Abstract

Dimensi hukum Islam meliputi pengaturan masalah Ibadah dan mu’amalah (interaksi sosial). Dalam kajian muamalah mencakup kegiatan ekonomi. Ekonomi syariah adalah sistem ekonomi yang didasarkan pada hukum dan nilai-nilai Islam yang bersumber dari Al-Qur'an dan Sunnah. Tulisan ini bertujuan untuk menggali dan mendeskripsikan ekonomi syariah modern dalam telaah teoritis, historis dan yuridis. Berdirinya Bank Tabungan Lokal Mit Ghamr sebagai Bank Syariah pertama yang merepresentasikan ekonomi syariah modern memberikan inspirasi bagi umat Islam untuk mampu mengembangkan perekonomian syariah lebih luas. Di Indonesia, Bank Muamalat hadir sebagai bank syariah pertama yang resmi beroperasi pada tahun 1992 melalui upaya para cendekiawan dan ekonom muslim yang peduli terhadap perekonomian umat agar terbebas dari transaksi yang mengandung unsur riba dan pada perjalannya hadir pula perundang-undangan yang menjadi landasan yuridisnya. Hingga saat ini selain bank syariah juga terdapat lembaga keuangan syariah lainnya seperti asuransi syariah, pegadaian syariah, baitul mal wat tamwil, pasar modal syariah, reksadana syariah serta lembaga zakat, infaq dan shadaqah yang hadir sebagai perwujudan dari sebuah kelembagaan ekonomi syariah dalam perekonomian modern

Abstract

Ekonomi Syariah adalah ekonomi yang di dasarkan pada ketentuan dalam syariat Islam yang berpedoman pada nash yaitu al-Quran dan hadits. Konstruksi makna dari al-Quran dan hadits telah disusun oleh para ulama melalui formulasi qawaid fiqhiyyah sebagai rumusan hukum Islam. Rumusan itu merupakan produk ijtihad interpretasi terhadap nash dengan bentuk kalimat yang menunjukkan suatu substansi dalam hukum Islam. Penelitian ini bertujuan untuk menguraikan makna salah satu kaidah fikih ekonoomi syariah yang berbunyi “ar-Ridhâ Bisy Syai` Ridhâ bimâ Yatawalladu Minhu (Keridhaan dengan sesuatu adalah ridha dengan akibat yang terjadi padanya) dalam kegiatan ekonomi syariah. Kaidah yang dibahas dalam artikel ini memiliki pemaknaan pada substansi keridhaan. Keridhaan dalam bermuamalah adalah sebuah prinsip yang harus dihadirkan. Maka dari itu transaksi akan sah jika dilandaskan kepada keridhaan kedua pihak yang bertransaksi (subjek akad). Dalam bertransaksi atau mengikat perjanjian dituntut untuk adanya transparansi berupa kejelasan maupun keterbukaan pada transaksi yang dilakukan agar dapat terhindar dari adanya penyimpangan informasi (ketidaksampaian informasi kepada salah satu pihak) yang pada nantinya menyebabkan sebuah tindakan terlarang yaitu kecacatan yang disembunyian (perilaku penipuan) yang memberikan dampak pada gugurnya keridhaan.

Abstract

This research aims to analyze the relationship between business actors and consumers in electronic transactions according to a review of electronic transaction law in Indonesia. This research uses normative legal research methods with a doctrinal type of research. Primary data is obtained from primary legal materials such as laws, government regulations, and court decisions. Meanwhile, secondary data is obtained from secondary legal materials such as books, scientific journals and legal articles. The data analysis technique used is qualitative analysis. The research results show that the relationship between business actors and consumers in electronic transactions is regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE), Law Number 8 of 1999 concerning Consumer Protection (UUPK), and statutory regulations. other related. Business actors have an obligation to provide correct and clear information about the products or services offered, as well as guarantee the security of electronic transactions. Consumers have the right to obtain correct and clear information about products or services, as well as the right to resolve disputes fairly.

