Abstract

This research aims to identify the contribution of fatwa (Islamic instructions of rules) from DSN-MUI in developing the theories and practices of the Islamic economics in Indonesia. The research method used is qualitative, which consists of 116 fatwa DSN-MUI as the main subjects of study. The collected data had been analyzed using content analysis method by creating inimitable and valid data inferences related to its context. The results show that DSN-MUI is the only institution mandated by the law to establish fatwa on Islamic economics and finance, and to provide the provisions of Islamic law toward the Islamic financial institutions in carrying out their activities. Since its establishment in 1998, the roles of DSN-MUI are enormous in laying the foundations of the development of Islamic economics in Indonesia. Until the end of 2017, DSN-MUI has issued 116 fatwa on Islamic economics and finances. Even, DSN-MUI has a very important and strategic role in developing and applying sharia values in the economic field. MUI's important and strategic roles are shown from its position as a pioneer in socialization, internalization, and triggering the Islamic economic growth in Indonesia.

Abstract

This article aims to examine the model of Islamic studies and local wisdom in Islamic State Universities (PTKIN) in Central Java. The method used is qualitative with the sociology of religion approach and belongs to the category of policy research, which is expected to help in recommending effective and efficient policies. The results of this study show that: first, the values ​​of Islamic studies and local wisdom enter into the course at PTKIN, developed through the academic community activities and entered into the structure of Islamic Higher Education, even though using different nomenclature. This study of Islam and local wisdom includes cultural and Islamic acculturation, cultural studies of the Grebeg Besar, Dandangan, Sekaten and other cultures that also have an Islamic spirit. Second, Islamic values ​​and local wisdom developed by the Islamic State Universities in Central Java can sow religious moderation. This can be proven from the ideas, thoughts, and attitudes of the academic community in accepting the differences and heterogeneity of various religious discourses in Indonesia.

Abstract

This paper aims to investigate the resilience of millennial Muslim families in Indonesia in the face of the COVID-19 outbreak. The indicators examined were their resilience in gender partnerships, health and security, economic conditions, social-psychological resilience, and social-cultural resilience. The sample of data used in this study were 403 respondents. This research is a quantitative descriptive. The SPSS tool is used to describe the percentage of respondents' answers. The results showed that the gender partnership, health and safety, psychological social resilience, and socio-cultural resilience were in a quite good condition, but the economic conditions of the millennial Muslim family were the opposite. Family science practitioners can estimate millennial Muslim family behavior after the COVID-19 pandemic through this article. As for academics, this article is used for further research by integrating millennial Muslim family endurance. Empirically this research is useful to increase understanding of family resilience in the face of crisis. Millennial Muslim family resilience is a relatively new phenomenon for practitioners and academics. This research is a preliminary study that investigates the resilience of millennial Muslim families. Therefore, this investigation will serve as an investigation of knowledge about the resilience of millennial Muslim families when a virus outbreak occurs in Indonesia and the world.

Abstract

This article reviews the breadth of the influence of Arabic on the languages of Nusantara, from the early arrival of Islam in the archipelago to the modern era.1 Focusing on both linguistics and culture, we pay attention to precolonial exchanges, regional languages – in particular Bima, Sasak, Javanese, Sundanese, and Bugis – and the recent influence of Arabic and Islamic culture on the development of technological products, Islamic financial systems, and Islamic lifestyles in contemporary Indonesia. From era to era, Arabic has not only played a role in enriching the vocabulary of the languages of Nusantara, it has also contributed to the social, religious, educational, literary, philosophical, legal, political, scientific, and cultural domains.

Abstract

This article aimed to analyze the perspective of Kiyahî Shâlih Darat in integrating fiqh and Sufism which are generally considered different from one another. Fiqh tends to illustrate the outward side in deriving legal rulings from the Qur’an and Sunnah, while Sufism tends to refer to the inner side in applying the teachings. The integration between both is deemed necessary to balance the internal and external dimensions of Muslim life, as they are an inseparable unit. This research is a qualitative library one with the data collected from the books of Kiyahî Shâlih Darat and research on his ideas. It is furthermore a study that attempts to analyze the contents of Kiyahî Shâlih Dârât’s thought objectively and scientifically to find its meanings and values. The results showed that the Kiyahî Shâlih Darat mastered various disciplines ranging from fiqh, Sufism, tafseer to hadith. His thought reflects the manifestation of a perfect religious intellectual spirit. He interpreted the Islamic teaching and its ritual practices in the context of carrying out the integration between fiqh which emphasized the outward aspects and sufism which focused on the inner ones. According to him, Muslims who only rely on one of both and ignore another cannot be considered perfect Muslims because Islam does not only give attention to external things but also internal ones. Likewise, Islam not only regulates the soul but also takes care of physical matters. Fiqh without Sufism, as he mentioned, will be empty, while Sufism without fiqh will be futile so real Islam is a combination between both.

