Abstract

Coastal reclamation is an effort to establish a new land area in the coastal area. The main objective of reclamation is to turn the untapped coastal area into a new area that is better for various people's lives, such as residential, industrial, airport, waste and environmental management areas, tourist areas, and other strategic purposes. Reclamation is carried out to increase the benefits of land resources from a socio-cultural, economic, and environmental point of view by utilizing the land to become more useful. Several cases of coastal reclamation, such as the reclamation of the north coast of Jakarta, the coast of Makassar, and Benoa Bali, have raised pros and cons and have had a significant impact on the lives of local communities, especially on environmental, economic, and socio-cultural aspects. This is very influential on the condition of the National Resilience of the Indonesian nation, especially the area. This research aims to conduct a comprehensive study of the impact of coastal reclamation on National Resilience. Activities start from a comprehensive understanding of the system that occurs through a critical review of previous research. As for based on preliminary observations and critical studies of previous research, which is followed by the preparation of significant factors from the environmental, economic, and socio-cultural aspects. Abstract

Ecotourism's dependence on climate resources makes it one of the industries considered to be the most vulnerable. This study aims to analyze the socio-economic conditions of vulnerability and resilience of coastal and marine natural resources related to ecotourism development. Data analysis used descriptive qualitative analysis to identify perceptions of disaster characteristics and impacts and climate variability, as well as quantitative descriptive analysis to calculate changes in the household income of the Tamban Beach community and the level of resilience and vulnerability using the Livelihood Vulnerability Index (LVI) method. The results show that the highest value of the main component is the ecology of 0.880, so it becomes the most vulnerable component. The factor with the highest value is the sensitivity, which is 0.475 and is the weakest. The LVI value in Tamban Beach is 0.311, indicating that community households in the area have a reasonably low vulnerability to coastal and marine resources in Tamban Beach. The household resilience level of the Tamban Beach community is mostly in the moderate category, as much as 45%. The Tamban Beach community needs to participate in seeking information on climate change actively weather forecasts together with related institutions.

Abstract

The status of Indonesia as an archipelago state is stated clearly in the Indonesian Constitution. Indonesia’s territory consists of three dimensions: land, sea, and air. To maintain the order of the State, the State’s security is crucial. It is further argued that State’s security in all territorial dimensions can be established through a comprehensive inward-looking approach. With this approach, national security can be achieved while holding on to the principles of national resilience. In order to maintain a stable national resilience, sustainable policies are needed to govern the land, air, and ocean territory. This research analyses whether existing policies in a state’s territorial governance are sufficient to maintain national resilience. Using a multi-disciplinary approach that combines descriptive-qualitative and normative-juridical methods, this research recommends a policy model for governing the State’s territory towards maintaining national resilience in Indonesia. While the inward approach is preferable, contemporary threats to national resilience need to be considered by considering an outward-looking approach.

Abstract

The research explores the nexus between taxation laws, climate change control, and energy transition acceleration, focusing on Indonesia's legal framework and international commitments. Highlighting Indonesia's ratification of the Kyoto Protocol and its subsequent policies, including the adoption of carbon taxes, the study underscores the need for effective fund allocation to combat climate change and accelerate the transition to renewable energy sources. Using a normative juridical research approach, the study analyzes legal provisions, literature, and comparative frameworks to elucidate the regulatory landscape. It identifies gaps in the current legal framework concerning carbon tax allocation and calls for establishing clear regulations to ensure transparency, accountability, and efficiency in fund utilization. Drawing upon legal principles such as environmental justice, prevention of environmental damage, and sustainability, the study advocates for a holistic approach to environmental protection and management. It proposes recommendations for formulating government regulations, emphasizing the importance of defining terms, outlining implementation procedures, and instituting mechanisms for monitoring and evaluation. Ultimately, the research underscores the pivotal role of law in addressing climate change and advancing sustainable development. By aligning taxation laws with environmental objectives, Indonesia can harness carbon tax revenues to foster renewable energy development, mitigate climate change impacts, and promote long-term ecological sustainability

