Abstract

The concept of state control over land is the underlying concept of land management in Indonesia, which is physically represented by the state land. The control of the utilization of state land is one of the sub-activities of the regency/city government. However, there has been no study on these sub-activities carried out based on the Regulation of the Minister of Home Affairs Number 90 of 2019, Law on Job Creation and its derivatives, and the concept of land administration. This paper presents the results of the study on state land management in regencies/cities. This study was conducted using content several methods: content analysis, secondary data analysis, and classifi­ca­tion analysis based on the concept of land administration. The data collected and analyzed were laws and regulations on land and their implementation in the context of land administration in several areas in Indonesia. The results of this study indicate that there are fundamental changes in the definition of state land, where the Law on Job Creation and its derivatives do not define land that has been attached to land rights as state land. In addition, the Regulation of the Minister of Home Affairs Number 90 of 2019 and the Law on Job Creation and its derivatives have regulated the autho­rity of the regency/city government in the administration of the control, use, development, and assessment of state land. By considering the definitions and laws and regulations regarding state land, state land management can be implemented through (1) the development of the state land cadaster system, (2) coordination with the agencies administering the control of state land, and (3) the regulation and implementation of the use, development, and assessment of state land. Abstract

AbstractLegal pluralism in Indonesia provides a place for indigenous peoples to manage their natural resources where their lives are based on a living philosophy that is in harmony with nature, produces a pattern of management of natural resources that is environmentally friendly and sustainable. This article focus on studying water resource management practices based on traditional wisdom carried out by indigenous peoples in Indonesia and whether the management of water resources based on traditional wisdom can be used as an example of sustainable water resource management. The results of research conducted on the Ciptagelar indigenous people, Subak practices in Bali and 9 (nine) regions in Indonesia show that the practices of water resource management carried out in these areas are in line with the approach of sustainable water resource management. Some forms of community practice can even be adopted in the management of water resources carried out by the government. Furthermore, regulation of water resources based on values that live in society is easier to implement in the life of the community itself, therefore, regulation of water resources in the future must pay more attention to the values that live in the community. Abstrak Pluralisme hukum di Indonesia memberikan tempat bagi masyarakat adat untuk mengelola sumber daya alamnya, yang kehidupannya dilandasi falsafah hidup yang selaras dengan alam, menghasilkan pola pengelolaan sumber daya alam yang ramah lingkungan dan berkelanjutan. Artikel ini fokus pada mempelajari praktek pengelolaan sumber daya air (SDA) berdasarkan kearifan tradisional yang dilakukan masyarakat adat di Indonesia dan apakah pengelolaan SDA berdasarkan kearifan tradisional ini dapat dijadikan contoh pengelolaan SDA yang berkelanjutan. Hasil penelitian yang dilakukan pada masyarakat adat Ciptagelar, praktik Subak di Bali dan 9 wilayah di Indonesia menunjukkan bahwa praktik-praktik pengelolaan SDA di wilayah tersebut sejalan dengan pendekatan pengelolaan SDA yang berkelanjutan. Beberapa bentuk praktik masyarakat bahkan dapat diadopsi dalam penyelenggaraan pengelolaan SDA yang dilakukan oleh pemerintah. Pengaturan SDA yang berbasis nilai-nilai yang hidup di masyarakat lebih mudah diterapkan dalam kehidupan masyarakat itu sendiri, sehingga ke depan pengaturan SDA harus lebih memperhatikan nilai-nilai yang hidup di masyarakat.

