Abstract

Introduction to The Problem: Obstetrician-gynecologists (OB-GYNs) must be observant in diagnosing diseases suffered by patients. OB-GYNs who act based on their knowledge can certainly not be blamed if their actions are already according to the procedures. Legal policies protect OB-GYNs in the case of a patient’s death.Purpose/Objective Study: This article aims to analyze the legal protection for OB-GYNs in cases of maternal, perinatal, and neonatal mortalities. Design/Methodology/Approach: This research was a field research with juridical-sociological method conducted in 2021. The researchers conducted interviews with four informants who experienced maternal, perinatal, or neonatal emergencies.Findings: Conditions with a high risk of maternal, perinatal, and neonatal deaths are handled by OB-GYNs. OB-GYNs must be proficient in the standards for obstetric and neonatal emergencies. OB-GYNs who have correctly followed the processes but experienced an accident also have the right to legal protection. In providing health services, OB-GYNs do not only examine the patients, but they also make efforts to recover the patient through treatments. In health law, such efforts of recovery are known as the Therapeutic Agreement. The relationship between obstetricians and patients is bound to a therapeutic transaction. OB-GYNs have the legal obligation to make improvements in their efforts and expertise in healing patients. Legal regulations stipulated in the Indonesian Civil Law are still too general. There  was one case involving dr DASP SpOG and dr HS SpOG, who were sentenced with 10 months in prison because they violated article 39 of the Indonesian Criminal Code because their patient died during the treatment. This case caused unrest among the OB-GYNs. Therefore, there needs to be a law that regulates the relationship between OB-GYNs and their patients. In terms of human rights in Indonesia, this particular healthcare issue is regulated in Law Number 36 of 2009 regarding Health (Indonesian Health Act). Chapter III Article 1 clause (1) and (4) specifially regulate the patients' rights. The legal and ethical responsibilities in health services observe how far the obstetricians' actions have legal implications in cases of errors or negligence in providing health treatments.Paper Type: Research Article

Abstract

This study aims to find out about employment problems at CV Sidu Utama. CV Sidu Utama is a printing company located in the city of Klaten. In this study the authors will help to uphold workers' rights, such as the right to legal protection and rights in the event of a work accident. The author of this article decided to find out how the company's responsibility in the event of a work accident that results in physical disability according to labor law occurs. And aims to find out the legal protection of workers while working in the company. This study uses the empirical law method, where interviews and observations are important sources of data to describe facts and data in the field. Empirical research is research that takes place or interacts in the life of the community around the research location. This is an empirical legal study or legal study that uncovers empirical facts derived from human behavior, both verbally and in real activities. In this research, legal sociology methodology is adopted. This is an approach to investigating law in a social environment. Abstract

Penelitian ini bertujuan untuk menganalisis dan menjelaskan fatwa majelis ulama kabupaten sragen tentang nishab zakat profesi menggunakan standar nishab perak. Yang menjadi pokok permasalahan adalah ketentuan hasil ijtihadnya. Pengumpulan data dilakukan dengan menggunakan fatwa yang diputuskan oleh majelis ulama kabupaten sragen dan menggunakan data-data untuk sebagai penguat dan pendukung. Adapun metode yang digunakan dalam penelitian ini menggunakan metode penelitian pendekatan normatif-deskriptif bahwa menyebutkan dengan cara yang rasional, empiris dan sistematis. Berdasarkan hasil analis diperoleh bahwa bolehnya menyamakan nishab zakat profesi dengan menggunakan perak senilai 595 gram. Mengukur nishab zakat profesi dengan zakat perak itu bukan mengada-ada, tetapi juga merujuk pendapat Yusuf Qardhawi karena lebih banyak maslahat bagi umat karena peluang kaum muslimin zakat lebih besar.

Abstract

This study aims to discuss the description of the implementation process of exchanging forest areas for the relocation of residents and legal certainty of ownership of community land certificates after the relocation of community forest area exchanges in Dusun Ngroto. The research method used in this research is juridical-empirical descriptive by using qualitative data analysis methods to review literature and events that actually occurred through observation and interviews. The research location is in Ngroto Hamlet, Pare Village, Selogiri District, Wonogiri Regency. The results of the discussion found that 1 )The background to the relocation was due to the fact that in March 1999 in the Ngroto Hamlet area a landslide occurred resulting in as many as 43 family cards (115 people), supporting factors for relocation including social relations, economy, community involvement and participation with the government while the inhibiting factors are infrastructure, policies that underlie relocation based on humanitarian considerations. 2) Legal certainty of ownership of land certificates after the relocation residents have not obtained the rights to the land they occupy regarding evidence of land certificates, the Wonogiri Regency Government is in the process of eliminating the land ownership rights of residents who have been victims of the landslide disaster 11.66 Ha (Eleven and Sixty Six One Hundred Hectares) with a replacement land obligation of 13.11 Ha (Thirte

