Abstract

This research discusses the legal protection for auction winners whose items are still held by the debtor, analyzed based on Law Number 4 of 2004 on Auctions. An auction is one of the ways to enforce the rights of creditors against debtors who are unable to fulfill their obligations. In this study, the author examines the provisions in Law Number 4 of 2004 as well as the applicable legal practices to provide an overview of the legal steps that auction winners can take to obtain the items they have won. The research findings indicate that although the auction winner has the right to the items once the auction process is complete, there is a legal protection mechanism that must be followed to obtain those items, including through the execution of goods by the auction official. This study also highlights the importance of legal protection for auction winners so that their ownership rights over the auctioned items can be effectively protected in accordance with the applicable procedures.

Abstract

Online auctions have become one of the most popular transaction mechanisms in the digital era, offering various conveniences and innovations in the world of commerce. This study aims to analyze the positive and negative impacts of online auctions from a socio-legal perspective, encompassing legal, social, and technological aspects. Data collection was conducted through a literature review technique. The results of the study indicate that online auctions provide numerous benefits, such as cost and time efficiency, ease of access, information transparency, and a wider reach for auction participants. These advantages position online auctions as an innovative solution to meet the digital transaction needs of modern society. On the other hand, the study also identifies several challenges, including legal ambiguities due to the proliferation of auction platforms that do not comply with regulatory provisions, risks of price manipulation, fraud, and violations of participants' privacy.

Abstract

The cancellation of the auction caused many parties to suffer losses because they had promoted the auctioned goods and if they had been purchased, the sale and purchase transaction would be canceled. In decision No. 478 K/Pid/2013, there was a cancellation of the auction against the mortgage right. The study aims to determine and analyze the cancellation of the execution auction against the mortgage right due to an unlawful act. This study is a normative legal study, namely a study that examines norms as an object of research. The results of the study indicate that the lawsuit against the execution of the mortgage right does not cancel the auction because it can cause other legal problems, namely the cancellation of the sale and purchase transaction of the auctioned goods. Every decision that already has permanent legal force and is executed cannot be canceled. Therefore, every decision that results in other transactions must be ensured that there is no longer a legal process. And or execution must not be carried out before the end of the time given to the losing party to make legal efforts in the form of an appeal to cassation. The legal consequences of a court decision regarding the postponement or cancellation of the auction are the existence of legal uncertainty regarding the court's decision, harming the party conducting the auction, harming the party conducting the sale and purchase transaction of the auction object.

Abstract

Permodalan dalam bentuk kredit memainkan peran dalam mendukung kegiatan bisnis dan ekonomi suatu negara, dengan jaminan seperti hak tanggungan sebagai elemen utama yang melindungi kepentingan kreditur. Dalam hal debitur gagal memenuhi kewajiban pembayaran, lelang harta tak bergerak, yang diatur secara ketat oleh peraturan perundang-undangan Indonesia, menjadi mekanisme penyelesaian utang yang penting. Proses ini melibatkan beberapa tahapan, mulai dari penyitaan hingga pelaksanaan lelang, dengan tujuan mencapai harga pasar yang wajar dan memastikan keadilan bagi semua pihak terkait. Namun, meskipun sudah ada prosedur yang jelas, pelaksanaan lelang sering menghadapi tantangan, seperti masalah kepemilikan, ketidakakuratan penilaian, prosedur yang rumit, serta kurangnya minat pembeli. Penelitian ini bertujuan untuk mengidentifikasi tantangan dan hambatan dalam eksekusi lelang harta tak bergerak di Indonesia, serta dampak hukum terhadap debitur dan kreditur. Menggunakan pendekatan kualitatif deskriptif, data dikumpulkan melalui wawancara dan studi dokumentasi, yang kemudian dianalisis dengan teknik analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa meskipun lelang merupakan solusi hukum untuk penyelesaian utang, tantangan seperti sengketa kepemilikan, prosedur panjang, dan ketidakpastian hasil lelang masih menjadi hambatan signifikan dalam efektivitasnya. Penelitian ini diharapkan dapat memberikan wawasan untuk memperbaiki praktik pelaksanaan lelang harta tak bergerak di Indonesia. Abstract

Lelang objek hak tanggungan secara online merupakan inovasi yang bertujuan untuk meningkatkan efisiensi, transparansi, dan aksesibilitas dalam sistem lelang di Indonesia. Seiring dengan pesatnya perkembangan teknologi, lelang elektronik (e-lelang) memungkinkan peserta untuk ikut serta tanpa harus hadir secara fisik, namun juga menghadirkan sejumlah tantangan hukum, terutama terkait kepastian hukum terhadap objek hak tanggungan yang dilelang. Penelitian ini bertujuan untuk Memberikan rekomendasi untuk meningkatkan kepastian hukum dalam pelaksanaan lelang objek hak tanggungan secara online serta Mengidentifikasi tantangan yang dihadapi dalam memastikan kepastian hukum lelang objek hak tanggungan secara online.. Hasil penelitian menunjukkan bahwa meskipun ada dasar hukum yang cukup untuk pelaksanaan lelang online, tantangan terkait keabsahan sistem, keamanan, akses teknologi, serta verifikasi objek lelang masih perlu perhatian lebih. Untuk itu, diperlukan peraturan yang lebih terperinci serta peningkatan pengawasan guna memastikan kepastian hukum dalam lelang elektronik.

