Abstract

This research discusses the legal protection for auction winners whose items are still held by the debtor, analyzed based on Law Number 4 of 2004 on Auctions. An auction is one way to enforce creditors' rights against debtors who cannot fulfill their obligations. In this study, the author examines the provisions in Law Number 4 of 2004, and the applicable legal practices to provide an overview of the legal steps auction winners can take to obtain the items they have won. The research findings indicate that although the auction winner has the right to the items once the auction process is complete, there is a legal protection mechanism that must be followed to obtain those items, including through the execution of goods by the auction official. This study also highlights the importance of legal protection for auction winners so that the applicable procedures can effectively protect their ownership rights over the auctioned items.

Abstract

The auction process in the fiduciary guarantee execution system is integral to resolving debt-debt disputes involving movable goods collateral. This research aims to analyze the legal aspects related to implementing auctions in the execution of fiduciary guarantees, which refers to the provisions of Law No. 42/1999 on Fiduciary Guarantees. The main focus of this research is to examine the auction procedure, the rights and obligations of the parties involved, and potential disputes that may arise during the process. In addition, this study evaluates the applicability of precautionary principles and the protection of debtor rights in executing auctions. The analysis results show that although the law has regulated the execution of fiduciary guarantees in detail, some challenges remain, such as unclear auction procedures and potential abuse of authority by creditors. Therefore, this study recommends stricter law enforcement and strengthening supervisory mechanisms in the auction process to protect debtors' rights and achieve justice.

Abstract

The execution of mortgage collateral auctions often encounters legal obstacles when the object of collateral provided by the debtor is under dispute. Such conditions pose significant challenges to the legal protection of creditors, particularly in their efforts to secure debt repayment through auction mechanisms. Disputes over the collateral frequently result in delays or even render the auction process infeasible, weakening the creditors' position as holders of mortgage rights. This study analyzes the legal protection afforded to creditors against obstacles in auction execution caused by disputes over the collateral. Furthermore, the research examines the role of legal provisions stipulated in Law No. 4 of 1996 concerning Mortgage Rights in resolving such challenges. The findings emphasize the necessity of stricter law enforcement and the establishment of effective dispute resolution mechanisms to safeguard creditors' rights, even when the mortgage collateral is subject to legal disputes.

Abstract

Perkembangan teknologi digital telah mendorong transformasi dalam berbagai sektor, termasuk pelaksanaan lelang elektronik (e-auction) yang menjadi bagian dari digitalisasi perdagangan. Transparansi dan keamanan menjadi aspek krusial untuk menjamin kepercayaan publik terhadap sistem ini. Penelitian ini bertujuan menganalisis efektivitas regulasi lelang elektronik di Indonesia, terutama Peraturan Menteri Keuangan (PMK) No. 122 Tahun 2023 dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), dalam mendukung transparansi dan keamanan transaksi digital. Metode penelitian yang digunakan adalah analisis kualitatif deskriptif melalui pendekatan analisis isi (content analysis) terhadap regulasi terkait. Data sekunder berupa dokumen regulasi dan literatur pendukung, serta studi kasus pelaksanaan lelang elektronik di Indonesia, digunakan untuk mendukung pembahasan. Penelitian ini menemukan bahwa meskipun regulasi telah mencakup beberapa aspek penting, masih terdapat kesenjangan teknis dalam implementasi, seperti perlindungan data pribadi, pengawasan penawaran harga, dan keamanan transaksi elektronik. Hasil penelitian menunjukkan perlunya penguatan regulasi, terutama dengan integrasi teknologi modern seperti blockchain untuk menciptakan transparansi proses dan keamanan data. Selain itu, audit sistem secara berkala dan peningkatan pengawasan terhadap proses lelang elektronik direkomendasikan untuk mendukung kepercayaan masyarakat. Penelitian ini berkontribusi dalam memberikan rekomendasi strategis untuk penyempurnaan regulasi dan implementasi teknologi yang relevan guna meningkatkan efektivitas lelang elektronik di Indonesia. Abstract

