Abstract

The land sector digital transformation represents a core aspect of Industrial Revolution 5.0 because it requires human-technology collaboration. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) launched electronic land certificates as a strategic move to enhance public administration efficiency and service transparency and land ownership legal certainty. The new system creates multiple difficulties which affect data protection and legal frameworks and administrative safeguarding of land ownership rights. The research investigates electronic land certificate distribution through state administrative law and community legal protection frameworks. The research design combines normative juridical analysis with evaluations of applicable laws and regulations and doctrinal interpretations and judicial decisions and digital technology integration in land administration. The research findings demonstrate that electronic land certificate distribution through blockchain systems or integrated servers provides reliable and efficient operations yet faces security threats and conflicting rules and user digital competence restrictions. The legal framework requires alignment between Law No. 11 of 2008 about Electronic Information and Transactions and Law No. 5 of 1960 about Basic Agrarian Principles and BPN implementing regulations to validate rights holder protection. The Industrial Revolution 5.0 requires electronic land certificate implementation to include enhanced data protection systems and digital bureaucracy accountability measures and flexible legal oversight that protects community rights through technological advancements.

Abstract

The problem examined in this study arises from Supreme Court Decision No. 903 PK/Pdt/2025, which annulled a Deed of Sale and Purchase Agreement (Akta Pengikatan Jual Beli, or APJB) due to misuse of its legal function. The APJB, which is originally intended as a preliminary agreement prior to the transfer of land rights, was instead used as collateral for a loan. This misuse created a defect of consent, as the formal structure of the deed did not reflect the parties’ true intentions. The purpose of this research is to analyze the legal validity of the annulled APJB and to examine the notary’s professional responsibility in the creation of a deed containing such a defect of consent. This study employs a normative-empirical legal research method by reviewing legislation, legal doctrines, and field data related to notarial practice. The findings indicate that although the deed formally meets the requirements of an authentic deed, it is materially defective due to a discrepancy between the expressed and actual intentions of the parties. Therefore, the annulment should be based on a defect of consent rather than a latent defect. This study emphasizes the importance of prudence, ethical responsibility, and procedural integrity in notarial practice to ensure legal certainty and protection for all parties. Bahasa Indonesia Abstract: Permasalahan dalam penelitian ini berangkat dari Putusan Mahkamah Agung Nomor 903 PK/Pdt/2025 yang membatalkan Akta Pengikatan Jual Beli (APJB) karena penyalahgunaan fungsi akta. APJB yang seharusnya berperan sebagai perjanjian pendahuluan sebelum peralihan hak atas tanah, dalam kasus tersebut justru digunakan sebagai jaminan pinjaman uang. Penyimpangan ini menimbulkan cacat kehendak karena bentuk formal akta tidak mencerminkan maksud sebenarnya para pihak. Tujuan penelitian ini adalah untuk menganalisis keabsahan hukum APJB yang dibatalkan tersebut serta mengkaji akibat hukum notaris terhadap lahirnya akta yang mengandung cacat kehendak. Penelitian ini menggunakan metode hukum normatif-empiris dengan menelaah peraturan perundang-undangan, doktrin hukum, serta data lapangan terkait praktik kenotariatan. Hasil penelitian menunjukkan bahwa meskipun akta memenuhi syarat formal sebagai akta otentik, secara materiil akta tersebut cacat karena adanya ketidaksesuaian antara kehendak dan pernyataan para pihak. Dengan demikian, pembatalan seharusnya didasarkan pada cacat kehendak, bukan cacat tersembunyi. Penelitian ini menegaskan pentingnya kehati-hatian, tanggung jawab etis, dan integritas profesional notaris dalam pembuatan akta untuk menjamin kepastian dan perlindungan hukum bagi para pihak.

Abstract

Indonesia’s democracy system was built on the basis and the strength of Pancasila, which did not favor the excessive desires of individual negotiations (liberalism) neither absolute state domination, non-liberalism, namely direct and indirect democracy that was once practiced. Those forms have their own weaknesses, but this paper will only highlight the positive side of the open democratic system, sincerely the democratic system of this nation is Pancasila democracy which refers to those two major forces of democracy. The implementation of Pancasila’s democracy in the Legislative Election can be shown in Law Number 7 of 2017 on the General Elections 2019 in Indonesia. The history of the implementation of elections in Indonesia revealed a variety of dynamics indicated by several changes in the constitutional law which were used as the basis for the implementation of elections. The publication of the Election Law is the elaboration of the provisions of Article 22E of the 1945 Indonesian Constitution. This means that the principles of democracy contained within 1945 Constitution of the Republic of Indonesia, must become the main foundations in designing norms in Law Number 7 of 2017 on the General Elections 2019, as happened, it turns out that the parliamentary threshold regulation within the Constitutional Law are ineffective in implementing this democracy.

