dalam sebuah sistem hukum. Peraturan perundang-undangan yang ada dalam penyelenggaraan pemerintahan desa akan menjadi tidak efektif bila belum diiringan oleh budaya hukum. Salah satu cerminan masih belum kuatnya kesadaran hukum dalam penyelenggaraan pemerintahan desa adalah masih terbatasnya desa yang menyusun peraturan desa sebagai instrumen dalam pembangunan desa. Pembentukan peraturan desa ini penting sebagai legitimasi kebijakan pemerintahan desa berdasarkan kewenangan desa. Sasaran khalayak dalam kegiatan ini adalah Pemerintah Desa, Badan Permusyawaratan Desa, dan perwakilan masyarakat. Lokasi kegiatan dilaksanakan di Desa Way Huwi, Kabupaten Lampung Selatan. Metode yang digunakan dalam kegiatan ini yaitu melalui ceramah, dan focus group discussion. Hasil dari kegiatan ini, yaitu para peserta semakin meningkat pemahamannya mengenai budaya sadar hukum dan peningkatan kesadaran hukum dalam penyelenggaraan pemerintahan desa. Kata Kunci: Budaya Hukum, Sadar Hukum, Pemerintahan Desa.

Abstract

In Indonesia, the increase in the number of medical disputes reflects dissatisfaction with health services. This study aims to analyze the role of MKDKI as a law enforcement tool in cases of violation of doctors' professional standards, as well as supporting and inhibiting factors for the implementation of this role. The research method used is the empirical normative method. The data collected was analyzed to identify how MKDKI carried out its role in handling violation cases. The results of the study show that the Government has established laws and established KKI, MKDKI, and MKEK to protect the doctor-patient relationship. This panel assesses disciplinary violations based on operational and professional standards. The effectiveness of the Assembly is influenced by regulations, member commitment, institutional support, and resources. Obstacles such as inadequate regulation and external intervention need to be overcome through regulatory revision strategies, increased resources, and transparency. The suggestion in this study is to increase transparency and consistency in handling cases of violations of doctors' professional standards, the Indonesia Medical Honorary Council (MKDKI) needs to be supported by strong regulations and the support of related institutions. It is also important to establish MKDKI in each province and conduct socialization about their roles, as well as ensure that their decisions are in line with the Indonesia Medical Council (KKI)

Abstract

This service aims to enhance awareness of personal data protection among Lampung residents in the digital era. As information technology advances, personal data has become a valuable yet vulnerable asset, at risk of theft, misuse, and privacy violations. Many individuals remain unaware of the importance of safeguarding their data and their rights. Through counseling, training, and outreach in schools, communities, and local institutions, this initiative educates the public on data protection regulations and best practices for securing personal information online. Using a participatory approach, the program engages participants in discussions, simulations, and case studies to foster deeper understanding. Results demonstrate increased knowledge, heightened awareness of data threats, and the adoption of safer digital practices. This initiative aims to empower Lampung's residents to better protect their personal data and mitigate privacy risks in an increasingly digital world.

Abstract

Arbitration serves as a dispute resolution method that offers notable benefits, especially in cases related to medical issues. In contrast, other methods such as litigation are often seen as less effective, while mediation lacks executory power due to the absence of legal enforceability, making agreements vulnerable to cancellation. In Indonesia, arbitration has not yet been adopted for resolving medical disputes, as specific technical regulations are still needed to guide relevant institutions and establish effective mechanisms. This research highlights the importance of implementing arbitration in Indonesia’s medical dispute resolution framework, using a comparative analysis of practices in the United States. Employing normative legal research with qualitative data analysis and comparative examination of international legal practices, the findings reveal that arbitration offers a binding and final resolution, making it a highly effective approach for handling medical disputes. To facilitate its adoption in Indonesia, comprehensive technical regulations and a legal framework—similar to the United States’ Uniform Arbitration Act (UAA), which outlines arbitration requirements for individual states—are necessary.

