Abstract

The problems in this research are: First , how are the roles of Regional Disaster Management Agency and Fire Department (BPBDPK) of Padang City in fire prevention in Padang City ? Second, what are the obstacles faced by BPBDPK Padang in fire prevention in Padang City? Third, what are the efforts made by BPBDPK in the fire prevention in Padang City?The approach method used in this research is the normative juridical approach as the main approach and supported by the empirical juridical approach. Sources of data used are secondary data and primary data. Data collection techniques used were field studies through interviews for primary data and library studies to find secondary data. Then the data is analyzed qualitatively and described in the form of analytical descriptive.From the research results obtained conclusion; Firstly , BPBDPK Padang has a strategic role because BPBDK Padang is an institution that is given authority and responsibility to handle fire problem in Padang City which is manifested in the role of organizer, role as coordinator, supervisor role, role as facilitator and role as a planner. All these roles are well underway and have been fully implemented in accordance with the main tasks and functions owned by BPBDPK Padang. Secondly, in the fire prevention in Padang City , BPBDPK of Padang City faces a number of obstacles such as: (a) The lack of water source in Padang city to support the fire handling process in Padang City; (b) Many obstacles to fire fleet units during the trip to the fire scene; (c) Lack of public awareness of the existence and working system of fire-fighters; and (d) Non-fulfillment of Fire Management Area (WMK) in every sub-district in Padang City. Third, natural d fire prevention in the city of Padang, the efforts made by BPBDPK Padang is: (a) education and training of personnel BPBDPK Padang; (b) Increasing community participation; (c) Improving institutional coordination ; and (d) Simulation of fire response time.

Abstract

DPRD is a regional house of representatives that is domiciled as an element of government administration which has three functions. One of the functions of the DPRD is to supervise the use of the APBD. In the implementation of supervision, there are lacks of effective supervision of the regional assembly by Kabupaten Kepulauan Mentawai that it cause local government budget deficit due to the use of the relevant agencies. This resulted in a lot of development not proceeding as it should be. Based on the results, there are three main points are; first, the implementation of supervision carried out by regional assembly of Kabupaten Kepulauan Mentawai has been running effectively. The supervision of the 2014-2019 regional budget is carried out through three stages, including: the planning stage, the implementation stage, and the evaluation stage. The regional assembly of Kabupaten Kepulauan Mentawai supervises all activities of the regional government apparatus and related parties in implementing the APBD. Second, the concrete obstacles encountered in the implementation of the DPRD's oversight function include: Internal barriers: (a) the background of the suitability of education and tasks is relatively inadequate, (b) Lack of communication between DPRD members and the community, (c) Management and work relationship relationships that are not effective and efficient, (d) The monitoring agenda has not yet been prepared and (e) Lack of standards, systems and procedures for parliamentary supervision (2) External obstacles: (a) Lack of community participation in the implementation of supervision, (b) Government intervention (executive ) is still dominant in the legislative function, and (c) The public is not yet politically aware. Third, efforts made by the government of the Kabupaten Kepulauan Mentawai: Preparing political cadres who are well educated and experienced (2) The system and procedures of the DPRD supervision standards, (3) Making the community information submission container as one of the monitoring tools, (4) Determining the agenda supervision, (5) Establishing related networks / agencies and strategic alliances, (6) Establishing personnel based on competencies and interests.

Abstract

Peran DPD Dalam Memperjuangkan Hak-Hak Masayarakat Di Sumatera Barat adalah mengajukan rancangan undang undang sesuai dengan aspirasi dari daerah yang diwakilinya. Salah satu kegiatan anggota DPD RI yaitu menyerap, menghimpun, menampung dan menindaklanjuti aspirasi masyarakat dan daerah yang berada dalam ruang lingkup tugas dan wewenang DPD. Penyerapan aspirasi daerah dilakukan dalam dua bentuk yaitu secara langsung dan tidak langsung. Pada segi substansi, sejauh mana anggota DPD bisa menangkap pokok masalah dalam kebijakan otonomi daerah dan pembangunan daerah, serta sejauh mana perbedaan aspirasi antar daerah tidak membelah anggota DPD, bagaimana DPD bisa menampung dan menyalurkan aspirasi masyarakat yang sesuai dengan keinginan masyarakat. Peran DPD Dalam Memperjuangkan Hak Hak Masayarakat Di Sumatera Barat berdasarkan teori Lembaga Perwakilan yakni Teori mandat berarti seseorang dianggap duduk di lembaga perwakilan karena mendapat mandat dari rakyat, sehingga disebut sebagai mandataris (orang yang menerima mandat). Hambatan yang ditemui dalam pelaksanaan peran dpd dalam memperjuangkan hak hak masayarakat di Sumatera Barat adalah Prosedur kerja lembaga pembentuk undang-undang yang bersifat top down dan arogansi pejabat negara (sebagai sisa-sisa kebiasaan dari sistem pemerintahan yang secara tradisional tertutup). Praktik administrasi yang bersifat rutin dan mekanis juga melemahkan kemampuan mengelola partisipasi. faktor penghambat internal terdiri dari anggaran dan sarana dan segi politis. faktor eksternal terdiri dari hambatan masyarakat dan hambatan sumber daya manusia. Hambatan masyarakat timbul karena kebiasaan dan tata cara hubungan masyarakat. Kebiasaan ini berupa tradisi yang sudah melembaga sehingga sukar untuk dirubah. Kondisi masyarakat seperti ini akan menghambat proses penyerapan oleh anggota DPD yang dilakukan dalam acara kunjungan kerjanya.

