Abstract

This research delves deeper into the longstanding practice of appointing heirs as leaders of funeral prayers within the cultural tapestry of the Kurai community in Bukittinggi. It endeavors to unravel the socio-cultural fabric that deems heirs as appropriate custodians of this sacred ritual, exploring the historical evolution and societal roles entrenched in traditional funeral ceremonies. Methodologically, this research utilizes a qualitative approach through in-depth interviews with local community leaders to gain a direct understanding of the appointment of heirs as leaders of funeral prayers. This approach is enriched by scholarly discourse on highly relevant legal and religious issues, enhancing the analysis with theoretical perspectives and comparative viewpoints. By synthesizing these interdisciplinary approaches, the research aspires to unravel the intricate nuances and underscore the profound significance of heirs assuming the mantle of funeral prayer leadership in the Kurai community in Bukittinggi. The findings from this study are anticipated to yield nuanced insights into the intricate interplay between indigenous traditions and Islamic principles within the realm of religious practices in the Kurai community. This scholarly inquiry aims to foster novel perspectives and enrich ongoing dialogues on how local adaptations harmonize with and enrich Islamic values in everyday life. In contribution to existing literature, this research offers a deeper understanding of the socio-cultural dynamics that influence the appointment of heirs as funeral prayer leaders. It also provides a nuanced exploration of the legal and religious implications of this practice, thereby contributing to broader discussions on the adaptation of Islamic norms in local contexts.

Abstract

This article examines the characteristics and transformations of Islamic law in the Islamic sultanates of Indonesia through a historical-normative approach combined with comparative analysis. The study aims to identify patterns of Islamic law implementation and to analyze its dynamic relationship with customary law (adat) and political authority during the pre-colonial period. Data were collected through library-based research, including legal manuscripts, royal chronicles, customary texts, and relevant scholarly literature. The findings demonstrate that Islamic law in the Islamic sultanates of Indonesia did not develop as a uniform or rigid system, but rather evolved in diverse, contextual, and adaptive forms. Four main models of Islamic law implementation are identified: normative-social, normative-formal, integrative adat–sharia, and legal codification models. These variations were shaped by local social structures, political authority, and indigenous legal traditions within each sultanate. The study further reveals that from its early development, Islamic law in Indonesia operated within a framework of legal pluralism through continuous processes of negotiation and accommodation. This research contributes to a deeper historical understanding of the foundations of contemporary Islamic law in Indonesia.

Abstract

This research examines the position of harta pusako tinggi in Minangkabau and the process of ta’lil al-ahkam in relation to waqf property, identifying the similarities and differences between the two. The research employs a qualitative approach, utilizing library sources and interviews, which are then formulated through inductive and deductive reasoning. The findings indicate that Minangkabau scholars analogize harta pusako tinggi to waqf, with particular emphasis on the aspect of legal validity (the permissibility of its utilization). Harta pusako tinggi and waqf are not entirely identical; rather, they share many similarities while also exhibiting several differences. Nevertheless, these differences do not hinder the validity of the analogy. From the perspective of ta’lil al-ahkam, waqf functions as the ashl (principal case), while harta pusako tinggi constitutes the furu‘ (derivative case). The ‘illah underlying this analogy is the characteristic of al-ḥabs, namely the practice of restraining property so that it may provide long-term benefits and prevent various forms of taṣarruf (disposal or transfer) over it. The legal ruling of the ashl is the permissibility of its utilization and legal legitimacy; such property may be used and continuously transmitted to subsequent generations in accordance with the established system. This form of analogy serves as a rebuttal to views that prohibit the utilization of harta pusako tinggi and, instead, reinforces its existence, continuity, and protection from extinction. In this regard, the concepts inherent in waqf can contribute to refining and complementing the existing regulations governing harta pusako tinggi.

Abstract

The development of National Strategic Projects (NSP) requires a substantial amount of land. However, the land acquisition process in Indonesia often encounters the complexity of legal pluralism, particularly in regions where customary law remains deeply rooted, such as West Sumatra, Jambi, and Riau. In West Sumatra, communal and sacred ulayat rights pose significant challenges to the implementation of land acquisition under Law No. 2 of 2012. Similarly, in Jambi and Riau, various forms of customary land rights remain fundamental to local decision-making, which often diverges from state law. This study examines the dynamics of interaction between state law and customary law in NSP land acquisition through a comparative approach. The findings reveal that disharmony between these two legal systems can trigger agrarian conflicts and social resistance, potentially obstructing development. Nevertheless, legal pluralism also provides opportunities for negotiation, adaptation, and the creation of more inclusive models of legal harmonization. This study emphasizes the importance of participatory and responsive approaches in national agrarian policy to ensure that NSP development proceeds in a just manner while respecting local wisdom.

Abstract

Penelitian ini bertujuan untuk menginterpretasikan bentuk pengorbanan seorang ibu yang terdapat dalam lirik lagu لغات العالم / lugāt al-‘ālam. Metode yang digunakan dalam penelitian ini adalah deskriptif analitik, yaitu menemukan dan mengungkapkan permasalahan secara sistematis dengan cara mendeskripsikan fakta-fakta terlebih dahulu lalu kemudian dianalisis. Dalam hal analisis, penelitian ini menggunakan teori semiotika riffaterre yang terrdiri dari beberapa tahapan seperti pembacaan heuristic dan hermeneutic, ketidak langsungan ekspresi, matriks, model, varian, dan hipogram. Adapun hasil dalam penelitian ini menunjukkan beberapa hal; pertama, lagu ini bertemakan kebaikan hati dan pengorbanan seorang ibu yang direpresentasikan melalui beberapa kata, seperti kata يا جنانا, يا حنانا, يا عيونا, kemudian kata يَا مَلَاذًا, يَا أَمَانًا, يَا رَحِيْقًا kedua, lagu ini merepresentasikan perasaan penyanyi terhadap ibunya yang digambarkan melalui lirik منذ ولدت وحرف الميم تراقص بفمي. Selanjutnya, kesimpulan dalam penelitian ini bahwa lirik lagu لغات العالم / lugāt al-‘ālam baik secara eksplisit maupun implisit bercerita tentang kasih sayang dan kebaikan hati seorang ibu sebagai bentuk pengorbanan untuk anaknya.

Abstract

The childfree phenomenon has become a growing social issue in modern society, including in Indonesia. The decision of married couples not to have children has generated various public responses because it is often considered contrary to cultural values, religious teachings, and the traditional purpose of marriage. On the other hand, modernization and changing social perspectives have led some groups to view childfree as an individual right in determining family life. This study aims to analyze public perceptions of the childfree phenomenon within modern marriage institutions, identify the factors influencing societal acceptance and rejection, and examine the shifts in social values related to family institutions. This research employed a qualitative method with a descriptive-analytical approach. The study was conducted as field research using interviews, observations, and documentation as data collection techniques. The informants consisted of community members, married couples, religious leaders, and community leaders. The data were analyzed through data reduction, data presentation, and conclusion drawing. The findings reveal that public perceptions of childfree are divided into two groups: those who accept and those who reject the phenomenon. The accepting group views childfree as a personal right of couples in determining their household life, while the rejecting group considers it inconsistent with cultural and religious norms. Furthermore, cultural, religious, economic, educational, and social media factors significantly influence public perceptions of childfree. This study contributes to understanding the transformation of marriage values in modern society, where marriage is increasingly oriented toward emotional fulfillment and quality of life rather than solely reproduction.