Abstract

Background: The rapid development of digital technology has generated new forms of cybercrime involving children as perpetrators. In Indonesia, existing legal frameworks, particularly the Criminal Code and Law No. 11 of 2008 on Electronic Information and Transactions, have not fully accommodated the dual position of children as offenders and subjects entitled to special protection. Objective: This study aims to reconstruct a regulatory model for cybercrimes committed by children based on restorative justice and the best interests of the child. Methods: This study applies a normative juridical method using statutory, conceptual, and comparative approaches. It examines Indonesian regulations, relevant doctrines, international child protection standards, and comparative legal frameworks from the United Kingdom, Australia, and Malaysia. Results: The findings show that Indonesian law remains largely retributive and lacks specific procedural guidelines for digital offenses involving minors. The proposed model emphasizes child-sensitive digital forensic procedures, diversion mechanisms, digital rehabilitation programs, and harmonization between the ITE Law and the Juvenile Criminal Justice System Law. Conclusion: The proposed framework integrates criminal liability, child protection, restorative justice, and digital literacy. Future research should empirically test this model through field studies involving legal practitioners and juvenile court data.

Abstract

Tindak kekerasan dalam lingkup rumah tangga (KDRT) terhadap kaum perempuan merupakan permasalahan sosial dan hukum yang masih banyak terjadi di Indonesia. KDRT tidak hanya menimbulkan penderitaan fisik, tetapi juga berdampak pada kondisi psikologis, sosial, dan ekonomi pihak yang mengalami kekerasan. Penelitian ini ditujukan untuk menganalisis KDRT terhadap kaum perempuan ditinjau dari sudut pandang hukum dan ilmu sosial. Metode yang digunakan adalah metode deskriptif kualitatif dengan pendekatan yuridis dan sosiologis melalui kajian terhadap Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan tindak kekerasan dalam lingkup rumah tangga serta berbagai faktor sosial yang memengaruhi terjadinya KDRT. Hasil penelitian memperlihatkan bahwa meskipun Indonesia telah memiliki regulasi yang mengatur perlindungan terhadap pihak yang mengalami kekerasan KDRT, implementasi hukum masih menghadapi berbagai kendala, seperti kultur patriarkal, stigma sosial, rendahnya kesadaran lingkungan sosial, dan kurang optimalnya implementasi hukum. Dari perspektif ilmu sosial, KDRT dipengaruhi oleh ketimpangan relasi gender, faktor ekonomi, serta lingkungan sosial dan budaya yang masih menempatkan kaum perempuan pada posisi subordinat. Diperlukan upaya penanganan yang bersifat holistik melalui penguatan implementasi hukum, edukasi lingkungan sosial, serta pemberdayaan kaum perempuan untuk mencegah dan mengurangi terjadinya KDRT.

Abstract

Perkembangan penyalahgunaan narkotika di Indonesia semakin mengkhawatirkan, terutama dengan munculnya berbagai cara dan media baru seperti penggunaan vape sebagai alat konsumsi zat narkotika sintetis. Fenomena tersebut menjadi ancaman serius bagi anak di bawah umur yang rentan terpapar akibat pengaruh lingkungan, pergaulan, serta kemajuan teknologi. Badan Narkotika Nasional (BNN) pada tahun 2023 mencatat tingkat prevalensi penyalahgunaan narkotika sebesar 1,73%, dengan peningkatan signifikan pada kalangan pelajar, sementara United Nations Office on Drugs and Crime (UNODC) pada tahun 2024 melaporkan terdapat 292 juta pengguna narkotika di seluruh dunia. Data UNODC menunjukkan pentingnya perlindungan hukum bagi anak di bawah umur sebagai bagian dari pemenuhan hak asasi manusia, khususnya hak untuk hidup, tumbuh, berkembang, dan mendapatkan perlindungan. Penelitian bertujuan untuk mengkaji bentuk perlindungan hukum terhadap anak di bawah umur sebagai korban penyalahgunaan narkotika berdasarkan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak, serta Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap anak telah diatur dalam berbagai instrumen hukum nasional, namun pelaksanaannya masih belum optimal dalam menghadapi perkembangan modus baru penyalahgunaan narkotika. Dengan demikian, diperlukan penguatan regulasi serta kebijakan preventif guna menjamin perlindungan hak anak secara lebih efektif.

Abstract

The loss of a customer's Certificate of Ownership (SHM) while it is in the possession of a financial institution as collateral for a loan is a legal issue that has implications for the rights, obligations, and civil liability of the financial institution. This study aims to analyze the legal regulations related to the obligations of financial institutions in storing and securing SHM based on the Banking Law, the Mortgage Law, and civil law provisions governing the relationship between creditors and debtors. In addition, this study examines the legal responsibility of financial institutions if the SHM is lost due to a natural disaster that meets the criteria of force majeure based on Articles 1244 and 1245 of the Civil Code. The method used is normative legal research with a regulatory, legal concept, and doctrinal analysis approach. The results of the study show that financial institutions are required to apply the principle of prudence in the storage of collateral documents, and if the loss occurs due to a natural disaster that is proven to be force majeure, financial institutions can be exempted from liability for compensation. However, financial institutions remain obliged to carry out administrative recovery, including assisting in the process of issuing replacement certificates and ensuring that customers' legal protection remains guaranteed. This study emphasizes the need for stricter document security standards to prevent the risk of loss due to disasters in the future.