Abstract

Di Desa Marunggi, Kecamatan Pariaman Selatan, Kota Pariaman ada Pemberian Pemberian Dana Langsung Tunai Dana Desa tahun 2020, bagi masyarakat terdampak Covid-19, adapun yang menjadi dasar hukum yaitu Peraturan Desa Marunggi Nomor 3 Tahun 2020 tentang Perubahan Anggaran Pendapatan dan Belanja Desa Marunggi tahun anggaran 2020 yang telah disepakati BPD dan Kepala Desa Marunggi. Spesifikasi penelitian adalah deskriptif analitis dengan metode pendekatan yaitu yuridis sosiologis, adapun sumber data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan data dengan wawancara untuk data primer yang dikumpul serta studi dokumen untuk data sekunder, data yang terkumpul kemudian dianalisis secara kualitatif dan disajikan dengan cara deskriptif kualitatif secara terstruktur untuk mengidentifikasi terhadap fenomena yang diteliti

Abstract

Peraturan Mahkamah Agung No 7 Tahun 2022 tentang Perubahan Peraturan Mahkamah Agung No. 1 Tahun 2019 tentang Administrasi Perkara dan Persidangan di Pengadilan secara Elektronik mengatur proses beracara di pengadilan dengan sistem elektronik. Pengadilan Agama Padang sebagai salah satu lembaga peradilan yang berada di bawah Mahkamah Agung harus menjalankan kebijakan Mahkamah Agung disusul dengan Surat Keputusan Ketua Mahkamah Agung Nomor 363/KMA/SK/XII/2022 tentang Petunjuk Teknis Administrasi Dan Persidangan Perkara Perdata, Perdata Agama, dan Tata Usaha Negara di Pengadilan Secara Elektronik. Penelitian ini merupakan penelitian hukum dengan spesifikasi penelitian yang bersifat deskriptif analitis. Pendekatan yang digunakan adalah pendekatan yuridis normatif sebagai pendekatan utama, didukung pendekatan yuridis empiris. Data yang digunakan adalah data primer sebagai data utama dan data sekunder sebagai data pendukung yang dikumpulkan melalui studi lapangan dengan teknik wawancara dan studi kepustakan. Data tersebut kemudian dianalisis secara kualitatif dan disajikan dalam bentuk deskriptif kualitatif.

Abstract

The title certificate over land is a form of State Administrative Decree, based on Article 1 number 3 of Law Number 9 of 2004 concerning the Second Amendment 2 to Law Number 5 of 1986 concerning the State Administrative Court. Related to that, if there are individuals and legal entities who object to the decision, the objection can be made through a lawsuit to the State Administrative Court based on the absolute compatibility of State Administrative Procurement. There are legal facts, the Sungai Full District Court of Jambi Province accepted, examined, tried and decided objections to the certification further in its decision stating that the certificates of the Defendants were invalid.

Abstract

The prospect of amendments carried out by a country shows that the country is following developments that the present will certainly not be the same in the future. Indonesia, which has undergone the replacement of the Constitution and the Amendment to the Law, has appointed Indonesia as a country to be better than in the past. Article 37 of the 1945 Constitution of the Republic of Indonesia becomes the Fundamental Basis. Related to legal issues and discourses on the terms of office of the President and Vice President for three periods which have led to polemics for and against, however, if it is related to the opportunities that exist in the MPR as a State Institution, amend Article 7 of the Constitution regarding the terms of office of the President and Vice President and fulfill the provisions of Article 37 of the Law. The Constitution and the people's approval so that the past history in this country does not repeat itself, meaning that it is normatively legal for the 2024 Election.