Abstract

Indonesian Muslims tend to seek religious solutions to face their problems, one of which is by referring to the fatwa of the Indonesian Ulama Council (MUI). Considering the position of hadith as a source of teachings in Islam, exploring the existence of hadith in legal formulations and the establishment of fatwas is also important. This research aims to reveal the use and absorption of hadith as a source of Islamic law in the determination of the Fatwa of the Indonesian Ulama Council as stated in the MUI Fatwa Association Book since 1975, totalling 173 fatwas, focusing on socio-cultural fatwas of 64 fatwas. This research used a qualitative method with a descriptive-critical approach. The research results show that of the 64 fatwas in the social and cultural fields, almost the majority use hadith as a source of law in formulating their fatwas. There are 51 fatwas related to social and cultural fields that use hadith as a source of law, while 13 other fatwas do not involve hadith in their legal sources. The total number of hadiths that are a source of law in the formulation of MUI fatwas in the socio-cultural field is 222 hadiths. Quoting hadiths in the determination of the fatwa of the Indonesian Ulama Council (MUI) in the Social and Cultural Sector as stated in the MUI Fatwa Association since 1975 generally uses two techniques: First, citing by including the source or narrator who transmitted the hadith from the Prophet PBUH. Second, quoting without mentioning the name of the hadith transmitter. All the hadith referred to by the MUI are of authentic quality and can be verified for their authenticity. [Muslim Indonesia memiliki kecenderungan untuk mencari solusi yang bersifat religius dalam menghadapi problem mereka, salah satunya dengan merujuk pada fatwa Majelis Ulama Indonesia (MUI). Mengingat kedudukan hadis sebagai salah satu sumber ajaran dalam Islam, maka menggali eksistensi hadis dalam formulasi hukum dan penetapan fatwa juga menjadi penting. Penelitian ini bermaksud mengungkap penggunaan dan penyerapan hadis sebagai salah satu sumber hukum Islam dalam penetapan Fatwa Majelis Ulama Indonesia sebagaimana yang tertuang dalam Buku Himpunan Fatwa MUI sejak 1975 yang berjumlah 173 fatwa dengan memfokuskan pada fatwa bidang sosial budaya sebanyak 64 fatwa. Penelitian ini menempuh metode kualitatif dengan pendekatan deskriptif-kritis. Hasil penelitian menunjukkan bahwa dari Dari 64 fatwa bidang sosial dan budaya hampir mayoritas menggunakan hadis sebagai sumber hukum dalam perumusan fatwanya. Terhitung 51 fatwa terkait bidang sosial dan budaya yang menggunakan hadis sebagai salah satu sumber hukum, sedangkan 13 fatwa lainnya tidak melibatkan hadis dalam pengambilan sumber hukumnya. Jumlah keseluruhan hadis yang menjadi sumber hukum dalam perumusan fatwa MUI dalam bidang sosial budaya adalah 222 hadis. Pengutipan hadis dalam penetapan fatwa Majelis Ulama Indonesia (MUI) Bidang Sosial dan Budaya sebagaimana yang tertuang dalam Himpunan Fatwa MUI sejak 1975 secara umum menempuh dua teknik: Pertama, pengutipan dengan menyertakan sumber atau periwayat yang mentransmisikan hadis tersebut dari Nabi Saw. Kedua, pengutipan tanpa menyebutkan nama transmittor hadis. Keseluruhan hadis yang dirujuk MUI tersebut berkualitas shahih dan dapat dipertanggung jawabkan kehujjahannya.]

Abstract

Penelitian ini dilakukan untuk mengetahui kebenaran implementasi PERMA No. 5 Tahun 2019 dari kasus dispensasi nikah pada putusan no. 134/Pdt.P/2022/PA.Kds, serta untuk mengetahui pemaknaan kepentingan terbaik anak dalam putusan dispensasi pernikahan tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian kepustakaan dengan cara mengungkap data peristiwa yang pernah terjadi di Pengadilan Agama Kudus dalam bentuk data yang valid. Dalam memperoleh sumbernya, penulis menggunakan bahan hukum primer berupa PERMA No. 5 Tahun 2019 dan nomor keputusan 134/Pdt.P/2022/PA.Kds, sedangkan bahan hukum sekunder dikumpulkan langsung oleh peneliti sebagai penunjang dari sumber data pertama yaitu hasil wawancara lanjutan untuk selanjutnya dianalisis menggunakan pendekatan perundang-undangan dan penafsiran hukum gramatikal. Hasil penelitian ini menunjukkan bahwa pemberian dispensasi pada putusan hakim nomor 134/Pdt.P/2022/PA.Kds menggunakan metode penemuan hukum dan dengan banyak pertimbangan. Dari semua pertimbangan tersebut, tujuan hakim adalah kelangsungan hidup anak dan kepentingan terbaik anak. Pemberian putusan dispensasi dalam hal ini sesuai dengan ketentuan PERMA Nomor 5 Tahun 2019 baik secara produral maupun substantif yang pada dasarnya demi melindungi hak-hak anak pemohon dispensasi pernikahan. Pertimbangan hakim dalam putusannya semata-mata atas dasar perlindungan, kelangsungan hidup anak, dan kepentingan terbaik anak serta pemberian dispensasi nikah juga didasarkan untuk melindungi anak dari sanksi sosial yang terjadi di masyarakat yang sering kali mengucilkan mereka karena sudah hamil dan melahirkan sebelum perkawinan terjadi.

Abstract

This paper examines the Indonesian Ulama Council (MUI) fatwa in responding and tackling the spread of COVID-19 in Indonesia using the Maqashid Sharia perspective. Maqashid Sharia is the objective of Islam contained in every enforcement of religious rules. The approach used is juridical-phenomenological. Juridically, a fatwa can be an alternative law in dealing with the spread of COVID-19. The phenomenological approach seeks and discovers the meaning of essential phenomena regarding handling COVID-19 cases in Indonesia. The result shows that Maqashid Sharia applied in the MUI fatwa in avoiding COVID-19 appear in four aspects: First, maintaining health and avoiding everything that may cause exposure to the disease. Second, people affected by the COVID-19 disease are obliged to isolate themselves so that transmission does not occur to others. Third, it prohibits activities involving public gatherings and worship at home to break the chain of distribution of the COVID-19 virus. Fourth, prohibit all actions that cause panic and cause public harm, such as buying up and hoarding necessities, hand sanitizers, and hoarding masks. These four aspects relating to the Maquashid Sharia, follow its core values, which ultimately guard the soul.