ABSTRAKHak tanggungan memberikan jaminan kepada kreditur atas pelunasan utang melalui eksekusi aset yang dijaminkan jika debitur gagal memenuhi kewajibannya. Penelitian ini bertujuan menganalisis permasalahan hukum terkait proses lelang sebagai mekanisme penyelesaian sengketa dalam eksekusi hak tanggungan di Indonesia. Latar belakang masalah ini adalah seringnya terjadi sengketa dalam praktik lelang, terutama terkait prosedur, pemilihan penawar, penentuan harga lelang yang adil, serta perlindungan hak-hak pihak yang terlibat. Penelitian ini menggunakan metode yuridis normatif untuk mengkaji kerangka hukum yang ada dan mengidentifikasi permasalahan serta solusi yang dapat diterapkan. Hasil penelitian menunjukkan bahwa sistem hukum lelang di Indonesia perlu perbaikan dalam penerapan peraturan yang lebih jelas dan konsisten. Hal ini bertujuan untuk memastikan keadilan dan transparansi bagi semua pihak yang terlibat dalam sengketa eksekusi hak tanggungan. Studi ini mengusulkan beberapa solusi untuk meningkatkan efektivitas dan keadilan dalam penyelesaian sengketa melalui proses lelang.ABSTRACTMortgage rights provide guarantees to creditors for debt repayment through the execution of pledged assets if the debtor fails to fulfil its obligations. This research aims to analyse legal issues related to the auction process as a dispute resolution mechanism in the execution of mortgage rights in Indonesia. The background of this problem is the frequent occurrence of disputes in auction practices, especially related to procedures, bidder selection, determination of fair auction prices, and protection of the rights of the parties involved. This research uses the normative juridical method to examine the existing legal framework and identify problems and solutions that can be applied. The results show that the auction legal system in Indonesia needs improvement in the application of clearer and more consistent regulations. This aims to ensure fairness and transparency for all parties involved in a mortgage execution dispute. This study proposes several solutions to improve effectiveness and fairness in dispute resolution through the auction process.

Abstract

Dalam era digital yang semakin maju, penerapan teknologi dalam berbagai aspek kehidupan menjadi suatu keharusan, termasuk dalam proses lelang. Di Indonesia, lelang tradisional yang biasanya dilakukan secara langsung kini mulai beralih ke lelang elektronik atau e-auction. Sistem ini diadopsi oleh Direktorat Jenderal Kekayaan Negara (DJKN) untuk meningkatkan efisiensi, transparansi, dan akuntabilitas dalam pengelolaan kekayaan negara. Namun, meskipun sudah diatur dalam beberapa regulasi seperti PMK Nomor 213/PMK.06/2020, pelaksanaan lelang elektronik masih menghadapi berbagai tantangan teknis dan regulasi yang belum memadai. Penelitian ini bertujuan untuk menganalisis efektivitas pengaturan hukum terhadap prosedur lelang elektronik di Indonesia dalam menjamin kepastian hukum. Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan data sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun regulasi sudah ada, tantangan seperti gangguan teknis, kurangnya pemahaman regulasi, dan birokrasi masih menghambat pelaksanaan lelang elektronik yang efektif. Untuk itu, diperlukan peningkatan infrastruktur teknis, pemahaman yang lebih baik tentang regulasi, dan transparansi dalam proses lelang untuk mencapai kepastian hukum yang diinginkan.

Abstract

Sharia banks also target MSMEs through KUR loans, growing like mushrooms in the rain. The small loan value becomes disproportionate if a dispute is resolved through the judicial process. So what is needed by financial service providers and the public is a dispute resolution model that is effective and efficient, fair and certain. Research specifications use descriptive analytical methods, with normative and empirical juridical approaches. The data used is secondary data with data collection techniques through literature studies and field studies, then the data is analyzed using legal interpretation and construction, using qualitative juridical methods. The settlement of sharia economic disputes juridically can be resolved in two ways, namely through litigation and non-litigation. According to the results of the study, currently the KUR guarantor is PT Jamkrindo Syariah under the supervision of the OJK, in practice when there is bad credit Jamkrindo Syariah chooses a non-litigation dispute resolution model by means of deliberation and mediation off line and online based on the good faith of the parties (vide Article 55 of Law Number 21 of 2008 and Perma Number 3 of 2022), so as to fulfill a sense of justice and legal certainty, therefore there is a need for a special legal umbrella for resolving sharia economic disputes outside the Court.

