Abstract

In a Limited Liability Company (LLC), the primary responsibility for running the company lies with the board of directors and commissioners, who act as extensions or executors of the rules of investors or shareholders. They are responsible for adhering to the provisions in the articles of association and the Company Law and managing the company according to the principles of Good Corporate Governance (GCG) such as justice, transparency, and accountability.One crucial aspect of implementing the provisions in the articles of association and the Company Law is holding the General Meeting of Shareholders (GMS). The Company Law explains the procedures for conducting GMS from the beginning to the formation of GMS decisions. In this study, the author analyzes juridical aspects and legal implications of the procedure for convening GMS through advertisements in newspapers, as regulated in Article 82 paragraph (2) of the Republic of Indonesia Law Number 40 of 2007 Concerning Limited Liability Companies, to determine its continued relevance. This study uses a normative research method focusing on examining the application of a legal norm using legal sources such as primary legal materials, secondary legal materials, and tertiary legal materials.

Abstract

The criminal act of corruption not only harms state finances, but also constitutes a violation of the social and economic rights of society at large, so that the criminal act of corruption needs to be classified as a crime whose eradication must be carried out in an extraordinary manner, to further guarantee legal certainty, avoid diversity of legal interpretations and providing protection for the social and economic rights of the community, as well as fair treatment in eradicating criminal acts of corruption. The statutory regulations that regulate criminal acts of corruption are Law no. 28 of 1999 concerning the Administration of a State that is Clean and Free from KKN, Law no. 31 of 1999 in conjunction with Law no. 20 of 2001 concerning Eradication of Corruption Crimes, Law no. 30 of 2002 concerning the Corruption Eradication Commission, and finally with the ratification of the United Nations Convention Against Corruption, 2003 (United Nations Convention Against Corruption, 2003) through Law no. 7 of 2006. The theories used to support the preparation of this book are the Theory of the Rule of Law, the Hierarchy Theory of Legal Norms, the Theory of Authority, the Concept of Corruption and Corruption Crimes and the Concept of Reverse Evidence. The approaches used in preparing this book are: statutory approach, conceptual research approach, case approach. Legal Materials use primary legal materials, in the form of secondary law and other legal materials. Primary legal materials include court decisions that have permanent legal force and laws related to corruption. Secondary legal materials are books, unpublished scientific works, journals and newspapers. Other legal materials are internet sites regulating the reverse evidence system in the provisions of Article 12B of Law Number 20 of 2001, Articles 37, 37A and 38B of Law Number 31 of 1999 in conjunction with Law No. 20 of 2001 and the Criminal Procedure Code. is limited or balanced, and uses a negative proof system according to law (negatief wettelijk overtuiging). The Public Prosecutor is still obliged to prove his charges. In the future, it is necessary to carry out an evaluation of the regulation of Corruption Crimes, it is necessary to strictly regulate the substance of the legal system of reverse evidence so that its application can be implemented effectively and is not just a rule contained in the norms.

Abstract

Fraudulent parking is an illegal or unofficial standing parking activity accompanied by unilateral recognition of the parking space. Therefore, the Denpasar City Government issued Regional Regulation Number 13 of 2016 concerning Transportation Management which regulates parking fraud. The problem formulation in this research is: 1) How is the law enforced against parking violations in Denpasar City based on Regional Regulations? And 2) What are the obstacles encountered in law enforcement against vehicle parking violations in Denpasar City? The type of research used is empirical legal research. Law enforcement is not yet optimal because there are still many obstacles from internal factors and external factors.

Abstract

Pariwisata selalu disebutkan menjadi salah satu penyebab utama munculnya degradasi lingkungan yang sangat serius saat berbagai ekosistem di laut, hutan, Sungai, lahan pertanian maupun pegunakan dirusak hanya demi kepentingan sarana dan prasarana penunjang pariwisata. Pergeseran perkembangan pariwisata tentunya akan berpengaruh terhadap keberlangsungan pariwisata pariwisata bali yang didasari oleh pariwisata budaya. Permasalahan yang dikaji yaitu penguatan hukum lingkungan dalam pengembangan desa pengembangan pariwisata yang berbasis kearifan lokal dengan selalu mengacu pada filosofi tri hita karana. Berdasarkan hasil pelaksanaan pengabdian kepada masyarakat pada salah satu desa di Bali yang telah menjadi sebuah desa wisata adalah Desa Penarungan yang bertempat di Kecamatan Mengwi, Kabupaten Badung. Desa Wisata Penarungan memiliki beberapa daya tarik wisata yang menarik untuk dikunjungi wisatawan. Dengan Minimnya pengetahuan mitra perihal pemberdayaan terhadap pariwisata budaya berbasis kearifan lokal, serta pemanfaatan warga lokal dalam pengelolaan lingkungan desa adat, hal ini membuat mitra kurang maksimal dalam pemberian pelayanan di bidang pariwisata dilakukan beberapa kegiatan yaitu mengadakan pelatihan terhadap pengelolaan pariwisata budaya dan mensosialisasikan mekanisme pengelolaan dan pelatihan masyarakat lokal dalam pengelolaan pariwisata budaya berbasis kearifan lokal