Abstract

Abstrak Perbankan konvensional di Indonesia masih menjadi pilihan utama masyarakat dalam transaksi keuangan, meskipun terdapat perbedaan pandangan di kalangan ulama mengenai status hukum bunga bank. Yusuf Al-Qardhawi secara tegas mengharamkan bunga bank karena dianggap sebagai riba, sementara Muhammad Sayyid Al-Thantawi memperbolehkannya dalam kondisi yang adil dan transparan. Penelitian ini bertujuan untuk menganalisis perbedaan pandangan kedua ulama serta mengkaji relevansinya terhadap praktik perbankan di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan komparatif terhadap kitab-kitab karya kedua ulama serta regulasi perbankan di Indonesia. Hasil penelitian menunjukkan bahwa sistem bunga dalam perbankan konvensional lebih sejalan dengan pandangan Muhammad Sayyid Al-Thantawi, karena diterapkan secara terbuka dan sesuai kesepakatan. Namun, sistem ini tetap bertentangan dengan prinsip yang dipegang oleh Yusuf Al-Qardhawi. Oleh karena itu, diperlukan peningkatan literasi keuangan syariah agar masyarakat memahami perbedaan antara sistem perbankan konvensional dan syariah serta dapat memilih layanan keuangan sesuai dengan keyakinannya. Selain itu, masyarakat diharapkan bersikap adil dalam menghadapi perbedaan pendapat ulama dengan tetap berpegang pada prinsip hukum Islam. Kata Kunci: Bunga Bank, Muhammad Sayyid Al-Thantawi, Perbankan Konvensional, Riba, Yusuf Al-Qardhawi. Abstract Conventional banking in Indonesia remains the primary choice for financial transactions, despite differing views among Islamic scholars regarding the legal status of bank interest. Yusuf Al-Qardhawi firmly prohibits bank interest, considering it a form of riba, while Muhammad Sayyid Al-Thantawi permits it under fair and transparent conditions. This study aims to analyze the differing perspectives of these two scholars and assess their relevance to Indonesia’s banking practices. The research employs a normative legal approach with a comparative analysis of the scholars' works and Indonesia's banking regulations. The findings indicate that the interest system in conventional banking aligns more closely with Muhammad Sayyid Al-Thantawi’s perspective, as it is implemented transparently and based on mutual agreement. However, it remains inconsistent with Yusuf Al-Qardhawi’s principles. Therefore, increasing financial literacy in Islamic banking is essential to help the public understand the differences between conventional and Islamic banking systems and make informed financial decisions. Additionally, society is encouraged to approach scholarly differences with fairness and objectivity while adhering to Islamic legal principles. Abstract

Artificial Intelligence (AI) first appeared as a product of the Industrial Revolution 4.0. Then, with the advent of the Society 5.0 era, information technology and AI were combined to create harmony between technological developments and enhance human welfare. The existence of AI in the context of human welfare will also be connected to the economy in general and financial institutions in particular, including Islamic financial institutions. This paper aims to explain the integration of AI and Islamic financial institutions in the era of Society 5.0, analyzing it through the lens of Islamic legal maxims. The research method employed normative legal research, utilizing a conceptual approach and an Islamic legal maxims approach. Based on the research discussion, AI could positively contribute to Islamic financial institutions. The integration of technology and Islamic finance was achieved through the use of AI to support the operations of Islamic financial institutions in implementing business management, encompassing services, performance, and risk management. From the lens of Islamic legal maxims, the use of AI by Islamic financial institutions is linked to Islamic legal maxims as guidelines, including the ibâhah principle in muamalah, intention, taisir, sad adz-dzarî'ah, and maslahah rules.

Abstract

The empowerment of Zero Waste Maritime Village Caring for the Marine Environment Based on Creative Economy was organized by the PPK Ormawa HMG Team, Lambung Mangkurat University, through socialization and education methods, training, and mentoring to the people of Wirittasi Village. With this program, the community can realize the potential of waste in Wirittasi Village. The activity results show that the district already has knowledge and skills in managing waste in Wirittasi Village through waste sorting activities and the 3R Movement. If continued, this program will improve the economic opinion of the community through waste management activities by the community. To maintain the program's sustainability, it is necessary to implement further programs, and the participation of village and local governments as facilitators for this community empowerment activity is needed.

Abstract

Akad wadiah yad dhamanah, dalam produk perekonomin Syariah telah menjadi salah satu instrumen yang populer. Muhammad Syafi’i Antonio dan Ammi Nur Baits merupakan dua tokoh Ulama di Indonesia yang ahli tentang hukum ekonomi Syariah telah menuangkan pikiran atau gagasan terhadap produk akad wadiah yad dhamanah pada perbankan Syariah. Terdapat perbedaan yang mencolok diantara kedua tokoh Ulama tersebut terkait perkara ini. Berdasarkan hasil penelitian Muhammad Syafi’i Antonio mengakui adanya wadiah yad dhamanah sebagai bentuk inovasi hukum untuk memenuhi kebutuhan transaksi perbankan modern. Sedangkan Ammi Nur Baits memiliki pandangan yang berbeda. Ia tidak mengakui adanya wadiah yad dhamanah karena konsep wadiah adalah amanah yaitu uang yang ditipkan tidak boleh dimanfaatkan serta pihak yang dititipi tidak menanggung resiko apapun. Jika bank memanfaatkan uang yang ditipkan, maka itu bukanlah wadiah, melainkan berubah menjadi akad qard (pinjaman). Dasar hukum yang digunakan oleh Muhammad Syafi’i Antonio yang menyatakan adanya akad wadiah yad dhamanah adalah hadits Riwayat Muslim dari Abu Rafie tentang memberi bonus berbeda dengan bunga dan Fatwa DSN MUI tentang tabungan dan giro wadiah. Sementara itu, dasar argumentasi Ammi Nur Baits yaitu hadits yang diriwayatkan al-Baihaqi dalam al-Kubro tentang penerima wadiah tidak menanggung resiko dan pernyataan di ensiklopedia fiqih tentang wadiah hanya amanah bukan dhamanah. Dengan demikian, terdapat perbedaan antara Muhammad Syafi’i Antonio dan Ammi Nur Baits tentang konsep wadiah yad dhamanah, yang masing-masing didasarkan pada argumentasi dan dasar hukum yang berbeda