Abstract

Improving Indonesia's economy is crucial for overcoming poverty, especially post-Covid-19, which caused many business closures. The government introduced the People's Business Credit (KUR) programme to support MSMEs, though some programmes face bad debt issues. In West Bandung Regency, MSMEs use the programme extensively for economic recovery. This research examines whether the Non-Adjudication Settlement model between MSME actors and Islamic banks upholds principles of justice. Using normative and empirical juridical methods, the study incorporates primary, secondary, and tertiary legal materials, along with interviews with MSME actors and KUR-issuing banks. Dispute resolution for problem credits can occur through adjudication (court) or non-adjudication (out-of-court). Islamic banks integrate values from Islamic teachings, encompassing law, morality, and social procedures. For KUR bad credit disputes, Islamic banks are mandated to select processes aligning with Islamic values of truth, justice, and compassion. The non-litigation settlement model is found to reflect Islamic and Indonesian societal values, emphasizing deliberation for consensus and justice. The contribution of this research is to provide an understanding of the effectiveness of the non-adjudication settlement model in handling bad credit in the KUR program, aligning with Islamic values and reflecting Indonesian values. This model can serve as a fairer and more efficient dispute resolution alternative for MSMEs and Islamic banks in Indonesia. Meningkatkan ekonomi Indonesia menjadi sangat penting untuk mengatasi kemiskinan, terutama pasca-Covid-19 yang menyebabkan banyak bisnis tutup. Pemerintah memperkenalkan program Kredit Usaha Rakyat (KUR) untuk mendukung UMKM, meskipun beberapa program menghadapi masalah kredit macet. Di Kabupaten Bandung Barat, UMKM menggunakan program ini secara luas untuk pemulihan ekonomi. Penelitian ini mengkaji apakah model Penyelesaian Non-Adjudikasi antara pelaku UMKM dan bank syariah menjunjung prinsip-prinsip keadilan. Dengan menggunakan metode yuridis normatif dan empiris, studi ini melibatkan bahan hukum primer, sekunder, dan tersier, serta wawancara dengan pelaku UMKM dan bank penerbit KUR. Penyelesaian sengketa untuk kredit bermasalah dapat dilakukan melalui adjudikasi (pengadilan) atau non-adjudikasi (di luar pengadilan). Bank syariah mengintegrasikan nilai-nilai dari ajaran Islam, yang mencakup hukum, moralitas, dan prosedur sosial. Untuk sengketa kredit macet KUR, bank syariah diwajibkan memilih proses yang sesuai dengan nilai-nilai Islam tentang kebenaran, keadilan, dan kasih sayang. Model penyelesaian non-litigasi ditemukan mencerminkan nilai-nilai Islam dan nilai-nilai masyarakat Indonesia, menekankan musyawarah untuk mufakat dan prinsip keadilan. Kontribusi penelitian ini adalah memberikan pemahaman tentang efektivitas model penyelesaian non-adjudikasi dalam menangani kredit macet dalam program KUR, yang sesuai dengan nilai-nilai Islam dan mencerminkan nilai-nilai Indonesia. Model ini dapat menjadi alternatif penyelesaian sengketa yang lebih adil dan efisien bagi pelaku UMKM dan bank syariah di Indonesia.

Abstract

This research explores the use of information technology in carrying out marriage contracts, especially via video teleconference, which has become commonplace during the COVID-19 pandemic. An example of an online wedding includes a couple from Singapore who were permitted by the Registry of Marriages (ROM) to have a virtual ceremony. In the context of Islamic law, a marriage contract via teleconference shows the flexibility of sharia in facing changing times, with the concept of mashlahah (benefit) which allows reform and reinterpretation to achieve benefits. In Indonesia, although the Marriage Law does not explicitly regulate marriage via telecommunications, the decision of the South Jakarta Religious Court No. 1751/P/1989 became jurisprudence that recognized the validity of online marriages as long as the identities of the parties involved could be ascertained. Article 14 of the Compilation of Islamic Law (KHI) requires the presence of the bride and groom, guardians, witnesses, and the marriage contract in one assembly, which in teleconference conditions can be fulfilled with real-time images and sound. In Singapore, virtual marriages are officially regulated by law which allows marriage ceremonies to be conducted online with witnesses and guardians present virtually. A comparison between the two countries shows that although the technical procedures are similar, Singapore has clearer and more structured regulations compared to Indonesia. This research highlights the importance of legal flexibility and adaptation to social dynamics, ensuring that legal processes remain relevant to current developments.

Abstract

The notary has the duties and responsibilities of making and at the same time keeping the olographic inheritance deed desired by the heir before he dies, which is written manually and contains the distribution of his inheritance after he dies without the potential heirs knowing. However, there are times when the olographic will is lost or damaged due to the notary's negligence, resulting in a loss to the maker of the olographic will. This study uses a descriptive normative juridical method; secondary data will be analyzed qualitatively through primary and secondary legal materials supplemented by interviews with notaries using purposive sampling. From the results of the research, it is known that based on Article 933 of the Civil Code requires that the will be submitted to a notary to be stored and sent to the Probate Court and the Central List of Wills. Furthermore, Article 1 paragraph (13) states that the notary has the duty and responsibility to keep the olographic will. Therefore, if the olographic kept by the notary is lost and or damaged, in addition to violating the code of ethics, it also violates Article 1365 of the Criminal Code in conjunction with Article 1367 of the Criminal Code so that the notary can be held accountable by the injured party based on Article 84 UUJN. 7 of 2016.