Abstract

Untuk merealisasikan pelaksanaan percepatan pendaftaran tanah, Pemerintah Indonesia menetapkan Peraturan Menteri Agraria dan Tata Ruang/ Kepala Badan Pertanahan Nasional Nomor 6 Tahun 2018 tentang Program Pendaftaran Tanah Sistematis Lengkap (PTSL). Program ini dilaksanakan untuk percepatan pemberian kepastian hukum dan perlindungan hukum hak atas tanah rakyat secara pasti, sederhana, cepat, lancar, aman, adil, merata dan terbuka serta akuntabel. Salah satu prosedur pelaksanaan PTSL adalah pengumpulan Data Yuridis dan Data Phisik kepada Panitia Ajudikasi, dan kemungkinan data tesebut dipegang oleh dua subyek hukum yang berbeda. Data mana yang mempunyai kekuatan hukum pembuktian dalam penerbitan sertifikat hak milik atas tanah, Data Phisik atau Data Yuridis?

Abstract

Indonesia as the 5th largest population country in the world, Indonesia has a very large labor force. Labor dynamics are very interesting to study and research more deeply because as a large population in Indonesia has switched, which used to make a living as a farmer but now more are working in the industrial sector which often causes many problems that have no end. The 1945 Constitution of the Republic of Indonesia in Article 27 paragraph (2) stipulates that “Every citizen has the right to a job and a livelihood worthy of humanity”. This provision raises issues related to the dilemma of workers with the concept of ngayah in the protection of workers' wages in the customary village business unit of the customary village? This arises from the phenomenon of dilemma between the concept of ngayah and the perspective of labor law. The concept of ngayah is a very principle thing by indigenous peoples on the basis of sincere values, which of course must get legal protection by the government against businesses that are done to produce in this case the business of baga utsaha padruen traditional village which oversees traditional village tourism with the management of the traditional village itself.

Abstract

Sekar Dewata is a non-formal arts institution, and has become one of the activities for diffable children. The problems faced by Sekar Dewata studio are the lack of uniforms for dance and painting practice, the absence of dance clothes for staging, the quality of folding tables used for painting practice are still relatively low, and do not yet have dance teaching standards for deaf children. The results obtained from this dedication activity are the process of dancing and painting practice running more effectively and comfortably, dance staging clothes do not need to be rented anymore, the quality of the tables used in painting exercises are not perishable, and there are operational standard dance procedures that facilitate dance instructors in training deaf child.

Abstract

This research discusses the issue of the existence of gubernatorial regulations Bali No. 1 of 2020 concerning the Governance of Balinese Fermented and/or Distilled Drinks, what is the Legal Certainty and Benefits. The aim of the research is to see to what extent the existence of Bali Gubernatorial Regulation No. 1 of 2020 can regulate the issue of governance of Balinese fermented and/or distilled drinks and whether this regulation can provide legal protection, legal certainty and benefits as expected. The problem that will be discussed is related to the Management of Balinese Fermented and/or Distilled Drinks Efficacy and Benefits for the people of Bali. Normative legal research methods with a statutory approach, historical approach, and conceptual approach. The research results show that the Governor based on his authority and function can issue Governor regulations, but materially, the substance regulated therein cannot conflict with the substance that has been regulated in the statutory regulations above. This study shows that the substances regulated in PERGUB1/2020 is contrary to the above regulations (PERPRES 74/2013) therefore, based on the principle of Lex Superior Derogat Legi Inferiori, Gubernatorial Regulation No. 1/2020 cannot normatively be enforced as a product of binding statutory regulations, thus its existence cannot provide legal protection and benefits for the community.

Abstract

The phenomenon of suicide in Bali is a complex issue that has not only psychological dimensions, but also social, cultural, and legal dimensions. This study uses a socio-legal approach to examine how suicidal behavior is understood and handled within the framework of customary law and in the context of the local wisdom of the Balinese people. By highlighting the traditional village as a place to ensure community welfare, this paper reveals how values ​​such as communal values ​​of society, the values ​​of karma phala, Tri Hita Karana, and Tat Twam Asi play a role in shaping social responses to suicide. This study also identifies opportunities and challenges in building a suicide prevention system that is contextual and culturally just.