Abstract

Auction is basically an act of buying and selling, where there are elements of price and goods, the difference is that the auction requires the presence of an auction official, with the stipulation of PMK 122/2023 concerning the implementation of electronic auctions, the auction can be carried out without the presence of an auction official, with the absence of the auction official contradicting the validity and strength of the auction minutes deed which still creates doubts for the auction winner in the implementation of the electronic auction. This study uses normative legal research that analyzes applicable laws and regulations and is applied in certain legal problems by analyzing laws and regulations relating to legal protection and electronic auctions, the results of the study obtained are the validity and legal force of the auction minutes deed can still be accepted as an authentic deed because it can be accounted for and the truth of the authentic deed by the auction official without deviating from the provisions of applicable laws and regulations.

Abstract

Auction is a method of selling goods or services conducted through an open bidding process, which is strictly regulated in Indonesia by laws and regulations, including the Minister of Finance Regulation No. 27/PMK.06/2016. In implementing auctions, the auction minutes act is important as an authentic document that records the auction process and its result. As a public official authorized to create authentic deeds, a notary is responsible for creating the auction minutes act, including as a Class II auction official. Although holding multiple positions is not allowed, the law grants notaries the authority to serve as Class II auction officials responsible for conducting voluntary non-execution auctions and creating the Auction Minutes Act. This article examines the legal responsibilities of notaries as Class II auction officials in creating the Auction Minutes Act, encompassing administrative, civil, and criminal aspects. Errors in creating the Auction Minutes Act may lead to serious legal consequences, including administrative sanctions, civil compensation, and criminal penalties. Additionally, notaries are required to store the minutes of the auction by applicable regulations. This study uses a normative legal research method with a legislative approach, aiming to provide an understanding of the legal responsibilities of notaries as auction officials in implementing auctions in Indonesia.

Abstract

Parate Executive or direct execution, namely the execution of mortgage rights, which is carried out by selling the object of the mortgage right by the first mortgage holder on his power through a public auction and taking the debt payment from the sale proceeds. Protection of mortgage auction has been carried out in a preventive manner by the State Wealth and Auction Service Office (KPKNL) because before the auction, KPKNL notifies the auction participants regarding the documents, conditions, and conditions of the object to be auctioned in truth and as it is as well as the consequences and risks that may arise from the auction object. Regarding repressive protection, namely efforts to obtain legal protection through judicial bodies and obstacles to implementation, there is no agreement on the price of the object being auctioned.

Abstract

The need for housing has now become mandatory. The credit scheme will make it easier for everyone to own a house by guaranteeing the legality of land rights burdened with mortgage rights. However, not everyone who has applied for credit always complies with the terms agreed in the Credit Agreement. One example is a debtor who breaks his promise or defaults by not paying installments so that the bank, as a creditor, confiscates the object of collateral. To pay the debtor’s remaining debt until repayment, the bank sells the collateral object belonging to the debtor by auction. The bank carries out this auction based on the executorial power attached to the Mortgage Rights Certificate so that the bank does not need to submit a request or lawsuit to the court because the executorial power of the Mortgage Rights Certificate is the same as a court decision with permanent legal force.

Abstract

The purpose of this research is to analyze the legal protection provided to buyers who purchase collateral objects sold at auction, as well as to explore the legal challenges faced by buyers in acquiring rights to these objects. The main focus of this research is to understand how the legal system provides protection for buyers. This study uses a qualitative method with a descriptive approach, aimed at describing and analyzing the legal situation in cases involving the auction of collateral objects. Data collection was carried out through interviews with various related parties, including notaries, legal practitioners, auction officials, and buyers of auctioned objects. The results of the study show that, although there are efforts to protect buyers under auction regulations, buyers often face challenges related to the legal status of the objects they purchase. Buyers are at risk of being caught in legal disputes concerning obligations attached to the purchased objects, especially with regard to third-party rights or debts associated with the object. This research also finds that the current auction procedures and regulations still have gaps that allow for legal uncertainty for buyers.