Abstract

ABSTRAK Badan bank tanah merupakan badan khusus (sui generis) berbadan hukum yang diberi kewenangan untuk mengelola pertanahan di Indonesia. Dalam penyelenggaraannya Badan Bank Tanah dilekatkan beberapa fungsi dan tugas yang salah satunya ialah pendistribusian tanah dengan melakukan kegiatan penyediaan dan pembagian tanah reforma agraria. Desember 2023 badan bank tanah merilis aset yang dimiliki seluas 18.478 ha tersebar di 28 kabupaten/kota dan merilis wilayah-wilayah yang telah dialokasikan untuk kegiatan reforma agraria. Namun, Masyarakat yang masuk kedalam wilayah delineasi yang ditetapkan oleh badan bank tanah untuk pendistribusian tanah reforma agraria tersebut memberikan respon penolakan sehingga hal tersebut menimbulkan konflik baru. Penelitian ini menggunakan metode yuridis normatif dengan meninjau berbagai data sekunder mengenai reforma agraria dan bank tanah. Hasil penelitian menunjukan bahwa peraturan pelaksana dari penyelenggaraan bank tanah ini perlu untuk dilakukan beberapa penyesuaian, dimana diharapkan peraturan pelaksana dapat lebih jelas mengatur terkait kriteria pemilihan delineasi lahan bank tanah untuk kegiatan redistribusi tanah penyediaan tanah reforma agraria melalui aset bank tanah khususnya pada lahan yang sebelumnya telah menjadi delineasi TORA, sehingga diharapkan peraturan pelaksana tersebut dapat meminimalisir konflik agraria baru dan dapat mewujdkan keadilan agraria. Kata kunci: Bank Tanah; Reforma Agraria; Redistribusi; Tanah. ABSTRACT The land bank is a sui generis that is authorized to manage land in Indonesia. In its implementation, the Land Bank is attached to several functions and tasks, which is the distribution of land by carrying out agrarian reform land provision and distribution activities. In December 2023, the land bank assets covering an area of 18,478 ha spread across 28 districts/cities and released the areas that have been allocated for agrarian reform activities. However, the community that enters the delineation area set by the land bank for the distribution of agrarian reform land responds to rejection so that it causes new conflicts. This study uses a normative juridical method by reviewing various secondary data regarding agrarian reform and land banks. The results of the study show that the implementing regulations of the implementation of the land bank need to be adjusted, where it is hoped that the implementing regulations can more clearly regulate the criteria for selecting land bank land delineation for land redistribution activities, the provision of agrarian reform land through land bank assets, especially on land that has previously been a TORA delineation, so it is hoped that the implementing regulations can be minimized agrarian conflicts are new and can promote agrarian justice. Abstract

Ketersediaan lahan untuk pertanian merupakan salah satu syarat untuk mewujudkan ketahanan pangan. Ketahanan pangan merupakan situasi dimana semua rumah tangga mempunyai akses baik fisik maupun ekonomi untuk memperoleh pangan bagi seluruh anggota keluarganya, dimana rumah tangga tidak beresiko mengalami kehilangan kedua akses tersebut. Akan tetapi, lahan pertanian di Indonesia setiap tahunnya mengalami pengurangan akibat dari alih fungsi lahan. Kabupaten Karawang merupakan wilayah yang berkembang dengan pesat dan menjadi produsen beras tertinggi kedua yang lahannya merupakan kawasan Lahan Pertanian Pangan Berkelanjutan (LP2B). Oleh karena itu, kegiatan pemberdayaan masyarakat di Desa Tanjungjaya terutama mengenai ketahanan pangan dirasa tepat di lokasi ini untuk melaksanakan kegiatan dalam rangka KKN-PPM. Ada pun kegiatannya berupa “Literasi Pangan Melalui Pengenalan Pangan Sejak Dini kepada Siswa-Siswi SD” dan “Sosialisasi LP2B di Desa Tanjungjaya, Kabupaten Karawang”. Metode yang digunakan pada kedua kegiatan tersebut adalah Pendidikan masyarakat dan advokasi. Hasil dari kegiatan tersebut adalah bertambahnya pemahaman dan pengetahuan siswa-siswi SDN 1 Tanjungjaya mengenai jenis-jenis pangan, dan bertambahnya pengetahuan dan pemahaman aparat pemerintah desa dan masyarakat terutama petani terkait pengelolaan dan perlindungan lahan pangan (sawah).The availability of land for agriculture is one of the conditions for realizing food security. Food security is a situation where all households have both physical and economic access to food for all family members, where households are not at risk of losing both accesses. However, agricultural land in Indonesia is reduced every year due to land use change. Karawang Regency is a rapidly growing area and is the second-highest rice producer whose land is a Sustainable Food Agricultural Land (LP2B) area. Therefore, community empowerment activities in Tanjungjaya Village, especially regarding food security, are considered appropriate in this location to carry out activities in the framework of KKN-PPM. There are also activities in the form of "Food Literacy through Early Food Introduction to Elementary School Students" and "LP2B Socialization in Tanjungjaya Village, Karawang Regency". The methods used in both activities are community education and advocacy. The result of this activity was an increase in the understanding and knowledge of SDN 1 Tanjungjaya students about the types of food, and an increase in knowledge and understanding of village government officials and communities, especially farmers related to the management and protection of food land (rice fields).

