Abstract

This study aims to analyze the authority of a notary as a class II auction official in providing legal counseling related to the auction minutes deed they create. This research focuses on understanding the notary's role in ensuring that the parties involved in the auction gain a clear legal understanding of their rights and obligations and provide accurate explanations regarding the auction process as reflected in the auction minutes deed. The study's findings show that the notary's authority as a class II auction official in providing legal counseling is crucial to ensuring that the auction process proceeds by the applicable legal provisions. The notary plays a key role in explaining the legality of the auction minutes deed, which can influence the decisions of the auction participants. However, challenges in implementing this authority were found, such as the limited legal understanding of the parties involved and the lack of coordination between the notary and the auction institution.

Abstract

This study aims to determine whether the service quality of internet-based auctions (e-Auction) has an impact on the satisfaction of auction applicants at KPKNL Metro. The research design used is a quantitative approach. The results show that the service quality of internet-based auctions (e-Auction) has a significant effect on the satisfaction of auction applicants at KPKNL Metro. The service quality of the internet auction on the satisfaction of auction applicants has a p-value of 0.000 < 0.05 and a t-value of 5.745 > t-table 2.023, indicating that H1 is accepted, meaning there is an effect of the internet auction service quality on the satisfaction of auction applicants at KPKNL Metro. The F-value of 33.006 > the F-table value of 3.24 further confirms that H1 is accepted, meaning there is a simultaneous effect of internet auction service quality (X) on auction applicant satisfaction (Y). The R Square value, or coefficient of determination, is 0.471, meaning that the effect of the independent variable (X) on the dependent variable (Y) is 47.1%. Therefore, it can be concluded that H0 is rejected, and Ha is accepted, indicating that the quality of internet auction the satisfaction of auction applicants at KPKNL Metro.

Abstract

This research discusses the legal protection for auction winners whose items are still held by the debtor, analyzed based on Law Number 4 of 2004 on Auctions. An auction is one way to enforce creditors' rights against debtors who cannot fulfill their obligations. In this study, the author examines the provisions in Law Number 4 of 2004, and the applicable legal practices to provide an overview of the legal steps auction winners can take to obtain the items they have won. The research findings indicate that although the auction winner has the right to the items once the auction process is complete, there is a legal protection mechanism that must be followed to obtain those items, including through the execution of goods by the auction official. This study also highlights the importance of legal protection for auction winners so that the applicable procedures can effectively protect their ownership rights over the auctioned items.

Abstract

The auction process in the fiduciary guarantee execution system is integral to resolving debt-debt disputes involving movable goods collateral. This research aims to analyze the legal aspects related to implementing auctions in the execution of fiduciary guarantees, which refers to the provisions of Law No. 42/1999 on Fiduciary Guarantees. The main focus of this research is to examine the auction procedure, the rights and obligations of the parties involved, and potential disputes that may arise during the process. In addition, this study evaluates the applicability of precautionary principles and the protection of debtor rights in executing auctions. The analysis results show that although the law has regulated the execution of fiduciary guarantees in detail, some challenges remain, such as unclear auction procedures and potential abuse of authority by creditors. Therefore, this study recommends stricter law enforcement and strengthening supervisory mechanisms in the auction process to protect debtors' rights and achieve justice.

Abstract

The execution of mortgage collateral auctions often encounters legal obstacles when the object of collateral provided by the debtor is under dispute. Such conditions pose significant challenges to the legal protection of creditors, particularly in their efforts to secure debt repayment through auction mechanisms. Disputes over the collateral frequently result in delays or even render the auction process infeasible, weakening the creditors' position as holders of mortgage rights. This study analyzes the legal protection afforded to creditors against obstacles in auction execution caused by disputes over the collateral. Furthermore, the research examines the role of legal provisions stipulated in Law No. 4 of 1996 concerning Mortgage Rights in resolving such challenges. The findings emphasize the necessity of stricter law enforcement and the establishment of effective dispute resolution mechanisms to safeguard creditors' rights, even when the mortgage collateral is subject to legal disputes.

