Abstract

Penelitian ini berjudul, “Mediasi Penal Ditingkat Kepolisian Dalam Mewujudkan Restoratif Justice”.Permasalahan yang dibahas dalam Penelitian ini adalah Penerapan mediasi oleh pihak kepolisian dalam penanganan tindak pidana sebagai upaya mewujudkan restoratif justice dan Faktor-faktor yang menghambat penerapan mediasi oleh kepolisian dalam upaya mewujudkan restoratif Justice. Metode penulisan yang digunakan dalam Penelitian ini adalah penelitian Normatif. Mediasi oleh pihak kepolisian dalam penanganan perkara tindak pidana sebagai upaya mewujudkan restoratif justice. Penyelesaian perkara pidana khususnya tindak pidana kepolisian. Peroses mediasi ini dilakukan oleh penyidik kepolisian agar terjadi pemecahan atas permasalahan hukum yang terjadi, sehingga kedua belah pihak merasa mendapatkan keadilan yang diinginkannya., Faktor penghambat penerapan perisip restoratif justice dalam penyelesaian perkara pidana adalah: Tidak adanya aturan hukum yang mengatur proses mediasi penal dalam penyelesaian perkara pidana, kewenangan diskresi yang dimiliki aparat kepolisian dalam mengambil langkah penyelesaian perkara pidana memiliki celah penyimpangan, aparat penegak hukum terkadang selalu berpegang teguh pada asas legalistik formal sehingga aparat kepolisian yakni penyidik mengesampingkan rasa keadilan serta kemanfaatan yang ada di masyarakat.

Abstract

Restorative justice, as a means of peacefully resolving conflicts outside the courts, remains difficult to implement. In Indonesia, many customary laws can be used as restorative justice, but their existence is not recognized by the state or codified in national law. Customary law can resolve conflicts that arise in society and provide satisfaction to the conflicting parties. The idea of restorative justice emerged as a critique of the criminal justice system, which relies on imprisonment for resolving social conflict, which is considered ineffective. This is because the parties involved in the conflict are not involved in conflict resolution. Victims remain victims, and perpetrators are imprisoned, creating new problems for families, and so on.

Abstract

Tri Hita Karana in balinese customary law as a basis for the settlement of the village boundary conflict in bali is the title used in this reseacrh, to demonstrate that the philosophical Tri Hita Karana is an extraordinary thought to solve the problems of the Balinese people, especially to solve the problem of village boundaries in Bali. The technicalities of the philosophical Tri Hita Karana are Parhyangan, Pawongan, Palemahan, so that the Balinese only see three technicalities of Tri Hita Karana. The objectives of this study is to examine the real form of the concept of Tri Hita Karana in resolving village boundary conflicts, and to examine the role of Pekraman Village in implementing the Tri Hita Karana concept as the guardian of the life balance of the Krama/Villager of his village community. This research method uses normative methods, namely legal research that examines written law from various aspects. This research analysis used is the analytical approach to History (approach of Historical analysis). The results revealed that Balinese people in resolving their problems, especially related to village boundaries, must always hold on to the concrete steps of Tri Hita Karana, namely Parhyangan, Pawongan, and Palemahan to shape the behavior of Balinese people to bring about conflict resolution by means of family negotiations, and mutual respect and try to understand the problem by way of consensus agreement to achieve good together and create harmony.

Abstract

Sekar Dewata is a non-formal arts institution, and has become one of the activities for diffable children. The problems faced by Sekar Dewata studio are the lack of uniforms for dance and painting practice, the absence of dance clothes for staging, the quality of folding tables used for painting practice are still relatively low, and do not yet have dance teaching standards for deaf children. The results obtained from this dedication activity are the process of dancing and painting practice running more effectively and comfortably, dance staging clothes do not need to be rented anymore, the quality of the tables used in painting exercises are not perishable, and there are operational standard dance procedures that facilitate dance instructors in training deaf child.

Abstract

Thuggery remains a social ill that can disrupt public order and security, necessitating effective, measurable, and sustainable measures. This study aims to analyze the role of the Bali Regional Police and the obstacles faced in combating thuggery within its jurisdiction. This study uses a juridical-empirical method, combining literature studies, laws and regulations, and field data through interviews and observations. The results show that the Bali Regional Police have implemented various strategies, one of which is Operation Pekat Agung. This police operation is supported by strategies such as a preemptive approach by providing counseling regarding thuggery, a preventive approach through community development, and repressive law enforcement against perpetrators of thuggery. However, several obstacles remain, both in terms of structure, substance, and legal culture. This study concludes that the police's role has not been effective, but that strengthening coordination, improving human resources, and community participation are needed to create a safe and orderly environment in Bali on an ongoing basis

Abstract

Unprotected mental health among employees can have a detrimental effect on productivity and the national economy. Nevertheless, Indonesia's present labor regulations do not include any specific provisions to safeguard workers' mental health. This research aims to identify and analyze issues regarding mental health workers that are often ignored, which cause decreased productivity and negative stigma for people experiencing mental health to medical personnel and facilities that are less qualified in protecting workers. This normative research examines legal texts, mainly primary and secondary legal materials. The results of the research show that, first, mental health problems in Indonesia are very complex, starting from the negative stigma that is still embedded in society regarding mental health diagnoses to regulations and law enforcement that do not support workers with mental health to recover from their illnesses. Second, based on Singapore, Singapore has a program and legal framework that supports public health and workers who experience mental health disorders monitoring that has been integrated with the system. Third, to overcome mental health problems for workers, there needs to be a clear regulatory framework that targets improving mental health, an integrated health monitoring system that is expanded to provide training for medical personnel, and health care quality.