Abstract

Agrarian reform is in essence a government policy attempting to restructure land ownership and control.  President Jokowi’s government set the target of 9 million hectares of which 4.1 million hectares is classified formerly as forest land.  It was and still is no easy task. But this agrarian reform, involving mostly change of ownership of forest land and redistribution, is considered necessary as part of effort to guarantee society’s welfare. This article purports to analyse the legal framework of forest land release and related problems. To do that a juridical dogmatic approach will be used and with secondary data as primary source of information.  The main finding of this research is that real problems arises in the context of implementing the Environmental and Forest Ministerial Decree Number180/Menlhk/Setjen/kum.1/4/2017 which provides guidance in regard the procedure and requirements to be met for forest land release. In the case that in the process, land ownership dispute arose, stakeholders should seek guidance from Presidential RegulationNumber  88/2017 regarding Settlement of Land Management/Ownership in Forest Land.

Abstract

Abstract: The government has addressed disparities in palm oil plantation ownership through the partnership model of the Nucleus Estate Smallholder Plantation (PIR-BUN) using a core-plasma scheme as outlined in Presidential Instruction No. 1 of 1986, aiming to achieve agrarian reform. However, in practice, the nucleus-plasma scheme has led to land conflicts and issues, one of which occurred in Teluk Bakung Village, West Kalimantan. Therefore, to ensure the effective implementation of the nucleus-plasma scheme in the future and the realization of agrarian reform, it is necessary to investigate the causes of plasma land conflicts in Teluk Bakung Village and the impacts of these conflicts on agrarian reform efforts. This study adopts a normative juridical method, examining secondary data from literature and primary data from Supreme Court Decision No. 3661 K/PDT/2019 concerning PT PALM’s default in profit-sharing on plasma land. The findings indicate that plasma land conflicts arise from differing interpretations of the 20% provision for community plantation development, inadequacies in institutional support and processes for the PIR-BUN program, and a lack of transparency from the nucleus company. These conflicts ultimately negatively impact the socio-economic aspects of plasma farmers in Teluk Bakung Village and hinder agrarian reform efforts, particularly in the region. Abstract

The negative impacts of the climate change phenomenon have a very broad impact, including on the agricultural sector, thus threatening food resilience in Indonesia. This research aims to find out how the regulation of climate change adaptation in the agricultural sector achieves food resilience in Indonesia, and to find out how its implementation occurs specifically in the regency of Kubu Raya, West Kalimantan Province, and Bandung City, West Java Province. Using a normative legal and analytical-descriptive approach, the main data are primary legal data and legal literature. The results showed that there are several climate change adaptation provisions in the agricultural sector in Indonesia, but food diversification as an adaptation measure is not contained in them. This makes the implementation of the agreements in Kubu Raya constituency try to adapt only to a commodity. Nevertheless, the implementation of climate change adaptation in the agricultural sector, especially in Kubu Raya constituency and Bandung city, has been pursued despite the respective problems outside the threat of climate change.