Abstract

Abstract This paper aims to describe the local wisdom of the sale and purchase contract of the Banjar people according to sharia economic law based on Shafi’iyah fiqh’s perspective, which interacts with customs in the local wisdom. The research method was normative legal research with a conceptual approach. The local wisdom of the sale and purchase contract of the Banjar people, which was deeply rooted in society, was the words tukar-jual and barelaan. The words tukar-jual, according to sharia economic law, were categorized as shighat (ijab and qabul) in the contract, and the expression barelaan was an expression of asking for willingness, which represented one of the principles of sharia contract law that must be implemented, namely the principle of ‘an taradhin (mutual consent). These words of tukar-jual and barelaan showed the interaction between custom and Shafi’i jurisprudence because, in the Shafi’i school of thought, a strong opinion stated that sales and purchases were considered valid when committing through verbal ijab and qabul; under circumstances when valid sales and purchase could be applied with mutual consent. Furthermore, consent is something that cannot be seen physically. In the Shafi’i school of thought, consent is defined through verbal statements, indicating pleasure’s fulfillment from both parties. The expression of barelaan in Banjar people, apart from entering into a contract through tukar-jual, is also a way to express approval.  Keywords: Contract; Banjar People; Local Wisdom; Sale and Purchase

Abstract

This study investigates the deployment of impoliteness strategies in political discourse, focusing on the iNEWS YouTube video “Keras! Rocky Singgung Penjilat, Silfester Emosi hingga Keluar Kata Kasar - Rakyat Bersuara 03/09.” Employing Culpeper's (1996) Impoliteness Theory, the research aims to identify, categorize, and quantify the specific strategies used by the discussants. The quantitative analysis reveals that Negative Impoliteness is the most dominant strategy, accounting for 28.85% of all occurrences, a clear indication that speakers prioritized direct attacks on the opponent’s intellectual credibility and self-worth to increase social distance. Following this were Sarcasm or Mock Impoliteness (23.08%) and Withholding Politeness (21.15%). These findings demonstrate that impoliteness in this public forum is not merely an emotional byproduct but a calculated rhetorical strategy used to assert dominance, attack the opponent's negative face, and shape public perception. The prevalence of these strategies underscores the confrontational nature of modern political debates on digital platforms, where aggressive discourse is strategically employed to gain attention and reinforce ideological positions. The study emphasizes the critical role of impoliteness as a strategic linguistic tool in media-driven political communication. Future research should explore the perlocutionary effects of these strategies on audience reception and their contribution to political polarization in the digital age.

Abstract

The background of this research is that in the practice of making pinisi boats in Pagarruyung Village, Kusan Hilir District, Tanah Bumbu Regency, problems can occur, namely if the shipbuilding has been completed, but the buyer does not have the money to pay for it, then the ship is detained. The study aims to determine whether the impact if the agreement is not in accordance with the agreement at the beginning is felt by the builders and customers of the ship in Pagarruyung Village, Kusan Hilir District, Tanag Bumbu Regency. This research is a qualitative descriptive research with a case study approach. With this research subject, the parties involved or who know about the Pinisi shipbuilding work agreement by the customer and the shipbuilder. As for the data obtained from research, namely through observation, interviews, and documentation through the process of collecting data and analyzing the data. Based on the data that has been explained that in carrying out work on shipbuilding pinisi using an oral agreement, where the contents of the agreement discuss the shape, model, size, height, price, payment system, time period, etc. depending on the agreement of the two parties in the initial agreement. the impact if there is a discrepancy in the agreement at the beginning if the payment system is borne by the shipbuilder, for example the maker has completed the work on time, but the buyer does not have the money to pay for it, then the shipbuilder will suffer a loss. In the view of Islamic law, in the case that the work agreement for the manufacture of the Pinisi ship had not been justified by Islamic law, it contained harm related to the discussion, an error was found, namely: the customer violated the agreement at the beginning.