Abstract

Napan Village, North Bikomi District - North Central Timor Regency - East Nusa Tenggara is some of the areas that border Indonesia on land with neighboring countries. Napan Village shares a land border with Timor Leste. Various issues regarding security, prosperity and the environment in development often arise. This research was conducted to develop models dynamically in three development scenarios using these three approaches. The research sample was obtained using a questionnaire distributed to 78 respondents consisting of village soldiers and police, Napan village officials, the North Bikomi sub-district head, and border officers in Napan village. From the results of the questionnaire, descriptive analysis and multiple regression analysis were carried out to obtain a regression model of the influence of security, prosperity, and environmental approach variables on border area development. Next, the analysis results are used to develop a system dynamics model with three simulation scenarios. The reference used in this simulation is the average data value for each variable minus and adding one standard deviation and the equation resulting from multiple regression analysis. The simulation results show that the target for achieving development in border areas will reach 73% within 5 years if input from security, prosperity, and environmental factors is increased from the current condition of 8% for security, 6% for prosperity, and 9% for the environment. Furthermore, it is recommended to increase development on factors in security, prosperity, and environmental approaches according to these results so that in the next five years significant progress can be achieved, which reaches almost double the current conditions.

Abstract

Infrastructure is an instrument to facilitate the rotation of the economy so that it can accelerate development. Funding is a major challenge in national infrastructure development. The state budget is only able to support about one-third of the total infrastructure funding required. Unconventional financing alternatives provide significant benefits to national infrastructure development. Unconventional state-owned infrastructure financing has a positive impact on national economic resilience. Increasing the speed of infrastructure development by using non-conventional approaches, infrastructure development can be accelerated because it can involve private participation in financing and managing infrastructure projects. This research uses normative juridical method by using statutory approach and conceptual approach.

Abstract

This paper critically examines the intersection of state sovereignty and the provision of humanitarian assistance in the context of international armed conflicts, addressing a pressing and increasingly relevant issue in global legal discourse. While state sovereignty remains a cornerstone of international law, its application during armed conflict, especially regarding external humanitarian aid, raises complex questions of responsibility and intervention. Using a blend of primary and secondary legal sources, the study explores how sovereignty intersects with the state's obligations to protect and meet the needs of its citizens during conflict, in line with the theory of "responsible sovereignty." The research highlights the nuanced tension between a state's right to control its territory and its duty to ensure the welfare of its population, even in the midst of war. Despite the fundamental principle of sovereignty, states are bound by international norms to allow humanitarian assistance when their capacity to respond to crisis situations is overwhelmed, thereby preventing further human suffering. The study challenges the traditional view that external aid constitutes an infringement on sovereignty, instead arguing that the refusal of humanitarian assistance in times of need may violate international legal and moral obligations. This paper offers a novel perspective on sovereignty, proposing that in an era of global interconnectedness and humanitarian crises, responsible sovereignty should prioritize the protection of human life over rigid territorial control. The findings contribute to ongoing debates in international law, urging a rethinking of the state's role in conflict zones and the responsibility to allow external humanitarian aid in the face of dire need.

Abstract

The emergence of new actors as subjects of international law presents a new challenge in the application of humanitarian law. During armed conflict, the civilian population is not a party to the war and must therefore be protected. One of the forms of protection that must be applied is the provision of humanitarian assistance. The issue of the provision of humanitarian assistance in situations of armed conflict is contingent upon the concept of state sovereignty. This article will examine the relationship between humanitarian assistance and sovereignty, as well as the obstacles to state consent to provide humanitarian assistance in international armed conflicts. In order to address this issue, this article presents a comprehensive explanation based on a normative and case-specific approach to the legal framework governing corporations in international law, with a particular focus on humanitarian law. This article His research highlights the complex relationship between state sovereignty and humanitarian assistance in armed conflicts. Sovereignty obligates states to protect civilians, yet international law, particularly the Fourth Geneva Convention (1949), mandates the non-discriminatory provision of aid. When a state cannot or refuses to assist its population, it must permit external aid. Failure to do so may justify international intervention, balancing sovereignty with humanitarian imperatives.