Abstract

Agrarian reform is a strategic policy to create equitable distribution of land tenure and people's welfare. Land Redistribution Object Agrarian Reform (TORA) is the main instrument to overcome inequality in land tenure. This policy aims to provide legal certainty for land recipient communities and encourage productive and sustainable land use. However, in its implementation, there are still various obstacles, such as land disputes, uncertainty about the status of land laws, and a lack of policy synergy between the central and regional governments. Based on this description, the purpose of this study is to examine the implementation of asset structuring through TORA redistribution in providing legal certainty for Agrarian Reform subjects and to find out the legal protection of ownership for Agrarian Reform subjects whose land objects are problematic as reviewed from Presidential Regulation Number 86 of 2018 or Presidential Regulation Number 62 of 2023. The research method used is normative juridical with a legal approach and case studies located in Ngargosari village, Kendal Regency and Pagerwangi Punclut village, West Bandung Regency. The data collection technique was carried out through literature studies and interviews with the local Land Office. The data analysis method uses qualitative normative analysis. The results of the study show that legal certainty on TORA redistribution in Indonesia already exists. However, in its implementation, there are still several obstacles, especially in the lack of transparency in the redistribution process and the lack of supervision over the implementation of the TORA redistribution policy. In addition, legal protection for the subject of Agrarian Reform is still not optimal. Therefore, concrete steps are needed to ensure that the land objects distributed are free from disputes, the priority resolution of land conflicts, and the improvement of legal assistance and inter-institutional coordination to ensure legal certainty and protection for the subject of Agrarian Reform.

Abstract

The article explains the emergence of property rights over land in Indonesia. Theoretically, the emergence of property rights in Java was deliberate. It is contrasts with the claim that spontaneous evolution of property rights . The article contributes to explaining the deliberate emergence of property rights in the case of the emergence of property rights to land in Java, Indonesia. The study is conducted by tracing the handover traces of land policy development from each period of power. The policy study begins in the period of feudalism where the concept of vorstendomain prevailed. During this period, awareness of property rights had not yet grown because the population considered the land to be the property of the king. Javanese colonialism and its land policy started the seedbed for the emergence of property rights over land. The Priangan system during the VOC started the realisation for the Javanese population about land ownership. Raffles' land-tax further solidified the awareness of land ownership rights. At this time, land distribution occurred to the local elite. The cultuure stelsel policy during Dutch colonialism had weakened land claims for Javanese people, because the workload that had to be borne was in accordance with the amount of cultivated land. Liberalism that grew in Europe had influenced changes in land policy in Java. In 1870, the Dutch colonial government issued the agrarisch wet which recognised land ownership rights for indigenous people in Java.

Abstract

Program redistribusi tanah di Indonesia menghadapi tantangan kompleks, terutama konflik agraria yang seringkali menghambat pencapaian tujuannya. Kajian ini membandingkan dua kasus, yaitu keberhasilan di Desa Muktisari, Ciamis, Jawa Barat, dan hambatan yang dihadapi di Nagari Padang Mentinggi, Pasaman, Sumatera Barat. Dengan pendekatan yuridis normatif dan analisis deskriptif, kajian ini mengkaji faktor-faktor penentu keberhasilan dan kendala program melalui studi literatur dan wawancara. Hasilnya menunjukkan bahwa keterlibatan aktif masyarakat dan dialog konstruktif di Desa Muktisari menjadi kunci keberhasilan. Berbeda halnya dengan Nagari Padang Mentinggi, di mana konflik yang berlapis dan kendala struktural mengakibatkan keterlambatan dan hasil yang kurang optimal. Oleh karena itu, keberhasilan redistribusi tanah memerlukan strategi menyeluruh yang meliputi penguatan hukum adat, transparansi yang lebih tinggi, partisipasi masyarakat yang bermakna, serta mekanisme penyelesaian sengketa yang efektif. kajian ini menyoroti perlunya reformasi kebijakan agraria yang komprehensif untuk mewujudkan keadilan dan keberlanjutan pengelolaan lahan di Indonesia.