Abstract

The cessation of healthcare services has traditionally required informed consent from the patient or their legal representative. However, with the enactment of Article 273 paragraph (2) of Law No. 17 of 2023 on Health, Indonesian medical personnel are now permitted to halt services unilaterally when faced with acts of violence, harassment, or degrading treatment. While this provision affirms the importance of healthcare worker safety, it also creates legal and ethical dilemmas, particularly regarding the limits of professional duty and the risk of being accused of negligence. The legal ambiguity surrounding the implementation of Article 273 further complicates the responsibilities of healthcare providers and the protection mechanisms available to them. In response to these challenges, this study addresses three main objectives: (1) to examine the scope of legal protection afforded to medical personnel who terminate healthcare services under Article 273, (2) to analyze the ethical and legal responsibilities that arise from such actions, and (3) to assess the political and institutional context that shaped the article’s development, as well as the practical barriers to its enforcement. By combining doctrinal legal analysis with a legal-political perspective, this research contributes to a more comprehensive understanding of how law, policy, and ethics intersect in regulating healthcare delivery in conflict-prone settings.

Abstract

The National Health Insurance Program (JKN) by BPJS Kesehatan provides broad access to health services to the public, but also presents its own challenges for doctors in carrying out their professional duties. The high workload, limited facilities, and patient expectations can pose a risk of criminalization for medical actions, even though they are in accordance with professional standards. This study aims to examine the forms and limits of criminal liability of doctors in BPJS services based on positive law in Indonesia, as well as examine how the principles of medical ethics become the basis of legal protection for doctors. The method used is a normative juridical approach with a literature study of relevant laws and regulations, such as Law Number 17 of 2023 concerning Health, Criminal Code, Presidential Regulation Number 59 of 2024 as an amendment to Presidential Regulation Number 82 of 2018 concerning Health Insurance, and other professional regulations. The results showed that doctors in the JKN system by BPJS have limited criminal liability, as long as medical actions are carried out according to professional standards and operational procedures. Medical ethical principles such as beneficence, non-maleficence, autonomy, and justice provide an important basis for legal protection, especially when doctors face a dilemma between professional obligations and system restrictions. Integration between law, ethics, and policy is needed to ensure fair legal protection for doctors in the practice of national health services

Abstract

Visum et repertum is an important piece of evidence in the criminal justice process that serves to bridge the gap between the medical and legal worlds. In practice, the limited number of forensic expert doctors causes the visum et repertum to be issued by general practitioners or doctors who are not forensic experts. This raises a debate regarding the legality and validity of the visum in the process of proving a criminal offense. This paper aims to analyze the legal basis and validity of a visum et repertum made by a doctor who is not a forensic expert from a medicolegal perspective. The method used is the approach of legislation, scientific literature, and case studies. The results of the study show that in order to guarantee fair legal protection for doctors in the practice of national health services. The legality of general practitioners has the authority to make a visum et repertum in accordance with the Criminal Procedure Code and Permenkes, as long as it is carried out based on their professional competence. However, in terms of medicolegal validity, a medical report made by a doctor who is not a forensic expert has the potential to cause weaknesses in evidence if it is not prepared with adequate forensic standards. The novelty of this paper lies in emphasizing the importance of standardizing medical-legal training for non-forensic doctors as a medium-term solution to the limited number of forensic experts in the criminal justice system in Indonesia.]

Abstract

Penolakan ahli waris terhadap harta warisan merupakan isu penting dalam sistem hukum Indonesia karena melibatkan pluralisme hukum antara Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan hukum Islam. Fenomena ini sering menimbulkan sengketa keluarga akibat perbedaan interpretasi mengenai hak dan kewajiban ahli waris dalam proses pembagian harta. Penelitian ini bertujuan menganalisis persamaan dan perbedaan konsep penolakan waris menurut kedua sistem hukum serta implikasinya terhadap kepastian hukum dan keadilan. Pendekatan yang digunakan adalah yuridis normatif dengan analisis komparatif, memanfaatkan data sekunder berupa peraturan perundang-undangan, doktrin, jurnal ilmiah, dan publikasi internasional. Hasil penelitian menunjukkan bahwa dalam KUHPerdata, penolakan waris harus dilakukan melalui prosedur formal di pengadilan dan berdampak pada hilangnya hak atas seluruh bagian harta peninggalan, sedangkan dalam hukum Islam konsep takharuj menekankan musyawarah, kerelaan, dan kesepakatan bersama tanpa prosedur formal yang kaku. Temuan ini menegaskan pentingnya harmonisasi antara kedua sistem hukum untuk mewujudkan mekanisme pembagian harta waris yang lebih adil, inklusif, dan responsif terhadap keberagaman sosial