Abstract

The implementation of the Nagari Madani in Agam Regency is regulated in the Regulation of the Regent of Agam Number 74 of 2016 concerning Guidelines for the Implementation of the Nagari Madani. This research is a legal research with analytical descriptive specifications. The Role of the Nagari Customary Density Institution in Realizing the Nagari Madani in Agam Regency is to participate directly in the Maghrib Koran activities, by giving recitations by the niniak mamak together with the nagari ulama at the end of each evening praying together at the surau. Collecting data on who is entitled to receive zakat for each of their people, and collecting zakat from all people. KAN conducts socialization and provides guidance to the community in every crime prevention activity in the nagari. Organize women and children protection groups by bundo kanduang in collaboration with the police. The obstacle encountered in the participation of the Nagari Customary Density Institution in Realizing the Nagari Madani in Agam Regency is the occurrence of disagreements between the parties. KAN's inability to enforce coercion so that the opinion given is carried out, is one of the obstacles that KAN encounters, especially the unavailability of devices capable of carrying out coercive measures against the results of the decision. In crime prevention activities, it is often found that KAN elements are arrogant so that they interfere with KAN's performance in the success of Nagari Madani activities. The existence of a conflict between the Wali Nagari and the Nagari Representative Council (DPN) and KAN is an inhibiting factor in the implementation of the Nagari Madani movement in Agam Regency.

Abstract

Berdasarkan ketentuan Pasal 3 Undang-undang Nomor 1 Tahun 2009 tentang Penerbangan, penyelenggaraan penerbangan harus ditata dalam satu kesatuan sistem transportasi nasional secara terpadu dan mampu mewujudkan penyediaan jasa transportasi yang seimbang dengan tingkat kebutuhan, selamat, aman, efektif dan efisien. Sebagai pelaksanaan ketentuan Pasal 333 Undang-undang Nomor 1 Tentang Penerbangan, lahirlah Peraturan Menteri Perhubungan Nomor PM 92 Tahun 2015 tentang Program Pengawasan Keamanan Penerbangan Nasional.” Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Pelaksananan kewenangan inspektur keamanan penerbangan Kantor Otoritas Bandar Udara Wilayah-VI Padang dalam melakukan pengawasan keamanan penerbangan adalah berupa mandat yang didapat secara berjenjang dari Menteri Perhubungan yang didelegasikan kepada Kepala Kantor Otoritas Bandar Udara wilayah VI-Padang. Pengawasan keamanan penerbangan yang dilakukan Inspektur keamanan pada tahun 2021 berupa inspeksi dan monitoring. Kendala-kendala yang ditemui dalam pelaksanaan kewenangan inspektur keamanan penerbangan Kantor Otoritas Bandar Udara Wilayah VI-Padang dalam melakukan pengawasan keamanan penerbangan mencakup kendala internal, yaitu :1) Jumlah personil inspektur keamanan penerbangan Kantor Otoritas Bandar Udara Wilayah VI-Padang masih kurang ; 2) Perencanan program pengawasan keamanan penerbangan masih memerlukan evaluasi perbaikan; 3) Data laporan dari hasil pengawasan belum semua terdokumentasi secara baik. Serta kendala eksternal yaitu adanya pembatasan dengan protokol kesehatan pada masa Pandemi Corona Virus Disease (Covid-19) serta pemotongan anggaran yang berkaitan dengan kegiatan pengawasan sangat berpengaruh terhadap kuantitas pengawasan.

Abstract

In human life, land is a very important need because almost all human activities take place on land. Provisions regarding land rights are regulated in Law no. 5 of 1960 concerning Basic Agrarian Regulations. Among the land rights are regarding Building Use Rights and Property Rights. And for this reason, it is necessary to register and upgrade from Building Use Rights to Property Rights. Building use rights have a limited period of time and should be upgraded to property rights in order to have legal certainty for the right holders. The increase in Building Use Rights to become permanent property rights must be registered at the Land Office where the object is located. The specification of this research is descriptive analysis. The approach used in this study is a normative-juridical approach. It is so called because this research is a literature research or document study aimed only at written regulations or other legal materials. Based on the results of the study, it shows that there is no legal protection for holders of Property Rights Certificates that have been canceled by the State Administrative Court Decision. The judge's consideration of the State Administrative Court in canceling land ownership rights is based on existing regulations and efforts made by the owner of the Certificate of Property Rights which has been canceled by the Decision of the State Administrative Court by filing an appeal.