Abstract

Pemberian fasilitas Kredit yang diberikan oleh kreditur kepada debitur dalam proses pengembalian atau pelunasan kredit yang dilakukan oleh debitur tidak semua berjalan lancar, untuk itu dapat terjadi proses lelang online obyek hak tanggungan jika proses pelunasan kredit tidak berjalan lancar. Untuk itu penulis melakukan penelitian ini dengan tujuan mengkaji dan membahas lebih dalammengenai mekanisme pelaksanaan lelang online terhadap obyek hak tanggungan. Adapun metode penelitian yng digunakan dalam penelitian ini adalag penelitian kualitatif dengan pendekatan yuridis-normatif, merupakan sebuah penelitian yang menitikberatkan ilmu hukum normatif. Hasil penelitian ini adalah pelaksanaan lelang online (e-auction) terhadap objek hak tanggungan melibatkan beberapa tahapan penting, yaitu pra-lelang, pelaksanaan lelang, pasca-lelang. Hambatan dalam pelaksanaan lelang online mencakup kekurangan dokumen lelang yang dapat menghambat proses pengajuan, gugatan dari debitur sebelum atau setelah pelaksanaan lelang terkait nilai hasil lelang yang dianggap merugikan debitur, serta kesulitan dalam pengosongan objek lelang yang masih dihuni oleh debitur atau pihak terkait lainnya. Kata Kunci: Lelang Online, Hak Tanggungan, Kredit   ABSTRACK The provision of credit facilities provided by creditors to debtors in the process of returning or repaying credit made by debtors does not all run smoothly, for this reason, there can be an online auction process for the object of mortgage rights if the credit repayment process does not run smoothly. For this reason, the author conducts this research with the aim of examining and discussing more deeply the mechanism for implementing online auctions of mortgaged objects. The research method used in this research is qualitative research with a juridical-normative approach, which is a research that emphasizes normative legal science. The result of this research is the implementation of online auction (e-auction) against the object of mortgage rights involves several important stages, namely pre-auction, auction implementation, post-auction. Obstacles in the implementation of online auctions include lack of auction documents that can hinder the submission process, claims from debtors before or after the auction regarding the value of the auction results which are considered detrimental to the debtor, as well as difficulties in vacating auction objects that are still occupied by debtors or other related parties. Abstract

Judges' independence in resolving criminal cases ensures justice and legal certainty inside the legal system from the standpoint of the legality principle. Independence from unlawful interference, autonomy in interpreting the law, and independence from internal and external pressure are all included. Judges must be strengthened to enhance the concept of judges' independence as much as possible. The legality concept can be seen in judges' suitable and effective resolution of criminal cases, which results in justice and legal certainty. To gain a complete picture of judges' independence in making decisions about criminal cases from the standpoint of legality principles, this study employed a normative juridical approach method, utilizing secondary data gathered through literature research with primary, secondary, and tertiary legal materials. The data was then analyzed using qualitative juridical methods. As a foundation for guaranteeing justice in the legal system, the study's findings indicated that judges' independence in resolving criminal cases from a legal standpoint is crucial. The legality principle, which highlights the idea that there can be no crime without law, must serve as the foundation for judges' independence in making decisions on criminal matters. In order to protect the defendant and uphold justice and legal certainty, the judge is not allowed to overstep or break any of the legal restrictions placed to stop abuse of authority. Beyond imposing penalties that fall short of the legal minimum, judges are also constrained by the idea of legality. Researchers contend that material legality, which emphasizes community-felt justice through ideas like restorative justice, should be added to the definition of legality. More research is still needed on this transition.

Abstract

Ideally, Indonesia's land ownership system should have fully adopted the provisions of the 1960 Basic Agrarian Law (Undang-Undang Pokok Agraria or UUPA), which abolished eigendom as a form of property ownership. However, in reality, legal disputes persist regarding former eigendom verponding land, as seen in Case Number 109 PK/Pdt/2022. This case reflects legal issues concerning land rights originating from the colonial system and their implications for legal certainty in land ownership in Indonesia. This study aims to analyze the legal status transformation of eigendom verponding after the enactment of the 1960 UUPA and to examine the legal impact of the Judicial Review (Peninjauan Kembali or PK) decision in Case Number 109 PK/Pdt/2022. This article falls under qualitative library research using a normative legal study methodology. The findings indicate that the legal status of eigendom verponding has been converted according to national agrarian regulations. However, in practice, differences in legal interpretation continue to arise, leading to land ownership disputes. Case 109 PK/Pdt/2022 reaffirms that land title certificates issued under agrarian law provisions hold greater legal recognition than ownership claims based on colonial-era eigendom verponding.

Abstract

Restorative justice demands a shift from punishment to rehabilitation. Article 54 of the Narcotics Law mandates rehabilitation as an obligation for addicts, shifting the criminal paradigm from punishment to protection and rehabilitation. This rehabilitation reflects the values of restorative justice, which emphasize social and personal recovery from drug abuse. This study aims to examine the position of Article 54 of Law Number 35 of 2009 concerning Narcotics within the framework of modern criminal justice and the concept of restorative justice, as well as to examine the implementation of rehabilitation for drug addicts as a form of recovery approach compared to punishment. The method used is normative juridical with a statutory and conceptual approach, through an analysis of positive legal norms and their relevance in the criminal justice system in Indonesia. The results of the discussion indicate that Article 54 of Law No. 35 of 2009 has an important position in the framework of modern criminalization and restorative justice , by emphasizing medical and social rehabilitation for addicts and victims of drug abuse, rather than punishment. In its implementation, although normatively it reflects a healing approach and protection of human rights, implementation in the field still faces obstacles such as limited facilities, social stigma, and weak support from officials, thus requiring strengthening of policies and institutions.