Abstract

Forest conservation currently attracts the attention of numerous countries in the world, including Indonesia. This is because the world’s forests have experienced terrible damage, including due to deforestation. Principal policies are crucial to prevent the problem of forest deterioration. Thus, many countries apply policies with the paradigm of sustainable forest development. It is based on balancing the sustainability of the economic, ecologic, social, and cultural functions through non-centralistic forest resource management which values the society’s independence. In essence, this paradigm uses local wisdom as its basis. Some requirements must be fulfilled to reach the goals of the forest policies. One of them is society’s active participation in conserving the forests’ natural resources. Society's participation in environmental conservation is crucial, as they act as the determinants (subjects). Apart from that, they simultaneously experience the impact of the determined policies (object).

Abstract

Penelitian ini bertujuan untuk mengkaji kebijakan Perum Perhutani KPH Saradan dalam mengadopsi kebijakan Pengelolaan Hutan Bersama Masyarakat (PHBM) sebagai kebijakan kehutanan dengan pendekatan baru, yaitu meningkatkan kesejahteraan masyarakat yang tinggal di sekitar hutan dan sekaligus melestarikan hutan. Penelitian ini merupakan penelitian non-doktrinal dengan pendekatan kualitatif, yaitu sesuatu dilihat dari sudut pandang orang yang diteliti (informan). Lokasi penelitian berada di wilayah kerja Perum Perhutani KPH Saradan. Jenis data dalam penelitian ini terdiri dari data primer dan data sekunder. Data primer diperoleh dari wawancara dengan responden yang diambil dengan metode purposive sampling dan dianalisis dengan analisis kualitatif. Berdasarkan hasil penelitian dan diskusi, dapat disimpulkan bahwa kebijakan PHBM memiliki tujuh tujuan, yaitu: perencanaan dan pelaksanaan kegiatan yang lebih fleksibel, peningkatan tanggung jawab Perum Perhutani (KPH Saradan) terhadap keberlanjutan fungsi dan manfaat hutan, peningkatan peran dan akses masyarakat desa hutan (MDH) dan pemangku kepentingan pengelolaan SDH, penyesuaian PHBM dengan pembangunan daerah, peningkatan sinergi dengan Pemerintah, peningkatan usaha produktif sehingga masyarakat mandiri dan mendukung peningkatan Indeks Pembangunan Manusia (IPM). Implementasi kebijakan PHBM dalam konsepnya adalah pengelolaan hutan bersama masyarakat, yaitu prinsip kerjasama, pengelolaan bersama, dan tanggung jawab bersama. Kebijakan dengan pendekatan kesejahteraan ini juga mengambil jalur kesediaan untuk berbagi hasil hutan kayu dan non-kayu dengan masyarakat Desa Hutan (MDH) yang sebelumnya telah dilakukan dan memiliki konsep pertanian di area hutan sehingga hutan dapat dimanfaatkan untuk kesejahteraan tanpa menyebabkan kerusakan hutan.   Kata Kunci: Kehutanan, Kebijakan, Saradan, Kesejahteraan   This study aims to examine the policies of Perum Perhutani KPH Saradan adopting the Community Forest Management (PHBM) policy as a forestry policy with a new approach, namely increasing the welfare of the people living around the forest and preserving forests on the other hand. This research is a non-doctrinal research with a qualitative approach, that is, something is seen from the point of view of the person being studied (informant). The research location is in the working area of Perum Perhutani KPH Saradan. The type of data in this study consists of primary data and secondary data. Primary data obtained from interviews with respondents from sampled with the purposive sampling method and analyzed with qualitative analysis. BerdaBased on the results of the research and discussion, it can be concluded that the PHBM policy has seven objectives, namely: more flexible planning and implementation of activities, increasing the responsibility of Perum Perhutani (KPH Saradan) for the sustainability of forest functions and benefits, increasing the role and access of forest village communities (MDH) and stakeholders. holders of SDH management, aligning PHBM with regional development, increasing synergy with the Government, increasing productive businesses so that the community is self-sufficient and supporting the improvement of the human development index (IPM). The implementation of the PHBM policy in its concept is community forestry, namely the principles of co-operation, co-management and co-responsibility. The policy with this welfare approach also takes the path of willingness to share timber and non-timber forest products with the Forest Village (MDH) community which was carried out previously and has the concept of agriculture in forest areas so that forests can be utilized for welfare without causing forest damage.   Keywords: Forestry, Policy, Saradan, Welfare.
